Peach Bottom

The Philadelphia Electric Company announced on June 20 that it will implements'new drug policy, effective on July 1,1988. Elements of the policy include.

Random drug testing at least once during the next year for employees with-

unescorted access clearance.

Periodic testing, on advance notice that testing will be performed during a-

specified 3 month period.

Any employee dealing in drugs, on or off PECo premises, on or off duty,-

will be discharged.,

Any employee using, possessing, concealing or purchasing drugs on PECo-

premises will be discharged and considered for rehire only under specialcircumstances.

Contractors must remove'from PECo premises any of their employees-

: violating the PEco drug policy and preclude that employee from perfonningL further PEco-related work.

|Shoreham'

p On June 23, 1988, the staff received a copy of the New York State /LILCO! agreement, in the principle, for transfer of ownership of the Shoreham Station.

Based on this agreement, LILCO would transfer Shoreham to LIPA in exchange for| being returned to an investment-grade financial condition, termination of

Court litigation concerning Shoreham and other issues.

US/ Japan Agreement

The US/ Japan Agreement for Cooperation goes into effect on July 17, 1988. At| that time the US must determine that the description of the key elements for

thenewplutoniumfuelproductionfacility(PFPF)satisfiesthesafeguardsi

concepts contained in the new Agreemant. This action is necessary because thenew PFPF, which began cold tests in September 1987 with depleted uranium,currently is conducting tests with US-orgin mixed oxide material, prior toceginning commercial operation this fall. The new Agreement requires that

| such new facilities must be listed under Annex 1 of the Agreement in order to|

process US-origin material. (Annex 1 of the Agreement list' those facilitiesin Japan which are authorized to possess and use US-ori; sterial under theAgreevnt.)

Drug Testing Program

Representatives from Policy and Labor Relations; Training, Benefits andEmployed Assistance; and Division of Security ARM, completed training on thedrug testing program at NRC in Regions II, III, and IV and at the TechnicalTraining Center, Chattanooga, Tennessee. Training for the remaining RegionalOffices and Headquarters are being scheduled.

Shoreham

On June 23, 1988, the staff received a copy of the New York State /LILCOagreenent, in the principle, for transfer of ownership of the Shoreham Station.Based on this agreement, LILCO would transfer Shoreham to LIPA in exchange forbeing returned to an investment-grade financial condition, termination ofCourt litigation concerning Shoreham and other issues.

Key points of the agreement:

1. LILCO will transfer Shoreham assets to LIPA at settlement. LIPA willthen close Shoreham and contract with NYPA for its decommissioning.

2. LILC0 will be guaranteed rate increases of 5% for three years, potential5% per year rate increases for the next seven years and stock holderswill receive $1.00, $1.50 and $2.00 annual dividends per share for threeyears, respectively.

3. LILC0 agrees to provide the PSC within 45 days of filing of the agreementadequate assurance that effectuation of the agreement will restore LILCO'sGeneral and Refunding Debt to an investment-grade rating. If such rating

cannot be achieved, the agreement can be deemed withdrawn from the PSC'sconsideration.

4. NYPA will build additional power generation on Long Island.

Nuclear Fuel Services, INC. (NFS) Decommissioning Holding Pondsand Plutonium Facility

On June 23, 1988, NRC representatives (NMSS and Region II) met with State ofTennessee officials and NFS representatives. The NFS representatives provided a*

status of their ongoing characterization study of the liquid holding ponds andthe decommissioning of the inactive plutonium facilities. The major issue forpond closure is to determine whether the pond sludge must be considered mixedwaste. Analytical results of Sond sludge will be available in July 1988. NFShas completed the preliminary lazards evaluation for Building 234 for decomis-sioning. The evaluation for Building 110 is in process. The major issue in theplutonium facility decommissioning is to obtain approval from the State of SouthCarolina for the disposal of material contaminated with TRV.

Dry Spent Fuel Storage Rulemakingr

On June 28, 1988, HMSS and RES representatives briefed the ACNW on draft proposedrulemaking to amend 10 CFR Part 72. This rule would provide for certified

jspent fuel storage casks which would be used under a general license by reactorl

licensees. Part 50 operating licensees could register to use approved casks,under the conditions of the storage cask certificate of compliance, for storage,

of spent fuel at reactor 5.ites. ACNW comments on the draft proposed rule weresolicited by the staff.

International

US/ Japan Agreement

The US/ Japan Agreement for Cooperation goes into effect on July 17, 1988. Atthat time, the US must determine that the description of the key elements forthe new plutonium fuel production facility (PFPF) satisfies the safeguardsconcepts contained in the new Agreement. This action is necessary because thenew PFPF, which began cold tests in September 1987 with depleted uranium,currently is conducting tests with US-orgin mixed oxide material, prior tobeginning commercial operation this fall. The new Agreement requires thatsuch new facilities must be listed under Annex 1 of the Agreement in order to*

process US-origin material. (Annex 1 of the Agreement lists those facilitiesin Japan which are authorized to possess and use US-origin material under theAgreement.)

During the week of June 20 and on June 28, staff from HMSS and IP participatedin detailed technical discussions concerning a draft Japanese document whichaddressed the key safeguards elements for the PFPF. Agreement on wording andnecessary detail was reached between the two parties on June 20. The USinteragency connittee (Action Plan Working Group - APWG) met on June 30. TheAPWG is responsible for reviewing the key elements document for the PFPF andmaking a recommendation to the Inter-agency Steering Group (ISG). It is expec-

ted that the APWG will recomend approval to the ISG and that the Department of~

State will execute tiie formal exchange of notes in time to meet the July 17deadline,

It should be noted that this action involving the PFPF sets the precedent forall new facilities, including the large reprocessing plant in the late1990's. In this regard, the US was successful in assuring that the properlevel of technical detail is included in the key elements description.Further, the US negotiating team was also successful in obtaining a comitmentfrom the Japanese team members to provide a formal statement to the USregarding the expected quantitative safeguards performance levels for the PFPFbased on theif preliminary calculations. This action will directly' address akey aspect of the Commission's concerns regarding the ' ability to determine theadequacy of safeguards in Japan under the Agreement.

On June 28, 1988, Dr. Michael Tokar made a presentation to the Advisory

Comittee on Nuclear Waste. The presentation was entitled, "High DensityPolyethylene (HDPE) Regulatory Issues," and included a presentation by Dr.' Stewart A. Silling, an NRC consultant, on review of the structural designs ofpolyethylene nich integrity containers (HICs). Dr. Silling stated that thedesign of poly: er structures for long-term service is a notoriously difficultprobla . The longest-term applications of HDPE are for water and gas pipelines,*d.ich are usually designed to last 50 years. Dr. Silling claimed that there is.

no evidence that the HDPE m1terials proposed for HIC designs can last for 300years under the expected conditions, and there is considerable evidence thatthey may not.

West Valley TRU Evaluation

On June 29, 1988, LLWM staff met with DOE and their contractor personnel to*

discuss DOE's planning process for submittal of their evaluations to justify aTRU limit and waste classification system specific to the West ValleyFacility. DOE proposed to submit evaluations in a piecemeal manner that wouldallow them to make decisions af ter critical analyses were performed. LLWMstaff indicated we would comment on the individual analyses provided anoverall evaluation plan is furnished. This plan should show how the individualanalyses would ultimately form the products needed by the NRC for a decisionon acceptable waste classification limits.

- HIGH-LEVEL WASTE MANAGEMENT~

Briefing to the Advisory Comittee on Nuclear Waste by DOE

On June 27, DOE briefed the Advisory Comittee on Nuclear Waste regarding adraf t Petition for Rulemaking DOE intends to submit to the NRC. This draftpetition recommends that NP.C adopt a dose guideline of 5 rem for thepermissible off-site consequences of an accidental release of radioactivematerials from a HLW repository. The draf t petition also reconnends changesin the existing definition of the term "important to safety," which is used toidentify items which must comply with particular design and QA criteria.DOE plans to submit the petition in approximately 2 months.

On June 28, the Advisory Connittee on Nuclear Waste was briefed by DOE regardingalternative e.onceptual models of the Yucca Mountain, Nevada candidaterepository site. DOE also described plans for site exploration to resolveuncertainties associated with those conceptual models. DOE will (1) provideimproved descriptions of the uncertainties in conceptual models, includinghypotheses regarding the validity of alternative models, and (2) developspecific tests to distinguish between alternative models. Thispresentation was designed to indicate how 00r is planning to respond to theNRC staff's CDSCP objection regarding the ' a of consideration of alternativeconceptual models of the Yucca Mountain site in developing the site characterizationprogram.

NRC Staff Observation Audit of DOE Nevada Waste Management Project Office Audit

From June 8-24, 1988, the Division of High-level Waste Hanagement. staff.perforced anobservation audit of the DOE Nevada Waste Management Project Office (WMPO)audit of the U.S. Geological Survey (USGS). The USGS is responsible forhydrological and geological characterization of the Yucca Mountain Site. Thepurpose of the staff observation audit was to assess whether DOE was conductingits audit so that the staff could gain confidence that the USGS QA 3rogram wasbeing properly irplemented. The audit was limited to those areas w1ere theprogram development is complete, i.e., procedures are in place.

As a result of its observations, the HLWH staff believes that the 00E/WMP0team did an effective compliance demonstration audit of those progre ' creas

,

already in place. However, the staff will recomend that in the future DOE notonly perform a compliance demonstration audit, but also audit the overallcompleteness of the program. A sumary report describing the staff findingswill be issued after completion of the audit. The WMP0 audit team has prepared

Incident Response

Staff members of the Incident Response Branch presented a protective measurestechnical training course at FEMA's Emmitsburg training facility on June 28-30,1988. The course was attended by headquarters and regional staff as well asother federal agency officials.

IRB staff members conducted training for new emergency officers from both NRR*

and NMSS on June 30.

Technical Training

The B&W simulator which beceme operational in June will be dedicated July 19,1988 during a ceremony at the TTC in Chattanooga. Commissioner Rogers plans toparticipate in the dedication.

Safety Programs

Two AE0D trends and patterns draft NUREGs were issued for peer review by thestaff and industry. "Operational Experience Feedback Report - Progress in ScramReduction," analyzes the trends and patterns in unplanned scrams and theircauses for 1984 through 1987, and highlights in recommendations to ownersgroups the remaining areas where further scram reduction efforts appear to beappropriate. The second report, "Trends and Patterns Analysis of EngineeredSafety Feature Event Sequences," maps the industry experience unplanned ESFactuations from 1984 through 1987. The report draws conclusions and makesrecomendations regarding trends in ESF's and problem areas, consistency inthe reporting of ESF's, and potential changes to the LER reporting practices.

Meeting with Local Officials

On June 21, 1988, A. Bert Davis, Regional Administrator; Roland Lickus, Chief,State and Government Affairs; and other Region III officials met in Seneca,Illinois with local officials near the LaSalle Nuclear Power Plant. Themeeting was held in conjunction with the LaSalle SALP meeting and was for thepurpose of discussing NRC's program for regulating nuclear power plants and toencourage dialogue with local public officials.

Contaminated Sites-

On June 28, 1988, Region III, NMSS, and State officials toured the contaminated(thorium-magnesium slag) sites in Midland, Bay City, and Kawkawlin, Michigan.In addition, a meeting was held with State officials in Lansing, Michigaaon June 29, 1988 to discuss the results of the tour and review the statusof efforts to dispose of the waste.

The following Civil Penalties Paid the week of June 27, 1988.

Cannonwealth Edison Company (Zion Units 1 and 2) paid the imposed civil penalty i

in the amount of $100,000. The action was based on inadequacies in the licensee's <

program and controls for the testing of pressure isolation valves. The licenseeresponded to the Notice in February 1988. After considering the response, thestaff concluded the violation had cccurred and an Order was issued May 26, 1988imposing the civil penalty. (EA 87-211)

St. Louis University, St. Louis, Missouri paid the imposed civil penalty in theamount of $6,000. The action was based on: (1) permitting an individual to,

receive a whole body dose of at least 7.5 rems during the fourth calendar quarterof 1987, (2) failing to assess the radiation hazards or observe three separatewarning lights which could have alerted the individuals, prior to entering the :

room, that the 8900 curie cobalt-60 teletherapy source was in an exposedposition, and (3) failing to report to the NRC within 24 hours that an over- J

exposure had occurred. The licensee responded to the Notice in February 1988.After considering the response, the staff concluded the violation had occurredand an Order was issued May 3, 1988 imposing the civil penalty. (EA87-234)

Second Building

At its meeting on July 12, the Montgorrary County Council will considerthe report of its Hearing Examiner on whether or not to approve thedevelopers' proposal to build a second office building on the WhiteFlint North site. The report recomends approval, but specifiesconditions with respect to the number of trips to be generated by allthe buildings to be erected on the site.

The Council has taken no action on the widening of the I-270 spurs, nor.

has it increased the job ceiling for the North Bethesda sector in itsannual growth plan review. This means that the moratorium on newsubdivisions in the area, imposed to prevent any increase in trafficcongastion, is still in force.

The White Flint North developers are taking the position that permissionto build the second building should not be affected by these factors,inasmuch as approval had previously been granted for construction of ahotel-conference center which would generate a maximum of 640 rush-hourtrips to and from the site. They claim that, as long as this limit canbe achieved, the proposal to erect a different combination of buildings

should not necessitate a new decision.

The hearing may provide an indication of the Council's thinking aboutNRC's need to consolidate, and whether the ultimate decision will belinked to the lifting of the general moratorium on new subdivisions.

| Installation of New pump Motors

New water supply pump motors have been installed at OWFN, and they arenow functioning. These should overcome any future problems resultingfrom low water pressure. The low pressure had previously affected waterflow to upper floors in the building, and was a contributory factor inthe air conditioning problems experienced earlier in the season.(Installation of the new motors is unrelated to the work which will ber

| done later this month to solve the lead contamination in the waterl supply.)

1. The Deputy Regional Administrator met with Arkansas Power & Light Companymanagement on June 28 in Russellville, Arkansas, to present certificatesto candidates for R0 and SR0 licenses.

2. St rra Testing, Incorporated, a radiography company, was found to beoperating in Tulsa, Oklahoma, without an NRC license. 0:tensibly, thecompany was operating under reciprocity from the state of Nebraska;however, contrary to 10 CFR 150.20, the company does not maintain anoffice in Nebraska. During an inspection on June 28, 1988, the company wasasked and subsequently agreed to cease operations in NRC jurisdiction,-

pending resolution of questions about their lack of an office in Nebraskaand the validity of their Nebraska license.

3. I 2 ment conference was held on June 30 with Computalog, Inc.it at the Region IV office to discuss the findings of anmai,

inspu; tion conducted May 26 and 27, 1988. The inspection, which examinedthe licensee's well logging operations, identified 14 apparent violations.

4 South Texas Project, Unit 1, has completed the 30 percent test plateauand has commenced testing at the 50 percent plateau. Testing at the50 percent plateau is scheduled to be completed on July 6, 1988.

The Region IV Deputy Director, Division of Reactor Projects, and a teamof Region IV and NRR staff members are performing an assessment of SouthTexas Project, Unit .1. at the 50 percent plateau.
