12601 In Jefferson County, under authority of House Bill 9 of theForty-third Texas Legislature, the State Highway Commission has acceptedthe tenderof aid from the U, S. Federal Emergency Administration of Pub-lic Works in the amount not to exceed $1,141,742.00 for the constructionof the Neohes River Bridge on State Highway 87, PWA Docket 8080-R andhas also accepted the net proceeds of a bond issue of Jefferson Countyin the amount of $701,745.67 and by Commission Minute 11344 has appro-priated State Highway funds in amount of $645,463.10, making availablefor construction of the Neches River Bridge project an amount of$2,488,950.77;

Whereas, by Minute 11664 on December 21, 1935 the Commissionawarded Contract 1 for substructure work in the amount of $828,740.00and by Commission Minute on June 17, 1936 .awarded Contract 2 forjSG o -*-!*- ^ f/ ljfoo.oo ,***£&—-•»&U e- -a? ff-7 J e c - t.- --' - ' .structure work'and superstructure* work amount to $2,442,240.00, towhich amount must be added 10$, or $244,224.00, for engineering andcontingencies, making grand total of project equal to $2,686,464.00,which is in excess of the amount of funds now available for the construc-tion of this project by an amount of $197,513.23}

It is therefore the order of -the Commission that an appropria-tion of $197,613.23 State Highway funds be appropriated to cover thedifference in total cost of project and the funds now available.

12602 The Commission having accepted the tender of aid in the form ofa grant from the United States Federal Emergency Administration of Pub-lic Works for the construction of the Neohes River Bridge on State High-way No. 87, P.W.A. Docket 8080-R, in the amount of not to exceed$1,141,742.00, and having by Minute 11664, awarded Contract No. 1 forsubstructure work to the Union Bridge and Construction Company in theamount of $828,740.00, and on June 17, 1936, awarded contract No, 2for the superstructure work to the Taylor-Fiohter Steel ConstructionCompany of New York City in the amount of $1,613,500,00, and to which theallowance of $244,224.00 for engineering and contingencies is added mak-ing a total estimated cost of the project of $2,686,464.00, which amountis in excess of the amount of funds available by $197,513.23. The fundsoriginally set up for this project are as followst Jefferson County$701,745.67} State Highway Funds $645,463.10} and Federal Grant$1,141,742.00, making a total of $2,488,850.77. Since the amount ofCounty Funds are badly needed for many other necessary road and bridgeprojects in the State of Texas, therefore

IT IS ORDERED by the Commission that the State Highway Engineerbe and is hereby authorized to make application for a supplementarygrant to the United States Federal Emergency Administration of PublicWorks in the amount of forty-five per cent of the excess funds requiredfor the completion of the project which is estimated to be $88,881.00*

12603 The following agreements supplemental to contracts previouslyapproved and entered into, having been examined and the terms and condi-tions having been found satisfactory, and it appearing that an additionalappropriation of funds will not be required, are hereby approved:

Wise Coun-ty, WPH 14-A, J. Lee & E. A. Vilbig, Contractors, providing forthe added item of common borrow and for increased quantity of quarterhaul} estimated cost of additional work $570.00.

Wise County, FAP 14, Unit 4, Standard Paving Co., Contractors, providingfor use of stone screenings in constructing shoulders} estimated increase-in cost $400.00.

Kimble County, FAP 133, Central Bitulithic Co., Contractors, providingfor the added item of Class "B" concrete; estimated cost of additionalwork $674.74.

Bosque County,Control 258-6-3, Lone Star Const. Co., Contractors, pro-viding for placing additional base material and building up shoulders}estimated cost of additional work $16,111.99, funds for which are pro-vided by Minute 12566.

In DeWitt and Karnes or Gonsales Counties, a State Highway isdesignated from Yorktown to a connection with Highway #132at the mostfeasible point of intersection between Gillett and Nixon, This designa-tion is made on condition that the counties furnish not less than 100'right-of-way on location approved by the State Highway Engineer andon condition that Maintenance will not be assumed on unimproved sec-tions. It is ordered that the surfaced sections of this road be takenover for Maintenance.

Nine Hundred and Forty Thousand and Twenty-seven Dollars ($1,940,027.00)instead of One Million, Five Hundred Thousand Dollars ($1,500,000.00), asprovided for in the Grant Agreement} thus leaving Four Hundred and FortyThousand Dollars ($440,000.00) to be obtained from other sources; and

WHEREAS, the additional cost was observed to be caused by goodand sufficient reasons, not reasonably to have been anticipated, all ofwhich are set forth in a letter dated January 24th, 1936, from the StateHighway Engineer to Mr. Harold L.Ickes, Administrator} and

WHEREAS, the State Highway Commission, realizing the extrememerit of the project, the necessity for immediate action, and feelingits obligation to assure the construction of this improvement, did appro-priate the additional funds above referred to, although it had been de-termined that the amount required was in excess of the maximum expendi-ture, consistent with reasonable distribution of the limited StateHighway funds available; and

WHEREAS, the additional appropriation would require the utiliza-tion of funds previously reserved for other purposes, and will requirethe abandonment of necessary work already Programmed} and

WHEREAS, there has been placed on the Texas Highway Departmenta financial burden, which was not contemplated,and which it is poorlyable to assume.

NOW, THEREFORE, it is ordered that the Public Works Administra-tion be and hereby is requested to increase the grant heretofore allottedto the State of Texas in the amount of One Hundred and Ninety EightThousand Dollars ($198,000.00), making a total grant of Eight Hundredand Seventy-three Thousand Dollars ($873,000.00), which is 45% of theapproximate total project cost of One Million Nine Hundred and Forty-Thousand Dollars ($1,940,000.00), this request being made in order to re-lieve the State Highway Department of a severe financial burden and toassure the construction of the project on the financial basis contem-plated in the original application for grant.

In Galveston County, FWA Docket Texas 1968-R, Galveston Cause-way, it having been necessary to establish wage scale for night watch-man (forty hours or less per week), and storekeeper (toolman), neitherof which is provided for in the original specifications, and, it havingbeen noted that a supplementary wage scale has been presented by theContractor and approved by the Supervising Engineer which provides aminimum wage rate of thirty oents per hour and a minimum wage rate ofseventy-five dollars per month for the above classifications respective^the said supplementary wage scale is hereby approved.

In Galveston County, the Galveston-Port Bolivar Ferry was madea free ferry effective May 1, 1936, There has been additional expenseadded to the cost of operation of these ferries which has caused an over-run of the funds appropriated. "WHEREAS, the late Roy B, Inks, did, during his residence in theCity of Llano, Texas, give much of his time and means to various andsundry Civic Improvements and affairs, and particularly with referenceto the building of good roads in Llano County, and the culmination ofproceedings that resulted in the resumption of the work on Buchanan Damon the Colorado River, which matters have resulted in great good andbenefit to the City and Bounty of Llano, and its citizens; and

"WHEREAS, the aforesaid bridge now in course of construction overthe Llano River is going to be when completed, such a splendid exhibi-tion of engineering and of such great convenience and value to theCitizenship of said City and County of Llano, that it is deemed advisableto give it a distinctive name and designation;

It is ordered that Item 17 of the WPGM Secondary Classificationbe reinstated in the program which item provides for grade separationand approaches on Bonner Street in Tyler, with an allotment of $53,000,00WPGM fundsi and the State Highway Engineer is directed to submit a re-quest to the U. S. Bureau of Public Roads, the Works Progress Adminis-tration, and the National Emergency Council providing for this projectreinstatement.

12699 WHEREAS, the Commission, on June 19, 1934, appropriated$300,000.00 to initiate a general maintenance betterment project onState Highway 81 from Helotes in Bexar County to Kerrville in Kerr County;and

"WHEREAS, a section of this project has been practically com-pleted from the Bexar-Medina County line to a point approximately 5miles north of Bandera, in Bandera County; and

WHEREAS, the grading and drainage structures have been con-structed with NHWR Funds only on that section of this project fromHelotes in Bexar County to a point approximately 3 1/2 miles north; and

WHEREAS, it has been found that the quantity of work required toconstruct this entire project from Helotes to Kerrville is greater thanthat antic ipated on June 19, 1934, and that the funds appropriated onthat date will not carry this project to completion; and

WHEREAS, it is now considered that the section of this projectfrom Medina City in Bandera County to Kerrville can be constructed bycontract method with greater advantage to the State of Texas;

IT IS, THEREFORE ORDERED by the Commission that Minute No.9632be amended to make applicable the original appropriation of $300,000.00only to those sections of this project from Helotes in Bexar County toa point approximately 5 miles north of Bandera in Bandera County, a dis-tance of approximately 35 1/2 miles; that after completion of thisproject thus shortened, the unexpended balance of the funds authorizedby Minute No. 9632 revert to the Available Surplus of the State HighwayDepartment; that work be suspended on that section of this project froma point 5 miles north of Bandera to Medina City; and, that no work bedone under this program on that section of this project from Medina Cityin Bandera County to Kerrville in Kerr County.

12700 It having been brought to the attention of the Commission thatvendors of various articles and products are stationing themselves, withtheir wares, along and upon the right-of-way of heavily traveled high-ways in various parts of the State, and are stopping cars on thesehighways to sell their articles and products, thus creating a serioushazard to traffic and a public nuisance, it is hereby ordered that thepractice of placing articles, things, or products on the right-of-wayof a State Highway in Texas be prohibited and that a standard signprohibiting this practice be erected on the shoulder of the highwaysat all points where this condition is known to exist, and the StatrHighway Engineer is directed to request the assistance of the PublicSafety Commission, if necessary, in the enforcement of this order.
