WHEREAS the Parliament of New South Wales now stands prorogued to Tuesday; the· twenty-fourth day of February. instant: Now I, Sir GERALD STRICKLAND, Count­della Catena, in pursuance of the power and authority in me vested as Governor of the­said State, do hereby futher prorogue the said Parliament to Tuesday, the third day of" March next : And· I do hereby further announce and proclaim that the· said Parliament, shall allsemble for the despatch of business on the aforesaid third day of March next,. at twelve o'clock at·noon, in the buildings known as the Legislative Council ChaJUbers,. situate in Macquarie-street, in the city of Sydney : And the membe,re of the­Legislative Council and Legislative Assembly, ·respectively, are hereby required t() give their attendance at the said time and place accordingly.

certain sums to make good the supplies granted for the service of the year from the let day of July, 1913, to the 30th day of June, 1914, inclusive of both dates; to adjust the vote "Ad,-ance to Treasurer," 1912-13, Consolidated Revmue Fund, for supplementary charges during the period from the 1st day of July, 1912, to the 30th day of June, 1913, inclusive of both dates; to cover payments "Unauthorised in Suspense," Consolidated Revenue Fund, for urgent claims on account of services of the year 1912-13; to provide for public works and other services out of the Public Works Fund; and to provide for services out of the Closer Settlement Fund; and for purposes connected with and incidental to the above objects. ·Committees in the name of a private member was not technically Govern­ment business, but was more important than Government business, seeing that the appointment of Chairman of Com­mittees and Deputy-Speaker was essen­tial to the carrying out of Government business, and ·therefore the motion was in order, nothwithstanding the ses­sional order that no business other than Government b-usiness should be taken, 219.

Closer Settlement (A.mendment) Bill: The bill was out of order, because clause 20 dealing with the reduction of the capital value of settlement pur­chases on the Bor.ee Creek Estate was beyond the order of .leave, 299. .

Close1· Settlement (Amendment) Bill· (No. 2): It would not be justifiable to rule the bill out of order on the highly tech­nical point, that it ~·ould have· the ef­fect of amending the Common Law Pro­cedure Act, and the Judgment Creditors Remedies A.ct. The title clearly sh.owed that it was intended to conserve the existing law. The general policy of the bill was to prevent fraud, and thE) act providing for writs of fieri facias was not amended, except in the sense tbat it might be modified . or suspended. in the interests of the. cpuntry itself, 818; it was not competent for a member to discuss the basic ·principles and policy of closer· settlement, but the discussion m'ttst be confined to ·the -essential prin­cipl€6 in the bill, 822.

.ASSEMBLY (continued): J!eputy-Leade1· of the Opposition: A

question of an ironical character was practically offensive to the Speaker, 97, 214; the Speaker was the custodian of the privileges and good order of the House, and he was the only individual concerned as to any notification by the leaders of parties in the House. l\ir. Speaker resented the interference by a member in a matter which should be

·one of information for himself; when a question had been raised and ruled out of order, it was irregular to repeat the question, 214; the fact that disorderly language had been used in the past could not be used as a subterfuge for· .applying disorderly expressions in the present; a -suggestion that the Speaker had, in endeavouring to earn the plaudits of the press, dealt unfairly with a member, was highly disorderly, 287.

Election Petitions: A. petition, which as the result of an unintentional lapse, contained a wrong form of address to his Excellency the Governor, should not be ruled ·out of order, as the effect would be to prevent investigation of claims by the Elections and Qualifica­tions Committee, which was a semi­judicial tribunal, 407; the Elections and Qualifications'Committee could not sit during recess, and in a case where the committee could 'ilot conclude their inquiry into a petition, it was com­petent for them to recommend that the matter be referred to the committee to be appointed in the following session, 1163.

Income-tax (Fw·ther Amendment) Bill: The only way a taxation bill could be considered was upon a resolution of Committee of 'Vays and 1\ieans, and this resolution could not appear on the busi­ness-paper until it had been moved in the ordinary way, 525; a resolution of Wass 'and Means was the basis for a .taxa-tion measure solely, and the invariable practice had been to bring down a measure founded on resolution of Ways and Means, providing for· the imposi­tion of taxation entirely apart from the machinery bill,· which was intra~ duced in Committee of the "Thole .• No precedent could be fo1md where in Committee of 'Vays and Means a re­sohition purely for imposing taxation had been passed, and the bill when pre­sented had provided for the amend­ment of other acts which could not,.be regarded as ejusdem ar.neris. The bill was out of order because it contained what must be regarded as extraneous matter, in the shape of provisions· for the amendment of the. Public. Service· Act and the Arres.t ·on Mesne Proc.ess Act, 660.

(No. 2): A taxation bill founded on a resolution of Ways and Means could not be utilised to amend various acts entirely foreign to it. The bill was out of order inasmuch as it con­tained provisions for the amendment of two acts which were not mentioned in the title, ,and would have the effect of circumscribing the rights of citi­zens under those acts, 815.

Stamp Duties (Amendment) Bill (No. 2): 'Vhere a bill based on a resolution of Committee of 'Vays and Means or Committee of the Whole had been withdrawn and it was proposd to bring in another bill of a similar nature, the usage was to read again the resolution and order another bill to be brought iu. Standing order 332 applied only to the original introduction of a bill based on a·resolution of 'Vays and Means, 694.
