During this interview you indicated that you conducted contract spraying of herbicides for AA Company Pty Ltd, on the property Goonoo. A search of our database indicates that you do not hold any current licenses to conduct such chemical applications in Queensland. In Queensland the Department of Agriculture, Fisheries and Forestry administers the Agricultural Chemicals Distribution Control Act 1966 (ACDC Act). The ACDC Act controls ground distribution of herbicides from ground equipment and aerial distribution of agricultural chemicals from aircraft. Ground distribution of herbicides requires the dual licensing of both persons who operate ground equipment and the contractors who carry on the business of ground distribution, or direct or authorise ground equipment to be used by licensed spray operators for the application of herbicides. Under section 39(2) of the ACDC Act, the business is required to have a Ground Distribution Contractor Licence and employees who apply the chemicals and are not supervised during the entire application, require a Commercial Operators Licence. On Tuesday 16th October 2012, inspectors from Biosecurity Queensland met with you and conducted a record of interview at the Emerald DAFF office. During this interview you indicated that you conducted contract spraying of herbicides for AA Company Pty Ltd, on the property Goonoo. A search of our database indicates that you do not hold any current licenses to conduct such chemical applications in Queensland.

In Queensland the Department of Agriculture, Fisheries and Forestry administers the Agricultural Chemicals Distribution Control Act 1966 (ACDC Act). The ACDC Act controls ground distribution of herbicides from ground equipment and aerial distribution of agricultural chemicals from aircraft.

Ground distribution of herbicides requires the dual licensing of both persons who operate ground equipment and the contractors who carry on the business of ground distribution, or direct or authorise ground equipment to be used by licensed spray operators for the application of herbicides.

On 6th September 2012, inspectors from Biosecurity Queensland visited your property as part of an investigation into alleged spray drift and made enquiries in relation to spray applications of herbicides. It was identified that your business does not make or keep records of chemical applications.

Biosecurity Queensland promotes the responsible use of agricultural chemicals, compliance with label instructions and encourages best practices which includes the making and keeping of detailed records. Please be aware that some chemical labels may require the user to make and keep records of use for a period of time.

The making and keeping of accurate spray records is a valuable exercise to demonstrate best practice and compliance with labels. Biosecurity Queensland is happy to provide assistance to chemical users about record keeping, spraying best practice and weather conditions for spraying. Investigation into Complaint of Spray Drift

On 16th July 2012, damage to your chickpea crop from an alleged incident of spray drift was reported. An investigation was commenced by Biosecurity Queensland and subsequent enquiries were conducted into this matter.

The investigation has been completed and at this stage the Department will not be commencing any proceedings for offences under the Chemical Usage (Agricultural & Veterinary) Control Act 1988.

Hi SarahJust a quick email to say we have had a compliant come in about a huge spray drift event that has affect 3 farms of young wheat,equally 2000 acres in Gindie. The COMPLIANT Michelle is inMackay and travelling back to Emerald to do a property visit tomorrow. We will involve Mick in compliance straight up as theCOMPLIANT will want to take this all the way. The first event was dealt with by Michael and Mary and as yet we do not know if itis the same POI or someone else. We are currently gathering evidence.

Capricornia Zone PBPI Situation Report

Week ending 05/07/2013

Michelle Janes is investigating an off target spray drift incident in Gindie. Wheat planted in May 2013 was now observed as displaying symptoms of agricultural chemical application damage causing significant crop damageand yield loss. A full investigation is underway as this is the second reported incidence from these properties in a year.
