GENERAL TERMS AND CONDITIONS:
1. Objective: This document is published in order to obtain competitive prices for Bituminous Materials.
2. Acquisition of Bid Documents: a. Bid documents are available for download at www.alleganyco.com; click
on Government then Public Works Department. They are also available at the Office of the Superintendent of Public Works, 7 Court Street, Room 210, Belmont, New York 14813. The office is open Monday – Friday, 8:00 a.m. to 4:00 p.m. Telephone number is (585) 268-9230.
b. Each contractor bears sole responsibility for acquisition of bid documents.
Requests for bid documents to be forwarded are neither a guarantee nor an incurred obligation on the part of Allegany County to ensure contractors requested receipt of bid documents, timely or otherwise.
c. Receipt of these documents, unsolicited or otherwise, shall not be
construed a predetermination of a contractor’s qualifications to receive a contract reward. Nor shall receipt of these documents be interpreted an endorsement that the contractor’s equipment, materials, products, and/or services are in compliance with the bid specifications.
3. Examination, Interpretation, Correction of Bid Documents:
Each contractor shall examine all bid documents and judge all matters relating to the adequacy of such documents. Any inquiries, suggestions or requests concerning interpretation, clarification or additional information pertaining to this bid solicitation shall be writing and submitted to the Public Works Department. The County shall not be responsible for oral interpretations given by any county employee, representative or others. The issuance of written addendum/addenda is the only official method whereby clarification or additional information can be given.
4. Preparation of Bid Documents: Bids must be submitted on the forms provided in these bid documents and prepared in the following manner:
a. All forms shall be clearly legibly completed using a permanent medium (i.e. ink, typewriter, laser printer, etc.) Illegible entries may be rejected.
i. If submittal of unit price(s) is a requirement, said unit price(s) shall prevail.
ii. All mathematical functions (extensions, additions, etc.) are subject to audit.
iii. Each price shall be expressed as a numerical dollar value; indicators such as ditto marks, arrows, etc. are not acceptable.

b. All forms requiring a contractor’s signature shall be signed by a contractor or the contractors authorized representative. Erasures and/or alterations shall be initialed by the representative whose signature appears on the forms.
c. The contractor shall submit the bid in accordance with the bid documents
and shall not make any changes in the wording or the bid forms or make any stipulations or qualify the bid in any manner.
d. Prices shall be F.O.B. any point in Allegany County, New York. Price
quoted shall include all delivery charges.
e. Prices shall be net; including transportation on delivery charges must be prepaid by the successful bidder and added to the invoice as a separate item. In any case title shall not pass until items delivered to the County and accepted by the requesting department.
f. All bids shall be firm for the period of forty-five (45) days from the bid
opening date; during which time the County shall render its decision.
5. Bid Surety: All bidders must submit a Bid Bond or Certified Check in the amount of Five Thousand Dollars ($5,000.00) payable to Allegany County Department of Public Works with their bid. Bid Bond or Certified Check will be refunded to unsuccessful bidders. The successful bidder(s) will be issued a Notice of Intent to award and will be required to submit a Performance Bond within three weeks of the date of receipt of the Notice of Intent. The amount of the Performance Bond will be determined at the time of award. Bond shall remain in effect until May 1st, 2018. Upon receipt of the Performance Bond or Certified Check the successful bidder(s) will be issued a Notice of Award. The Bid Bond will be returned with the Notice of Award. The Performance Bond will be released upon completion of work and acceptance by the Superintendent of Public Works. Performance Bonds for towns and villages should be provided directly to the respective town or village.
6. Contract Term: May 1, 2017 through April, 30, 2018
7. Quantities: a. Quantities are not guaranteed. A minimum and/or maximum quantity shall
not be established. All purchases, therefore the cumulative annual purchase quantity shall be “as required” by Allegany County.
b. If this bid specifies “estimated quantities”, said quantities are specified for
bid purpose only. These quantities are not intended, nor should they be construed to reflect the actual purchase requirements of Allegany County.

8. “In-Place” Work:
The County accepts more than one bid for In-Place Hot Mix Asphalt, In-Place Cold Mix Asphalt and In- Place Surface Treatment in order to allow an option to the County in event the low bidder is unable to perform when the County requires these materials. If the low bidder cannot perform within a reasonable time (a judgment made by the County Superintendent) the County has the option of using the next lowest bidder or bidders. ALL “IN-PLACE” WORK MUST BECOMPLETED BY SEPTEMBER 15, 2017 UNLESS APPROVED IN WRITING BY THE SUPERINTENDENT OF PUBLIC WORKS. ANY “IN-PLACE” WORK NOT COMPLETED BY SAID COMPLETION DATE MAY BE SUBJECT TO LIQUIDATED DAMAGES OF $750.00/DAY UNLESS PREVIOUSLY NEGOTIATED WITH THE SUPERINTENDENT OF PUBLIC WORKS.
Municipalities (Towns, Villages, School Districts or Fire Districts) making purchases of the above materials pursuant to General Municipal Law Section 103 are required to follow the above County procedure. The determination of whether or not the low bidder can perform within a reasonable time shall be made by the appropriate Superintendent or Official, and not by Allegany County.
9. Non-Collusive Bidding Clause and Certificate: The contractor shall submit a signed and dated Non-Collusive bidding certificate with its bid which is included in this bid document. Said certificate is mandated by Section 103-g of the General Municipal Law.
10. Hold Harmless Clause and Form: The contractor shall submit a signed and dated Hold Harmless Clause form with its bid, which is included in this bid document.
11. Iranian Energy Sector Divestment Certification: Contractor hereby represents that said contractor is in compliance with New York State General Municipal Law; Section 103-g entitled “Iranian Energy Sector Divestment.” By submission of this bid, each contractor and said person signing on behalf of any contractor certified and in case of a joint bid, each party hereto certifies as to its own organization, under penalty of perjury, that the best knowledge and belief, that each contractor is not on the list created pursuant to NYS Finance Law Section 165-A (3) (b). The contractor shall submit a signed, notarized and dated Iranian Energy Sector Divestment Certification, included in this document, with its bid. Said certificate is mandated by Section 103-g of the General Municipal Law. Reference the Iranian Energy Sector Divestment Certificate Form included in this document.

12. Required Insurance: a. This bid document includes an information sheet entitled: ALLEGANY
COUNTY STANDARD INSURANCE REQUIREMENTS. These requirements establish the minimum insurance(s) which the contractor shall have in effect prior to entering into a contract with Allegany County. Said insurance(s) are required to remain in effect through the term of the contract(s). In the event that the contractor’s insurance lapses during the term of the contract(s), the County reserves, as its right, the right to cancel the contractor’s contract(s), and to purchase the contracted product(s)/service(s) on the open market; with any increase in cost(s) to Allegany County charged to the awardee. Credit shall not be issued to the awardee where open market cost(s) to the County are less than the cost(s) contracted with the awardee.
b. Additional Insured & Certificate Holder:
i. Allegany County shall be named as an “additional insured” for the
purpose of coverage on direct, primary and non-contributory basis in the contractor’s policy for all intents and purposes of contract(s) issued as a result of an award of this bid. Additional insured shall read- Allegany County, 7 Court Street, Room 210, Belmont, New York, 14813.
ii. Certificate Holder shall read- Allegany County, 7 Court Street, Room 210, Belmont, New York 14813.
c. Each contractor shall submit an original of its Certificate of Insurance and
NYS Workers Compensation Insurance Coverage Form (which indicates the contractor’s compliance with the above sections a. and b.) to the following: Allegany County DPW, 7 Court Street, Room 210, Belmont, New York 14813.
13. Sales Tax Exemption:
The County is exempt from payment of sales and compensating use taxes of the State of New York and cities within the State of New York.
14. Protection from Claim Against or Equal: In the event of any claim concerning or relating to the issues of equal or better, the contractor agrees to hold the County of Allegany free and harmless from any and all claims, legal fees and court costs for loss or damage arising out of this transaction for any reason whatsoever.
15. Addendum/Addenda: a. If an addendum has been issued prior to the County’s receipt of bids;
Allegany County shall attempt to notify contractors know to have received the sealed bid documents and who contact information is on file with Allegany County. Allegany County does not ensure the potential

contractor’s receipt of the addendum. It shall be the responsibility of the contractor, prior to submitting its bid, to contact the Department of Public Works (585) 268-9230, to determine if an addendum has been issued.
b. Addendum shall be available online at www.alleganyco.com; click on
Government then Public Works Department. They are also available at the Office of the Superintendent of Public Works, 7 Court Street, Room 210, Belmont, New York 14813.
c. It is a requirement that the contractor sign date and include the addendum
with its bid submittal. Failure to do so may result in rejection of bid.
16. Multiple/Alternate Bid Submittal(s): For those contractor’s intending to submit multiple/alternate bids in response to this bid solicitation; the contractor is required and shall submit a complete bid document for each bid submitted. Note: If there is a bid surety requirement, one (1) surety instrument written for the highest amount, shall suffice.
17. Submittal of Bid(s): a. The bid shall be submitted in a sealed envelope with the following marked
on the outside: i. Print your company’s name in the upper left corner ii. In the lower left corner print:

c. Bids will be received at the Public Works Department at the time specified.
At which times bids will be opened.
d. Facsimile transmitted bids are not acceptable and shall be rejected.
e. Security procedures are in effect at the Allegany County Office Building. Interested parties, especially contractors who intend to hand deliver bids and/or conduct business with Allegany County Department of Public Works should allow sufficient time for any delay which may arise as a result of security procedures. To be considered delivered and on time a bid submittal must be received at the Public Works Department by the appointed hour.
f. All bid proposal sheets shall remain intact and be submitted with the bid.

18. Business Hours: Contractors will maintain normal business hours during the time in which the material bid will be needed by the County. Bidders agree that normal business hours shall mean 8:00 a.m. to 4:00 p.m. Bidders acknowledge and agree that on some occasions it may be necessary to open before and remain open beyond normal business hours in order to provide the County with material bid.
19. NYSDOT Standard Specifications or Source(s) & Materials: a. All materials proposed or materials supplied by the bidder to Allegany
County shall conform to the requirements set forth in Standard Specifications (US CUSTOMARY UNITS), published by the New York State Department of Transportation, May 2, 2008, including all current amendments, or to any other standard or standard specifications. If the materials bid are subject to certification or approval by the State of New York and the bidder shall furnish with the bid proof of such approval or certification.
b. The Superintendent of Public Works may order tests for the materials
proposed by the bidder or supplies by a successful bidder, at any time, the costs of such testing shall be the responsibility of the bidder and/or successful bidder as the case may be. The bidder and/or successful bidder agree to pay the costs of such tests when presented with an invoice by the Superintendent of Public Works.
20. Compensation:
Payment shall be rendered to the contractor(s) for satisfactory compliance with the general terms and conditions of this bid. Invoice terms shall be net 30 days. The county normally processes invoices for payment bi-monthly, according to a regular established schedule.
21. Late Bids: Contractors bear the sole responsibility for the delivery of their bid in a timely manner. Reliance upon the U.S. Postal Service or other carriers is at the contractor’s risk. Late bids will not be considered and will be returned unopened.
22. Right of County to Seek Clarification, Accept or Reject Bid(s), etc.: a. Allegany County reserves as its right, the right to require clarification from
the contractor for the purpose of assuring a full understanding of the contractor’s responsiveness to the solicitation requirements.
b. Allegany County reserves as its right, the right to accept or reject any and
all bids (or separable portions thereof), the right to waive irregularities and technicalities, and the right to request resubmittal of bids (re-bid).

23. Civil Rights: The County of Allegany in accordance with the provisions of Title VI of the Civil Rights Act of 1964 and New York Labor Law; Article 8- Public Works, Section 220e hereby notifies all contractors will affirmatively ensure that any contract awarded as a result of this bid solicitation will be awarded without discrimination on the grounds of race, color, sec or natural origin.
24. Award of Bid: For the purpose of this bid and subsequent award(s), it is intended that award(s) that will be made on a line item basis:
a. Bids will be awarded to qualified and responsible contractor(s) who sufficiently meet the terms, conditions and specifications stated herein. However under all circumstances and all statements to the contrary notwithstanding, Allegany County reserves as it right, the right to determine award(s)/awardee(s) in accordance with the best interest of Allegany County.
b. Award of Bid is not made at the bid opening. All bids are subject to final
review and acceptance by the Public Works Committee of the Allegany County Legislature before any award may be made.
25. Executory Clause:
Allegany County shall have no liability under any contract or contracts or to anyone else beyond funds appropriated and available for the purpose of this document and resultant contract(s).
26. Assignability: The contractor shall not assign, transfer, convey, sub-contract, sublet or otherwise dispose of all or portions of this contract (and/or work to be performed as a result of the contract) or its right, title, or interest to any other person, company, corporation, without prior written consent of the Superintendent of Public Works.
27. Extension of Contract Usage by Political Subdivisions: Political subdivisions within Allegany County (Towns, Villages, School Districts and Fire Districts), as defined in Section #103 of the General Municipal Law may participate in any contract awarded as a result of this bid document. Additionally, per section 408-a (2) of County Law and Allegany County Resolution No. 202-15, all political subdivisions within the state of New York may piggyback off this competitive bid as long as it is mutually agreed to by both parties. Responsibility, financial or otherwise, for purchase(s) made by other parties as a result of the extension of this contract, shall not be borne by Allegany County.

28. Contractor’s Failure to Comply:The Contractor’s failure to perform in compliance with the bid award shall result in withholding of payment. The payment shall be withheld until such times as the contractor fulfills its responsibilities. Compliance shall be determined by and to satisfaction of Allegany County. Such action would not necessarily preclude further initiatives on the part of Allegany County to protect and preserve its best interest.
29. Cancellation of Contract: Allegany County reserves, as its right, to cancel the contract(s) resulting from an award of this bid solicitation at any time during the contract period, without penalty to Allegany County and without stated reason, by delivering a written ten (10) day notice of intent to the contractor(s) or its representative(s). Said notification mailed to the contractor or its representatives via the US Postal Service, First Class Mail shall be considered sufficient and delivered.

ITEM NO. 6
SPECIFICATIONS FOR LIQUID BITUMINOUS MATERIALS It is the intent of these specifications to describe the requirements for bituminous materials to be used by the Allegany County Department of Public Works for the proposed maintenance of County Highways for the 2017-2018 year.
BITUMINOUS MATERIALS REQUIREMENTS: All bituminous materials furnished shall meet the material requirements for bituminous materials as specified in Section 702 of the New York State Department of Transportation Standard Specification or by the Allegany County Department of Public Works as follows:
Plastic Joint Material has added rubber compounds, either virgin polymers or recycled rubber tires. The inclusion of these rubber compounds produces a sealant, which is elastic and remains flexible over a wide temperature range. The rubber also prevents the sealant from softening and becoming tacky in hot weather, and so eliminates any tracking. These two rubberized sealants are made to two sets of specifications, ASTM D1190 or ASTM D3405, and differ in the percentage of rubber compound (3405 having a higher amount.)
Materials for use in the Manufacture of Stockpile Patching Materials shall conform to the requirements of NYSOGS Group Specification for Commodity Group 31502, No. 624 dated July 2, 1996.
Sampling, Testing, Inspection & Reporting: All liquid bituminous material intended for use on County projects shall be sampled tested, inspected, certified and shipped in accordance with New York State Department of Transportation Materials Method N.Y. 8.1, 8.2 & 8.3 and addenda. The County reserves the right to inspect liquid bituminous material supply facilities and the equipment of any successful bidder at any time for conformance with the requirements listed herein, if deficiencies are found, such deficiencies shall be corrected within 10 days or the bidder will be considered in default.
Payments: Payment shall be made at contract price per gallon for the actual quantities of liquid bituminous material furnished and verified by the receiving agency. This determination as to quantities involved in any contract shall be accepted as final and binding upon the contractor. For the purpose of measurement, a gallon shall be a volume of 231 cubic inches, and measurement shall be based on the volume of the liquid bituminous material at a temperature of 60 degrees Fahrenheit. All invoices shall show an allowance for temperature above 60 degrees Fahrenheit. The temperature-volume correction to obtain the correct volume at 60 degrees Fahrenheit shall be 0.00025 per Fahrenheit degree for all asphalt emulsions. The method to be used for volume corrections for petroleum products shall be the method and coefficients of expansion given in the “Standard Petroleum Tables, A.S.T.M. D1250.”

Tack Coat (702-90) payment shall be made at the contract price per gallon plus all on job distributor time which will be paid at the contract price per hour.
Delivery Ticket: A delivery ticket shall be provided with each load of bituminous material and filler for joints stating the following:
1) Storage facility identifications 2) Ticket Number 3) Date & Time 4) Item Number & Type 5) Quantity ticket printed by machine 6) Quantity in 60 degrees Fahrenheit gallon emulsions
Approved List Criteria: The County will perform inspection of the facility of the primary source and/or supplier to determine conformance with these requirements and establish the approved lists. Copies of the approved lists status are available from New York State Department of Transportation Materials Bureau, 1220 Washington Avenue, Albany, New York 12232. Material & Equipment Requirements: 1) All materials in this bid shall be supplied from NEW YORK STATE DEPARTMENT OF TRANSPORTATION APPROVED LIST OF LIQUID BITUMINOUS MATERIAL PRIMARY SOURCES AND/OR SUPPLIERS. The bidder shall supply asphalt cement for paving only from a firm listed as a primary source. The approved liquid bituminous material primary sources and/or suppliers list is a listing of firms that meet the following requirements:
a. The liquid bituminous material at a supplier’s facility shall be obtained from an approved primary source. (In many cases a firm listed as supplier will also be an approved primary source, and therefore, automatically meets this requirement.) An approved primary source is a firm that samples, tests and certifies that the material is in conformance with the New York State Department of Transportation materials specifications. Primary sources may be refineries, terminals, emulsion manufacturing plants, lime-blend plants, intermediate storage facilities or other similar plants that sample test and certify the materials.
b. Asphalt emulsions shall be stored in an approved facility having a minimum of one permanent storage tank. The tank(s) shall have a storage capacity of at least 10,000 gallons each and have equipment capable of heating the material to the proper application temperature prior to shipment. These tanks shall be equipped with a sampling valve and thermometer. The sampling valve shall be so designed and installed as to be non-clogging and safe. The type of valve and its general location shall be according to written instructions by the New York State Department of Transportation. If tack coat, Material Designation 702- 90, is stored in a permanent tank, this tank shall have agitating equipment in addition to the other tank requirements.
c. The quantity of liquid bituminous materials except fill for joints, shall be measured with an accurate truck scale or meter (s) and the quantity shall be ticket printed by machine. The truck scale or meter (s) shall meet the requirements of National Bureau of Standard Handbook 44. If a meter is used, it shall be permanently installed to connect it with the approve storage tank, and it shall be used to measure all quantities. The meter (s) shall be equipped with automatic temperature compensation devices to

provide quantity in 60˚ Fahrenheit gallons. The quantity of filler for joints shall be measured by volume or weight using an accurate measuring device.
The ticket printer shall meet the following requirements:
1. Truck Scales: The ticket printer shall machine print in digital form a minimum of two (2) of the following:
a) tare weight b) gross weight c) net weight
The scale system shall be interlocked to allow printing only when the scale has come to a complete rest.
Material & Equipment Requirements: 1. Meters:
The ticket printer shall machine print in digital form a minimum of two (2) of the following:
a. Beginning meter reading b. Ending meter reading c. Total gallons at 60 degrees Fahrenheit
The firm shall have evidence available to show that the scale meter(s) have been tested for accuracy by a competent scale technician approved by the New York State Department of Transportation, in the calendar year that the material is being supplied. The truck scale shall be located at the storage facility unless the following conditions are met:
a. The firm owns the truck scale or has full control of the weighing operations. The scale shall be located in close proximity (approximately 1,000 feet or less) to the storage tanks.
b. The acceptability of the distance will be determined by the Allegany County Department of Public Works.
c. The firm provides written proof to the Allegany County Department of Public Works that the firm has complete access to the truck scale 24 hours a day, 7 days a week.
d. The firm is responsible for calibration and repairs of the weighing equipment.
2. The bidder shall have equipment required to complete the work of the item(s) requiring applicators as follows:
a. For item(s) requiring distributors, at least one distributor for each 100,000 total gallons of liquid bituminous material to be applied. The distributor shall meet the requirements of the New York State Department of Transportation Standard Specifications, Section 410, Bituminous Surface Treatment. The distributor minimum capacity shall be 2,000 gallons. Each distributor shall be equipped with a calibrated measuring stick to measure the actual quantity used when only a portion of the original quantity of liquid bituminous material is used at the project site. The measuring stick shall be calibrated such that the quantity can be determined within an accuracy of +/- 25 gallons when the distributor is in a level position.
b. For item(s) requiring aggregate spreaders, at least one aggregate spreader for each 100,000 total gallons of liquid bituminous material to be applied covered with

aggregate. The aggregate spreader shall be a self-propelled unit capable of uniformly spreading the aggregate at a rate specified by the engineer with an allowable variation not to exceed 0.5 pounds per square yard. The spreader hopper shall have a minimum spread width of 12 feet with gate openings graduated so that spread widths can be adjusted in 6 inch increments. The spreader shall be equipped with a self-locking hitch with a minimum of 90 degree vertical movement. For item(s) requiring pugmill mixers, at least one pugmill mixer for each 200,000 total gallons of liquid bituminous material.
c. The pugmill mixer shall be a rotating paddle shaft mixer meeting the requirements of New York State Department of Transportation Standard Specifications, Section 302 Bituminous Stabilized course or better.

SPECIFICATIONS FOR BITUMINOUS PLANT MIXTURES: (HOT MIXES)
MATERIAL REQUIREMENTS: Material requirements for bituminous plant mixes shall conform with New York State Department of Transportation Standard Specifications for plant mix pavements Section 401, Sub-section 401-2. Materials requirements for the Manufacture of Stockpile Patching Materials shall conform to the requirements of NYSOGS Group Specification for Commodity Group 31502, No. 624 dated July 2, 1996. TESTING REQUIREMENTS: It shall be the responsibility of the supplier to extract one (1) box sample for every 500 tons of material supplied or delivered. The supplier shall then have the sample tested either by their own laboratory or by a independent laboratory. Testing will conform to Bituminous Concrete Testing New York State Materials Method #5 for Extraction and Gradation. The gradation of the various Bituminous Concrete items shall conform to the standards set forth in the latest New York State Standard specifications and construction materials manual. The results of the tests shall be sent to the Allegany County Department of Public Works within two (2) working days of the taking of the sample. The Allegany County Department of Public Works reserves the right to take samples for independent testing. The County will, when sampling, take two (2) samples with the second being sent to the supplier. The supplier then may test this sample if so desired. Should the test fail the supplier shall cease all operations until the situation is corrected and compensation for the rejected material is negotiated with the County Superintendent of Public Works.
PRICE ADJUSTMENTS 1. Price adjustments allowed will be based on October 1, 2016 average of the F.O.B. terminal price per ton
of AC-10 or AC-20 asphalt cement (base average F.O.B. terminal price), at the following locations:

In the event that one or more of the above named sources discontinue posting a price for asphalt cement, the base average F.O.B. terminal price shall be recalculated upon notice by the supplier to discontinue posting a price. A revised base average F.O.B. terminal price than shall be determined by removing that location from the original base average F.O.B. terminal price. All revised and new average F.O.B. terminal prices calculated from that date shall reflect the reduction in the number of reporting locations.
Any introduction or withdrawal of a temporary voluntary allowance, terminal operator’s allowance, or other

discount offered to the trade in general from the posted price of asphalt cement at any of the above terminals will be considered, for purposes of price adjustment, as a change in the F.O.B. terminal price.
2. The new average F.O.B. terminal price will be determined based on the above F.O.B. terminal prices posted for each month, hereafter known as the “Adjustment Date”, during the contract period. However, price adjustments, in accordance with the formula below, will be effective for deliveries made on and after the first day of the month following the adjustment date.

If at any time after October 1, 2016 the average posted price of asphalt cement at the aforementioned terminals increases or decreases by $4.00 per ton or more over or under the last average FOB posted price utilized by the State for adjustment purposes, the State shall publish a special price adjustment which shall be effective eight (8) days subsequent to the date on which the change in the average FOB posted price becomes effective.
8. All price adjustments will be computed by calculator to three decimal places.
All bid prices will be effective through May 1, 2018.
The liquid bituminous material for item(s) requiring distributors shall be applied in accordance with New York State Department of Transportation Standard Specification, Section 410 Bituminous Surface Treatment.

MATERIAL REQUIREMENT: Material shall meet the requirements of the New York State Department of Transportation Standard Specifications, Section 702, latest revision, for bituminous liquid tack coat. CONSTRUCTION REQUIREMENTS: The material shall be delivered to the site upon 24 hours notice and applied in accordance with NYSDOT Standard Specifications, Section 407, latest revision. The tack coat shall be applied within the confines of the paving construction work zone as directed by the County Superintendent or his Designee. BASIS OF BID: The unit price bid shall include all costs to furnish, deliver and install the material at the recommended and/or agreed upon application rates. The unit bid price shall be the cost per gallon factoring in an established price of $125.00 / hour for the rental of the bituminous distributor with operator. METHOD OF MEASUREMENT: The quantity of material to be paid for shall be measured by the number of gallons used. The number of hours charged for the distributor truck and operator will only be for the hours on the project site. No payment will be made for travel to and from the project site or for mechanical breakdown of the distributor. The time charged shall be agreed upon for the project at the end of each working period by the County Superintendent or his Designee. TRAVEL MIX PAVER: The liquid bituminous material for these items shall include a Midland Mix Paver (or equal) and an operator and screed man.
PUGMILL & PAVER: The liquid bituminous material for these items shall include a rotating paddle shaft pugmill with operator, a Blaw Knox PF 200 Paver (or equal) with an operator and screed man.
PUGMILL ONLY: The liquid bituminous material for these items shall include a rotating paddle shaft pugmill with operator.
Material shall be delivered to the Allegany County Equipment Shop on North Branch Road in Friendship NY. Asphalt fillers and sealers shall be shipped in double end steel drums 26 to 28 gauge or in cardboard containers.
For other item(s) requiring shipment in containers: Asphalt emulsions and liquid asphalts shall be shipped in clean, leak-proof containers not exceeding a capacity of 55 gallons each. All steel 55 gallon drums shall have side bungs with 1 ½” or 2” standard pipe threads.
All liquid bituminous materials furnished and/or applied, shall be in accordance with Specifications for Bituminous Materials in the book entitled, NEW YORK STATE DEPARTMENT OF TRANSPORTATION STANDARD SPECIFICATIONS, CONSTRUCTION AND MATERIALS, January 2, 1990”, as currently amended by the New York State Department of Transportation, and as amended herein.
HYPERPATCH HIGH PERFORMANCE COLDPATCH COMPOUND
HYPERPATCH permanent asphalt patching material shall be a proprietary mixture of liquid asphalt, adhesion agents, polymers and synthetic latex that when mixed with specific graded limestone aggregate shall form a permanent patching material. This material can be used to fill potholes, utility cuts, drop-offs, and similar pavement repairs. It can be stockpiled, packaged, or used immediately from the mixer.
HYPERPATCH liquid shall be delivered and metered by the gallon at a temperature range of 180 – 240 degrees F. The material shall be free flowing, pumpable, and mixable through an approved portable pugmill mixing plant with ambient temperature aggregate. Mixing temperatures should not be below 32F. The liquid material shall provide an adequate coating of the aggregate and show no signs of stripping.
Hyperpatch material shall meet the NYS DOT specifications for high performance cold patch

Price to the county will include all delivery, handling and pump-off to the pugmill. Mixing with a pugmill shall be included in the per gallon price.

BITUMINOUS CONCRETE IN-PLACE SPECIFICATIONS
At the discretion of the Allegany County Superintendent, or his designee, materials may be ordered in place. In addition to all existing specifications, the following provisions shall apply:
Labor Rates:
The successful bidder will comply with the prevailing rates, a copy of which is attached and made a part of this specification, and present to the County Superintendent a certified payroll report at the time of each billing.
Bituminous Pavers:
Bituminous pavers shall be self-powered units, provided with an activated screed or strike-off assembly. The machine shall be capable of spreading and finishing courses of bituminous plant mix material in lane widths applicable to the specified typical section and thicknesses shown on the plans. Pavers used for shoulders and similar construction shall be capable of spreading and finishing courses of bituminous plant material in widths shown on the plans. The paver shall have a receiving hopper with sufficient capacity for uniform spreading operation and with automated flow controls to place the mixture uniformly in front of the screed. The screed or strike-off assembly shall be heated as necessary to produce a finished surface of the required evenness and texture without tearing, shoving or gouging the mixture. When laying mixtures, the paver shall be capable of operating at forward speeds consistent with satisfactory placement of mixtures.
The bituminous paver shall be at the job site sufficiently ahead of the start of paving operations to be examined and approved by the County Superintendent or his designee. Any paver found worn or defective either before or during its use shall be immediately repaired to the satisfaction of the County Superintendent or his authorized representative or replaced.
Rollers:
All rollers shall be either of an approved vibratory type or static steel wheel used according to the requirement of sub-section 401-3.11 of the New York State Department of Transportation Specifications. The rollers shall be in good mechanical condition, free from excessive backlash, and capable of operating at speeds slow enough to avoid displacement of the mixture. The number and weight of rollers shall be sufficient to satisfactorily compact the mixture while it is still in a workable condition. The use of equipment which results in excess crushing of aggregate will not be permitted. Alternate types of rollers may be approved by the Allegany County Superintendent, or his designee, if field tests or other data demonstrates that satisfactory results can be achieved. The Contractor will be required to supply two (2) rollers which are to be on the job site at all times for any in place work, and both may need to be used at the same time.
Hauling Equipment:
The mixture shall be transported from mixing plants to the work site in tight vehicles having clean and smooth metal beds. Each load shall be covered with canvas or other suitable material of such

size as to protect the mixture from the weather. When necessary, so that the mixture will be delivered on the road at the specified temperatures, truck bodies shall be properly insulated.
Personnel:
The successful bidder must provide sufficient competent, trained personnel under the direction of a superintendent or foreman who has experience in all aspects of the placement of hot mix bituminous material. Personnel must be of sufficient number to accomplish the work. The number of personnel used is subject to approval by the Superintendent or his designee.
Finished Pavement:
Compacted depth of in-place pavement to be determined by the Superintendent of Public Works. Compaction and finished mat must be approved by the Superintendent or his designee.
The initial lift of hot mix asphalt shall be 6F Top that is applied to the old road surface that is lightly tack coated by others. The final lift of hot mix asphalt shall be 7F top.
Traffic Control:
The successful bidder must provide all traffic control responsible for the entire work zone and shall conform to New York State Traffic Control Standards. The Contractor shall be required to place temporary pavement markings in accordance with NYS DOT specifications 619-3.06. At a minimum a 15” strip shall be placed at 50’ intervals along the entire length of the project. The temporary pavement marking tape or paint/glass beads will be supplied to the contractor by Allegany County.
Method of Measurement:
The quantity to be paid for will be in tons of bituminous plant mixture incorporated into the project.
Basis of Payment:
The unit price bid per ton of bituminous plant mix in-place will include the transportation to the job site, all necessary equipment and labor, including traffic control, and materials necessary to satisfactorily complete the project within a normal work day.
If a project takes multiple days, the contractor shall use the average tons per day to determine the price per ton to be charged for the project.

BITUMINOUS SEAL COAT IN PLACE Section 1
Description: This work is an application of bituminous material, immediately followed by an application of coarse aggregate. The aggregate for this work will be provided by the County and a list of stockpile areas will be provided as needed. At the time of bidding, the successful bidder must own and operate a New York State approved Bituminous Manufacturing Facility located within the State of New York.
Section 2
Material: Bituminous material shall be Item 702-3101 RS-2 or Item 702-3301 HFMS- 2GH or 702-4101 CRS-2 and conform to New York State Department of Transportation Specifications. This material shall be obtained from the successful bidders bituminous manufacturing facility within New York State that is approved at the time of bidding. Application temperature shall be as specified by New York State D.O.T. specifications.
Section 3
Construction: The successful bidder shall sample the aggregate to be used and determine the approximate application rate using the design method.
a) Conditioning Existing Surface: The successful bidder shall clean the entire existing road surface of loose and foreign materials. Any temporary pavement tape shall be removed by the contractor prior to surface treatment. Any patching shall have been done by County Forces prior to this application.
b) Application of Bituminous Material: Do not apply bituminous material unless entire surface
is in condition to permit satisfactory penetration and adhesion, and unless air and surface temperatures are 60 degrees Fahrenheit. Use a distributor designed, equipped, calibrated, maintained, and operated so material may be applied uniformly, on variable width of surface up to 20 feet, at readily determined and controlled rates, as specified, capable of uniform distributing pressure, and with an allowable variation from any specified rate not exceeding 0.02 gallon per sq. yd. Provide a distributor equipped with a tachometer, pressure gauges, accurate volume-measuring devices or a calibrated tank, a thermometer for measuring temperatures of tank contents, a power operated pump, and full circulation spray bars adjustable laterally and vertically. The distributor shall be calibrated in accordance to these specifications (calibration is discussed in Distributor Calibration) prior to its use. Small areas inaccessible to the distributor may be applied with hand- spraying equipment. Apply bituminous material, at a rate to be determined by the Public Works Superintendent or his authorized agent.
Insure uniformity at the junction of applications.
c) Spreading and Rolling Coarse Aggregate: Use a self-propelled, mechanical stone spreader capable of uniformly spreading 10 to 50 pounds per square yard of coarse aggregate of at least 11 feet wide in a single layer. Calibrate the spreader using the method specified later

in these specifications. The final application rate shall be determined by the County Public Works Superintendent or his authorized agent.
Apply the aggregate within 30 seconds of the application of bituminous material.
Use a sufficient number of pneumatic-tired rollers to cover the entire width of stone spread during the contact pressure of 40-50 psi. Rolling shall follow within 30 seconds of aggregate. After one-half of the roadway has had seal coat applied and prior to starting work on the unsealed portion onto the shoulder. Also, broom all loose aggregate within the one foot area from the center lane edge of the newly applied seal coat portion to insure a uniform adhesion over the center line joint. In addition, any excess aggregate that is left loose after the proper curing time shall be swept from the entire surface. The surface shall be swept at the time determined by the County Public Works Superintendent or his authorized agent.
d) Maintenance and protection of Traffic during construction: The contractor shall provide a minimum of Two flag persons attired with ANSI approved safety vests to be stationed at each end of the work zone. The contractor shall also provide signs and at least one pilot car and driver to control traffic within work zone. Provide one lane traffic protection during daylight construction and keep traffic off the seal coat application by the use of sufficient pilot vehicles until the seal coat is adequately cured. Weather conditions or high volume traffic may dictate that the pilot vehicles remain in operation for an extended period of time after sealing has been completed.
The pilot vehicles shall keep all thru traffic off the uncured seal coat and at speed of 25 M.P.H. or less within the limits of work. The pilot vehicles shall be equipped with reflectorized signs on the rear of the vehicles stating “Pilot-car - Follow me.”
E) Hauling Equipment: The aggregate shall be transported from stockpiles to the work site in tight vehicles having clean and smooth metal beds. These vehicles shall travel no faster than 25 M.P.H. anywhere on the jobsite. THE HAULING SHALL BE DONE BY ALLEGANY COUNTY DPW OR TOWN TRUCKS. THE TRUCKS WILL BE LOADED BY THE SUCCESSFUL BIDDER’S LOADER AT THE STOCKPILES.
f) Personnel: The successful bidder must provide sufficient competent, trained personnel
under the direction of a superintendent or foremen who have experience in all aspects of applied in place bituminous seal coat. Personnel including sub-contracted haulers must be of sufficient numbers to accomplish the work. The number of personnel used and their relevant experience with in place bituminous seal coat is subject to approval by the Superintendent or his designee. The superintendent or his designee reserves the right to remove any personnel deemed incompetent to accomplish the work in a professional manner.

SPECIAL NOTES: 1) The County, if this item is used, intends to complete all the routes planned. By mutual
agreement of the County and supplier, additions and subtractions may be made to do work as the County deems necessary.
2) Because of the nature of the work involved the County will make every attempt to
schedule this work to occur without interruption, however, this cannot be guaranteed and the County will be the final authority as to the schedule.
3) The successful bidder will comply with the prevailing labor rates, a copy of which is
attached and made a part of this specification, and present to the County Public Works Superintendent a certified payroll report at the time of each billing.
4) The application rates determined will be given to the County Superintendent of Public
Works at least 2 weeks prior to the start of work. These rates will be used as a guideline by the County Superintendent of Public Works or his authorized agent and may be revised by him if field conditions warrant.
Method of Measurement:
Bituminous Seal Coat In Place: Work shall be measured by the square yard and agreed to between County Public Works Superintendent or his authorized agent and contractor.
Asphalt Emulsion: The quantity paid for will be in gallons measured as defined in the section “SPECIFICATION FOR LIQUID BITUMINOUS MATERIALS”.
Basis of Payment:
Bituminous Seal Coat In Place: Payment will be made per square yard for completed work. The price per square yard bid will include labor, traffic control, equipment, and materials with the exception of aggregate and Asphalt Emulsion.
Asphalt Emulsion: Payment will be made per gallon and will include application with an approved and calibrated asphalt distributor.

SPECIFICATIONS FOR IN-PLACE CRACK SEALING
Scope - This specification shall describe the Equipment, Labor, and Materials to be used for crack sealing on County Roads. Cracks which are ¼” or larger shall be filled and payment will be on a per gallon basis.
Equipment - Containerized, hot oil heated, thermostatically controlled, agitated tank, air compressor with a minimum of 125 CFM. Application equipment capable of heating seventy five percent (75%) of the tank capacity in one hour when the ambient air temperature if 70 Degrees Fahrenheit. The unit shall be equipped with insulated discharge valves, hoses and application wand. The application shall incorporate a shut off valve, preferably located near the wand tip.
Application - The contractor shall fill any cracks which are ¼” wide or larger. The cracks shall be blown clean using the described air compressor and shall be adequately filled without excessive waste. The material shall be spread evenly along the crack with a squeegee. No work shall be performed when the ambient air temperature is less than 60 Degrees Fahrenheit.
Labor - All operators and laborers must be experienced and trained to perform the required tasks to complete the work in a professional manor. The Contractor shall comply with all applicable OSHA requirements.
The successful bidder will comply with the prevailing labor rates, which are attached to these specifications. A certified payroll report shall accompany the invoice and shall be directed to the Superintendent of Public Works.
Maintenance and Protection of Traffic - The Contractor shall supply a minimum of three flag persons. The Flagpersons shall be equipped with portable radios, hard hats, reflective safety vests and stop/go paddles. The Flagpersons shall be required to keep traffic off any newly applied materials until such time that no tracking of materials occur.
Material - The material shall in accordance with Specifications for Bituminous Materials in the book entitled, “NEW YORK STATE DEPARTMENT OF TRANSPORTATION STANDARD SPECIFICATIONS, CONSTRUCTION AND MATERIALS, January 2, 1990”, as currently amended by the New York State Department of Transportation, and as amended herein.

BITUMINOUS CONCRETE SCRATCH OR LEVELING COURSE
AND
BITUMINOUS SEAL COAT - IN PLACE Section 1
Description: This work shall consist of the placement, at any location in the County, of a scratch or leveling course of bituminous concrete and a bituminous seal coat wearing course in conformance with this specification. the payment lines, and typical sections on the plans or as specified by the Superintendent of Public Works. Section 2
Materials: Materials will conform to the Sections “Specifications for Liquid Bituminous Materials” and “Specifications for Bituminous Plant Mixtures”. The type of Bituminous Concrete to be used for the “Scratch of Leveling” course will be determined by the Superintendent of Public Works or his representative. Section 3
Construction Details: The construction details shall be the same as those in the sections “Bituminous Concrete In - Place” and “Bituminous Seal Coat In - Place”.
The thickness of the “scratch or leveling” course of bituminous concrete will be determined by the Superintendent of Public Works or his representative and the intent is to place a thin layer of material to level the roadway in preparation of placing the bituminous seal coat. The “scratch or leveling” course will be placed the full width of the roadway as to provide a uniform surface for the Seal Coat. The Bituminous Seal Coat shall be placed as directed by the Superintendent of Public Works or his representative. The “scratch or Leveling” course shall be allowed to cure for a minimum of ten (10) days before the Bituminous Seal Coat is placed unless instructed to do so by the Superintendent of Public Works or his representative.

Section 4
Method of Measurement:
Bituminous Concrete Scratch or Leveling Course: The quantity of Bituminous Concrete Scratch or Leveling Course will be measured in tons of 7-F bituminous concrete incorporated into the project. Bituminous Seal Coat In Place: Work shall be measured by the square yard and agreed to between County Public Works Superintendent or his authorized agent and contractor.
Asphalt Emulsion: The quantity paid for will be in gallons measured as defined in the section “SPECIFICATION FOR LIQUID BITUMINOUS MATERIALS”. Basis of Payment:
Bituminous Concrete Scratch or Leveling Course: The unit price bid per ton of bituminous plant mix in-place will include the transportation to the job site, all necessary equipment and labor, including traffic control, and materials necessary to satisfactorily complete the project.
Bituminous Seal Coat In Place: Payment will be made per square yard for completed work. The price per square yard bid will include labor, traffic control, equipment, and materials with the exception of aggregate and Asphalt Emulsion.
Asphalt Emulsion: Payment will be made per gallon and will include application with an approved and calibrated asphalt distributor.
DETAILED SPECIFICATIONS
PAVER PLACED SURFACE TREATMENT
1.0 DESCRIPTION
The Paver Placed Surface Treatment system shall consist of a warm polymer modified asphalt emulsion sprayed immediately preceding the application of a hot mix asphalt wearing course which forms a homogeneous well-textured and durable wearing surface that can be opened to traffic immediately on cooling. The nominal thickness of the layer shall be 5/8 inch, the maximum thickness of the mat shall not exceed 1½ inches.
The wearing course system shall be placed in one pass by a single machine. This machine shall complete the operation by spraying the polymer modified asphalt emulsion and applying a hot mix asphalt overlay. The machine shall incorporate a receiving hopper, asphalt emulsion storage tank, variable width asphalt emulsion spray system and a variable width heated screed. The machine shall be capable of applying the Paver Placed Surface Treatment at 20 to 100 feet per minute, and actual application shall not be less than 30 feet per minute.

2.0 POLYMER MODIFIED ASPHALT EMULSION MATERIAL
The liquid material shall be a cationic, rapid setting, asphalt emulsion, NYS Item 702-4001 except as modified in DATA TABLE I – POLYMER MODIFIED ASPHALT EMULSION. The emulsion shall be obtained from a storage facility that has been approved by the Director, Materials Bureau, New York State Department of Transportation, within the current calendar year, prior to the start of work.
3.0 HOT MIX ASPHALT MATERIAL FOR WEARING COURSE
The wearing course shall be a plant mixed hot asphalt concrete and shall be a mixture of single size coarse aggregate, fine aggregate, mineral filler and asphalt cement. The single size course aggregate shall be nominal ¼ inch for Type A mix, nominal 3/8 inch for Type B and nominal ½ inch for Type C mix, according to the gradation specficiations in Date Table II. The hot mix asphalt concrete shall be obtained from a facility that has been approved by the Director, Materials Bureau, New York State Department of Transportation, within the current calendar year, prior to the start of work. The asphalt content of the mix shall be 4.8 – 5.3% by weight of the total mix and must be computed based on the actual job mix.
4.0 SURFACE PREPARATION
The following items will be performed by the contracting agency, unless otherwise directed:
A. Manhole covers, water valves, catch basins, and other drainage structures shall be clearly referenced for location and adjustment after the surfacing operation.
B. Thermoplastic traffic markings shall be removed. All vegetation at the edge of pavement shall be removed.
C. Pavement cracks and joints, greater than ¼ inch wide, shall be cleaned and filled with an approved material prior to the surfacing operation.
D. Before applying the Paver Placed Surface Treatment, serious surface irregularities shall be corrected. Wheel ruts greater than 1 inch in depth shall be filled prior to the re-surfacing operation.
E. The pavement surface area to be overlaid shall be cleaned and made free of any debris that may hinder bonding of the overlay.
5.0 APPLICATION
Paver Placed Surface Treatment shall be placed on a dry or damp, but not on a wet, pavement surface. The pavement temperature shall be not less than 45 degrees Farenheit and rising.

The polymer modified asphalt emulsion shall be applied by the asphalt emulsion spray system mounted on the self-priming paver. The spray system shall accurately, uniformly and continuously monitor the rate of application across the entire width to be overlaid.
The rate of spray shall be 0.2 +/- 0.05 gallons per square yard. The asphalt emulsion shall be applied at a temperature of 140 – 180 degrees Fahrenheit. No wheel or other part of the paving machine shall come into contact with the polymer modified asphalt emulsion before the hot mix asphalt-wearing course is applied.
The hot asphalt concrete wearing course shall be delivered to the self-priming paver at a temperature of 315 +/- degrees Fahrenheit. The application rate of the hot asphalt aggregate mixture shall be:
Type A (nominal ¼ inch) 50 +/- 10 pounds per square yard
Type B (nominal 3/8 inch) 55 +/- 10 pounds per square yard
Type C (nominal ½ inch) 60 +/- 10 pounds per square yard
The hot mix asphalt-wearing course shall be spread over the polymer modified asphalt emulsion within seconds of the spray application. Where shape correction is necessary or the old surface is porous, the application rate of the emulsion and hot mix asphalt wearing course may need to be increased.
Compaction of the Paver Placed Surface Treatment shall be accomplished with a minimum of a steel wheeled, double drum roller of minimum dead weight of 10 tons before the material temperature has fallen below 180 degrees Fahrenheit at mid-layer. Because of the speed of the paving machine, and if production is over 15,000 square yards per day, two steel-wheeled double drum rollers may be required.
6.0 TRAFFIC
Maintenance and protection of traffic will be provided by the contractor.
The new pavement surface may be opened to traffic when rolling is completed and proper cooling has taken place. In general, traffic can use the new surface at a distance of 300 feet behind the last roller.
7.0 VERIFICATION OF QUANTITIES AND TESTING
At the end of each working day or completed job site, a check shall be made to determine the quantities of polymer modified asphalt emulsion used. The check shall be made by means of the gauge on the self-priming paver or the unit used to transport the material. The total gallons of material sprayed shall be divided by the total square yards sprayed to determine yield per square yard.

The hot mix asphalt concrete spread rate shall be calculated by dividing the tonnage placed by the square yards covered to determine yield per square yard.
Samples of the hot mix asphalt shall be taken at a rate of 1 per 250 tons and tested for aggregate gradation and asphalt cement content. Samples of the polymer modified asphalt emulsion shall be taken once per tanker load or once per day.
At the conclusion of each day’s production, a delivery ticket or invoice shall be completed by the contractor and signed by a representative of the Contracting Agency.

DENSE GRADED COLD MIX SPECIFICATIONS 1.0 SCOPE: This specification covers supplying a dense graded cold mix pavement for use as a base, binder
or surface course. This work shall consist of one or more courses of dense graded cold mix bituminous pavement consisting of aggregate, bituminous material, mixing, hauling, placing and compacting to a predetermined depth in accordance with these specifications. This operation is intended to provide a binder and/or top course and shall be followed by a liquid bituminous surface treatment as a finished wearing surface.
2.0 MATERIALS:
2.1 Bituminous Materials: The bituminous material for the dense graded cold mix shall be HFMS-2gh asphalt emulsion.
2.2 Aggregate: The mineral aggregate shall conform to the requirements set out in the following referenced subsections in the NYSDOT Standard Specifications:
Fine Aggregate 703.01 Coarse Aggregate 703.02
3.0 DESIGN, CERTIFICATION, AND DEMONSTRATIONS: 3.1 Prior to bidding, it shall be the responsibility of the contractor to sample all sources of
aggregates and any existing stockpiles of aggregates and determine the quantity of asphalt emulsion required in the cold bituminous mixture.
3.2 Prior to commencing any mixing work, the contractor shall submit a certified recommended job mix formula to the Superintendent of Highways. The recommended job mix should include the following as a minimum: (1) Gradation of each aggregate to be used. (2) Proposed aggregate blend. (3) Proposed aggregate gradations for types 3 and 6. (4) Proposed asphalt content based on the total weight of the mix, exclusive of water or
oil distillate. 3.3 Acceptance of the job mix formula by the Superintendent of Highways is solely for the
purpose of quality control and in no way releases the contractor from his responsibilities. 3.4 Once the project has commenced, the contractors shall sample the cold bituminous mixture
a minimum of once daily. Samples shall be taken from the auger of the bituminous finishing machine, prior to placement on the pavement. Certified test results shall be submitted to the Superintendent of Highways for each sample taken. Sampling and testing shall be done by NYSDOT Materials Method 5, except the mixture shall be heated to 250 F for a minimum of 15 minutes prior to testing. As a minimum, all test results shall state: (1) Percent asphalt residue based on total weight of mix. (2) Calculated asphalt emulsion content in gallons per ton and/or gallons per cubic
yard. (3) Aggregate gradation based on total weight of the aggregate.

3.0 DESIGN, CERTIFICATION, AND DEMONSTRATIONS (Cont.) 3.5 The Contractor shall supply the Superintendent of Highways with a certified test analysis of
the asphalt emulsion used on the project. The Superintendent of Highways may at any time have samples tested by a certified independent testing lab.
3.6 Payment for mixing grade materials - the unit price per gallon will only be paid on the quantity delivered within the range of various mixtures in Table CDM-2. The Highway Department will only be responsible to pay for the maximum quantity in gallons per ton set forth in Table CDM-2.
4.0 EQUIPMENT:
All equipment and the condition of the equipment for this work shall be subject to approval of the Superintendent of Highways at all times. 4.1 Pugmill. Mixing shall be done with a rotating twin paddle shaft pugmill providing suitable
pressure-kneading action in mixing. Mixing by blading, shoveling and/or scooping will not be permitted. The mixer shall be a central continuous or batch type pugmill designed to accurately proportion either by volume or by weight, so that when the aggregate and bituminous materials are incorporated in the mix, a thorough and uniform coating will result. The mixer shall be equipped to mechanically or electrically interlock the bituminous feed with the aggregate feed such that uniformity of the mixture is assured at all times. The pugmill mixer shall be provided with weighing, volumetric or other gauging equipment which shall be capable of providing accurate control at all times of the amount of aggregate entering the mixer per time interval. The mixer shall be equipped with a positive displacement metering system capable of totalizing the quantity of bituminous material applied to the mixing chamber. The aggregate feed system must contain a minimum of two (2) compartments or bins; each compartment or bin shall have adjustable feed gates so that the aggregates can be proportioned at the specified rate. The capacities of the cold feed bins shall be sufficient to maintain a continuous flow of material. Each bin shall have a mechanical device for uniform feeding of the aggregate. The mixer unit shall be approved by the Superintendent of Highways or his representative prior to commencing any work.
4.2 Paver. The paver shall be equipped with automatic transverse slope and longitudinal grade screed controls. The paver shall be equipped with a screed that is fully extendible from 10 feet to 19 feet 6 inches. Heat and vibration shall be provided for the full-extended width. The extenders shall have independent slope control and on the go capabilities to change width and slope.
4.3 Roller. The roller shall be a twin drum vibratory with static weight of 22,000 lbs. or more. Drum width shall be a minimum of 78 inches and capable of providing the necessary compaction of the dense graded cold mix.

5.0 METHOD OF MEASUREMENT: 5.1 The dense graded cold mix shall be measured by the number of tons of compacted mix
placed in accordance with the specifications. 5.2 When suitable platform truck scales are not available, the tonnage shall be measured and
calculated based on the number of gallons of asphalt emulsion actually used on the project divided by the gallons per ton of mix used based on the submitted job mix formula and verified by the certified extractions of the mix.
6.0 PAYMENT:
The unit price per ton shall include the cost of furnishing all aggregate, asphalt emulsion, labor, supplies and equipment including the hauling, pugmill, loader, paver, roller, as well as all labor and equipment for the Maintenance & Protection of Traffic.
7.0 PRICE EXTENSION:
Political subdivisions within Allegany County (Towns, Villages, School Districts and Fire Districts), as defined in Section #103 of the General Municipal Law may participate in any contract awarded as a result of this bid document. Additionally, per section 408-a (2) of County Law and Allegany County Resolution No. 202-15, all political subdivisions within the state of New York may piggyback off this competitive bid as long as it is mutually agreed to by both parties. Responsibility, financial or otherwise, for purchase(s) made by other parties as a result of the extension of this contract, shall not be borne by Allegany County.
Performance Bonds for all other municipalities should be provided directly to the respective municipality by the bidder.
8.0 BIDDER QUALIFICATIONS:
8.1 The bidder at the time of bidding must be listed as a supplier on the NYSDOT APPROVED LIST OF LIQUID BITUMINOUS MATERIAL PRIMARY SOURCES and/or SUPPLIERS.
8.2 The bidder at the time of bidding will own and operate an emulsion manufacturing plant. The particular plant shall have been owned and operated by the bidder for at least five (5) years. The plant shall be a permanent facility.
8.3 The bidder shall own, operate and maintain, or have access to, a working laboratory. The laboratory shall be equipped with all equipment necessary to perform all specified tests on any emulsion sample. As a minimum, this shall include the following equipment: (1) Saybolt-Furol Viscometer (2) Distillation equipment (3) Penetration apparatus (4) All necessary equipment and supplies to perform the tests required for meeting
the emulsified asphalt specifications. 8.4 The laboratory shall be operated by a full time qualified technician and shall be
available for use by any Highway personnel. The Laboratory shall also include sufficient

equipment to test aggregates and mixes required by NYSDOT Materials Method 5. In addition, the Superintendent of Highways may have samples tested by a certified independent testing lab.
8.5 The Superintendent of Highways reserves the right to make any investigations or
inquiries necessary to determine the competence and ability of the bidder to properly perform the work. If after said investigation the Superintendent of Highways is not satisfied that the bidder is properly qualified to meet all requirements contained herein and to perform all work in a satisfactory manner, he may recommend to the Highway Committee that the bidder be rejected as unsatisfactory.
9.0 GUARANTEE:
9.1 The bidder shall guarantee that all material and equipment used to fulfill this contract meets the enclosed specifications.
9.2 A two-year guarantee for defective or inferior bituminous material and/or workmanship shall apply to all bituminous materials supplied and applied under this contract.
9.3 Upon completion, the successful bidder will provide a two-year maintenance bond to the department and each political subdivision purchasing under this contract.

HOLD HARMLESS CLAUSE
The agent shall at all times defend, indemnify and hold harmless the County of Allegany and its employees from any and all claims, damages or judgments or for the defense or payment thereof, based on any claim, action or cause of action whatsoever, including any action for libel, slander or personal injury, or any affiliated claims, by reason of any act or failure to properly act on the part of Agent and in particular as may arise from the performance under this contract. Such obligation to the County shall not be construed to negate, abridge or reduce other rights of indemnity which would otherwise exist. ALLEGANY COUNTY STANDARD INSURANCE REQUIREMENTS
Insurance shall be procured and certificates of Insurance delivered to the County Attorney’s Office, the County department responsiblefor the agreement, and the Clerk of the County Board of Legislators prior to commencement of work or delivery of merchandise or equipment. The Certificates of Insurance shall be made to the County of Allegany, County Office Building, Belmont, New York 14813 must comply with all coverage specifications of the contract; and must be executed by an insurance company and/or agency or broker licensed by the Insurance Department of the State of New York. The “ACCORD” form certificate may be used, provided the following two additions are added to the form verbatim:

General Provisions of Laws Covering Workers on Article 8 Public Work Contracts
Introduction
The Labor Law requires public work contractors and subcontractors to pay laborers, workers, or mechanics employed inthe performance of a public work contract not less than the prevailing rate of wage and supplements (fringe benefits) in thelocality where the work is performed.
Responsibilities of the Department of Jurisdiction
A Department of Jurisdiction (Contracting Agency) includes a state department, agency, board or commission: a county,city, town or village; a school district, board of education or board of cooperative educational services; a sewer, water, fire,improvement and other district corporation; a public benefit corporation; and a public authority awarding a public workcontract.
The Department of Jurisdiction (Contracting Agency) awarding a public work contract MUST obtain a Prevailing RateSchedule listing the hourly rates of wages and supplements due the workers to be employed on a public work project.This schedule may be obtained by completing and forwarding a "Request for wage and Supplement Information" form (PW39) to the Bureau of Public Work. The Prevailing Rate Schedule MUST be included in the specifications for the contract tobe awarded and is deemed part of the public work contract.
Upon the awarding of the contract, the law requires that the Department of Jurisdiction (Contracting Agency) furnish thefollowing information to the Bureau: the name and address of the contractor, the date the contract was let and theapproximate dollar value of the contract. To facilitate compliance with this provision of the Labor Law, a copy of theDepartment's "Notice of Contract Award" form (PW 16) is provided with the original Prevailing Rate Schedule.
The Department of Jurisdiction (Contracting Agency) is required to notify the Bureau of the completion or cancellation ofany public work project. The Department's PW 200 form is provided for that purpose.
Both the PW 16 and PW 200 forms are available for completion online.
Hours
No laborer, worker, or mechanic in the employ of a contractor or subcontractor engaged in the performance of any publicwork project shall be permitted to work more than eight hours in any day or more than five days in any week, except incases of extraordinary emergency. The contractor and the Department of Jurisdiction (Contracting Agency) may apply tothe Bureau of Public Work for a dispensation permitting workers to work additional hours or days per week on a particularpublic work project.
There are very few exceptions to this rule. Complete information regarding these exceptions is available on the "4 Day /10 Hour Work Schedule" form (PW 30R).
Wages and Supplements
The wages and supplements to be paid and/or provided to laborers, workers, and mechanics employed on a public workproject shall be not less than those listed in the current Prevailing Rate Schedule for the locality where the work isperformed. If a prime contractor on a public work project has not been provided with a Prevailing Rate Schedule, thecontractor must notify the Department of Jurisdiction (Contracting Agency) who in turn must request an original PrevailingRate Schedule form the Bureau of Public Work. Requests may be submitted by: mail to NYSDOL, Bureau of Public Work,State Office Bldg. Campus, Bldg. 12, Rm. 130, Albany, NY 12240; Fax to Bureau of Public Work (518) 485-1870; orelectronically at the NYSDOL website www.labor.state.ny.us.
Upon receiving the original schedule, the Department of Jurisdiction (Contracting Agency) is REQUIRED to providecomplete copies to all prime contractors who in turn MUST, by law, provide copies of all applicable county schedules toeach subcontractor and obtain from each subcontractor, an affidavit certifying such schedules were received. If the originalschedule expired, the contractor may obtain a copy of the new annual determination from the NYSDOL websitewww.labor.state.ny.us.
The Commissioner of Labor makes an annual determination of the prevailing rates. This determination is in effect fromJuly 1st through June 30th of the following year. The annual determination is available on the NYSDOL websitewww.labor.state.ny.us.
Payrolls and Payroll Records
Every contractor and subcontractor MUST keep original payrolls or transcripts subscribed and affirmed as true underpenalty of perjury. Payrolls must be maintained for at least three (3) years from the project's date of completion. At aminimum, payrolls must show the following information for each person employed on a public work project: Name,Address, Last 4 Digits of Social Security Number, Classification(s) in which the worker was employed, Hourly wage rate(s)paid, Supplements paid or provided, and Daily and weekly number of hours worked in each classification.

Every contractor and subcontractor shall submit to the Department of Jurisdiction (Contracting Agency), within thirty (30)days after issuance of its first payroll and every thirty (30) days thereafter, a transcript of the original payrolls, subscribedand affirmed as true under penalty of perjury. The Department of Jurisdiction (Contracting Agency) shall collect, reviewfor facial validity, and maintain such payrolls.
In addition, the Commissioner of Labor may require contractors to furnish, with ten (10) days of a request, payroll recordssworn to as their validity and accuracy for public work and private work. Payroll records include, by are not limited to timecards, work description sheets, proof that supplements were provided, cancelled payroll checks and payrolls. Failure toprovide the requested information within the allotted ten (10) days will result in the withholding of up to 25% of thecontract, not to exceed $100,000.00. If the contractor or subcontractor does not maintain a place of business in New YorkState and the amount of the contract exceeds $25,000.00, payroll records and certifications must be kept on the projectworksite.
The prime contractor is responsible for any underpayments of prevailing wages or supplements by any subcontractor.
All contractors or their subcontractors shall provide to their subcontractors a copy of the Prevailing Rate Schedulespecified in the public work contract as well as any subsequently issued schedules. A failure to provide these schedulesby a contractor or subcontractor is a violation of Article 8, Section 220-a of the Labor Law.
All subcontractors engaged by a public work project contractor or its subcontractor, upon receipt of the original scheduleand any subsequently issued schedules, shall provide to such contractor a verified statement attesting that thesubcontractor has received the Prevailing Rate Schedule and will pay or provide the applicable rates of wages andsupplements specified therein. (See NYS Labor Laws, Article 8 . Section 220-a).
Determination of Prevailing Wage and Supplement Rate Updates Applicable to All Counties
The wages and supplements contained in the annual determination become effective July 1st whether or not the newdetermination has been received by a given contractor. Care should be taken to review the rates for obvious errors. Anycorrections should be brought to the Department's attention immediately. It is the responsibility of the public workcontractor to use the proper rates. If there is a question on the proper classification to be used, please call the districtoffice located nearest the project. Any errors in the annual determination will be corrected and posted to the NYSDOLwebsite on the first business day of each month. Contractors are responsible for paying these updated rates as well,retroactive to July 1st.
When you review the schedule for a particular occupation, your attention should be directed to the dates above thecolumn of rates. These are the dates for which a given set of rates is effective. To the extent possible, the Departmentposts rates in its possession that cover periods of time beyond the July 1st to June 30th time frame covered by aparticular annual determination. Rates that extend beyond that instant time period are informational ONLY and may beupdated in future annual determinations that actually cover the then appropriate July 1st to June 30th time period.
Withholding of Payments
When a complaint is filed with the Commissioner of Labor alleging the failure of a contractor or subcontractor to pay orprovide the prevailing wages or supplements, or when the Commissioner of Labor believes that unpaid wages orsupplements may be due, payments on the public work contract shall be withheld from the prime contractor in a sufficientamount to satisfy the alleged unpaid wages and supplements, including interest and civil penalty, pending a finaldetermination.
When the Bureau of Public Work finds that a contractor or subcontractor on a public work project failed to pay or providethe requisite prevailing wages or supplements, the Bureau is authorized by Sections 220-b and 235.2 of the Labor Law toso notify the financial officer of the Department of Jurisdiction (Contracting Agency) that awarded the public work contract.Such officer MUST then withhold or cause to be withheld from any payment due the prime contractor on account of suchcontract the amount indicated by the Bureau as sufficient to satisfy the unpaid wages and supplements, including interestand any civil penalty that may be assessed by the Commissioner of Labor. The withholding continues until there is a finaldetermination of the underpayment by the Commissioner of Labor or by the court in the event a legal proceeding isinstituted for review of the determination of the Commissioner of Labor.
The Department of Jurisdiction (Contracting Agency) shall comply with this order of the Commissioner of Labor or of thecourt with respect to the release of the funds so withheld.
Summary of Notice Posting Requirements
The current Prevailing Rate Schedule must be posted in a prominent and accessible place on the site of the public workproject. The prevailing wage schedule must be encased in, or constructed of, materials capable of withstanding adverseweather conditions and be titled "PREVAILING RATE OF WAGES" in letters no smaller than two (2) inches by two (2)inches.
The "Public Work Project" notice must be posted at the beginning of the performance of every public work contract, oneach job site.

Every employer providing workers. compensation insurance and disability benefits must post notices of such coverage inthe format prescribed by the Workers. Compensation Board in a conspicuous place on the jobsite.
Every employer subject to the NYS Human Rights Law must conspicuously post at its offices, places of employment, oremployment training centers, notices furnished by the State Division of Human Rights.
Employers liable for contributions under the Unemployment Insurance Law must conspicuously post on the jobsite noticesfurnished by the NYS Department of Labor.
Apprentices
Employees cannot be paid apprentice rates unless they are individually registered in a program registered with the NYSCommissioner of Labor. The allowable ratio of apprentices to journeyworkers in any craft classification can be no greaterthan the statewide building trade ratios promulgated by the Department of Labor and included with the Prevailing RateSchedule. An employee listed on a payroll as an apprentice who is not registered as above or is performing work outsidethe classification of work for which the apprentice is indentured, must be paid the prevailing journeyworker's wage rate forthe classification of work the employee is actually performing.
NYSDOL Labor Law, Article 8, Section 220-3, require that only apprentices individually registered with the NYSDepartment of Labor may be paid apprenticeship rates on a public work project. No other Federal or State Agency ofoffice registers apprentices in New York State.
Persons wishing to verify the apprentice registration of any person must do so in writing by mail, to the NYSDOL Office ofEmployability Development / Apprenticeship Training, State Office Bldg. Campus, Bldg. 12, Albany, NY 12240 or by Faxto NYSDOL Apprenticeship Training (518) 457-7154. All requests for verification must include the name and socialsecurity number of the person for whom the information is requested.
The only conclusive proof of individual apprentice registration is written verification from the NYSDOL ApprenticeshipTraining Albany Central office. Neither Federal nor State Apprenticeship Training offices outside of Albany can provideconclusive registration information.
It should be noted that the existence of a registered apprenticeship program is not conclusive proof that any person isregistered in that program. Furthermore, the existence or possession of wallet cards, identification cards, or copies ofstate forms is not conclusive proof of the registration of any person as an apprentice.
Interest and Penalties
In the event that an underpayment of wages and/or supplements is found:
- Interest shall be assessed at the rate then in effect as prescribed by the Superintendent of Banks pursuant tosection 14-a of the Banking Law, per annum from the date of underpayment to the date restitution is made.
- A Civil Penalty may also be assessed, not to exceed 25% of the total of wages, supplements, and interest due.
Debarment
Any contractor or subcontractor and/or its successor shall be ineligible to submit a bid on or be awarded any public workcontract or subcontract with any state, municipal corporation or public body for a period of five (5) years when:
- Two (2) willful determinations have been rendered against that contractor or subcontractor and/or its successorwithin any consecutive six (6) year period.
- There is any willful determination that involves the falsification of payroll records or the kickback of wages orsupplements.
Criminal Sanctions
Willful violations of the Prevailing Wage Law (Article 8 of the Labor Law) may be a felony punishable by fine orimprisonment of up to 15 years, or both.
Discrimination
No employee or applicant for employment may be discriminated against on account of age, race, creed, color, nationalorigin, sex, disability or marital status.
No contractor, subcontractor nor any person acting on its behalf, shall by reason of race, creed, color, disability, sex ornational origin discriminate against any citizen of the State of New York who is qualified and available to perform the workto which the employment relates (NYS Labor Law, Article 8, Section 220-e(a)).
No contractor, subcontractor, nor any person acting on its behalf, shall in any manner, discriminate against or intimidateany employee on account of race, creed, color, disability, sex, or national origin (NYS Labor Law, Article 8, Section 220-e(b) ).

The Human Rights Law also prohibits discrimination in employment because of age, marital status, or religion.
There may be deducted from the amount payable to the contractor under the contract a penalty of $50.00 for eachcalendar day during which such person was discriminated against or intimidated in violation of the provision of the contract (NYS Labor Law, Article 8, Section 220-e(c) ).
The contract may be cancelled or terminated by the State or municipality. All monies due or to become due thereundermay be forfeited for a second or any subsequent violation of the terms or conditions of the anti-discrimination sections ofthe contract (NYS Labor Law, Article 8, Section 220-e(d) ).
Every employer subject to the New York State Human Rights Law must conspicuously post at its offices, places ofemployment, or employment training centers notices furnished by the State Division of Human Rights.
Workers' Compensation
In accordance with Section 142 of the State Finance Law, the contractor shall maintain coverage during the life of thecontract for the benefit of such employees as required by the provisions of the New York State Workers' CompensationLaw.
A contractor who is awarded a public work contract must provide proof of workers' compensation coverage prior to beingallowed to begin work.
The insurance policy must be issued by a company authorized to provide workers' compensation coverage in New YorkState. Proof of coverage must be on form C-105.2 (Certificate of Workers' Compensation Insurance) and must name thisagency as a certificate holder.
If New York State coverage is added to an existing out-of-state policy, it can only be added to a policy from a companyauthorized to write workers' compensation coverage in this state. The coverage must be listed under item 3A of theinformation page.
The contractor must maintain proof that subcontractors doing work covered under this contract secured and maintained aworkers' compensation policy for all employees working in New York State.
Every employer providing worker's compensation insurance and disability benefits must post notices of such coverage inthe format prescribed by the Workers' Compensation Board in a conspicuous place on the jobsite.
Unemployment Insurance

The Department of Labor is cognizant of the concerns of the potential for misuse or inadvertent disclosure of social security numbers. Identity theft is a growing problem and we are sympathetic to contractors’ concerns with regard to inclusion of this information on payrolls if another identifier will suffice. For these reasons, the substitution of the use of the last four digits of the social security number on certified payrolls submitted to contracting agencies on public work projects is now acceptable to the Department of Labor.
NOTE: This change does not affect the Department’s ability to request and receive the entire social security number from employers during the course of its public work / prevailing wage investigations.

1. Purpose and Scope:
This Item describes the Public Work Enforcement Fund (the Fund, PWEF) and itsrelevance to State agencies and public benefit corporations engaged in construction orreconstruction contracts, maintenance and repair, and announces the recently-enactedincrease to the percentage of the dollar value of such contracts that must be deposited intothe Fund. This item also describes the roles of the following entities with respect to theFund:
- New York State Department of Labor (DOL),- The Office of the State of Comptroller (OSC), and- State agencies and public benefit corporations.
2. Background and Statutory References:
DOL uses the Fund to enforce the State's Labor Law as it relates to contracts forconstruction or reconstruction, maintenance and repair, as defined in subdivision two ofSection 220 of the Labor Law. State agencies and public benefit corporations participatingin such contracts are required to make payments to the Fund.
Chapter 511 of the Laws of 1995 (as amended by Chapter 513 of the Laws of 1997,Chapter 655 of the Laws of 1999, Chapter 376 of the Laws of 2003 and Chapter 407 of theLaws of 2005) established the Fund.
3. Procedures and Agency Responsibilities:
The Fund is supported by transfers and deposits based on the value of contracts forconstruction and reconstruction, maintenance and repair, as defined in subdivision two ofSection 220 of the Labor Law, into which all State agencies and public benefit corporationsenter.
Chapter 407 of the Laws of 2005 increased the amount required to be provided to this fundto .10 of one-percent of the total cost of each such contract, to be calculated at the timeagencies or public benefit corporations enter into a new contract or if a contract is amended.The provisions of this bill became effective August 2, 2005.

OSC will report to DOL on all construction-related ("D") contracts approved during themonth, including contract amendments, and then DOL will bill agencies the appropriateassessment monthly. An agency may then make a determination if any of the billedcontracts are exempt and so note on the bill submitted back to DOL. For any instancewhere an agency is unsure if a contract is or is not exempt, they can call the Bureau ofPublic Work at the number noted below for a determination. Payment by check or journalvoucher is due to DOL within thirty days from the date of the billing. DOL will verify theamounts and forward them to OSC for processing.
For those contracts which are not approved or administered by the Comptroller, monthlyreports and payments for deposit into the Public Work Enforcement Fund must be providedto the Administrative Finance Bureau at the DOL within 30 days of the end of each monthor on a payment schedule mutually agreed upon with DOL.
Reports should contain the following information:
- Name and billing address of State agency or publicbenefit corporation;
- State agency or public benefit corporation contact andphone number;
- Name and address of contractor receiving the award;- Contract number and effective dates;- Contract amount and PWEF assessment charge (if
contract amount has been amended, reflect increase ordecrease to original contract and the adjustment in thePWEF charge); and
- Brief description of the work to be performed under eachcontract.

law, Labor Law §220, paragraph a of subdivision 3-a. It requires

RRequirements for OSHA 10 Compliance
Chapter 282 of the Laws of 2007, codified as Labor Law 220-h took effect on July 18, 2008. The statute provides as follows:
The advertised specifications for every contract for public work of $250,000.00 or more must contain a provision requiring that every worker employed in the performance of a public work contract shall be certified as having completed an OSHA 10 safety training course. The clear intent of this provision is to require that all employees of public work contractors, required to be paid prevailing rates, receive such training “prior to the performing any work on the project.”
The Bureau will enforce the statute as follows:
All contractors and sub contractors must attach a copy of proof of completion of the OSHA 10 course to the first certified payroll submitted to the contracting agency and on each succeeding payroll where any new or additional employee is first listed.
Proof of completion may include but is not limited to:
Copies of bona fide course completion card (Note: Completion cards do not have an expiration date.)
Training roster, attendance record of other documentation from the certified trainer pending the issuance of the card.
Other valid proof

Introduction to the Prevailing Rate Schedule
Information About Prevailing Rate Schedule
This information is provided to assist you in the interpretation of particular requirements for each classification of worker contained in theattached Schedule of Prevailing Rates.
Classification
It is the duty of the Commissioner of Labor to make the proper classification of workers taking into account whether the work is heavy andhighway, building, sewer and water, tunnel work, or residential, and to make a determination of wages and supplements to be paid orprovided. It is the responsibility of the public work contractor to use the proper rate. If there is a question on the proper classification to beused, please call the district office located nearest the project. District office locations and phone numbers are listed below. Prevailing Wage Schedules are issued separately for "General Construction Projects" and "Residential Construction Projects" on a county-by-county basis. General Construction Rates apply to projects such as: Buildings, Heavy & Highway, and Tunnel and Water & Sewer rates. Residential Construction Rates generally apply to construction, reconstruction, repair, alteration, or demolition of one family, two family, rowhousing, or rental type units intended for residential use. Some rates listed in the Residential Construction Rate Schedule have a very limited applicability listed along with the rate. Rates foroccupations or locations not shown on the residential schedule must be obtained from the General Construction Rate Schedule. Pleasecontact the local Bureau of Public Work office before using Residential Rate Schedules, to ensure that the project meets the required criteria.
Paid Holidays
Paid Holidays are days for which an eligible employee receives a regular day's pay, but is not required to perform work. If an employeeworks on a day listed as a paid holiday, this remuneration is in addition to payment of the required prevailing rate for the work actuallyperformed.
Overtime
At a minimum, all work performed on a public work project in excess of eight hours in any one day or more than five days in any workweek isovertime. However, the specific overtime requirements for each trade or occupation on a public work project may differ. Specific overtimerequirements for each trade or occupation are contained in the prevailing rate schedules. Overtime holiday pay is the premium pay that is required for work performed on specified holidays. It is only required where the employeeactually performs work on such holidays. The applicable holidays are listed under HOLIDAYS: OVERTIME. The required rate of pay for these covered holidays can be found in theOVERTIME PAY section listings for each classification.
Supplemental Benefits
Particular attention should be given to the supplemental benefit requirements. In most cases the payment or provision of supplements is foreach hour worked (noted in the schedule as 'Per hour worked'). Some classifications require the payment or provision of supplements foreach hour paid (noted in the schedule as 'Per hour paid'), which require supplements to be paid or provided at a premium rate for premiumhours worked. Some classifications may also require the payment or provision of supplements for paid holidays on which no work isperformed.
Effective Dates
When you review the schedule for a particular occupation, your attention should be directed to the dates above the column of rates. Theseare the dates for which a given set of rates is effective. The rate listed is valid until the next effective rate change or until the new annualdetermination which takes effect on July 1 of each year. All contractors and subcontractors are required to pay the current prevailing ratesof wages and supplements. Apprentice Training Ratios
The following are the allowable ratios of registered Apprentices to Journey-workers.
For example, the ratio 1:1,1:3 indicates the allowable initial ratio is one Apprentice to one Journeyworker. The Journeyworker must be inplace on the project before an Apprentice is allowed. Then three additional Journeyworkers are needed before a second Apprentice isallowed. The last ratio repeats indefinitely. Therefore, three more Journeyworkers must be present before a third Apprentice can be hired,and so on.

Under Article 8 and Article 9 of the NYS Labor Law, a contractor, sub-contractor and/or
its successor shall be debarred and ineligible to submit a bid on or be awarded any
public work or public building service contract/sub-contract with the state, any municipal
corporation or public body for a period of five (5) years from the date of debarment
when:
• Two (2) final determinations have been rendered within any consecutive six-year
(6) period determining that such contractor, sub-contractor and/or its successor has
WILLFULLY failed to pay the prevailing wage and/or supplements
• One (1) final determination involves falsification of payroll records or the kickback of
wages and/or supplements
NOTE: The agency issuing the determination and providing the information, is denoted
under the heading ‘Fiscal Officer’. DOL = NYS Dept. of Labor; NYC = New York City
Comptroller's Office; AG = NYS Attorney General’s Office; DA = County District
Attorney’s Office.
