What people are sayingW & W has a clear lesson structure. The timeline is outlined for daily lessons at the front of lesson plan. There is incorporated art, videos, etc. making lessons more approachable to a wider variety of learning styles.

I think that W & W fits with the priorities set forth by the team. The fact that Fundations is a piece of this program will be beneficial since we are familiar with it and have seen successes.

This program is developmentally appropriate and presents content through engaging essential questions that students can easily relate to.

5TH GRADE IN MIDDLE SCHOOL

Many districts have fifth grade included at middle level including

Jamestown, Chariho, Narragansett, South Kingstown, Portsmouth,

Middletown, and Newport

Chariho has been an example of one elementary school of three ending at

grade 4. 21-22 WMS fifth graders would have the benefit of moving with

new sixth grade and would know roughly 50% of WMS students upon

arrival.

5TH GRADE AT WMS

• Similar Conditions to 5th Grade In NKSD Elementary Schools

• Same Curriculum with One-Teacher Format

• 5th Grade in their own wing of WMS with their own bell schedule, lockers,

entrance and exit, lunch time, etc. Staffing and class sizes would remain

similar to that at Hamilton. 5th grade rituals including 5th grade promotion

would remain in place.

Dr. Auger also wanted to acknowledge Mr. Garland and his group of students that participated in the DECA Career

Development Conference. The students did exceptionally well representing North Kingstown at the state wide level.

There were many first, second and third place finishers. Dr Auger stated that if this was a regular year that the group

would be traveling to the national competition and he congratulated Mr. Garland and all of the students.

1. Information Technology Update with Mike Waterman Mike Waterman presented the districts Information Technology updates with a slide presentation. Mr. Waterman

discussed the districts plan to refresh devices for all students and staff on a predictable and manageable schedule. He

also explained that consideration in bundling Securly into this RFP is favorable as they abide by RI state laws for

privacy agreements.

Mrs. Hildebrand asked to clarify that all certified teaching staff will be issued the laptops and the Chrome Books

were scheduled to go to the Juniors.

Mr. Waterman also presented on our Web page and Mobil App Apptegy that is up for approval explaining that

currently we have one app and a different vendor for our webpage. He is recommending switching web page

providers to improve timely communication and to ensure important information does not get left off of one of the

platforms. Pricing is aligned with what we have been paying each company for their service and also represents a

discount if we were a new client. Mr. Mather asked to clarify that there was no financial impact.

Dr Auger complemented Mr. Watermen's presentation and leadership and thanked him for managing this major task

to align technology with our five year plan.

Mr. Waterman thanked the School Committee for supporting these initiatives.

2. High Quality Curriculum Update w Denise Mancieri Dr. Mancieri presented with a series of slides on where the district is now regarding the high quality curriculum roll

out. The Curriculum Legislation time line is set for June 2023, where all K-12 will have high quality curriculum

materials in the district.

An update was provided on the districts ELA Curriculum implementation for grades 6-8, Math Curriculum selection

on grades 6-8, and ELA Curriculum selection for grades K-5. Professional Learning to support this rollout by

providing bi monthly common planning time support, grade level district planning meetings and 1:1 coaching cycles

were explained.

Dr. Mancieri discussed that Wit &Wisdom is the choice, after analyzing surveys of the K-5 curriculum for the

elementary schools. Dr. Mancieri will get numbers finalized together for school committee approval at a later date.

The Right to Read Act was also introduced. This Science of Reading was passed by RIDE at the same time as the

high quality curriculum legislation. RIDE has introduced guidance on the Right to Read Act which was explained

with more information to follow.

Dr. Maniceri also discussed the RI Core Standards that will replace Common Core. RI will transition to the RI Core

Standards for ELA/Literacy and Math from the Common Core State Standards. Teachers received an email

regarding the transition. To assist users in making any adjustments, RIDE has created crosswalk documents

highlighting the instances where expectations differ between the RI Core Standards and the CCSS.

Mr. Blasbalg thanked Dr. Mancieri and her team for all the great work done on this.

Dr. Auger also thanked Dr. Mancieri and her team for all the hard work in rolling over this curriculum.

3. Student Government Presentation with Jacob Cedor & Owen Grace ATTACHMENTS:

Jacob Cedor and Owen Grace presented their slide presentation on Student Government and their Subcommittees for

this year.

They explained all the Subcommittees and listed the student Chairpersons of each one that included School Safety,

Sustainability, COVID-19, Technology and Student Wellness. They addressed short team and long term goals for

the future and recent accomplishments and current projects.

Mr. Blasbalg thanked both Jacob and Owen for their presentation.

II. Citizen's Comments - Pursuant to Policy BE, individual's comments are respectfully

requested to be limited to 3 minutes Jacob Cedor- No address given. Thanked Dr. Auger for his communication that addressed the reopening after April

break. Concerns about reopening the week after April break due to traveling and Covid causing the loss of

graduation and prom.

Tanja Carroll- 118 Pinecrest Drive. Responding to Dr. Auger's email on March 19. Concerns that the majority of the

high school students will not be immunized as of April 26. Would like students given the option to continue to

attended distance learning.

Kim Lanowy- 47 Sylvan Court. Thank you to Dr. Auger, Dr. Mancieri and the School Committee for looking at the

data and putting protocols in place in a plan to open the schools full time.

Lori Duffy- 88 Haverhill Ave. Spoke on the agenda item for the NKSD DEI Sub Committee. She stated how much

she was in support of this Sub Committee happening. Thank you to the School Committee for supporting this.

Carlos Hernandez- 1259 Lafayette Road. Commented on the DEI Sub Committee and wanted to show his support

and stated it was a great idea to implement.

Christean Trask- 94 Laurel Ridge Lane. Supported the DEI Sub Committee and open communication from the

school. Thanked Dr. Auger for listening and supporting the students.

Michelle Girasole- 635 Annaquatucket Road. Supporting the creation of DEI Sub Committee and feels it is very

important for the committee to have a team of experts who can advise and council.

III. Superintendent's Report

1. Update regarding Covid conditions Dr. Auger addressed the letter that was sent last week and the approach that the district was taking.

The RIDOH Play Book has not been updated at the time of this meeting. The update should be coming within the

week and should be aligned with the CDC guidelines.

Dr. Auger addressed that he has attended meetings on how to safely host proms and graduations. The district needs

to wait and see the updates so we can make a responsible plan. Dr Auger stated that he totally understands all the

concerns. He stated that he will continue to communicate as more information is received. All decisions made will

be made with the safety of the students in line with the RIDOH guidelines provided..

Mr. Blasbalg thanked Dr. Auger, the administration and all the teachers and staff members in the district and agreed

that they must follow the full guidance given by the RIDOH.

Dr. Auger explained that RIDE presented options on the state wide calendar regarding the PD Days. North

Kingstown made an adjustment to the Professional Development days to coincide with one of the options.

Dr. Auger stated that a snow day would be an asynchronous learning day unless there was some type of emergency

that needed to be addressed.

Dr. Auger also explained the holiday observance note at the bottom of the calendar.

Mrs. Hildebrand clarified the last day of school as June 20th with Dr. Auger as we are now starting two days later.

1. NKSC Diversity, Equity, and Inclusion Special Subcommittee ATTACHMENTS:

Mr. Blasblag presented the proposal of the DEI Sub Committee. He stated that it would be co-chaired by a member

of the NK School Committee and a member of the NKSD Central Office Administration and also include a total of

ten NKSD community members to include administrators, teachers, support staff, parents, and students and will seek

to include diverse perspectives.

Dr. Auger discussed that the North Kingstown School Department supported the creation of a special subcommittee

to ensure that students have equitable access to educational opportunities that help them achieve their full potential

while supporting and harnessing their individuality as well as the history and backgrounds of their families and the

entire North Kingstown community.

Mrs. Hildebrand said thank you and that she in favor of this and had a question on how a special sub committee was

formed.

Mrs. Lima read a statement and stated that educational equity was important and thanked Dr. Auger and Dr.

Mancieri for the importance of this work in helping put this proposal together.

Concerning a Collaboration known as the

“GEMS-Net Collaboration”

This MEMORANDUM OF AGREEMENT is entered into as of July 1, 2021 by and among the University of Rhode Island, on behalf of its College of Education and Professional Studies, and its “GEMS-Net Project” (“URI”) and the above-named school districts (the “School Districts”).

WHEREAS, research and policy have shown that professional development, curriculum, instruction, pre-service teaching, and assessment should be aligned with each other and the expectations set forth in the Common Core State Standards, Next Generation Science Standards, and K-12 Computing Framework;

WHEREAS, children learn for lasting knowledge when they construct understanding through the use of a research-based sequence of hands-on, minds-on lessons and when this firsthand learning is supported through the application of reading, writing, math and computing;

WHEREAS, the parties wish to collaborate on a project, known as the “Guiding Education in Math & Science Network Collaboration” (a/k/a the “GEMS-Net Collaboration” or the “Collaboration”) to be led by URI, in consultation with, and with participation by, the above-named School Districts; and WHEREAS, the GEMS-Net Collaboration works together to improve student proficiency in STEM+C through:

● Ongoing professional development for all teachers, including workshops, classroom coaching, and grade-level planning

● Curriculum, instruction, professional development, and assessment all aligned with Next Generation Science Standards, Common Core State Standards, and K-12 Computing Framework

● Leadership development through principal workshops, teacher leader cadre, and the teacher-in-residence program

● High-quality materials aligned with state requirements ● Scientist and engineer mentorship ● Data collection and analysis to inform research and practice

NOW, THEREFORE, the parties hereto, agree as follows:

1. The parties will participate in the GEMS-Net Collaboration as set forth in this MOA. The

Collaboration will be considered a “research-practice” type collaboration, and all parties agree to participate in the Collaboration with the overall goal of continuous improvement in K-12 education in Rhode Island.

2. During the term of agreement, URI will:

a. Provide high-quality professional development for all teachers b. Use current research and policy to inform the program c. Collect data and feedback to guide programs and research dissemination d. Develop capacity in each district through teacher and principal leadership e. Support district alignment of professional development, curriculum,

instruction, assessment, and research f. Work with districts to ensure grades K-5 classrooms have adequate physical

materials g. Seek external funding to support the goals of the Collaboration

3. During the term of this agreement, the District will:

a. Release teachers for workshops and pay substitutes b. Ensure adequate time for science and engineering instruction

c. Monitor alignment between intended curriculum and taught curriculum d. Support the development of teacher leadership by encouraging

teachers to co-facilitate workshops e. Consider participation in the teacher-in-residence program, so long as

GEMS-Net provides reimbursement of the full salary and benefits of the substitute annually.

f. Participate in an annual assessment of the GEMS-Net Project g. Share district/school data to support research, in compliance with all applicable

laws including the federal student records law known as FERPA

4. For the services and materials rendered as called for in this memorandum of agreement, the GEMS-Net districts agree to pay URI the sum listed in Table 1.

5. The term of this MOA will be for three (3) years from July 1, 2021 through June 30, 2024,

unless it is terminated effective at the end of the initial year, or at the end of the second year in accordance with the termination procedure described in the following sentence. Any party may terminate their participation in the Collaboration at the end of the first year, or at the end of the second year, by providing the other parties with written notice of such termination at least 60 days prior to the end of that year.

6. This agreement constitutes the entire understanding and agreement between the

GEMS-Net districts and URI with regard to all matters herein. This agreement supersedes all previous agreements, whether written or oral between the parties with regard to the subject of this contract.

7. None of the parties shall have the power to bind or obligate the other in any manner

except as expressly provided in the Agreement.

8. Duplicate Originals. The parties may sign any number of copies of this MOA. Each signed copy shall be an original, but all of them together represent the same agreement. The exchange of copies of this Indenture and of signature pages by facsimile or PDF transmission shall constitute effective execution and delivery of this MOA as to the parties hereto and may be used in lieu of the original MOA for all purposes. Signatures of the parties hereto transmitted by facsimile or PDF shall be deemed to be their original signatures for all purposes.

Advantage Glass is an authorized installer for this type of work. This repair is a somewhat

specialized field. The glass panels are held within a vapor matrix frame network. Advantage

Glass was the only local company that was comfortable with the greenhouse project.

Texas Greenhouse Company (TGC) was the original greenhouse shade company. Advantage

Glass is an authorized installer. It is important to replace in kind to avoids.

BACKGROUND:

The District has a 9 year old International CE Series Bus that needs $25K worth of work to

replace the engine (see attached quote from Sampson's Automotive where the bus is currently

housed). At the 2/16/21 SC meeting, there was a discussion regarding what would be the best

option - fix this 9 year old bus or purchase a new bus.

Unfortunately, during the time we have been seeking an RFP for a new bus and gathering further

data, an 11 year old bus has broken down, needing extensive engine repair work. The total for

the work needed on this 11 year old bus is yet unknown. However, the District must repair one

or both of these buses and must seek approval at this time for repair.

Because this 9 year old bus has less miles and is 2 years newer, it is recommended that for the

now we move forward with repairs to this bus and investigate option for the 11 year old bus,

repair and/or replacement.

Recommend approval.

NORTH KINGSTOWN SCHOOL COMMITTEE ADMINISTRATOR’S CONTRACT

This employment contract is entered into this date ___________, by and between the North Kingstown

School Committee (hereinafter called the “Committee”) and Alison Palladino, (hereinafter called the

“Administrator”). The Committee and the Administrator, for the consideration herein specified, the

sufficiency of which is hereby acknowledged, agree as follows:

1. TERM OF CONTRACT

The Committee hereby employs, and the Administrator hereby accepts employment as School

Principal at Wickford Middle School commencing on April 14, 2021 and ending on June 30, 2023.

with the understanding that this period of time April 14, 2021 to June 30, 2022 is a probationary period

and this contract can be terminated for any reason during that probationary period.

This agreement supersedes all prior written and oral agreements and may be amended by mutual

agreement of both parties only in writing executed by both parties.

2. PROFESSIONAL CERTIFICATION:

The Administrator shall obtain, maintain and furnish to the Superintendent and/or the Committee

evidence of, throughout the life of this contract, a valid and appropriate certificate to act as a School

Principal in accordance with the laws of the State of Rhode Island.

3. DUTIES OF ADMINISTRATOR:

a. The Administrator will faithfully and diligently observe, enforce and implement the rules, policies

and regulations adopted by the Committee amended from time to time.

b. The Administrator will faithfully and diligently perform all the duties and exercise the powers

which are set forth and described in the job description, School Committee regulations and policy

and instructions of the Superintendent as the same may be amended from time to time.

c. The Administrator shall, under the direction of the Superintendent, make recommendations with

respect to and undertake such remedial action as may be reasonably required, in connection with

any and all criticisms, complaints, evaluations and suggestions which the Superintendent may refer

to said Administrator.

d. The Administrator will faithfully and diligently perform, under the advice and direction of the

Superintendent, such other duties and faithfully diligently exercise such other powers, as the

Superintendent shall, from time to time, assign to said Administrator.

e. The Administrator may at any time be assigned other duties or be transferred to other positions by

the Superintendent of Schools for as long as the Superintendent deems necessary for the effective

operation of the School District and/or the best interest of the students.

f. The Administrator will devote full time and attention to the duties of School Principal as set forth

in this agreement and will faithfully and diligently perform the same and exercise the powers

delegated and assigned in accordance with this agreement, to the full extent of his/her skill, ability

and knowledge, it being understood, however, that with the approval of the Superintendent, in

writing, said Administrator may undertake outside work consulting but not during school time.

4. COMPENSATION

a. The initial salary shall be $112,000 per year and will be paid in equal bi-weekly installments

pro-rated for the 2020-2021 school year. The salary for the 2021-2022 and 2022-2023 will be

determined and established by the Superintendent and approved by the School Committee during

each year of the contract and will be paid in equal-bi-weekly installments. In no event shall the

Administrator’s salary be reduced, except for suspension, dismissal or leave without pay.

b. Upon request of the Administrator, the Committee shall withhold and transfer a portion of the

Administrator’s salary to a tax deferred annuity program approved by the Committee.

5. OTHER COMPENSATION:

The Committee shall provide the Administrator with all benefits applicable to Non-Unit

Administrative and Supervisory personnel in accordance with Policy # GCB of the North

Kingstown School Committee Policy Manual. ¹

6. PROFESSIONAL GROWTH:

The Administrator shall be encouraged to join those professional organizations, to attend those

professional meetings, conferences and conventions as are approved by the Superintendent, with

approved expenses to be paid by the School Department so long as the expense is approved by the

Superintendent prior to the Administrator joining said organization or signing up for said meetings,

conferences or conventions and is contained in the budget. Further the Superintendent reserves the

right to deny payment of expenses by the District at his/her sole discretion, based on financial or

staffing constraints. The school department will pay for the dues to RIASP for all administrators.

7. LEAVE:

See North Kingstown School Committee Policy # GCB for sick leave, sick leave bank, personal

days, family illness and bereavement leave. ¹

8. TRAVELING EXPENSES:

See North Kingstown School Committee Policy #GCB. ¹

9. INABILITY TO PERFORM:

Should the Administrator, in the opinion of the Committee, be unable to perform by reason of

absence or other event and said inability exists for a continuous period of six (6) months or if said

inability is, in the opinion of the Committee, permanent, irreparable or of such nature as to make

performance impossible, the Committee may, at its option, terminate this agreement, whereupon the

respective duties, rights and obligations hereof shall terminate.

10. EVALUATION:

The Administrator will participate in the RI Model Evaluation System for all observations,

conferences and evaluation protocols required by the RI Department of Education.

If said evaluation results in an unsatisfactory rating (ineffective or developing) then the

Administrator will be given, in writing, suggestions for improving his/her performance.

In the event of an unsatisfactory evaluation, the Director shall be evaluated within the next six

months. Should the Director receive a second consecutive unsatisfactory rating (ineffective or

developing) that shall be considered as grounds for termination pursuant to Section 12 of this

Agreement.

11. CONTRACT TERMINATION:

This employment contract may be terminated by:

a. mutual agreement of the parties;

b. retirement or resignation from position, inability or death of the Administrator. In the case of

resignation, retirement, or leaving the District to pursue or take other employment, 90 days’

written notice from the Administrator to the Superintendent is required. If 90 days’ written

notice is not given, then the Administrator waives any and all severance benefits set forth in the

Agreement.

c. Termination by the Committee in accordance with the laws of Rhode Island for, but not limited

to, professional unfitness or inability to serve as role model;

d. Annulment, suspension, lapse or revocation of certification;

e. In accordance with the provisions of this Agreement;

f. Failure to achieve satisfactory evaluations or

g. Non-renewal by the School Committee.

It is understood and agreed that the Administrator shall be subject to suspension and/or dismissal

by the Committee for cause, including but not limited to reasons such as incompetency, assault,

cruelty, insubordination, neglect of duty, incapacity, conduct unbecoming of an Administrator

(scandal, arrest, etc.) or failure, in whole or in part, to observe, perform and comply with the

provisions of this agreement, the directions of the Superintendent, the policies of the Committee,

the laws of the State of Rhode Island or the applicable state regulations and rulings. Before any

dismissal, the Administrator shall be given a written statement of the cause of such dismissal and

shall be entitled to a hearing thereon. Upon such dismissal, this agreement shall forthwith

terminate.

12. AFFIDAVIT:

The Administrator swears and affirms that he/she has not had any disciplinary action taken against

his/her professional certificate as a teacher or Administrator in any state, that he/she is presently

certifiable as an Administrator without delay in Rhode Island and that he/she has never had

criminal convictions regarding the treatment of a child or criminal or moral turpitude or a felony.

13. RENEWAL:

The parties hereto may, by mutual agreement in writing, extend or renew this contract for

additional periods provided, however, that the extension, when combined with the existing term or

balance thereof, shall not exceed three (3) years. In the event that the Committee does not

affirmatively vote to extend or renew this contract on or before March 31, 2023 , the contract is

terminated as of June 30, 2023 .

14. LENGTH OF WORK YEAR

The Administrator shall devote such time and energies as are necessary to perform the duties

specified. It is expressly agreed that the duties of this position required the Administrator to work

during times beyond normal business hours.

The work year will be a minimum of 215 work days . These days will include 180 school days,

4 professional development days, 10 days before school starts, 5 days after school ends and 16 days

to be used at the administrator’s discretion during non-school days. The administrator shall

provide the Superintendent by July1 st of each year the schedule of the administrator’s work days.

If these days cannot be logistically worked due to unexpected occurrences, adjustments may be

made with the authorization of the Superintendent.

Holidays and personal days are as outlined in Policy GCB. ¹

15. SAVINGS CLAUSE:

It is understood and agreed that this agreement is subject to the General Laws of Rhode Island and

the rules and regulations of the State Board of Regents and Department of Education.

If any portion of this contract is deemed illegal due to conflict with State or Federal Law, the

remainder of the contract shall remain in full force and effect, further, this contract does not

constitute any obligation either written or implied for re-employment beyond the term set forth

herein.

AGREEMENT FOR THE PERIOD OF JULY 1, 2015 2020 TO JUNE 30, 20182023

Scope / Term: This document constitutes the formal written agreement between the North Kingstown

School Committee (hereafter referred to as “School Committee”) and the North Kingstown Bus

Contractor’s Association (hereafter referred to as “Association”) for the period of July 1, 2015 2020 to

June 30, 20182023 during which the Association shall provide busing for the North Kingstown School

Department as outlined in the services below with the exception of any services that are provided

within the School Department. On or before November 1, 20172022, by mutual agreement of the

School Committee and the Association and an affirmative vote by the School Committee, the parties

shall have the option to renew this contract for a period of two (2) years until June 30, 20202025.

Terms and Definitions:

A. Inconvenience Fee: Fee paid to a contractor for a kindergarten, vocational, or parochial run unscheduled run between 9:30 AM and 1:30 00 PM.

B. First Line Bus: Any bus under contract to the North Kingstown School Department (hereafter referred to as “School Department”) to provide regular daily scheduled home-to-school service (i.e. a regularly scheduled route bus).

C. Spare Bus: Any bus not used in regular daily scheduled home-to-school service but rather as a temporary replacement for a First Line Bus in the event of a breakdown or similar instance, or used primarily for Field/Extracurricular trips.

D. Unauthorized Use: Use of a vehicle for a purpose not specifically approved by the Supervisor of Transportation or his/her designated representative.

1. GENERAL

a. Dues assessed by the Association will be assessed and handled by the NKSBCA and its members directly.

b. The Association is comprised of individual bus contractors. c. At any time the North Kingstown School Committee may suspend and or terminate a

contractor for good and just cause.

d. Individual bus contractors, with the approval of the North Kingstown School Committee may in some cases hire drivers to operate their bus.

e. At any time the North Kingstown School Committee can remove a bus driver from driving a bus.

f. The members of the Association are required to follow all policies and regulations adopted by the North Kingstown School Committee.

g. The incident of a breakdown of a school bus or the failure of a Driver/Contractor to complete his/her scheduled run shall not increase the cost to the North Kingstown School Department. If another bus assists, that additional mileage shall not be charged to the School Department nor shall the School Department pay more than the average daily mileage of the bus involved.

h. The Driver and/or Contractor of a Bus that breaks down or fails to complete their assigned run or trip and does not notify the Transportation Office may be assessed a charge not to exceed an amount equal to the payment for a Category I trip as identified in Addendum B hereto.

i. Contractors shall strictly comply with all applicable Federal, State, and Local rules and regulations, as well as the Transportation Policy of the School Committee, at all times while providing service under the terms of this agreement.

j. Contractors shall maintain a written record for all repairs and maintenance conducted on each bus and shall retain this record until such time as the vehicle is taken out of service. These records shall be made available to the School Department upon request. All maintenance and repairs shall be listed on a form provided by the Transportation Office. This form shall be submitted to the Transportation Office at least once a month and retained for the service life of the bus in compliance with R. I. General Law 31-22-11.2. The School Committee shall have the authority to remove vehicles from service if these reports are not submitted for two consecutive months. Contractors will be subject to a fine equivalent to the rate charged for a Category 1 trip as identified in Addendum B hereto for each month in excess of two months that said reports are not submitted. The continued failure to submit forms shall be adequate reason to terminate the agreement with the contractor concerned.

k. Contractors are responsible for any eye test necessary for any required or requested examination. The North Kingstown School Department shall incur the cost for regular drug testing of drivers. However, in the event that the District has reason to suspect that a driver is under the influence of drugs and/or alcohol, the driver shall be responsible for the cost of any drug testing required. A refusal by a driver to undergo drug testing shall result in an automatic termination of the driver. Any driver who operates a school bus in service to the School Department will have furnished to their contractors a valid pre-employment drug/alcohol test and completed background check. This information shall be on file with the School Department and will be subject to random testing as required by law. All drivers are required to register on the Department of Transportation Drug and Alcohol Clearinghouse website.

l. The School Committee reserves the right of final approval for every driver operating a bus for the School Department, and may reject any individual. Every contractor must submit the names and addresses of their drivers to the Transportation Office not later than August 1 of each school year for approval.

l.m. The School Committee reserves the right to engage the services of a different service provider should the Association be unable/unwilling to provide a contractor for any routes that may be needed by the District.

m.n. Reimbursement for damage to a contracted vehicle caused by passenger vandalism will be limited to a maximum of two hundred dollars ($200.00) per bus per school year. Drivers/Contractors will assist the School Committee, as necessary, in any investigation into such vandalism. Any monies received as restitution will be used to restore, on a dollar-for dollar basis, any deductions made from the “account” for that bus. Contractors will submit proof of vandalism, upon request, prior to any reimbursement being made. Items damaged by normal wear and tear are not subject to replacement/reimbursement under the terms of this paragraph.

n.o.The Supervisor of Transportation will meet with the President of the Association at least twice a year to discuss ways to equalize fees paid to contractors. The first meeting shall be held before the forty-fifth (45th) day of school.

o.p.No contractor or driver shall use a bus for any purpose other than that authorized by the Supervisor of Transportation or his/her designated representative. Unauthorized use of a vehicle governed by this agreement may result in revocation of the contract as it applies to that vehicle or other such measures as the School Committee may deem appropriate. The decision as to the disposition of an instance of unauthorized use rests solely with and at the discretion of the School Department. In the event that the Transportation Office has to obtain a driver for a contractor, for either a Home-to-School route or a field/extracurricular trip, a charge equal to fifty (50%) per cent of the daily rate or scheduled fee may be assessed.

p.Should the Rhode Island Department or Health or any other governmental body require specific cleaning due to Covid-19, the School Committee shall supply each bus with the required cleaning supplies.

2. FIELD TRIPS

a. After field trips are assigned, it shall be the responsibility of the contractor to provide a driver and vehicle for each trip. The contractor must provide the Transportation Office, at least two working days prior to the departure of the trip, with the name of the driver and any other pertinent information. Contractors who refuse a trip, once assigned, may be subject to an assessment equal to the payment for a Category I trip as identified in Addendum B hereto.

b. A payment equal to a Category I trip rate charge, as noted in Addendum B, will be made to a contractor whose bus arrives for a field trip that is subsequently cancelled without prior notification. Conversely, any contractor who fails to fulfill a properly scheduled and assigned trip will be assessed an amount equivalent to a Category I charge.

c. All field trips require the driver and vehicle to remain at the field trip location. An exception to this requirement may be made only after consultation with the individual teacher or coach who requested the trip with the final approval resting solely with the Transportation Office. No extra time or mileage will accrue as a result of a driver/vehicle leaving a trip and returning at a later time.

d. A charge equal to one hour of trip time shall be paid to a contractor in the event that extraordinary post-trip cleaning of the bus is necessary. The client shall be notified at the time that they sign the field trip report that this charge will be assessed. The addition of this charge must be listed separately on the field trip report and is subject to final approval by the Transportation Office.

3. VEHICLES

a. The School Committee shall inform the Association of any anticipated increase or decrease in the overall number of buses to be used to provide service. In the event that the School Committee votes to go out to bid for a new contractor, said contractor will be required to reimburse the independent bus contractor for the Fair Market Value (FMV) of his/her vehicle or pay for any remaining payments on the vehicle, whichever is the greater amount, as long as the original payment schedule is up to date and there are no late payments due.

b. All contractors will submit bus specifications to the School Department for review and approval before any bus, except those buses purchased from an existing contractor, is placed in service. It is the responsibility of each contractor to provide these specifications sufficiently ahead of time to allow for adequate review and approval of the proposed vehicle prior to it being placed in service. Vehicles may be equipped with video camera boxes or devices compatible with the recording system in use and a mobile phone. In the event that the School Committee determines that it will require vehicles to be equipped with devices such as GPS, video cameras, recording system, etc., the Association shall work with the School Committee to obtain said devices.

c. The School Department shall have the authority to remove any vehicle from service for safety reasons. Any vehicle removed from service shall not be allowed to transport students until approved by the School Department and/or the Rhode Island Department of Motor Vehicles as appropriate. It shall be the responsibility of the contractor to provide a spare vehicle during this period, at no additional cost to the School Department. All buses governed by this agreement shall be kept in good operating condition. Any necessary repairs shall be made in a reasonable amount of time at the expense of the contractor concerned.

d. The School Department shall supply diesel fuel for student busing. e. The School Department shall insure and register all buses engaged in providing service under

the terms of this agreement. f. Each contractor is responsible for maintenance and upkeep to the vehicle(s) he/she operates

under this agreement including all parts, fluids (except diesel fuel), tires, labor charges, etc. g. Upon the execution of the Agreement, title to the bus transfers to the School Department and,

upon termination of the Agreement, title reverts to the contractor. However, if the contractor wishes to sell the bus within 3 months after the reversion, the School Department has a right of first refusal.

h. The Association shall provide at least six approved Spare Buses. Spare Buses are to be utilized primarily as back-ups for First Line Buses that become incapacitated. The

Association shall establish internal procedures to insure availability of all Spare Buses to the School Department.

i. The contract period for a newly purchased bus shall be seven (7) years. Thereafter the parties have a mutual five (5) year option to renew.

j. In the event that a used bus is purchased for use as a First Line Bus the following criteria will apply:

1. Vehicle must be diesel powered.

2. The age of the vehicle shall not exceed three (3) years at the time of purchase as determined by model year. An exception to this requirement is allowed for a bus purchased from a NKBCA contractor up to twelve years in age. The balance of the contract life for a NKBCA seller may be transferred to the NKBCA member buyer, all other provisions of this agreement, state law, and NKSD policies apply.

3. The length of a contract with individual contractors, awarded for a used bus will not exceed a total of twelve (12) years from date of manufacture unless approved by the School Committee. Contracts will be awarded for an initial period of seven (7) years minus the age in years of the bus, plus a five (5) year option to renew (i.e. a two year old bus would be awarded a five year initial contract with a five year option to renew).

k. No bus, other than a Spare Bus, will be allowed to operate beyond twelve (12) years unless requested by the NKBCA in writing and with express written approval of the NKSC.

l. Prior to use, the contractor must present evidence that the vehicle has passed all inspections required by the Rhode Island Department of Motor Vehicles and any other agency with jurisdiction over the operation of these busses.

4. SAFETY

a. Monitors: The School Department will provide bus monitors as required. It will be the responsibility of the individual contractor/driver to verify that a bus monitor is present and properly performing his/her duties. If not, the contractor/driver will immediately notify the Transportation Office. The contractor/driver shall work cooperatively with the monitor to ensure compliance with all safety rules and regulations.

b. Drills: School Bus Contractors will perform emergency exit drills, along with a demonstration of the public address system on each bus, twice per school year, with the first such drill to be conducted in September. These drills will be conducted in accordance with the “Guidelines for Conducting Emergency Exit Drills” as set forth in the National Standards for School Bus Operation. Both drills will be individually documented on a Field Trip Report that will be submitted to the Transportation Office with the mileage documentation for the week in which each drill is conducted.

c. Equipment: All safety equipment will be properly mounted and maintained in good working condition at all times. Maintenance of required safety equipment is the responsibility of the individual contractor.

d. All new buses purchased to provide service for the School Department shall be equipped with:

1. A “crossing arm” affixed to the front bumper that extends when the red lights are activated. 2. A device that requires that the driver check the bus for sleeping children before exiting the vehicle (i.e. “Child Checkmate” system or a similar device).

e. Procedures and Policies to implement a safety program will be developed in a cooperative effort between the Association and the School Department.

5. ACCIDENT PROCEDURES

In order to establish a uniform policy to be followed in the event of an accident involving any contractor’s vehicle, the following procedures will be followed:

a. In the event of any accident, the appropriate local police department will be notified and requested to respond before any vehicle is moved.

b. The Supervisor of Transportation and/or the Transportation Office will be notified as soon as possible and provided with an initial report including but not limited to:

1. Location and brief description of accident 2. Number of students on board 3. Extent of any injuries 4. At a minimum, registration number and make/model of other vehicles involved.

c. All necessary reports shall be filled out and turned in to the Transportation Office as soon as possible, unless alternate arrangements are approved by the Supervisor of Transportation.

d. When required, it shall be the responsibility of the contractor to secure three (3) estimates to repair damage. Any costs relating to obtaining an estimate shall be paid by the North Kingstown School Department unless damage was caused while on an unauthorized trip. Estimates will be turned in to the Transportation Office and date stamped to verify receipt.

e. The contractor(s) will be informed in a timely fashion of the decision of the School Department and/or insurance carrier to approve or disapprove any claims.

f. In the event of an accident that occurs during the unauthorized use of a vehicle, such use being defined as use for a purpose not specifically authorized by the Supervisor of Transportation, the contractor will be responsible for the repair of any and all damage to the school bus. The contractor will also be subject to a penalty, of an amount not to exceed one thousand dollars ($1000.00) in the event of an accident that occurs during unauthorized use, the exact amount to be determined on a case-by-case basis.

g. In cases where the driver is convicted of a violation of the Motor Vehicle Code, the contractor will be responsible for the deductible portion of the insurance policy in the event of a related accident, as well as any fines, assessments, and penalties that ensue from said conviction.

PAYMENT

The North Kingstown School Department shall send to the Association the payment for the services of

all the contractors covered by this agreement twice monthly upon the receipt of invoice from the

Association.

SCHOOL YEAR

The school year shall be based on a minimum of 172 days. In the event that the buses do not run for at

least 172 days, the Association shall be paid 35% of the daily rate per bus toward the overhead

expenses for each day up to the 172 days that the buses do not run. Payment of the 35% shall be paid

at the conclusion of the school year.

FIELD/EXTRACURRICULAR/ATHLETIC TRIPS

Category 1 rates include three (3) hours of trip time, categories 2 through 6 include five (5) hours of trip time unless otherwise noted. These rates cover round trip transportation and time; they do not include tolls, parking, mileage, etc. which are the responsibility of the customer. Except for mileage, miscellaneous charges such as tolls and parking will each be listed separately on the Field Trip Report and will only be reimbursed upon submission of an appropriate receipt for the expense.

6. Termination

a. This Agreement shall terminate on June 30, 2018 2023 unless the written notice required under the Section entitled “Scope / Term” is given to the Association at the following address:

BUS CONTRACTOR’S ASSOCIATION

AGREEMENT FOR THE PERIOD OF JULY 1, 2020 TO JUNE 30, 2023

Scope / Term: This document constitutes the formal written agreement between the North Kingstown

School Committee (hereafter referred to as “School Committee”) and the North Kingstown Bus

Contractor’s Association (hereafter referred to as “Association”) for the period of July 1, 2020 to

June 30, 2023 during which the Association shall provide busing for the North Kingstown School

Department as outlined in the services below with the exception of any services that are provided

within the School Department. On or before November 1, 2022, by mutual agreement of the School

Committee and the Association and an affirmative vote by the School Committee, the parties shall

have the option to renew this contract for a period of two (2) years until June 30, 2025.

Terms and Definitions:

A. Inconvenience Fee: Fee paid to a contractor for an unscheduled run between 9:30 AM and 1:00 PM.

B. First Line Bus: Any bus under contract to the North Kingstown School Department (hereafter referred to as “School Department”) to provide regular daily scheduled home-to-school service (i.e. a regularly scheduled route bus).

C. Spare Bus: Any bus not used in regular daily scheduled home-to-school service but rather as a temporary replacement for a First Line Bus in the event of a breakdown or similar instance, or used primarily for Field/Extracurricular trips.

D. Unauthorized Use: Use of a vehicle for a purpose not specifically approved by the Supervisor of Transportation or his/her designated representative.

d. Individual bus contractors, with the approval of the North Kingstown School Committee may in some cases hire drivers to operate their bus.

e. At any time the North Kingstown School Committee can remove a bus driver from driving a bus.

f. The members of the Association are required to follow all policies and regulations adopted by the North Kingstown School Committee.

g. The incident of a breakdown of a school bus or the failure of a Driver/Contractor to complete his/her scheduled run shall not increase the cost to the North Kingstown School Department. If another bus assists, that additional mileage shall not be charged to the School Department nor shall the School Department pay more than the average daily mileage of the bus involved.

h. The Driver and/or Contractor of a Bus that breaks down or fails to complete their assigned run or trip and does not notify the Transportation Office may be assessed a charge not to exceed an amount equal to the payment for a Category I trip as identified in Addendum B hereto.

i. Contractors shall strictly comply with all applicable Federal, State, and Local rules and regulations, as well as the Transportation Policy of the School Committee, at all times while providing service under the terms of this agreement.

j. Contractors shall maintain a written record for all repairs and maintenance conducted on each bus and shall retain this record until such time as the vehicle is taken out of service. These records shall be made available to the School Department upon request. All maintenance and repairs shall be listed on a form provided by the Transportation Office. This form shall be submitted to the Transportation Office at least once a month and retained for the service life of the bus in compliance with R. I. General Law 31-22-11.2. The School Committee shall have the authority to remove vehicles from service if these reports are not submitted for two consecutive months. Contractors will be subject to a fine equivalent to the rate charged for a Category 1 trip as identified in Addendum B hereto for each month in excess of two months that said reports are not submitted. The continued failure to submit forms shall be adequate reason to terminate the agreement with the contractor concerned.

k. Contractors are responsible for any eye test necessary for any required or requested examination. The North Kingstown School Department shall incur the cost for regular drug testing of drivers. However, in the event that the District has reason to suspect that a driver is under the influence of drugs and/or alcohol, the driver shall be responsible for the cost of any drug testing required. A refusal by a driver to undergo drug testing shall result in an automatic termination of the driver. Any driver who operates a school bus in service to the School Department will have furnished to their contractors a valid pre-employment drug/alcohol test and completed background check. This information shall be on file with the School Department and will be subject to random testing as required by law. All drivers are required to register on the Department of Transportation Drug and Alcohol Clearinghouse website.

l. The School Committee reserves the right of final approval for every driver operating a bus for the School Department, and may reject any individual. Every contractor must submit the names and addresses of their drivers to the Transportation Office not later than August 1 of each school year for approval.

m. The School Committee reserves the right to engage the services of a different service provider should the Association be unable/unwilling to provide a contractor for any routes that may be needed by the District.

n. Reimbursement for damage to a contracted vehicle caused by passenger vandalism will be limited to a maximum of two hundred dollars ($200.00) per bus per school year. Drivers/Contractors will assist the School Committee, as necessary, in any investigation into such vandalism. Any monies received as restitution will be used to restore, on a dollar-for dollar basis, any deductions made from the “account” for that bus. Contractors will submit proof of vandalism, upon request, prior to any reimbursement being made. Items damaged by normal wear and tear are not subject to replacement/reimbursement under the terms of this paragraph.

o. The Supervisor of Transportation will meet with the President of the Association at least twice a year to discuss ways to equalize fees paid to contractors. The first meeting shall be held before the forty-fifth (45th) day of school.

p. No contractor or driver shall use a bus for any purpose other than that authorized by the Supervisor of Transportation or his/her designated representative. Unauthorized use of a vehicle governed by this agreement may result in revocation of the contract as it applies to that vehicle or other such measures as the School Committee may deem appropriate. The decision as to the disposition of an instance of unauthorized use rests solely with and at the discretion of the School Department. In the event that the Transportation Office has to obtain a driver for a contractor, for either a Home-to-School route or a field/extracurricular trip, a charge equal to fifty (50%) per cent of the daily rate or scheduled fee may be assessed.

q. Should the Rhode Island Department or Health or any other governmental body require specific cleaning due to Covid-19, the School Committee shall supply each bus with the required cleaning supplies.

2. FIELD TRIPS

a. After field trips are assigned, it shall be the responsibility of the contractor to provide a driver and vehicle for each trip. The contractor must provide the Transportation Office, at least two working days prior to the departure of the trip, with the name of the driver and any other pertinent information. Contractors who refuse a trip, once assigned, may be subject to an assessment equal to the payment for a Category I trip as identified in Addendum B hereto.

b. A payment equal to a Category I trip rate charge, as noted in Addendum B, will be made to a contractor whose bus arrives for a field trip that is subsequently cancelled without prior notification. Conversely, any contractor who fails to fulfill a properly scheduled and assigned trip will be assessed an amount equivalent to a Category I charge.

c. All field trips require the driver and vehicle to remain at the field trip location. An exception to this requirement may be made only after consultation with the individual teacher or coach who requested the trip with the final approval resting solely with the Transportation Office. No extra time or mileage will accrue as a result of a driver/vehicle leaving a trip and returning at a later time.

d. A charge equal to one hour of trip time shall be paid to a contractor in the event that extraordinary post-trip cleaning of the bus is necessary. The client shall be notified at the

time that they sign the field trip report that this charge will be assessed. The addition of this charge must be listed separately on the field trip report and is subject to final approval by the Transportation Office.

3. VEHICLES

a. The School Committee shall inform the Association of any anticipated increase or decrease in the overall number of buses to be used to provide service. In the event that the School Committee votes to go out to bid for a new contractor, said contractor will be required to reimburse the independent bus contractor for the Fair Market Value (FMV) of his/her vehicle or pay for any remaining payments on the vehicle, whichever is the greater amount, as long as the original payment schedule is up to date and there are no late payments due.

b. All contractors will submit bus specifications to the School Department for review and approval before any bus, except those buses purchased from an existing contractor, is placed in service. It is the responsibility of each contractor to provide these specifications sufficiently ahead of time to allow for adequate review and approval of the proposed vehicle prior to it being placed in service. Vehicles may be equipped with video camera boxes or devices compatible with the recording system in use and a mobile phone. In the event that the School Committee determines that it will require vehicles to be equipped with devices such as GPS, video cameras, recording system, etc., the Association shall work with the School Committee to obtain said devices.

c. The School Department shall have the authority to remove any vehicle from service for safety reasons. Any vehicle removed from service shall not be allowed to transport students until approved by the School Department and/or the Rhode Island Department of Motor Vehicles as appropriate. It shall be the responsibility of the contractor to provide a spare vehicle during this period, at no additional cost to the School Department. All buses governed by this agreement shall be kept in good operating condition. Any necessary repairs shall be made in a reasonable amount of time at the expense of the contractor concerned.

d. The School Department shall supply diesel fuel for student busing. e. The School Department shall insure and register all buses engaged in providing service under

the terms of this agreement.

f. Each contractor is responsible for maintenance and upkeep to the vehicle(s) he/she operates under this agreement including all parts, fluids (except diesel fuel), tires, labor charges, etc.

g. Upon the execution of the Agreement, title to the bus transfers to the School Department and, upon termination of the Agreement, title reverts to the contractor. However, if the contractor wishes to sell the bus within 3 months after the reversion, the School Department has a right of first refusal.

h. The Association shall provide at least six approved Spare Buses. Spare Buses are to be utilized primarily as back-ups for First Line Buses that become incapacitated. The Association shall establish internal procedures to insure availability of all Spare Buses to the School Department.

i. The contract period for a newly purchased bus shall be seven (7) years. Thereafter the parties have a mutual five (5) year option to renew.

j. In the event that a used bus is purchased for use as a First Line Bus the following criteria will apply:

1. Vehicle must be diesel powered.

2. The age of the vehicle shall not exceed three (3) years at the time of purchase as determined by model year. An exception to this requirement is allowed for a bus purchased from a NKBCA contractor up to twelve years in age. The balance of the contract life for a NKBCA seller may be transferred to the NKBCA member buyer, all other provisions of this agreement, state law, and NKSD policies apply.

3. The length of a contract with individual contractors, awarded for a used bus will not exceed a total of twelve (12) years from date of manufacture unless approved by the School Committee. Contracts will be awarded for an initial period of seven (7) years minus the age in years of the bus, plus a five (5) year option to renew (i.e. a two year old bus would be awarded a five year initial contract with a five year option to renew).

k. No bus, other than a Spare Bus, will be allowed to operate beyond twelve (12) years unless requested by the NKBCA in writing and with express written approval of the NKSC.

l. Prior to use, the contractor must present evidence that the vehicle has passed all inspections required by the Rhode Island Department of Motor Vehicles and any other agency with jurisdiction over the operation of these busses.

4. SAFETY

a. Monitors: The School Department will provide bus monitors as required. It will be the responsibility of the individual contractor/driver to verify that a bus monitor is present and properly performing his/her duties. If not, the contractor/driver will immediately notify the Transportation Office. The contractor/driver shall work cooperatively with the monitor to ensure compliance with all safety rules and regulations.

b. Drills: School Bus Contractors will perform emergency exit drills, along with a demonstration of the public address system on each bus, twice per school year, with the first such drill to be conducted in September. These drills will be conducted in accordance with the “Guidelines for Conducting Emergency Exit Drills” as set forth in the National Standards for School Bus Operation. Both drills will be individually documented on a Field Trip Report that will be submitted to the Transportation Office with the mileage documentation for the week in which each drill is conducted.

c. Equipment: All safety equipment will be properly mounted and maintained in good working condition at all times. Maintenance of required safety equipment is the responsibility of the individual contractor.

1. A “crossing arm” affixed to the front bumper that extends when the red lights are activated. 2. A device that requires that the driver check the bus for sleeping children before exiting the vehicle (i.e. “Child Checkmate” system or a similar device).

e. Procedures and Policies to implement a safety program will be developed in a cooperative effort between the Association and the School Department.

5. ACCIDENT PROCEDURES

In order to establish a uniform policy to be followed in the event of an accident involving any contractor’s vehicle, the following procedures will be followed:

a. In the event of any accident, the appropriate local police department will be notified and requested to respond before any vehicle is moved.

b. The Supervisor of Transportation and/or the Transportation Office will be notified as soon as possible and provided with an initial report including but not limited to:

1. Location and brief description of accident 2. Number of students on board

3. Extent of any injuries 4. At a minimum, registration number and make/model of other vehicles involved.

c. All necessary reports shall be filled out and turned in to the Transportation Office as soon as possible, unless alternate arrangements are approved by the Supervisor of Transportation.

d. When required, it shall be the responsibility of the contractor to secure three (3) estimates to repair damage. Any costs relating to obtaining an estimate shall be paid by the North Kingstown School Department unless damage was caused while on an unauthorized trip. Estimates will be turned in to the Transportation Office and date stamped to verify receipt.

e. The contractor(s) will be informed in a timely fashion of the decision of the School Department and/or insurance carrier to approve or disapprove any claims.

f. In the event of an accident that occurs during the unauthorized use of a vehicle, such use being defined as use for a purpose not specifically authorized by the Supervisor of Transportation, the contractor will be responsible for the repair of any and all damage to the school bus. The contractor will also be subject to a penalty, of an amount not to exceed one thousand dollars ($1000.00) in the event of an accident that occurs during unauthorized use, the exact amount to be determined on a case-by-case basis.

g. In cases where the driver is convicted of a violation of the Motor Vehicle Code, the contractor will be responsible for the deductible portion of the insurance policy in the event of a related accident, as well as any fines, assessments, and penalties that ensue from said conviction.

PAYMENT

The North Kingstown School Department shall send to the Association the payment for the services of

all the contractors covered by this agreement twice monthly upon the receipt of invoice from the

Association.

SCHOOL YEAR

The school year shall be based on a minimum of 172 days. In the event that the buses do not run for at

least 172 days, the Association shall be paid 35% of the daily rate per bus toward the overhead

expenses for each day up to the 172 days that the buses do not run. Payment of the 35% shall be paid

at the conclusion of the school year

FIELD/EXTRACURRICULAR/ATHLETIC TRIPS

Category 1 rates include three (3) hours of trip time, categories 2 through 6 include five (5) hours of trip time unless otherwise noted. These rates cover round trip transportation and time; they do not include tolls, parking, mileage, etc. which are the responsibility of the customer. Except for mileage, miscellaneous charges such as tolls and parking will each be listed separately on the Field Trip Report and will only be reimbursed upon submission of an appropriate receipt for the expense.

6. Termination

a. This Agreement shall terminate on June 30, 2023 unless the written notice required under the Section entitled “Scope / Term” is given to the Association at the following address:

b. The School Committee may terminate this Agreement at any time, with or without just cause, by providing the Association with thirty (30) days written notice at the address set forth above.
