7 an extreme depar t ure f rom the st andard of care.

8 B. On or about Oct ober 17, respondent by

9 t el ephone was i nf ormed that C. K. ' s condi t i on remai ned

unchanged. At respondent ' s di rect i ve, C. K. came to

11 respondent ' s of f i ce and was gi ven an i nj ect i on of Gamma

12 Gl obul i n and Li ncoci n by respondent ' s nurse.

13 Respondent hi msel f di d not see C. K. On the af ternoon

14 of Oct ober 17, C. K. ' s wi f e tel ephoned agai n to report

15 that C. K. ' s temperature was over 104 degrees and hi s

16 abdomen was di st ended. Respondent , agai n over the

17 t el ephone, advi sed C. K. to cont i nue the prot ocol of

18 Tyl enol , Val i um and hot showers every f our hour s.

the cont i nuat i on of the protocol of Tyl enol , Val i umand

8 hot showers. When respondent f ai l ed t o come to

9 eval uate C. K. unt i l over 12 hours af ter hi s admi ssi on,

1 0C. K. ' s wi f e di smi ssed hi mf rom the case. Gi ven the

pat i ent ' s sympt omatol ogy and hi st ory, i t was an extreme

depar ture f rom the standard of care f or respondent to

13 have ordered a t reatment regi men wi t hout havi ng

perf ormed a physi cal exami nati on and t o have del ayed

15 hi s personal eval uat i on of C. K. unt i l 12 hours af ter

16 the pat i ent ' s hospi tal admi ssi on.

1 7 E- C- K- was subsequent l y di agnosed as havi ng a

18 per f orated duodenal ul cer . He suf f ered resul tant

19 sept i c shock, renal i nsuf f i ci ency and gast roi ntest i nal

20 bl eedi ng. C. K. di ed i n the hospi t al on December 4,

21 1988. Earl y assessment of C. K. ' s condi t i on at the
