A discussion of the most common wage and hour violations/issues encountered:
Misclassification (1099ing) of employees: Am I an employee? Hours worked: Do I have to pay them for doing that? Over-time (private
industry) vs. Comp time (govt ): Looking ahead - future changes affecting all; Joint employment liabilities when using staffing
companies: Am I liable for their missed payrolls?
Sales Tax: Define the difference between real property and tangible personal property; Know the general tax rule for real property
contractors; Describe contract types; Discuss fabrication of materials off site.
Re-Employment Tax: Describe who is liable for the tax; Define the employer/employee relationship; Know the difference between an
employee and independent contractor; Discuss tax rates and reporting requirements.
Every year, employers are faced with the task of changing how they do business to adapt to new laws and regulations; decisions by the
National Labor Relations Board, Department of Labor, Equal Employment Opportunity Commission; and creative new legal claims by
plaintiffs’ attorneys. This session will review the most important new developments in labor and employment law; and will attempt to
provide practical advice to employers to assist their efforts to manage their businesses in the face of these new developments.
The presenters will discuss the purpose of using criminal background checks in employment, Fair Credit Reporting Act requirements,
racial disparities in the criminal justice system, EEOC guidance on the use of arrest and conviction records in employment decisions, the
“Ban the Box” movement, and offering second chances to applicants with criminal histories.
The presenter will engage participants in a discussion on implicit bias as an obstacle to diversity and inclusion efforts in the workplace.
Discussion points will include:
- defining implicit bias
- examples of bias in practice
- tools to help overcome/combat implicit bias in the workplace.

This presentation will examine effective ways to manage generational diversity in the workplace. Specifically, the four key generations
within today’s work force will be defined and the presentation will explore the ways in which these different generations view work,
diversity & inclusion, and each other. The presentation will then make specific recommendations for effectively managing these different
generations to achieve common organizational goals.
