Whereas in. CWP No. 737 of 2016, the petitioner i.e. Sh. Umesh Chander

is claiming the benefit of continuity of service w.e.f. 15.01.1997, the date of his

initial appointment as lecturer Economics on contractual basis since the this

benefit has been granted to other similar situated contractual lecturers of the

Department. In support of his claim, he cited an example of one of such

lecturers i.e. Sh. Rajesh Kumar, who was earlier appointed on contractual

basis for the period of 89 days and like petitioner he was also relieved from

service after the expiry of contractual period. Sh. Rajesh Kumar allowed to join

back on duty in compliance of the Hon'ble Court directions, and was given the

benefit of continuity of service vide this office order dated 19.05.2006 alongwith

two other petitioners, but the same benefit has not been given to the petitioner,

neither decision on the representation of the petitioner dated 04.04.2012 has

been taken by the Department, though the petitioner is similar situated.

That on receipt of the notice in the present writ petition, the claim of the

petitioner for continuity of service was considered by the Department and it

has been observed that the claim of the petitioner is maintainable and liable to

be accepted keeping in view of the facts and circumstances of the case that the

same relief has been granted in number of cases by the Department to other

similar situated person.

The petitioner was appointed as lecturer in Economics on contractual

basis for the period of 89 days and he joined as such in GSSS, Nayan

(Mahendergarh) on 15.01.1997. He was relieved from service after the

completion of period of 89 days by the concerned DDO, retaining the other

similar situated counterpart in service beyond that period. Aggrieved by this

action of the Department, he filed a CWP No. 9269 of 2005, which was

disposed of by the Hon'ble High Court with a direction to the respondents to

take final decision on the representation of the petitioner. In compliance of the

above directions of the Hon'ble Court, his claim was considered and the then

Director General School Education, Haryana vide order dated 09.12.2005 took

the petitioner back in service as fresh appointee. Since then, he is working in

the Education Department as lecturer in Economics and now claiming the

benefit of continuity of service w.e.f. the initial date of his appointment.

After going through the entire facts of the case, I have come to the

conclusion that the claim of the petitioner is genuine and is liable to be

accepted. Though the claim of the petitioner can be rejected as time barred

claim, but keeping in view of the observation of the Hon'ble Supreme Court of

India on time barred claim that "the State should not raise the plea of

limitation to defeat the just claim of the citizen." This contention of the

petitioner appears rational that if, the Department has already granted the

benefit of continuity in service to the other similar situated persons, thus being

similar situated, the same benefit should be given to him. So, the petitioner is

hereby granted benefit of continuity in service w.e.f. 15.01.1997 and condition

No. 5 imposed in the order No. 13/52-05 HRL (4) dated 26.10.2005 is modified

accordingly. However, they will not be entitled for any financial benefit except

the benefit of continuity in service.

Whereas, Sh. Ravinder Singh [000188] has filed CWP No. 16215 of

2016 in the Hon'ble Punjab 84 Haryana High Court, Chandigarh praying

therein to quash/ cancel/ set aside the PGT/ Lecturer (History) transfer list

dated 06.08.2016 (Annexure P-3), qua the petitioner only mentioned at Sr.

No. 3 being unjust and contrary to the recently enacted new Teachers

Transfer Policy, 2016 as the petitioner has not completed period of 5 years

at the present place of posting and this is his first urban posting. It has

been further prayed to direct the respondents not to transfer the petitioner

from his present posted school because the petitioner has not completed

period of 5 years at the present posting and the said policy have only

perspective application. This writ petition came up for hearing before the

Hon'ble High Court on 10.08.2016, wherein the following order was

passed:-

" Accordingly, the present petition is disposed of with a direction to the competent authority to decide upon the grievance/ representation of the petitioner by treating this petition as supplementary representation within a period of 7 days from the date of receipt of certified copy of the order. The competent authority in making its decision would consider the law in Shilpi Bose (Mrs.) v. State of Bihar, AIR 1991 SC 532 and Union of India and others v. S.L. Abbas, 1995 (4) SCT 455. The petitioner shall not be relieved from the present place of posting till re-examination of his case."

That in compliance of the aforesaid direction of the Hon'ble Court, the

representation of the petitioner dated 06.08.2016 (Annexure P-4) has been

considered and it has been observed that the main contention of the

petitioner is that as per the latest transfer policy of Government of Haryana,

no transfer of any Government employee of Education Department can be

effected who have not spent more than 5 years at one station/school. I have

gone through the record of this case and the following actual situation has

emerged:-

1. The School Education Department vide order No. 1/97-2016-eGov.

dated 21.07.2016 has issued clarification in regard to Teachers

Transfer Policy-2016 and it is clearly mentioned at 1.1.1 of said

clarification that the total period of stay would be counted in a

particular Zone not in School. Para No. 1.1.1 of said clarification is

redefined as under:

"Presently the Department is considering all those teachers who have completed five years of stay in a zone in any capacity like

JBT, TGT, PGT whether as guest teacher or regular teacher or on any non-teaching post of the school education department to be on a deemed vacant post. In other words, if a teacher was recently posted in a particular school just one year back and such teacher happened to have been posted earlier also in the same zone and that period of stay was more than four years, then the total period of stay of such teacher in the same zone would come out to be more than five years in such a zone. Clearly, the stay of a teacher whether at a stretch at a particular station or in breaks in the same zone would be counted to pronounce a vacancy as deemed one."

2. Sh. Ravinder Singh [000188] PGT/ Lecturer (History) was posted in

GSSS Shahpur [35] Ambala ever since February, 2004 to May,

2015 and in GSSS Rambagh Road [7] Ambala from June, 2015 to

July, 2016.

3. Both the above said schools i.e. GSSS Shahpur [35], Ambala and

GSSS Rambagh Road [7], Ambala are falling in Zone-1 of District

Ambala. Thus, the petitioner was posted 12 years 5 months in

Zone-1 and due to completion of more than 5 years of his service

in Zone-1, it is mandatory for the petitioner to participate in the

General Transfer Drive carried out on 06.08.2016, however, he

doesn't preferred any school for transfer.

4. Therefore, he had to be given any station available vacant in the

state by treating him to be part of "anywhere in the state category"

because no choices of stations given by him. He is not the sole

case who has been treated to be part of 'anywhere in the state'

category and all the similar situated teachers were transferred

being treated to be part of "anywhere in the state category".

5. The petitioner have also been provided an additional window of

opportunity to participate in the second drive carried out on

21.12.2016. In the second drive it was hoped that the petitioner

would choose his options keeping in mind his weightage and the

level of competition in particular zones/districts. However, he did

not participated in the 2nd Transfer Drive and missed an

opportunity to get transfer on the basis of his weightage and the

level of competition.

In the light of above discussion, it is clear that Sh. Ravinder Singh is

a duly posted case. Therefore, his claim is not tenable.

The Hon'ble High Court vide order dated 28-01-2015 disposed of the CWP

.No. 1460 of 2015-titled as Raj Kumar Suhag Vs State of Haryana and other with a

direction to respondent no. 3 (District Education Officer, Bhiwani) to take a final

decision on the legal notice dated 18.10.2014, given by the petitioner, within four

months of the date of receipt of the order.

In the legal notice dated 18.10.2014, the petitoner has requested for of

fixation of his pay, grant of casual leave alohgwith pay and allowance, grade pay,

senority, ACP, leave and all other financial/ other benefits by counting of former Service

rendered as ex-servicemen, he being an ex-combatant clerk retired/released from

service and re-employed as clerk in civil post. This he has requested by citing Chief

Secretary Haryana Govt. letter No. 12/2 /96-4/GS-11 dated 16.02.1999.

Sh. Raj Kumar Suhag has now filed COCP No. 2820 of 2015 titled Raj

Kumar Suhag V/s Smt. Nirmal Sheoran, DEO, Bhiwani.

The Hon'ble High Court in the aforesaid COCP has passed the interim

order dated 13.02.2017. The relevant part of the orders is reproduced here under:-

"In case, respondent No.3 is not the competent authority

then respondent No.2 could have taken action in

accordance with the directions issued by this Court as it

was the duty of the District Education Officer, Bhiwani to

send the case to the competent authority.

However, in case, the necessary compliance is not done

within a period of two weeks from today then respondent

No.2 is directed to be present in the Court on the next date

of hearing.

Adjourned to 07.03.2017."

In compliance of the orders, the case of the petitioner has been examined

the period 26.10.1991 to 30.04.2012 (20 years and 6 months) as a combatant clerk.

As per State Govt. instruction dated 27.08.1998 and 16.02.1999, it has

been ordered that the fixation of pay of ex-combatant clerk retired/released from

service in the Armed Forces on re-employement as clerk in Civil Post will be made while

allowing the number of completed year of service rendered in Armed Force as

Combatant Clerk. Accordingly, the benefit of fixation of pay as ex-combatant clerk has

been granted vide this office letter No. 13/191-2014 HRME (3) dated 23.02.2017.

As far as other benefits claimed are concerned Sh. Raj Kumar Suhag is

not entitled for the same as seniority and ACP are allowed only to those ex-servicemen,

who rendered service during the National Emergency i.e. for the period from 26.10.1962

to 10.01.1968 as per Punjab Government National Emergencey (Concession) Rules,
