The new age of global immigration and mobility: challenges and opportunitiesPatterns of global mobility have changed considerably over the past two years. Overseas secondments are common and many employees expect to have a cycle of experience outside their home country. Business visits are increasing exponentially and are often the most common route of global mobility for many companies.

Against this trend, countries are introducing protectionist immigration policies to meet political demands. Brexit, US immigration policy and other global developments have turned immigration policy upside down. This has created a perfect storm. What are the challenges faced in this situation and what opportunities are there?

The eminent panel of experts from a wide range of countries across the globe will address the current immigration situation and underlying trends and discuss the future state.

ModeratorJulia Onslow-Cole PwC, London; Chair, IBA’s Human Rights Institute Trust

1045 – 1215 Second breakout sessions

BREAKOUT ONE

Between cooperation and competition: the place of immigration lawyering in a global mobility worldGlobal mobility becomes an issue for many multinational enterprises. Where in the past the ex-pat community was made mostly of high-ranking professionals and VIP’s, nowadays, global HR increasingly sources talent all over the world. As a result, clients are in need of global mobility schemes that cover employment, tax, social security and immigration law as much as moving, relocation assistance and inter-cultural training. Many multinationals no longer address their needs in this field to immigration lawyers directly, but have their procurement department handle relocation. Relocation providers that are present in multi-jurisdictions increasingly act as vendors providing services directly or with lawyers as sub-contractors.

What advantages can be found by cooperation and where are the limits to sub-contracting set by Bar regulations and competition laws?

International Bar Associationthe global voice of the legal profession

The International Bar Association (IBA), established in 1947, is the world’s leading organisation of international legal practitioners, bar associations and law societies. The IBA influences the development of international law reform and shapes the future of the legal profession throughout the world. It has a membership of more than 80,000 individual legal professionals and 190 bar associations and law societies spanning all continents and has considerable expertise in providing assistance to the global legal community.

Grouped into two divisions – the Legal Practice Division and the Public and Professional Interest Division – the IBA covers all practice areas and professional interests, providing members with access to leading experts and up-to-date information. Through the various committees of the divisions, the IBA enables an interchange of information and views among its members as to laws, practices and professional responsibilities relating to the practice of law around the globe. Additionally, the IBA’s world-class conferences provide unrivalled professional development and network-building opportunities for international legal practitioners, senior business professionals, regulators and government officials.

IBA Immigration and Nationality Law Committee overviewThe Immigration and Nationality Law Committee is concerned with all aspects of immigration and nationality law on a worldwide basis, including business-related immigration, family reunion policies, refugees and compassionate cases.

The committee aims to provide a forum for the discussion of comparative data on immigration and nationality policies of countries worldwide.

The Mission and focus of the committee is to provide a platform for lawyers practising immigration laws to receive input and update about the immigration laws of their country and also immigration laws and procedures of other jurisdictions. We achieve this by holding annual conferences and presentation of papers, newsletters and providing other online resources to enhance the knowledge of its member in multiple jurisdictions.

Additionally, the Immigration and Nationality Law Committee works with the following committees to form the Human Resources Section:• Discrimination Law• Employment and Industrial Relations Law• Global Employment Institute

The IBA Global Employment Institute is becoming the leading voice and authority on global HR issues by virtue of having a number of the world’s leading labour and employment practitioners in its ranks, and the support and resource of the world’s largest association of international lawyers.

The Human Resources Section Board was established in 2014 in order to coordinate activities and joint efforts within the Section. Board members consist of the current and immediate past Chairs of each of the committees in the Section.

IBA European Regional Forum overviewThe European Regional Forum was established in 1989 to provide a focus originally on the work undertaken by the IBA in developing the practice under changing legal systems of lawyers in Eastern and Central Europe. The forum was also intended to act as a channel for IBA communication with the bar associations of these local lawyers. Since 2004 the forum has been developing and strengthening the existence of the IBA within the whole of Europe by promoting the goals of the IBA to members, non-members and others, disseminating professional know-how, and assisting the committees and other constituencies of the IBA to increase their presence in the different neighbouring regions of Europe, including parts of North Africa and the Middle East.

The goals of the forum include addressing current and long-term needs of professional organisations and individual members within the geographical reach of the forum, as well as increasing membership and participation in the IBA and integrating them within the organisation. The forum will also facilitate cross-border activity between lawyers and bars in different European countries. The forum has a particular focus on cross-disciplinary activities. The forum seeks to facilitate relevant networking and information/experience sharing opportunities and encompasses the social and collegial interests of both members and potential members with other regional fora, the Corporate Counsel Forum and the Young Lawyers Committee and all LPD committees in general. At present the forum has 7,700 members and its numbers continue to increase as it becomes one of the most integrated and dynamic for a of the IBA.
