At 23, while in Strasbourg,France studying physicsand chemistry, Jean-

Pierre Kempf decided he wantedto drive a car just using his hands.

It was 1954 and the only trans-portation he had since he lost theuse of his legs due to polio at theage of two, was a tricycle. Mechan-ics was his passion, so he as-sembled a car out of various partsand adapted it to be able to driveit himself. He installed a ring ontop of the steering wheel to accel-erate, a lever left as a hand clutchand a lever right as a hand brake.“I realized that once I was behindthe wheel, I was like anybody else!”he said, so he decided to share hisexperience. He sent a letter to acar magazine and the publicationof it brought him such a large de-mand from paraplegics and am-putees that he started his com-pany to adapt cars and filed apatent for the ring in 1955.

For him the “thank you” fromhis customer was more importantthan the money he received. It

took him over a year before he couldbuy a wheelchair. It was a foldingwheelchair that changed his lifeand made him really independent.

His company became the lead-ing driving aids manufacturer inFrance.

The accelerator ring and handbrake became the standard handcontrols in France.

He used to say, “We are notbuilding prosthesis to the cars. Weare adapting the cars with the besttechnology available and makingsure they look as nice as the man-ufacturers designed them. Kempfadaptations should look like fac-tory made.”

His company adapted over100,000 vehicles in his lifetime. Hewas involved in the design untilthe end of his life in 2002. His fam-ily made sure his legacy lives on.Daughter, Martine who lives inCalifornia manages the companyKEMPF SAS in France. In 2007she started KEMPF Inc. in Cali-fornia and Florida and in 2012 inChina.

Acommon question thatparents and grandpar-ents ask is how to save for

a child/grandchild with a disabil-ity. The answer is a simple one: es-tablish a supplemental needstrust for the benefit of the child.

A supplemental needs trust isa special kind of trust. It can havethousands of dollars in the trustand not affect the beneficiary’s eli-gibility for government benefitssuch as Supplemental SecurityIncome and Medicaid. These twogovernment benefit programs payfor the services and supports anindividual with disabilities needsto live in the community and havea full and productive life.

A recent change in the federallaw has created an account calledan ABLE Account: Achieving aBetter Life Experience. These ac-counts are similar to a 529 Edu-cation accounts. Funds can growtax free, annual contributions can

Saving for a Disabled Child or Grandchildbe made by anyone, but are lim-ited to $14,000 in the aggregateand, most importantly; funds inthe account at the death of thebeneficiary with the disability aresubject to claims by Medicaid.

Third party supplementalneeds trusts contain funds fromthird parties such as parents andgrandparents and are not subjectto claims by Medicaid. The cre-ator of the trust can designate whoreceives funds in the supplemen-tal needs trust at the death of thebeneficiary. They are a better op-tion for parents and grandparentswho wish to put their hard earnedfunds aside for a person with a dis-ability.

As parents, we are thenatural legal guardiansof our minor children.

We do not need anyone else togive us the power to talk to ourchild’s doctor or open a bank ac-count on their behalf. However,in New York, once a personreaches age 18, it is like a switchis turned on and he or she isdeemed a competent adult, re-gardless of physical or mentalcondition. At that moment, asparents we no longer have theauthority to make decisions forour now adult child.

At this point there are twooptions. First, if your adult childhas the requisite mental capac-ity, he or she can sign a HealthCare Proxy (for health care de-cisions) and a Durable Power ofAttorney (for financial matters).

If your child lacks the capac-ity to sign these legal documents,then you can apply to theSurrogate’s Court to become thelegal guardian.

This process is referred to as a“17A Guardianship” after thestatute that created the process.Once you are named guardian bythe court, you will have the legalauthority to again make impor-tant health and financial deci-sions for your son or daughter.

If you believe you will need tobecome guardian for your child,you should begin the process afew months before his or her 18th

birthday to allow time to gatherthe required documentation thatyou will need for the court. Aspecial needs planning attorneycan offer assistance and guid-ance during this important pro-cess.
