THE PRIMARY SCARCITY IN FRONT OF INDIA TODAY IS OF LACK OF

JUSTICE. EVERY YEAR MILLION OF PENDING CASES GOES UNHEARD

IN ACOUNTRY COMPRISING A POPULATION OF MORE THAN 1.7

BILLION. THE SAME IS NOT VALID FOR A CELEBRITY OR A PERSON

WITH HOT POCKETS BUT IS ONLY APPLICABLE FOR A COMMON MAN.

THEREFORE DOES A COMMON MAN IN AN ECONOMY FEELS THAT IS

JUSTICE IN INDIA IS NOT EVERY PERSONS CUP OF TEA.THE QUESTION IS

NOT OF LACK OF LAW AND ORDER BUT IT PRIMARILY RELATES TO LACK

OF IMPLEMENTATION. IF A INTERNET BROWSER NEED AN UPGRADATION

FORM TIME TO TIME THEN WHY SHOULD NOT BE THE SAME CASE WITH

OUR CONSTITUTION?

Pending Cases

• There are so many cases pending at different level of courts in India.

Shortage of Staff

• Shortage of judges also leads to delay.

• The Law commission in its 120th report recommended the increase of the strength of the judges from the current 10.5 to 50 judges per million. The current ratio is approximately 11 judges per million.

Stress on Paper work

• Still in this modern time, judiciary is heavily dependent on the paper work which cost lots of time wastage.

Corruption • Corruption is every where in this

field

• LIKE:-

• Sometime police doesn't file the case.

• Sometimes lawyers of both sides having their own settings.

• Sometime cases are manipulated with the help of judges too.

Inequality • All individuals should be equal in

front law.

• Sometime some pupils are treated like freedom fighter.

• Eg:- Kasab a terrorist of 26/11 Mumbai attack was treated like a freedom fighter in jail

• Quality of investigation and documentation should be enhanced.

• The SP/SSP should maintain a record of FIRs in respect of influential public persons so as to enable him to keep track of such cases from time to time.

• The SP/SSP shall, from time to time, get reports from the SHO regarding the course and progress of investigation and issue suitable instructions

• There should be a provision for automatic relay of the telephone conversation between the caller and Police Station operator to all the Patrol vehicles of the police deployed in the area to reduce the response time of police.

• Networking of all police stations to establish a link with all the courts.

POLICE

• All criminal courts ought to be provided with Audio recording through tamper-proof technology for recording of statements of witnesses so that the appellate courts can also refer to the same for determining the exact statement made by the witnesses.

• There must be a Special Cell in the High Court exclusively to take stock of old pending Sessions cases.

• In the quarterly statements also, the District Judges should record brief reasons for the delay in Sessions cases which are more than 3 years old from the date of framing the charges and inter-alia they must state whether the case relates to an influential public person.

• Victim of any crime should be given special protection for their safety.

• Number of courts should be increased.

• Implementation of strong lokpal bill. This will free up a lot of cases pending before the conventional courts.

• Government website must be updated time to time.

• RTI should give the proper reason behind the rejection of any application for the satisfaction of citizen of India.

• CBI should be independent organization.

GOVERNMENT

• All civic problems must be concerned as it is faced by every citizen in his/her day to day life.

• Every individual should respect the law.

• Every individual should cooperate with police and other investing agencies.

• Fee concession should be given to poor people by the

government of India due to their economic condition.

THERE SHOULD BE A STRONG BELIEVE OF EACH AND EVERY CITIZEN OF COUNTRY THAT ALL ARE EQUAL IN FRONT OF LAW.

BELIEVE OF PEOPLE INCREASE OVER THE POLICE AND SYSTEM.

TEAM CONSIST OF EXCELLENT CBI OFFICERS.

CBI SHOULD NOT WORK UNDER ANY MINISTRY AND LOOK WHOLE MATTER.

START GETTING RESULTS OF CASES PENDING FROM YEARS.

IF 60-70% PENDING CASES SOLVE WITH IN A YEAR OR TWO.

CONSISTS OF HIGHLY QUALIFIED RETIRE JUDGES HAVING LOTS OF EXPERIENCE.

REGULAR REPORT SHOULD BE PROVIDED TO IT DEPARTMENT OF MINISTRY.

LOWERING THE RANK OF COUNTRY IN CORRUPTION LIST BY UNO.

LAWS SHOULD BE PROPERLY FOLLOWED.

SURPRISE CHECK IN DIFFERENT GOVT. OFFICE BY IPS AND IAS.

COLLECTOR SHOULD LOOK AFTER THE WHOLE MATTER AND SUBMIT THE REPORT TO MINISTRY.
