Street Improvements at Maple and Vandeventer

RECOMMENDATION: Staff recommends approval of this cost share with Kappa Delta Sorority to pay $28,470 for street and sidewalk improvements to Maple Street and Vandeventer Avenue. BACKGROUND: In late 2017, the Development Services Office received a request for a Site Improvement Plan for construction of the Kappa Delta Sorority House at the Northwest Corner of Maple Street and Vandeventer Avenue. The request was to construct a new sorority house to replace the existing house, and add more capacity. The Site Improvement Plan was approved by staff on February 9, 2018. The current configuration of the intersection at Maple and Vandeventer is confusing and dangerous for both vehicles and pedestrians. Maple Street at this location is a two lane with a master street plan designation of ST-45. However, there is a jog in the right of way that over the years has resulted in a relatively large paved width (in some areas 44 - 50 feet wide). This results in some confusion in the location of the travel lanes vs. parking areas as these have historically only been defined by pavement markings. This in conjunction with the steep hill to the east can also lead to issues with speeding making it dangerous for pedestrians and vehicles in the intersection. DISCUSSION: During development and permitting review of the new Kappa Delta Sorority house, the project was required to make improvements to the sidewalk along both Maple and Vandeventer. In conjunction with this, the engineering division recognized an opportunity to partner with the project to improve traffic flow and safety at this intersection by extending those improvements further east. The improvements included in this cost share would consist of new curb and gutter to reduce the overall paved width of Maple, while also defining the intersection better with proper

radii and on designated on street parking. In addition, sidewalks will be reconstructed to city standards including new ADA ramps, and a new crosswalk. CONTRACTUAL AGREEMENT FOR COST SHARE OF STREET IMPROVEMENT COSTS

This Agreement, made and entered into on this _______ day of October 2018, by and between the City of Fayetteville, Arkansas (“City”) and Zeta Gamma House Corporation of Kappa Delta Sorority (“Kappa Delta”), witnesseth: WHEREAS, Kappa Delta has proposed a new large scale development, approved at the northwest corner of Maple Street and Vandeventer Avenue, and

WHEREAS, the Kappa Delta development is required to construct street improvements along its property frontage of Maple Street and Vandeventer Avenue: and

WHEREAS, offsite street improvements, which exceed the rough proportionality of

impact of the project are necessary east of the site on Maple Street to realign the curb and sidewalk to create a safe intersection with Vandeventer Avenue WHEREAS, the City of Fayetteville Engineering Division recommends the offsite street improvements, which exceed the rough proportionality of impact from the development be funded by means of a cost share. NOW, THEREFORE, the City of Fayetteville, Arkansas and Kappa Delta agree as follows:

1. The City of Fayetteville, Arkansas agrees to:

A. Reimburse Kappa Delta for $28,470.00 which represents the cost to install approximately 164 linear feet of curb, 120 linear feet of 5 ft wide sidewalk, ADA Ramps, a driveway apron, and crosswalk in the area identified in Exhibit “A”, attached.

B. Payments due to Kappa Delta, shall be remitted within sixty (60) days after receipt of valid invoices, and pending successful inspection and acceptance of the completed work by the City of Fayetteville Engineering Division.

2. Kappa Delta agrees to:

A. Provide the necessary and normal project management, inspection, and testing

as necessary for a complete and acceptable curb and sidewalk installation per the City of Fayetteville Standard Specifications for Street and Drainage Construction.

B. Provide a copy of the invoices from the Contractor upon City approval of the street widening and drainage installation.

 October 4, 2018  Cost Share for On‐street Parking/ Curb Alignment: 

Intersection of Vandeventer Ave. and Maple St.   In regards to the public improvements for sidewalk, crosswalk, curb realignment and parking at the intersection of Vandeventer Ave. and Maple St. we have created the cost share below.   The proposal is for the City of Fayetteville to pay the increase in costs associated with curb and sidewalk realignment as well as defined on‐street parking on Maple St.  Currently, the intersection comes in at a difficult and unexpected angle.  On‐street parking is unprotected and on this downhill slope increased speeds and gravel accumulation can make traffic lanes more difficult to navigate.    We have deducted the original amount for striping.
