RECOMMENDATION

Authorize the Chief Executive Officer to:

A. Negotiate and exec~~te Contract PS093343240GA with STV Incorporated (STV) to provide advanced conceptual engineering (ACE), bid support, and construction support services for the proposed Union/Patsaouras Plaza Busway Station in an amount not-to- exceed $928,364.

B. Execute additional contract mo&fications, if required, to Contract No. PS093343240GA for additional design or professional services for the Union/Patsaouras Plaza Busway Station, if required, in an amount not to exceed $200,000.

RATIONALE

At its February 2009 meeting, the Board of Directors approved a life of project (LOP) budget for the El Monte Busway Improvements and Transit Center Expansion project, a project which is funded b y the Los Angeles Region Congestion Reduction Demonstration Initiative (LA CRD). The project scope includes two primary transit enhancements, construction of a new and expanded El Monte Transit Center, and construction of a new passenger station connecting the El Monte Busway to the Patsaouras Transit Plaza. This item solely relates to the Union/Patsaouras Plaza Busway Station project.

For some time, the entrance to the existing high occupancy vehicle (HOV) and El Monte Busway lanes at Union Station has been in need of reconfiguration to allow for the more efficient ingress and egress of pedestrians, buses and automobiles. Further, the passenger boardinglalighting areas are not located contiguous with Union Station, but rather are situated at the corner of Alameda and the busway entrance, which would require a I/4 mile

walk to the Plaza. ?'here is no direct pedestrian connection to Union Station, and there are no passenger amenities such as lighting, closed circuit television (CCTV), information displays, or landscaping. This issue will only become more acute upon revenue operation of the Congestion Reduction Demonstration Initiative, since all new passengers would alight I/4 mile from Union Station, a relatively long walk to malce other transit connections such as the Red Line, Gold Line, and Metrolink. To resolve these issues and provide a more user- friendly passenger experience, a number of potential new station configurations have been evaluated. The preferred configuration is to relocate the existing passenger boardinglalighting areas on the south side of Patsaouras Plaza. A drawing showing a rough concept of the proposed passenger station is included as Attachment A.

As currently envisioned, the scope of work for the Union/Patsaouras Plaza Bus~vay Station will consist of the following elements: (1) relocation of the Busway patron boarding island (now situated at the corner of Alameda) to the east side of Patsaouras Plaza to allow more efficient passenger boarding and alighting for buses running on the El Monte Busway; and (2) installation of related capital improvements to the El Monte Busway, Patsaouras Plaza, East Portal and the Gateway Office Building to accommodate passenger boarding and alighting within an elevated median "BRT" type station with a direct pedestrian connection to Union Station. The scope of work may also include, dependent on right-of-way availability, feasibility, and budget, a flyover structure from Patsaouras Plaza to Rarnirez Street, which would provide an alternate ingresslegress point for buses leaving/entering Patsaouros Plaza.

Provision of this station configuration will significantly enhance the smooth implementation of Metro's proposed "Expresslanes" project (Congestion Reduction Demonstration Project) by allowing busway passengers direct pedestrian connections to both Union Station and Patsaouras Plaza. By saving over one-fourth mile pedestrian walking distance, mode shift to regional and local buses, heavy rail, light rail and commuter trains is encouraged. In addition, this new configuration will also improve the overall operational efficiency of Patsaouras Plaza by reducing a number of seemingly unnecessary short bus trips.

In consideration of the extremely aggressive schedule required for completion of the Union/Patsaouras Plaza Busway Station (December 31,2010), staff recommends the immediate engagement of STV to move the project into the conceptual planning, environmental clearance, advanced conceptual engineering (ACE), and entitlement phases. This advanced conceptual engineering and design work is required in order to complete environmental studies and obtain National Environmental Policy Act (NEPA) clearance from the Federal Transit Administration (FTA), and to reach our goal of issuing a designlbuild procurement package for solicitation of a designlbuild contractor by January 2010. STV's scope of work includes, but is not limited to, research of readily available technical studies, conceptual site planning and charettes, coordination with Caltrans, review of geotechnical reports and survey data, completion of advanced conceptual engineering drawings and specifications suitable for use in a designlbuild solicitation, cost estimation, third party coordination, universal fare system and gating coordination, sustainable design services, and bid and construction support services.

In regards to tlie schedule for project completion, the plan is to complete the advanced

conceptual engineering documents to an approximate level of 30% completion and achieve FTA approval of NEPA documentation by January 2010, prepare a designlbuild procurenlent package for solicitation of a designlbuild contractor by February 2010, award the designlbuild construction contract by May 2010, and complete construction of the project by December 2010.

FINANCIAL IMPACT

The fiunding to complete the proposed scope of services for the Union/Patsaouras Plaza Busway station portion of the project is included in the adopted life of project budget in Cost Center 3340, Facilities Maintenance, under Capital Project 202286, El Monte Busway Improvements and Transit Center Expansion Project. Since this is a multi-year project, the cost center manager and Chief Operations Officer will be responsible for budgeting project costs in future fiscal years. In addition, award of the bid support and construction support services tasks of this contract is contingent on receiving approval of all NEPA clearance documentation, which is expected to occur no later than January 2010.

The source of funds for the proposed project is a combination of federal and local funds and is part of the Congestion Reduction Demonstration Project. These funds are not eligible for bus and rail operating and capital expenditures.

ALTERNATIVES CONSIDERED

The Board of Directors may choose not to authorize the contract for advanced conceptual engineering at this time. The Board could elect to: (1) recommend using our staff to engineer, design and support construction of the project; or, (2) not authorize the CEO to award and execute the contract. Both of these options are not viable because we do not have sufficient resources or staff expertise to perform the necessary architectural and engineering services required for a project of this type. It is therefore necessary to contract with outside architects and engineers for this high priority and much needed transit enhancement project. In addition, if the contract is not approved, staff would be unable to complete the project in accordailce with the USDOT toll revenue operation deadline of December 31, 2010.

A. Background on Contractor

STV Incorporated (STV) is a multidisciplinary engineering, architectural, planning, environmental, and construction management firm with an office in Los Angeles for over 60 years. Currently they are located at 1055 West Seventh Street, Suite 3150. The firm is a wholly-owned subsidiary of STV Group, Inc., established in 1912 and headquartered in New Yorlc. Previous work completed for Metro by STV includes the design for the Metro Gold Line Los Angeles River Bridge and well as the designlbuild documents for the Metro Orange Line BRT. Current Metro projects for STV include the Four-Quadrant Gate Feasibility Study, Redline Station Entrance Canopies, and the Project Management Assistance contract. Major contracts with other transit agencies include Route 101 /Reyes Adobe Road Interchange Improvements for the City of Agoura Hills, CA and the Perris Valley Line Project with Riverside County Transportation Commission, Riverside, CA.

Past Performance is reported to be satisfactory.

B. Procurement Background

This Request for Proposal is a qualifications-based competitive negotiated procurement issued under the Broolts Act for conceptual and advanced conceptual engineering design services for the Union/Patsaouras Plaza Busway Station project.

The Diversity & Economic Opportunity (DEOD) recommended a 20% Disadvantaged Business Enterprise (DBE) Anticipated Level of Participation (VALP) for this procurement.

C. Evaluation of Proposals

The solicitation was issued in accordance with the Procurement Policy Manual. A Source Selection Committee was convened and conducted a comprehensive technical evaluation of the proposals received and held oral discussions. Based on the evaluation criteria stipulated within the RFP solicitation, STV received the highest ranking of the two responsive proposals submitted.

D. Cost/Price Analysis Explanation of Variances

A fair and reasonable price will be negotiated based upon Management Audit Services (MAS) pre-award audit, a cost analysis, independent cost estimate, an extensive technical review and fact find sessions.
