Information Report to the Extraordinary Chief Pleas, 25th August 2016

REVISED TRACTOR LICENCING CODE DEFINITIONS

The Road Traffic Committee has been working on streamlining the Tractor Licencing Code Definitions that have been in use since October 2012, to remove some of the confusion and ambiguity that the Version 7 has caused. The Version 8.1 of the Tractor Licencing Code Definitions was drawn up in February this year and sent out as a house-to-house consultation in April, along with the Annual Regulations for 2016. There was only one respondent, who did not suggest any changes. The Road Traffic Committee has brought this latest version to Chief Pleas to keep it informed prior to its introduction for 2017. Letters informing tractor owners of any changes to their allocated codes will be sent out by the end of October this year.

Road Traffic Committee Tractor Licencing Code

Definitions

A. AGRICULTURE, HORTICULTURE AND GARDEN MAINTAINANCE To include the transport of all agricultural, horticultural and gardening machinery, implements, tools, livestock, meat, fodder, water, crops, fertiliser, compost, seeds, plants, timber, fencing equipment and equipment for arboreal work.

B. BUILDING CONTRACTORS (PLUMBING. ELECTRICAL BUILDING)

To include the transportation of all building materials involved in plumbing, electrical, decorating and construction works to include ladders, scaffolding, removal of waste rubble and disposal of same.

C. CHARITABLE EVENTS

The transportation of paraphernalia related to recognised charitable events, for no monetary gain.

D. DISTRIBUTORS (FUEL SHOPS AND WHOLESALE)

D(1) FUEL The transportation for distribution to customers of solid and liquid fuels, bottled gas and lubricants and collection from Harbours. This included H(1) access. D(2) SHOPS AND WHOLESALERS The transportation of goods and supplies for the sole use of your business and delivery to customers of goods purchased from your business. This included H(1) access.

E. EVENT SERVICE PROVIDERS

The transportation of marquees, flooring, toilets, sound systems, matting, generators, catering and related equipment, for reward.

F. FISHERMEN, 12 AND UNDER CHARTER BOATS

F(1) FISHERMEN The transportation of boats subject to time restrictions H(2C), related equipment, fuel, mooring equipment, catches to and from Harbours and distribution of said catches to customers.

F(2) 12 and UNDER CHARTER BOATS The transportation of essentials to and from the harbours.

G. GENERAL CARTING

The service of carting to and from the Harbours includes (H(1)(2)) and distribution round the Island shipping containers, commodities, cargo, luggage, supplies, parcels and boats for reward.

H(m) MASELINE HARBOUR H(c) CREUX HARBOUR H(1) (m),(c) To collect and deliver goods, luggage and cargo from scheduled passenger, cargo boats and licensed charter boats. H(2)(c) The launching and retrieval of a boat before 0800 and after 1830 Monday to Saturday inclusive. At all other times with the ad hoc permission of the Constable and Harbour Master.

I. HOTELS/GUEST HOUSES/SELF CATERING

The carting of goods, supplies, luggage for the sole use of the business.

J. MAIL

Delivery of mail to and from the Post Office this includes H(1) (m) & (c)

K. HARBOUR HILL (1) Bus service by licenced operatives (2) Access to Public Works Quarry and Half Way Quarry (3) The collection / delivery of trailers to / from the Trailer Park (4) The maintenance of Tenement Land on Harbour Hill NOTE No tractor is permitted to be parked or left unattended on Harbour Hill between the Power Station and the bottom Apron

between Maseline and Creux Harbour Tunnels at any time except for holders of H (m),(c) codes legitimately attending a cargo or passenger boat. Except for those permitted to legitimately attend cargo or passenger boats NOT to descend or ascend Harbour Hill one hour before or half hour after scheduled sailings of said boats.

L. UTILITIES

(1) The maintenance of the Electricity Supply System by an authorised supplier and includes automatic permission to carry out emergency and / or safety works outside permitted hours. (2) The maintenance of Telecoms Systems by an authorised supplier and includes automatic permission to carry out emergency and / or safety works outside permitted hours.

M. MECHANICAL ENGINEERING

To include the transportation of engineering tools, materials and equipment for the repair to machinery. This grants access to the Harbours for repairs to Boats.

N. MISCELLANEOUS

(1) Undertakers. The transportation of coffins, monumental masonry and associated tools. This included H(1) access. (2) Veterinary and Farrier Services. For the carrying of one Farrier or two Veterinary Officials and their equipment round the Island. This grants permission when required to transport these persons and equipment to and from the Harbours.

O. SARK EMERGENCY SERVICES

For tractors which are usually used by the Fire Service, Doctor, Ambulance Service, Constables, all restrictions are lifted, except for the safety of operatives and public, when on service call. (Please ensure insurance policy covers this.)

SPECIAL PERMISSIONS Prior permission can be obtained from the Constable to temporarily allow, on an ad hoc basis, the use of a tractor which has not been granted a specific definition; but only at the Constables discretion.

Definitions

A. Agriculture (To include the transportation of all classes of agricultural crops, livestock, meat, farm implements, tools, water, fodder, fertilizer, seeds, timber and fencing)

B. Contractors (1) Plumbing

(To include the transportation of all plumbing materials, boilers, sanitary ware, tanks, tools, equipment and related items)

(2) Electrical (To include the transportation of all electrical materials, cables, equipment, tools, ladders, and aerials)

(3) Building (To include the transportation of all building materials, equipment, tools, ladders, scaffolding, decorating materials, spoil rubble, demolished buildings and the disposal of associated waste)

(4) Mechanical Engineering (To include the transportation of engineering materials, equipment and tools)

C. Charitable events (The transportation of charity related paraphernalia for no monetary gain to the owner)

D. Distributors (1) Fuel

(The distribution and collection of solid fuel, heating oil, diesel, petrol, lubricants and bottled gas for distribution to customers)

(2) Shops (The carting of goods, supplies for the sole use of your business and the delivery to customers of goods purchased from your business)

E. Event Service Providers (The transportation of marquees, flooring, toilets, tables, chairs, refrigerators, matting, generators, sound systems and related equipment)

F. Boat Operators (1) Fishermen

(The delivery of wet and shellfish to customers and the transportation of fuel, bait, pots, nets, rope, other fishing gear, moorings, equipment and boats)

(2) 12 and Under Charter Boats G. Garden Maintenance and Tree Surgery.

(To include: the transportation of mowers, garden machinery, related equipment, cut grass, hedge cuttings/trimmings, compost and composting materials. Also ladders, ropes, saws, related equipment and tools, cut branches and timber, and the delivery of logs to customers)

H. Horticulture (To include the transport of all classes of horticultural crops, implements and tools, fertiliser, compost, seeds and plants)

I. Hoteliers (The carting of goods, supplies, luggage for the sole use of the business)

J. General Carting (The service of carting commodities, cargo, supplies, luggage, parcels, transport/shipping containers, boats to and from the harbour and around the island for reward)

K. Access to Maseline Harbour (1) To collect/deliver luggage/supplies/cargo to/from scheduled

passenger boats (2) To collect/deliver luggage/supplies/cargo to/from chartered

passenger boats (3) To collect/deliver supplies/cargo to/from scheduled cargo boats (4) To collect/deliver supplies/cargo to/from chartered cargo boats (5) The launching/retrieval of a boat by crane with prior permission from

the Constable

Notes: 1. No tractor is allowed to park on the Harbour Hill from the Power Station or bottom apron between the Maseline and Creux tunnels and be left unattended at any time, with the exception of K.(3) & K.(4) holders legitimately attending a cargo boat.

2. Unless issued F., O.(1), K.(1), L.(1) or N. Not to attempt to descend the harbour hill 1 hour before and ½ hour after any scheduled sailing of either passenger or, unless issued K.(3), cargo vessels.

P. Utilities (1) The collection of fuel for the use of the power station and

maintenance of the power supply. (2) The maintenance of the telephone system by a regulated supplier.

Notes: 1. This definition incorporates K.(1) & L.(1) so that the Officials can be collected/delivered directly, in order to maximise their time on the island.

S. Sark Emergency Services For tractors which are normally used by: the Sark fire and Rescue Service; the Constables; the Doctor; The Ambulance services. (All restrictions except for the safe operation of the tractor are removed when the tractor is under the control of an on-duty member of the above Services)

Notes: 1. please ensure your tractor has sufficient insurance to cover this condition.

HARBOURS AND PILOTAGE COMMITTEE

Information Report to the Extraordinary Chief Pleas, 25th August 2016

REPAIRS TO CREUX HARBOUR

Part of the responsibility of the Harbours and Pilotage Committee is the maintenance of the Harbours, and this year the exterior wall of the Creux Harbour was identified as needing attention, (the usual raking-out and pointing). To achieve this, the Committee employed two experienced men for the work. After the first day the Committee met with the men who in turn provided it with a comprehensive report including photographs of serious damage to an area of the exterior wall. It became obvious to the Committee that prompt emergency work needed to be carried out to avoid serious long term damage to a much larger part of the wall. The advice of a Guernsey States Engineer has been obtained on the most cost effective method to do this work and the best material to be used. The Committee is confident that the work can be done by its small workforce as soon as the tidal conditions allow, and within the budget for Harbour repairs.
