Tree FarmIn May 2001, Stockade Nursery purchased the (related) business of Buthurra Tropical Trees Pty Ltd, based on an 80 hectare property in Mackay, Central Queensland and assimilated it into the mother company. This acquisition provides Stockade Nursery with a strong presence in the super-advanced in-ground tree market, and we can now provide a complete size range of plant material to the landscape market.

The first nursery pad was constructed at Buthurra in December 2001 which gave us some space to produce 1,500 by 45 litre bag-stock in the slightly warmer climate and a springboard to service the North Queensland market with bag-stock as well as ex-ground trees. Today we have 5 pads completed enabling us a 7,000 container stock capacity.

There is sufficient room for further expansion of our facilities and production capacity for the next few years. We have

completed construction of a shade house for the production of

our tropical range - the first of many.

Never lift or carry the tree by the trunkWhen unloading or moving a tree, care must be taken to prevent serious damage. Use an appropriate wide sling under the basket to carry the weight of the tree. Use the lifting eyes on the basket to adjust the root ball to the final position once the root ball has been lowered into the ground. The addition of a ‘choker’ around the trunk restricts the tree wanting to tilt. Use the assistance of another person to prevent swing.

When planting a tree, the root ball must be left above the original ground level to allow for settling. The strapping and hessian is to be

removed from around the trunk. The top ring of the basket may be cut off below ground level, leaving the rest of

the basket in the ground.

Don’t forget to back fill properly and guy the tree to support if necessary, to assist its establishment.

Root balls will usually sit slightly proud of the top horizontal wires shown. Weights are a guide only and vary with moisture content, tree size and species.

Brown Pines can tolerate mild frost. Soil type: can grow in a variety of soils as long as water is available.

Tabebuia aureaExotic: of Brazil and Argentina coming from the dry highlands.Dimensions: small tree to 6m.Flower: are bright yellow trumpet shape in clusters.Flower season: profuse display in spring.Fruit: a capsule that splits open.Uses: semi deciduous with a wonderful cork textured bark. They make an excellent ‘ impact specimen tree ’.Soil type: moist and well drained.

Washingtonia robustaCotton PalmExotic: from north-western Mexico.Dimensions: tall palm to 20m over a very long time.Flower: cream colour sprays.Flower season: summer.Uses: will grow from Melbourne through to the tropics, excellent avenue, park, specimen tree and along driveways. Has been used as large containerised specimen in city areas.Soil type: tolerates a wide range of well-drained soils.

Waterhousia floribundaWeeping LillypillyNative: fringing rainforest in northern NSW and QLD.Dimensions: evergreen tree 15-30m but can be kept smaller in cultivation.Flowers: small white fragrant flowers.Flower season: spring to summer.Fruit: green berries to 13mm.Uses: graceful evergreen with a drooping habit, can be used as park trees, street trees, large screen or hedge.Soil type: most soils and often found near watercourses.

Ficus macrophylla Moreton Bay FigNative: along the east coast of Australia from the Atherton Tablelands to southern New South Wales.Dimensions: tall spreading tree to 30m.Flower: insignificant.Fruit: edible brown berries.Uses: large tree for parks or large avenue plantings.Soil types: moist well drained soils and tolerates saline soils.

Aloe barberaeTree AloeExotic: from South Africa.Dimensions: in the wild it can reach 18m, in cultivation often as wide as it is tall.Flower: orange pink flowers.Flower season: autumn and winter.Uses: a striking specimen plant similar to the native pandanus in habit, used as a containerised plant or planted into the ground. The outstanding long green leaves make it a feature.Soil type: adaptable to most soil types and tolerates drier conditions.

INTERPRETATION1. In these conditions: A. “Stockade Nursery” means Stockade Nursery Pty Ltd ACN 010 688 356 of 70 Wades Rd,Bellmere QLD 4510,

which is the seller of the goods. B. “Purchaser” means the purchaser of the goods specified in the credit application or invoice as the case may be. C. “Goods” means the products and, if any, services provided to the purchaser from time to time. D. Nothing in these conditions shall be read or applied so as to exclude, restrict or modify or have the effect of

excluding, restricting, or modifying any condition, warranty, guarantee, right or remedy implied by law (Section 74H, of the Trade Practices Act Cth 1974) and which by law cannot be excluded, restricted or modified.

2. These conditions (which shall only be waived or varied in writing signed by Stockade Nursery) shall prevail over all conditions of the purchaser’s order to the extent of any inconsistency.

TERMS OF SALE3. The goods sold by Stockade Nursery are sold or provided on these terms and conditions.STOCKADE NURSERY QUOTATIONS4. Unless previously withdrawn, Stockade Nursery quotations are open for acceptance within the period stated or, where

no period is stated, within seven (7) days after the receipt of the quotation.SHORTAGE5. The purchaser waives any claim for shortage of any goods delivered if a claim in that regard has not been lodged

with Stockade Nursery within seven (7) days from the date of receipt of the goods by the purchaser, or its agent.SPECIFICATIONS6. (I) All specifications, drawings and particulars of weights or dimensions submitted by Stockade Nursery are

approximate only and any deviation shall not be taken to vitiate any contract with Stockade Nursery or form grounds for any claim against Stockade Nursery.

(ii) The descriptions, illustrations and performances contained in catalogues, price lists and other advertising matter do not form part of the Contract of Sale of the goods. Where specifications, drawings or other particulars are supplied by the purchaser, Stockade Nursery price is made on estimates of quantities required. Should there be any adjustments in quantities above or below the quantities estimated by Stockade Nursery and set out in the quotation, then any such increase or decrease shall be adjusted on a unit rate basis according to unit prices set out.

DELIVERY7. Stockade Nursery will not be liable for late delivery or non delivery of goods sold and under no circumstances will

Stockade Nursery be liable for any loss, damage or delay occasioned to the purchaser or its customers arising from late or non delivery or late installation of the goods.

LOSS OR DAMAGE IN TRANSIT8. (I) Stockade Nursery is not responsible for any loss or damage to goods in transit. (ii) Stockade Nursery will render the purchaser such assistance as may be necessary to press claims on carriers

providing the purchaser has notified Stockade Nursery and the carriers in writing immediately the loss or damage is discovered on receipt of goods and will lodge a claim with the carrier within three days of the date of receipt of the goods.

GUARANTEE9. (i) Except as provided herein, all express and implied warranties, guaranties and conditions under statute or

general law as to merchantability, description, quality, suitability or fitness of the goods for any purpose or as to design, assembly, installation, materials or workmanship or otherwise are expressly excluded.

(ii) Stockade Nursery will not be liable for physical injury, loss or damage or for consequential loss or damage of any kind arising out of the supply, layout, assembly, installation or operation of the goods arising out of Stockade Nursery’ negligence or in any way whatsoever.

(iii) Stockade Nursery’ liability for breach of a condition or warranty implied by division 2 of part V of the Trade Practices Act 1974 (other than section 69) is hereby limited to:

(i) In the case of goods, any one or more of the following: (a) The replacement of the goods or the supply of equivalent goods; (b) The repair of the goods; (c) The payment of the cost of replacing the goods or of acquiring equivalent goods; (d) The payment of the cost of having the goods repaired; or (ii) In the case of services the supply of the services again; or (a) The payment of the cost of having the services supplied again.

10. Stockade Nursery’ liability under section 74H of the Trade Practices Act 1974 is expressly limited to a liability to pay to the purchaser an amount equal to:

(i) The cost of replacing the goods; (ii) The cost of obtaining equivalent goods; (iii) The cost of having the goods repaired, whichever is the lesser amount.PRICES11. Unless otherwise stated, all prices quoted by Stockade Nursery will include a component for the Goods and Services Tax.PAYMENT12. (I) The purchase price in relation to goods will be payable on or before the 30th day of the month, next following

the delivery of the goods unless other terms of payment are expressly stated here in writing. (ii) Interest on overdue accounts shall be chargeable at the rate of 12% per annum (and compounded three

monthly) from the date of each invoice to payment. Any failure on the part of Stockade Nursery to insist or require payment of interest on any outstanding account will not constitute a waiver of its rights to subsequently require payment of interest on that, or any other account.

RETENTION OF TITLE CLAUSE13. (a) Stockade Nursery reserves the following rights in relation to the goods until all accounts owed by the

purchaser to Stockade Nursery are fully paid: (i) Legal ownership of the goods; (ii) To enter the purchaser’s premises (or the premises of any customer, associated company or agent

where the goods are located) without liability for trespass or any resulting damage and re-take possession of the goods; and

(iii) To keep or re-sell any goods repossessed pursuant to (ii) above. (b) If the goods are re-sold, or goods manufactured using the goods are sold by the purchaser, the purchaser will

hold such part of the proceeds of any such sale as represents the invoice price of the goods sold or used in the manufacture of the goods sold in a separate identifiable account as the beneficial property of Stockade Nursery and will pay such amount to Stockade Nursery upon request.

(c) Notwithstanding the provisions above, Stockade Nursery will be entitled to maintain an action against the purchaser for the full purchase price and the risk of the goods will pass to the purchaser upon delivery.

PURCHASER’S PROPERTY14. Any property of the purchaser under Stockade Nursery’ custody or control will be entirely at the purchaser’s risk as

regards loss or damage caused to the property or by it.RETURNED GOODS15. Stockade Nursery will not be under any obligation to accept goods returned by the purchaser and will do so only on

terms to be agreed in writing in each individual case.GOODS SOLD16. All goods to be supplied by Stockade Nursery will be as described on the purchase order agreed by Stockade

Nursery and the purchaser and the description on the purchase will prevail over all other descriptions.CANCELLATION17. No order may be cancelled except with the consent in writing and on terms which will indemnify Stockade Nursery

against all losses.PLACE OF CONTRACT18. The contract for sale of goods is made in the State of Queensland and the parties agree to submit all disputes arising

between them to the Brisbane Registry of any such Court as is competent to hear the matter.SEVERABILITY19. If any provision of this document is unenforceable in accordance with its terms, any provisions which are self

sustaining are, and continue to be, enforceable in accordance with their terms.
