OFFICER INTEREST DECLARATION Nil PURPOSE To consider proposed Scheme Amendment No.4 to: 1. Rezone Pt Lot 1022, Reserve No. 33549, Pt Lot 432, Lot 938 and Pts unallocated
Crown Land as depicted on the Amendment Map from “Tourist” zone and “Parks and Recreation Reserve” to Special Use Zone SU8;
2. Amend Schedule 4 – Special Use Zone provision to include appropriate conditions
for SU8; and 3. Amend the Scheme Maps accordingly. The Special Use zone is to provide land for a Caravan Park and associated land uses. BACKGROUND On 17 February 2009 Council resolved to require Shire officers, together with the then Lancelin Ward Councillors, to identify land for a new caravan park of sufficient size to be developed to a minimum of 200 bays. In accordance with Council’s resolution, an area of land comprising Part Lot 1022, Reserve No. 33549, Part Lot 432, Lot 938 and portions of unallocated Crown land on Hopkins Street, Lancelin were identified for the required purpose.

ORDINARY MEETING AGENDA 17/03/2015 SHIRE OF GINGIN Subsequently, at its meeting of 7 April 2009, Council resolved to progress a caravan park on the subject land and requested the then Department for Planning and Infrastructure to assist in progressing the matter as the land identified was primarily unallocated Crown Land. On 27 August 2010 the Department of Regional Development and Lands (DRDL) sought assistance from the Shire in undertaking community consultation with respect to the proposal to develop the subject area for tourism purposes. Following a 35 day non statutory public notice period, submissions were forwarded to the DRDL for consideration. During the public submission period, a public meeting was held in Lancelin which was attended by community members, Councillors and Shire and State Government Officers. At the conclusion of the public consultation period, it became apparent that there was general support for the proposal. However, certain concerns were raised including: • Loss of public access tracks to the beach; • Loss of amenity presently experienced by Casserley Way residents; • Increased local traffic; • Destruction of vegetation; and • Concerns in relation to coastal setbacks. Over the intervening period, Tourism WA engaged consultants to undertake various technical studies to demonstrate the opportunities and constraints at the site with respect to the development, including the following reports: • Demand and Pre-feasibility Report, Brighthouse Pty Ltd, June 2011 • Landvision Pty Ltd, Lancelin Caravan Park Traffic Study, June 2014 • Lancelin Tourist Park, Water Management Plan, prepared for Tourism Western

May 2014 • GHD Flora and Fauna Assessment December 2014 The Demand and Pre-Feasibility study concluded that it is considered that the only barrier to Lancelin developing into a significant tourism destination is the lack of tourism infrastructure, particularly caravan and camping facilities which meet the accommodation requirements of Lancelin visitors. In addition to the studies commissioned by Tourism WA, a Caravan and Camping Action Plan 2013-18 was developed from the findings of a study undertaken by Brighthouse Consultants – A Strategic Approach to Caravanning and Camping Tourism in WA (2013), which recommended that up to five new Crown Land caravan park sites be released in areas of extreme priority, with Lancelin being identified as one of these priority locations.

A copy of correspondence from Tourism WA is attached as Appendix 2. The Scheme Amendment has been referred to the Environmental Protection Authority who did not assess the Proposal but provided advice at Appendix 3. The proposal was advertised for public comment commencing on 17 December 2014 and closing on 29 January 2015, and is returned to Council for consideration before forwarding the proposal to the Hon. Minister for Planning for final approval, with or without modification or refusal. COMMENT Design The subject area consists of four separate land parcels with a total area of approximately 10ha, and is bounded by Casserley Way and Hopkins Street to the north and the existing Lancelin South End Caravan Park and a Water Corporation reserve with tank to the west. Of the four parcels, Lot 1023 is owned by Council in freehold title and will be included in the development footprint but is not the subject of this scheme amendment. Lot 1023 is presently zoned Tourist. Lot 1022 (Reserve 22549) includes a portion of land being leased to the Lancelin Angling and Aquatic Club Inc (LAAC) and the balance of land subject to the proposal is Unallocated Crown land (UCL). With the exception of that area used by the LAAC, the land is vacant and undeveloped but does contain several access tracks which give public access from residential land to the beach. The Lancelin South End Caravan Park to the west of the subject land is currently leased until 2016. The Shire of Gingin understands that potential opportunities may arise when the lease expires, including the potential to amalgamate the leased land with the area that is subject to this proposal.

ORDINARY MEETING AGENDA 17/03/2015 SHIRE OF GINGIN Landform Research has identified that generally the site has an elevation of around 1.0m Australian Height Datum (AHD), with some swales dropping to an elevation of 0.3m to 0.6m AHD. Adjacent to the coastal dunes in the south of the site, the land rises to heights varying between 2.0 and 5.0m AHD, rising again to a height of 10.0m and 15.0mAHD on the fore dune and first dune adjacent the beach. The dune areas are mainly located within the coastal reserve, but extend into the proposed Scheme Amendment area in the south and east. The site is relatively low lying and therefore fill and cut or fill works will be required to achieve a minimum 0.5 separation between ground water level and development and to provide a relatively flat development site. The Scheme Amendment documentation is designed to ensure that the land remains as a Caravan Park in perpetuity by identifying the area as a Special Use zone as opposed to a Tourist Zone which has historically resulted in Caravan Parks evolving to higher end land uses. The proposed land uses include camping, chalets, holiday accommodation, manager’s dwelling, caravan sites and eco-safari tents. The present Indicative Development Concept Plan (IDCP) shows up to 280 sites, with Stage One providing 171 sites. The breakdown of product is listed below; • 127 caravan sites; • 32 ensuite cabins; • 32 camp sites; • 9 safari tent sites; • 15 drive through sites; • 26 chalet sites; • 39 park home sites; • Ablution facilities; • 3.5ha open space and recreational facilities (BBQ’s, tennis court, pool and mini golf
course); and • 5ha foreshore reserve The IDCP includes the potential for boat storage facilities on part of the leased area, and Brighthouse Pty Ltd have discussed this possibility with the LAAC. The Lancelin Tourist Park - Coastal Management Plan prepared by Essential Environmental considers and provides for sea level rise, storm surges and inundation projections for the development site and provides a risk assessment for the proposal. The risk assessment identifies certain issues at the site which should be addressed by the proponent at the development stage, including: 1. Setback for permanent infrastructure no less than 150m (foreshore reserve
boundary); 2. Floor levels in buildings and design of infrastructure should consider site specific risk
of flooding; 3. Controlled access to the beach required through restricting access to the foreshore
via managed access points;

ORDINARY MEETING AGENDA 17/03/2015 SHIRE OF GINGIN 4. Low lying areas should be filled and/or provided with adequate drainage to address
shallow groundwater and possible sea level rise of 0.3m; 5. Development within the tourist park should be set to provide clearance from
predicted storm surge levels over the life of the development; 6. A stormwater management strategy should be prepared for the tourist park to
identify rainfall flood risk and management actions; 7. Allowance for appropriate public access paths and implementation of a Foreshore
Management Plan; and 8. Development should be designed to address potential visual impacts. Risks have been analysed by dedicating a qualitative measure of likelihood, and the consultant recommends that both the risk assessment and outcomes be reviewed every five to ten years. The responses to the risk assessment have been included in the Special Use Conditions as a component of the Scheme Amendment proposal. (Note that Appendix 1 of the Coastal Management Plan does not relate to the subject land and in the Shire Officer’s opinion has no relevance.) The Coastal Management Plan includes setback calculations for coastal erosion in two planning time frames. The analysis indicates a setback distance of 80m for the 50 year period to 2063, and an increased setback of 150m for the subsequent 47 year period to 2110. It is clear that the site will become more vulnerable in 2110 and the Plan suggests that the area at risk to the south of the subject land is included as a temporary development area and that the dune system to the north west of the site be preserved with controlled access. It is noted, however, that the life of the development is estimated to be approximately 50 years. The frontal dune provides protection to the landward environment by forming a barrier to wind, associated sediment transport and inundation that would otherwise result during high ocean water levels and wave activity (Damara 2012). The Plan further refers to Cell 14 (within which the subject site is situated) and notes that construction on the foredune, frontal dunes and historic blowouts on any section of this coast (>100m) is highly likely to be affected by the vulnerability of this part of the coast to metocaean processes. This is demonstrated by historic fluctuations in dune and blowout activity, which has reduced since the 1960s. Essential Environmental (2015) Principal Shelley Sheppard, comments that the development site is located at the northern end of Cell 14 and is not directly connected to the southern sand sheet. It is therefore unlikely that development of the site would contribute significantly to the risk above. Notwithstanding, the statement highlights the importance of active management and possible interventions by way of revegetation and careful control and design of access points to stabilise foredunes and existing blowouts.

ORDINARY MEETING AGENDA 17/03/2015 SHIRE OF GINGIN Community Consultation At its meeting on 16 September 2014, Council resolved to initiate Amendment 4 to Local Planning Scheme No. 8 and, in accordance with the Town Planning Regulations 1967, commence public notice. A public notice period of 42 days was allowed, closing on 29 January 2015. A total of 212 submissions were received at the close of the public submission period. Of that total, 61 submissions supported the proposal and 140 were opposed. The balance was represented by comment only/State Government agencies

ORDINARY MEETING AGENDA 17/03/2015 SHIRE OF GINGIN Submitters who did not support the proposal demonstrated concern for: • Natural environment including flora, fauna and habitat loss; • Preservation of the dune system; • Residential amenity disturbance created through additional noise and traffic; • Loss of views of bushland; • Site selection; and • Perception that Lancelin already has two caravan parks and Council has not
considered those sites by allocating land for another caravan park.
The concerns of the community, as identified in the Schedule of Submissions (Appendix 4 – circulated as a separate document), are generally the same as those raised in the Level One Community Consultation Phase (2010).
Comments received from supporting submitters related primarily to:
• The economic benefits to Lancelin; • The importance of tourist land uses in the town; • Current lack of short stay sites in Lancelin available for caravans; and • Promotion of Lancelin as a tourist destination. The public submission process identified disparities amongst submitters, in that the general trend identified that the majority of submitters living in Lancelin support the proposal whilst the majority of those submitters opposing the proposal are ratepayers with mailing addresses outside the Shire of Gingin, or non-ratepayers. Nevertheless, regardless of this fact the majority of submitters raised some concern in relation to the proposal.
In accordance with the Town Planning Regulations 1967, the Schedule of Submissions includes only those submissions received on Form 4. The following table indicates the submissions received that fall outside of the formal submission process specified by the Town Planning Regulations 1967. Servicing Porter Consulting Engineers conducted a Servicing Report for the land in December 2013. That report concluded that: i. The tracks on the site should be closed however some form of public access
provided to the coast; ii. A water main and fire service will be required and most likely connect in at Casserly
Way; iii. An upgrade of the adjacent waste water pumping station may be required to 90L/s
and this would be undertaken by the Water Corporation; iv. Detailed design is required for power however the development can connect into the
RGN 604 Lancelin Feeder; v. The site is poorly drained with the lowest part of the site in the north west corner with
water generally flowing east to west across the site; vi. There are existing telecommunication services in Lancelin; and vii. The site will need to be excavated and levelled before construction can begin with
one way roads throughout the site. The development will be serviced by both reticulated water and power. Porter Consulting has confirmed that compaction and fill at the site would not result in elevating ground water levels in the vicinity.

ORDINARY MEETING AGENDA 17/03/2015 SHIRE OF GINGIN A Traffic Study prepared by GHD Pty Ltd considered the present road infrastructure, having regard for the increase in road use to the site. That report commented that whilst traffic flows will markedly increase in the area, such increase does not exceed the thresholds as determined for road type in the Western Australian Planning Commission’s Liveable Neighbourhoods Policy. Further line marking and a Give Way sign would be required at the Hopkins Street/Casserley Way intersection, as well as signage requiring traffic to use Walker Avenue and Hopkins Street as the primary access and egress route. Further engineering and geotechnical information and assessment will be required at the development stage. Planning Assessment The Shire’s Local Planning Strategy 2012 (LPS) states an objective to recognise, promote and continue to accommodate the tourism value of Lancelin. The Policy Position and Actions section includes the following as a high priority: 7. Recognise Tourism and the Tourist Activity Nodes by;
i) Investigating and facilitating the development a of a suitable caravan park site, including rezoning. Crown Land may be the most suitable for a caravan park site, taking advantage of the increased certainty of land offered by such land tenure in comparison with freehold land.
A key issue is also the protection/rehabilitation of coastal dune systems. The LPS states that the coastal environment is very fragile and will continue to be subject to conflicting demands. In accordance with this key issue, it is considered appropriate to require a new Detailed Area Plan (DAP) for the site which will be required to demonstrate a high regard for the preservation of the dune system. This will include a Foreshore Management Plan, an objective of which will be to preserve and rehabilitate a defined foreshore reserve. The Plan will include the prevention of uncontrolled access to the beach and the establishment and maintenance of formal access tracks. Retaining the dune system will also assist in preserving coastal views by retaining of ridge lines. Prior to the public consultation period, the proposal was forwarded to the Environmental Protection Authority (EPA) for consideration of a level of assessment. The EPA elected not to assess the proposal but provided advice including the following: The EPA has based its assessment on the Scheme Amendment to provide for further detailed management strategies and scheme provisions addressing environmental factors such as Coastal Processes, Terrestrial Fauna, landforms, Terrestrial Environmental Quality, Hydrological Processes and Inland Waters Environmental Quality and will be addressed prior to the finalisation of the structure plan….

ORDINARY MEETING AGENDA 17/03/2015 SHIRE OF GINGIN It is expected that environmental factors will be adequately managed, where appropriate, through detailed planning process and in consultation with the Department of Parks and Wildlife, Department of Water and other relevant agencies. The EPA notes that the Indicative Concept Plan for the Lancelin Tourist Park, dated 24/6/14, has a 130-150metre setback from the coast to the development. The 130m metre setback area may be inconsistent with the State Planning Policy 2.6 Coastal Planning Policy. The EPA recommends that the setback be determined to the satisfaction of the Western Australian Planning Commission. The Scheme Amendment provides for management actions to ensure that the environmental values of the site are considered and includes further details to be provided, including: 1. Coastal Management Strategy; 2. Water Management Plan; 3. Foreshore Management Plan; 4. Flora and fauna detailed studies; 5. Viewscapes; 6. Notification on title in respect of potential coastal hazard risk; 7. Fire management plan; 8. Construction management plan; 9. Groundwater management; 10. Flood protection; 11. Storm water management; 12. Water quality management; and 13. Wastewater and drinking water. A Level One Flora Survey, conducted by GHD Pty Ltd (Dec 2014), demonstrates that the native vegetation on the site varies from Very Good (21%) to Degraded. The Report notes that the main threatening processes onsite are the presence of weeds and access tracks enabling wind erosion in the mobile dunes. The field survey confirmed that no threatened ecological communities or priority communities exist within the study area. The site recorded 60% native flora and 40% introduced species. Further, the report states that the vegetation and flora are well represented in the local area and surrounding region. During the field survey conducted and reported by GHD Pty Ltd, no conservation significant fauna species were recorded in the study area. A Likelihood of Occurrence Assessment was conducted which concluded that although four conservation significant fauna species are likely to occur in the area, including the Lancelin Island Skink, Black Striped Snake, Carpet Python and Rainbow Bee Eater, none of these species would rely on the existing habitat for habitat resources.

ORDINARY MEETING AGENDA 17/03/2015 SHIRE OF GINGIN Given the vulnerable status of the Lancelin Island Skink, a targeted survey was undertaken over a ten day trapping period in February 2015 in consultation with Department of Parks and Wildlife and it has been confirmed that the species does not exist in the area due to incompatible habitat. The public notice period raised concerns from members of the public who currently have unfettered access to the UCL and ratepayers living near the subject area in relation to increased noise, traffic, loss of privacy and loss of general amenity and access. The land sits adjacent to Tourist Zone land and the coast, and there are competing values between residential use and the perceived impacts from a caravan park. Good management of the caravan park would be required to limit noise from the site. A new DAP would be required to include the interface of the development frontage with the streetscape, including a landscaping plan and limiting vehicles on street frontage by utilising a rear loading design. The DAP will be subject to further consideration by Council and a public notice period in accordance with the Shire’s LPS No.9. If the Scheme Amendment is approved, then it is conceivable that the land uses would generally be permitted in the special use area. Issues raised in submissions with respect to amenity disturbance during construction would be addressed in the Construction Management Plan. Shire Officers are of the view that the proposed Indicative Development Concept Plan (IDCP) is not appropriate and that Council should require a DAP to be submitted at the development application stage. CONCLUSION The proposed Scheme Amendment generally meets objectives identified in the Shire of Gingin Strategic Community Plan and the Shire’s Local Planning Strategy No. 9. Strategically, the site is well located to provide a good tourist outcome. The proposal offers many social and economic benefits to the town of Lancelin and the State, although the development must be designed to accommodate the coastal environment and have regard, through design principles, for the adjacent residential zone. The public submission process has resulted in a very good response and has assisted in identifying issues and opportunities at the site. The primary concerns raised relate to impacts to residential amenity and the desire for preservation of the coastal environment at this location. Support for the proposal is based on the social and economic contributions the tourist development would bring to Lancelin. The technical reports attached to the Scheme Amendment identify the constraints at the site and make recommendations to manage those constraints. Further, the EPA is of the view that environmental matters can be sufficiently managed subject to the required management plans, as identified in the Special Use conditions. The Officer’s recommendation acknowledges that the site should be developed subject to the requirements of the Special Use conditions and, in response to the public submissions received, suggests modification to the proposal as follows:

the south east portion of the site.
Removal of this area will prevent development on the system and retain the integrity of the dune to provide shelter to the development and residences and minimise erosion through development and vegetation loss. Such retention will also assist to improve viewscapes. Alternatively, if Council wishes the whole site to be included in the Scheme Amendment area, then it should preclude or limit development at this location (see Appendix 5).
The potential infrastructure loss incurred if the significant dunes are removed from the Scheme Amendment area as recommended will equate to approximately 9 safari tents, 26 standard van sites, 19 camping sites, 10 ensuite sites and 11 chalets.

Removal of a portion of land from the Scheme Amendment will, according to the Indicative Concept Plan provided, result in a development footprint of approximately 200 various sites. It is conceivable that ultimately the existing Lancelin South End Caravan Park may be amalgamated with this development in the future, thus providing capacity for additional sites.
2. Remove reference to the development being in accordance with the Indicative
Development Concept Plan as included in the Scheme Amendment documentation and require a Detailed Area Plan at the Development Application stage which, at a minimum, includes:
• a landscaping plan along Hopkins Street and Casserley Way; • requirement to consider retaining the primary dune system on the site;
• a requirement for chalets or units facing local streets to be rear loaded;
• provision of an engineering report to demonstrate stabilisation of the site;

• provision of supporting technical information to determine floor levels and fill required, having consideration for potential coastal inundation over the planning timeframe; and

The Detailed Area Plan would be the subject of a further public submission period and would need to be considered by Council in respect of the design elements at the site.
It is noted that, in any event, once Council has made a decision then the proposed Scheme Amendment will need to be forwarded to the Minister for Planning for final consideration in accordance with requirements of the Planning and Development Act 2005. BACKGROUND The Shire of Gingin has conducted each local government election since 2001 as a postal election. Analysis of statistics received from the Western Australian Electoral Commission (WAEC) has shown that the proportion of voter participation via postal voting is consistently greater than that generated by traditional “in person” voting. The Shire of Gingin Election Report provided by the Western Australian Electoral Commission following the last elections showed that, in 2013, the Shire of Gingin had a participation rate of 36.59%. The State average for local governments using the postal voting method in 2013 was 27.76%. Section 4.61(2) of the Local Government Act 1995 empowers a local government to conduct an election as a postal election. Postal elections must be conducted by the Western Australian Electoral Commissioner. The Local Government Act 1995 (section 4.20(5)) specifies that Council must make a decision with respect to appointing the Electoral Commissioner as the person responsible for conducting the election no later than 80 days prior to election day. The 2015 local government elections will be conducted on 17 October 2015. COMMENT Correspondence has been received from the Electoral Commissioner, advising that the estimated cost of conducting the 2015 Shire of Gingin local government elections as a postal ballot is $23,000 (GST inclusive). This figure is based on the following assumed parameters:

The WAEC’s estimate does not include costs related to: • Non-statutory advertising (ie, any additional advertising in community newspapers
and promotional advertising); • Any legal expenses other than those that are determined to be borne by the WAEC
in a Court of Disputed Returns; • One local government staff member to work in the polling place on election day; or • Any additional postage rate increases by Australia Post. Section 4.20(4) of the Local Government Act 1995 requires that a local government must obtain the agreement of the Electoral Commission before resolving to declare the Commission responsible for the conduct of an election. In order to satisfy this legislative requirement, the Commissioner has also confirmed that the letter of quotation is to be taken as his agreement to be responsible for the conduct of the ordinary elections in 2015 for the Shire of Gingin. 3. Direct Shire officers to give no assistance in any form to candidates unless

BACKGROUND At its meeting on 16 December 2014, Council resolved to adopt the proposed Shire of Gingin Bush Fire Brigades Amendment Local Law 2014 for the purpose of advertising, and to give local and state-wide public notice of its intention to make the local law. A notice advising of Council’s intention and of the purpose and effect of the proposed local law was duly published in accordance with s3.12 of the Local Government Act 1995 (the Act), with the required public submission period closing at 4.00pm on Friday, 20 February 2015. COMMENT No public submissions were forthcoming with respect to the proposed Bush Fire Brigades Amendment Local Law 2014. In accordance with the requirements of the Act, a copy of the proposed local law was also submitted to the Minister for Local Government and the Minister for Emergency Services for consideration and a response has subsequently been received from the Department of Local Government recommending a number of amendments. No comment has been received from the Department of Fire and Emergency Services.
Most of the suggested changes relate to formatting and consistency in presentation and terminology. All amendments recommended by the Department are listed in Appendix 1 for Council’s information, together with the Officer’s comments with respect to each. All suggested amendments are supported by Officers and have been incorporated into the Local Law presented for Council’s consideration (Appendix 2). It is not considered that any of the amendments are of sufficient magnitude to require recommencement of the public submission process. In the event that Council resolves to make the local law as presented, the following sequence of events will commence:

Minister for Local Government and the Minister for Emergency Services; 2. After gazettal, local public notice will be given stating the title of the local law, its
purpose and effect (including the date it comes into operation) and advising where copies of the local law may be inspected or obtained; and
3. A copy of the local law, together with an accompanying explanatory memorandum,
will then be submitted to the WA Parliamentary Joint Standing Committee on Delegated Legislation for scrutiny.
The local law will come into effect two weeks after gazettal and the Shire of Gingin Bush Fire Brigades Local Law 2004, which is the principal local law, will be amended to incorporate the changes imposed by the amendment local law. Council should be aware that it is possible that the Joint Standing Committee, after reviewing the local law, may require certain amendments to be made. If this is the case, then the Shire will be required to recommence the process of advertising for public comment, resolving again to make the local law, gazettal and re-submission to the Committee for further consideration. BACKGROUND At its meeting on 16 September 2014, Council resolved to adopt the draft Shire of Gingin Local Emergency Management Arrangements (LEMA). However, further consultation with the Shire’s Local Emergency Management Committee (LEMC) has resulted in a request for the LRP (Appendix 1) to be formalised to complement the existing LEMA. The LRP is a formal plan that is appendixed to the LEMA and its purpose is to set out the roles and responsibilities of key stakeholders, planning for recovery and special considerations (i.e. at-risk groups). It comes into effect when the Local Recovery Committee has been activated as a result of a large scale incident (i.e. fire or flood). The LRP was presented to the Shire of Gingin LEMC on 11 March 2015. The Committee resolved to recommend that the Shire of Gingin Council adopt the Shire of Gingin Draft Local Recovery Plan in its current form and that it form an appendix to the LEMA. COMMENT It is a function of a local government to ensure that effective local emergency management arrangements and associated plans are prepared and maintained for its district to manage recovery following an emergency affecting the community in its district and to perform other functions given to the local government under the Emergency Management Act 2005 (the Act). In accordance with Division 2, Section 41 of the Act, a local government is to ensure that arrangements for emergency management in its district are prepared.

emergency management in the local government district; (c) provisions about the coordination of emergency operations and activities relating
to emergency management performed by the persons mentioned in paragraph (b); (d) a description of emergencies that are likely to occur in the local government
district; (e) strategies and priorities for emergency management in the local government
district; (f) other matters about emergency management in the local government district
prescribed by the regulations; and (g) other matters about emergency management in the local government district the
local government considers appropriate. Once adopted, a local government is to provide a copy of its LRP, and any amendment to the arrangements, to the State Emergency Management Committee (SEMC) as soon as is practicable thereafter. The Plan will become a live document which will be distributed to all Hazard Management Agencies and neighbouring local governments, and made available to the community. Minor amendments will be made to the Plan by the LEMC as and when required. BACKGROUND The subject lot is located in Boonanarring, approximately 8km northwest of the Gingin townsite, and has a direct access to the Brand Highway. The site area is 70.6829ha. The following Planning Approvals have previously been issued to the subject lot: • Aquaculture and Irrigated Horticulture (Wildflowers) – issued on 19 September 1996; • Irrigated Horticulture (Olives and Wildflowers) – issued on 6 September 1999; • Rural Industry (Table Olive Processing Facility) – issued on 22 November 2005; An olive farm and associated olive processing facility have been established on the subject lot by previous land owners. The proponents purchased this property later last year and plan to relocate their processing facility from Geraldton to Gingin. The proponent is applying for Planning Approvals for the following items: • Porch for the existing processing shed (18m x 15m); • Three cabin structures to be used as staff accommodation and amenity units;
• One new bottling shed (31m x 16m) with a porch of (8m x 16m) on the north side; • An additional porch (8m x 12m) to the approved existing reticulation shed on the
north side;

A location plan and a copy of the applicant’s proposal have been provided as Appendix 1. COMMENT Community Consultation This application has been referred to all surrounding landowners for comment for a period of 21 days. One submission was received. The Schedule of Submissions and Recommended Responses is provided at Appendix 2. Planning Assessment The subject lot is zoned General Rural under Local Planning Scheme No. 9 (LPS No. 9). The objectives of the General Rural zone are as follows: (a) manage land use changes so that the specific local rural character of the zone is
maintained or enhanced; (b) encourage and protect broad acre agricultural activities such as grazing and more
intensive agricultural activities such as horticulture as primary uses, with other rural pursuits and rural industries as secondary uses in circumstances where they demonstrate compatibility with the primary use;
(c) maintain and enhance the environmental qualities of the landscape, vegetation, soils
and water bodies, to protect sensitive areas especially the natural valley and watercourse systems from damage; and
(d) provide for the operation and development of existing, future and potential rural land
uses by limiting the introduction of sensitive land uses in the General Rural zone. The definition of Industry - Rural under LPS No. 9 is as follows: (a) an industry handling, treating, processing or packing rural products; or (b) a workshop servicing plant or equipment used for rural purposes; The definition of Staff Accommodation under the LPS No. 9 is as follows: …shared self-contained living accommodation (separate to a single dwelling) used for the accommodation of persons directly employed in an approved activity carried out on the Lot and does not include a Caretakers Dwelling;

The development is well set back from any neighbouring land, with the closest distance between the proposed development and lot boundaries being 55.331m. Council’s Officer is of the view that the proposed development is consistent with the objectives of the General Rural zone and therefore recommends approval subject to conditions. Advice Notes Should Council approve this Application, the following Advice Notes will be added:
A. Further to this approval, the Applicant is required to submit working drawings and
specifications to comply with the requirements of the Building Act 2011 and Health Act 1911 which are to be approved by the Shire of Gingin’s Regulatory Services Department prior to issuing a Building Permit.

OFFICER INTEREST DECLARATION Nil PURPOSE To consider the implementation of further concept design for aged accommodation in Gingin including: 1. Reviewing the current concept design over Lots 60 and 61 Robinson Street, Gingin;
and 2. Providing detailed financial modelling for a staged development. BACKGROUND As Council would be aware, the Charitable Trust over Lot 60 has required a change of purpose to enable the provision of aged accommodation on that site. On 11 December 2014 the Perth Supreme Court considered the Shire’s Application to change the existing purpose of the Charitable Trust over Lot 60 Robinson Street, Gingin. Advice received on 15 January 2015 from the Shire’s legal representatives indicated that the Supreme Court had considered the Shire’s proposal to change the Charitable Trust purpose so that aged persons’ accommodation could be constructed on Lot 60. Lot 61 Robinson Street is the adjacent lot and is owned by the Shire in Freehold Title with no encumbrances. It is intended that Lots 60 and 61 could comprise the area of accommodation. On 17 February 2015, the Gingin Retirement Village Committee met in order to progress the initiative. The purpose of the meeting was to advise the Committee that the Charitable Trust change of purpose has been completed and to consider the next steps forward in the development of a concept design and financial modelling that would provide a framework for the delivery of accommodation on Lots 60 and 61 Robinson Street, Gingin.

ORDINARY MEETING AGENDA 17/03/2015 SHIRE OF GINGIN In this regard the Committee was requested to: 1. Form a holistic view on how it would like to progress the initiative further; and 2. Progress next steps forward.
The change of the Charitable Trust purpose has been a necessary but convoluted and time expensive exercise. Now that the land use purpose of aged persons’ accommodation is secured for Lot 60, further concept development for Lots 60 and 61 can now be investigated, including financial modelling. Council may recall that the Gingin Community Bank had some involvement in the initial discussion for the concept and provided a concept design plan over Lots 60 and 61. A copy of the plan is attached (Appendix 1). Options explored by the Committee to progress the development were: • Consider the Community Bank concept plans as a possible design for the
development and engage a consultant to undertake financial modelling for a staged construction process that would be managed by a Committee set up for that purpose; or
• Advertise for Expressions of Interest in order to attract private enterprise to undertake
financial modelling, potential concept design and construction. It was also considered that as the Charitable Trust is prescriptive for Lot 60 only for the purpose of the provision of aged persons’ accommodation, an opportunity exists for Lot 61 to be utilised for differing community housing requirements, possibly as a staged or future development. Financial modelling was considered the most appropriate way to provide any best model scenarios for “lease for life” arrangements for the aged persons’ accommodation intended for Lot 60. AND COMMUNITY SERVICES REPORT DATE: 17 MARCH 2015 REFER: N/A OFFICER INTEREST DECLARATION Nil PURPOSE To consider a proposal by the Gingin Playgroup to upgrade the current Gingin Playgroup premises with a prefabricated addition to be undertaken in the 2014/15 financial year. The new annexe would replace the existing kitchen and ablution within the Road Board building. BACKGROUND For some years now the Gingin Playgroup has been lobbying Council to renovate its premises in the old Road Board building on Constable Street, Gingin. Under former management the Playgroup was advised that it needed to secure external funding to off-set the associated costs of renovating the building. In this regard, the Playgroup has secured funds from Lotterywest - $15,000 and Bendigo Bank (Gingin/Lancelin) - $15,000. The grant bodies are keen for the approved grants to be expended as soon as possible as the funds will have to be returned if not used in the near future. The renovation costs were included in Council’s adopted 2013/14 budget. The exterior roof was replaced in the 2013/14 financial year however none of the other renovation items were undertaken due to other costs being identified that were not included in the initial funding scenario. In preparation for the 2014/15 Budget, the Shire’s Manager Building Services sourced a quote from a local builder for renovations to the Old Road Board Building, including replacement of the internal ceiling, which resulted in a figure of approximately $130,000. Due to reassessment of the Shire’s significant projects for the 2014/15 financial year the old Road Board building was not included in the works programme for that year. In August 2014, Shire Officers met with Gingin Playgroup representatives to advise of Council’s decision not to include renovations to the Old Road Board Building in the 2014/15 budget.

ORDINARY MEETING AGENDA 17/03/2015 SHIRE OF GINGIN Taking into account the estimated cost of removing the building, the option of moving the Playgroup from its current premises to the Bendigo Complex was discussed with the Playgroup Management Committee and it was decided that the proposal would be put to the balance of the Playgroup Committee. Officers also approached the Gingin Recreation Group to gauge its position with respect to the proposed relocation of the Gingin Playgroup to the Bendigo Complex, with “in principle” support being received. In the intervening period the Playgroup has researched alternative renovation methods and has provided costs associated with construction of a prefabricated annexe, incorporating a kitchen and ablution pod, which could be delivered on site and “attached” to the existing building to replace the existing kitchen and ablution facilities. The design of the annexe would not be dissimilar to that of the Gingin Medical Centre/Community Resource Centre, with a cost in the order of $62,000. It is noted that, other than the costs associated with the prefabricated building and septic tank upgrades (labour costs), all other components have been sourced by the Gingin Playgroup Management Committee either at cost or no cost (ie donated), or the cost has been substantially reduced. The Chief Executive Officer and Coordinator Community Services met with the Gingin Playgroup Management Committee on 18 February 2015, at which time Playgroup representatives reiterated that the Playgroup is very keen to remain in its current premises and would like to attract other community groups to operate out of the Old Road Board Building with a view to “value adding” to the current use, which could make the costs associated with any renovations more equitable for Council. On 2 March 2015, Councillors, Officers and Playgroup representatives met at the Old Road Board Building to give Council a first-hand impression of the day-to-day operations of the Group and their reasoning as to why it was important for them to continue to use the building. COMMENT An allocation of $30,000 will be required from the 2014/15 Municipal budget in the event that Council agrees to: 1. Commit to undertaking the proposed renovation works; and 2. Undertake the works in the 2014/15 financial year (noting that the funding from other
contributors is required to be spent in the 2014/15 financial year) STATUTORY ENVIRONMENT Nil POLICY IMPLICATIONS Nil

BACKGROUND LA423 and GG100 are owned in freehold title by the Shire of Gingin. Both properties are developed with residences constructed in 1982 and 1969 respectively, and are in need of some significant maintenance. It is therefore suggested that Council may wish to consider disposing of both lots and then determining whether to utilise the resulting funds on rebuilds or investment in its Reserve Fund. LA423 (Appendix 1) was previously leased to DADAA and is now vacant following DADAA’s relocation to the new Wangaree Community Centre. GG100 (Appendix 2) is currently used as staff housing, but has some significant maintenance requirements. The Shire currently owns two other properties that are leased on short term rental agreements, and in the event that Council disposes of GG100 then alternative staff housing can be provided from existing assets. COMMENT Independent valuations obtained for LA423 and GG100 have previously been circulated to Councillors for their information. Section 3.58 of the Local Government Act 1995 (the Act) specifies how property may be disposed of by local government. Accordingly, in the event that Council agrees to dispose of LA423 and GG100, then the following options are available to it: 1. Disposal to the highest bidder at public auction; 2. Disposal in accordance with the most acceptable tender (whether or not it is the
highest tender) received as a result of a public tender process; or 3. By private sale, providing that Council has previously given local public notice, for a
period of not less than two weeks, inviting public submissions on the proposed disposal. Council must then consider any submissions received before agreeing to dispose of the property.

BACKGROUND Every year the Department of Sport and Recreation’s Community Sporting and Recreation Facilities Fund (CSRFF) – Small Grant Scheme provides grants of between $2,500–$66,666 for approved projects involving a basic level of planning. In order to be eligible, projects must not have a total project cost exceeding $200,000 and approved grants must be expended during the financial year following the date of approval. The CSRFF offers two rounds of the Small Grants Scheme each year. Rounds are advertised and open in February and July and close on the last working day of March and August.
Examples of small grant projects include:
• cricket pitch and practice wickets; • safety fences for sport and recreation facilities, i.e. motor sports;
• minor upgrade to swimming pool;
• small floodlighting project;
• court resurfacing or upgrade;
• construction of or upgrade to shade shelters;

grant offered is $60,000);
• various planning studies to a maximum grant amount of $25,000.
Applications must be submitted by 27 March 2015 in order to be considered in the current funding round.
COMMENT Council will be aware that it has an allocation of $20,000 in its 2014/15 Municipal Budget for development of a Community Facilities Plan. Additional funds can be sourced to add further scope and value to this project, and to that end officers have identified the CSRFF Small Grant Scheme as a potential source of funding. Given that the Small Grant Scheme funds one-third of the total cost of an eligible project, it is envisaged that funding for the development of a Shire of Gingin Community Facilities Plan would be apportioned as follows: • Shire of Gingin two thirds (up to a maximum of $20,000) • CSRFF Small Grant Scheme one third Quotes are currently being sourced from consultants to undertake preparation of the Community Facilities Plan and therefore the actual cost of the project had not been determined at the time of writing this report. However, it is proposed that the maximum contribution by the Shire of Gingin will be limited to the $20,000 currently included in Council’s adopted Budget. STATUTORY ENVIRONMENT Nil POLICY IMPLICATIONS Nil BUDGET IMPLICATIONS At this stage it is unclear as to what the cost of the Community Facilities Plan may be. BACKGROUND The Disability Services Act 1993 (the Act) requires that every public authority, including local governments, must have a Disability Access and Inclusion Plan (DAIP) to ensure that its dealings with the public both meet the principles applicable to people with a disability, and the objectives for services and programs for people with a disability, as specified by the Act. The Act also requires that public authorities review their DAIP, as a minimum, once every five years. In accordance with this requirement, the Shire of Gingin’s DAIP has now been reviewed and is presented to Council for adoption prior to submission to the Disability Services Commission. A copy of the reviewed DAIP 2012 is attached as Appendix 1. COMMENT The review process consisted of the following components: 1. Analysis of the strategies and actions listed in the existing DAIP to determine what
achievements have been reached and identify areas in need of improvement; 2. Examination of the Shire of Gingin Strategic Community Plan, Annual Report and a
range of relevant policies, procedures and standards to ensure that the DAIP reflects, and is consistent with, the aims and outcomes of these documents;
3. A review of the Shire’s six year Building Maintenance Plan to ensure that proposed
maintenance projects address access issues for people with disability; and 4. Public comment.

ORDINARY MEETING AGENDA 17/03/2015 SHIRE OF GINGIN Amendments to the DAIP include the incorporation of an additional Outcome in Outcome 7. The Outcomes contained within the DAIP are consistent with the Standards for Disability Access and Inclusion Plans as specified in Schedule 2 of the Disability Services Regulations 2004. The Schedule was amended in 2013 to include a Standard which specifies that a DAIP must provide a means of reducing barriers to people with disability obtaining and maintaining employment. The review also reflects the outcomes from the Community Satisfaction Survey completed in 2014. This issue can be addressed during Council’s Annual Budget deliberations. STRATEGIC IMPLICATIONS N/A VOTING REQUIREMENTS – SIMPLE MAJORITY RECOMMENDATION It is recommended that Council adopt the reviewed Shire of Gingin draft Disability Access and Inclusion Plan 2012 for submission to the Disability Services Commission.
