Included in the agenda were two pieces of correspondence; (i) a letter from Minister Glen Murray congratulating Ontario’s 38 source protection authorities on the historic milestone reached in November 2015 when the source protection plans were approved; and (ii) an email from Lynn Dollin, Chair, South Georgian Bay Lake Simcoe Source Protection Committee advising of her reappointment as Chair of the Source Protection Committee for another three years.

VI. GENERAL UPDATES

(a) SPC Update

Lynn Dollin, Chair, South Georgian Bay Lake Simcoe Source Protection Committee, provided an update on the activities of the South Georgian Bay Lake Simcoe (SGBLS) Source Protection Committee (SPC) since the last meeting, noting with her reappointment as Chair for a further

three years, she is looking forward to continuing working with everyone. With the Source Protection Plan approved over a year ago, she was pleased to advise that implementation was going fairly well due in large part to the great work of the communications and project management team. Chair Dollin went on to note that MOECC is in the process of reviewing the technical rules with regards to vulnerability, including short- and long-term changes to how the vulnerability of municipal wells, municipal intake pipes, and aquifer recharge areas is assessed. She also noted that annual reporting on implementation the Source Protection Plan objectives will begin at the end of 2017, and staff are working with other SPAs to develop a reporting framework that will collect the information. NVCA has been working with LSRCA and SSEA to refresh brochures to be provided to municipalities and RMOs, an initiative that fits with recommendations provided by external consultant Letter M. The factsheets are expected to be completed in October 2016.

(b) Retirement of Keith Sherman from SSEA

Bill Thompson, Manager, Integrated Watershed Management, commented on Staff Report No. 02-16-SPA regarding the retirement of Keith Sherman from Severn Sound Environmental Association, noting that Mr. Sherman has been the Executive Director since its inception. Mr. Sherman, who retired in July 2017, has been the primary point of contact for LSCBR staff at the Severn Sound Source Protection Authority, and he has been instrumental in the operations of the Source Protection Committee, the drinking water vulnerability assessment, the development of the Source Protection Plan, and engaging landowners and other partners in plan implementation. Mr. Thompson was pleased to note that Mr. Sherman has accepted a part-time position as Risk Management Official for many municipalities in the Severn Sound Source Protection Area.

SPA-13-16 RESOLVED THAT Staff Report No. 02-16-SPA regarding the retirement of Keith Sherman be received; and

FURTHER THAT the Lakes Simcoe and Couchiching/Black River Source

Protection Authority provide a letter to Mr. Sherman, thanking him for his contribution to Source Water Protection in this Region, and congratulating him on his retirement. CARRIED

(c) SGBLS Source Protection Committee Membership

Bill Thompson, Manager, Integrated Watershed Management provided a presentation on the process used to fill vacancies on the Source Protection Committee, along with recommendations for new members. He noted that members are responsible for developing and monitoring the implementation of a Source Protection Plan, and in the case of SGBLS SPC, the committee is

comprised of one Chair plus 22 members, including one First Nations representative and seven representatives from the municipal, economic/industrial sectors, and public at large. LSCBR SPA as the lead SPA is responsible for appointing members to the Source Protection Committee.

The process for municipal representatives, as Mr. Thompson explained, begins with a letter from Mike Walters to LSCBR SPA municipal CAOs seeking nominations. Nominations received as a result included: • Don Goodyear – Manager, Water Resources, York Region • Kyle Mitchell – Manager, Water Resources, City of Orillia • Katie Thompson – Risk Management Official, City of Barrie Mr. Thompson further explained that seeking applicants from the public/industrial sector is much different, in that notices are placed on websites an in local papers. This process resulted in three applicants from the economic sector (which had two vacancies), and seven applicants from the public sector (which had one vacancy). A selection committee was then struck, with evaluations and interviews following. Recommendations for the three positions are: Economic / Industrial Sector representatives: • Ian Chadwick – Ontario Municipal Water Association • Rick Newlove – Simcoe County Heavy Construction Association

I. WELCOME & OPENING REMARKS All were welcomed to the meeting and attendance details were reviewed:

Mike Walters was unable to attend therefore Keith Sherman is acting as Source Protection Authority (SPA) Liaison for this meeting

Bill Thompson was introduced as the new Manager of Integrated Watershed Management (IWM) with Lake Simcoe Region Conservation Authority (LSRCA) – he will be transitioning into the position of Project Manager for Source Water over the coming months; Ben Longstaff will remain engaged with the Source Protection Committee (SPC)

Teresa McLellan from the Ministry of the Environment and Climate Change (MOECC) has taken a new position, as such she is no longer the SPC MOECC Liaison Officer (LO) – Elizabeth (Beth) Forrest was welcomed as the new MOECC LO to the SPC

Joan E. Patch was welcomed as a new addition to the LSRCA Communication Staff for Source Water (SW) Communications support

Mike Wilson was welcomed as the new Source Water Protection Coordinator / Hydrogeologist with LSRCA

Stacey McCarthy and Doug MacMillan from Letter M Marketing were welcomed as guest presenters on the topic of the Source Water Education and Outreach Strategy

V. ANNOUNCEMENTS (a) Activities of the Chair & Committee

A brief update from the recent Project Managers (PMs) & Chairs Meeting was provided.

An overview of the Cap and Trade Reg. 172 was provided

An update on the Great Lake Protection Act was provided

Discussion occurred around out of scope steady state items i.e. fracking and outdoor fuel storage – policy gap letter previously provided by the SPC was reference for policy oversights

The Province provided an update letter on what they have done in order to conform to policies

o The Province has adopted the prohibition policy across all regions

(b) Agricultural Sector Update to the SPC

The SPC Agricultural Representatives (Ag Reps) reviewed what activities they have recently undertaken for Source Water:

They presented on the topic of Source Water at a two day Central Ontario Agricultural Conference (COAC) – their message was well received

They co-hosted and presented at the “Negotiating Risk Management Plans with Farmers - Making the Right Connections” workshop held on March 29, 2016 – again this event was well attended and their message well received – LSRCA staff were thanked for their efforts in coordinating the event

The Ag Reps were commended for their successful presentations and continued efforts in support of communication and implementation of agricultural Source Water policies

The Ag Reps will be meeting with Conservation Ontario staff on April 27, 2016 to discuss their aid in preparing a series of articles to be published in Better Farming magazine on Source Water and agricultural effects

(c) MOECC Update

Elizabeth Forrest provided a brief update on the status of MOECC Source Water activities:

At the recent PM and Chairs meeting they focused on Annual Reporting for the purpose of monitoring policies implementation and effectiveness

The MOECC mapping tool is now live and available for public use at Ontario.ca

o It was noted that upgrades to the mapping tool will be done in the

future including linkage to a policy database and parcel data

They are undertaking a review of the Source Water Program in order to identify how the program will evolve moving forward – an update on this will be provided as soon as possible

VI. DELEGATIONS None. VII. PRESENTATIONS (a) Education & Outreach Strategy Doug MacMillan and Stacey McCarthy from Letter M Marketing presented on the status of the Source Water Education & Outreach (E & O) Strategy. SPC members were assured that there will be multiple opportunities for collaboration throughout the process and that the input of SPC members will be sought in terms of messaging used in the communication of the EDU policies prior to any implementation. It was clarified that this is a responsibility that falls to the lead SPA and as such, does not fall under the SPC i.e. SPC Communication Sub-Committee. That being said, close collaboration with SPC members will be sought by Letter M Marketing as it is considered a vital resource in the process. It was noted that the use of an independent communication consultant, in this case Letter M Marketing, will aid in the implementation of communication for targeted policy messaging, instead of general communication of the Source Water Program. Collaboration with the other 19 Source Protection Regions (SPRs) is underway; informal consultation and resource sharing is occurring behind the scenes. Although there is a desire from a communication messaging stand point to preserve the autonomy of each local area, there is a need to maintain Province wide consistency. The communication strategy that is developed will define the implementation action plan on which the SPAs will act; necessary tools will be developed at that time and will be shared resources across SPRs. However, those municipalities that have already made headway in this area are not required to abandon their efforts and adopt this strategy; it along with any communication tools will be available if needed. Discussion occurred around how to get SPA buy in from those that remain reluctant. Letter M Marketing will work to make the strategy as simple as possible with a central resource of communication expertise to ensure implementation is easy.

In terms of program evolution, the MOECC assure there will be many opportunities for collaboration and input. Feedback is expected from SPC members through their PMs. Discussion as to how the members of this SPC envision the role of the Committee changing should occur. A need for ground level input to be provided at the onset was emphasized. Discussion occurred around how the role of the SPC is changing and how there is a strong need for the roles of SPCs and SPAs in each phase to be clearly identified. According to the MOECC, there remains a legislative role for SPCs and they are looking at whether

In the case of this SPC, as they have some municipalities that have been early adopters of the SPP policies, work on policy effectiveness can already begin.

It was clarified that many SPCs are not changing their number of members and are undergoing a similar membership refresh process. The membership refresh approach that his committee is taking was reiterated for clarification. It was noted that there will be an SPC membership advertisement published in newspapers across the watershed tomorrow, April 21, 2016. Depending on the response received for public and economic sector members, a review committee will be formed to take candidates through the evaluation process. In terms of municipal members, Don Goodyear has been nominated as the new York Region representative and Katie Thompson has been nominated as the new Barrie representative. Discussion occurred regarding Clayton Cameron’s current position, SPC membership and eligibility status. According to Beth he may still be eligible to apply as a public sector representative on the Committee.

Ramara First Nations is made up of 7 parcels, 2300 acres of land and 1800 acres in Ramara Township – these additional lands are split between Ramara First Nations and Ramara Township may pose some regulatory challenges

Additionally, RMOs are ultimately accountable to their local SPC; SPC members will be responsible for weighing whether RMOs are interpreting and supporting the implementation of policies the way they were intended. Discussion occurred around the deadline for septic re-inspections. As the deadline is in early 2017 a reminder to municipalities should be circulated.

(e) Issues Contributing Area (ICA) Study Update Keith Sherman provided and update on the status of the Lafontaine ICA study.

Purpose of the study is to assess the ICA policies and how to approach implementation based on the technical information gathered

Background information on the ICA was provided

They are looking at how to reduce Nitrates in the ground water and the source(s) of Nitrate compounds

Trends show that Nitrate levels are on the rise in both Township and private communal wells

The Surface Water Model was run backwards until particles broke land surface – contributions from different areas and how particles travel was discussed

The focus of the work looks at where water flows after it hits the ground, it does not look at concentrations and takes into consideration intermittency based on seasonal flows

The travel time of Nitrate particles is also being looked at as part of this study

Some Best Management Practices as well as some Risk Management Measures have been identified

Pseudo-yield maps were reviewed Discussion occurred around whether the Nitrate contributions are coming from natural sources or if there is enough agricultural activity in the identified areas to be a possible contributor to contamination. Karen Kivilahti noted that as an outcome of the data reflected in this current ICA study, the Simcoe Muskoka District Health Unit will be looking to revise and share more of the initial work done on this issue with SSEA in 2012. Paul Maurice was noted as playing a vital role in the success of this study; he acts as an ambassador to the local agricultural community. Given some of the new data collected on water flow, it was suggested that consideration be placed on how Well Head Protection Areas (WHPAs) are identified moving forward. It may be that this Committee should look at protecting source areas that lie outside the boundaries of current WHPA boundaries. Source Protection Committee member appointment The new members of the Source Protection Committee, who were appointed at the last Source Protection Authority meeting, were introduced to the other committee members at our September meeting. In preparation for their first committee meeting, SPA staff and I provided a half-day orientation session, giving them an overview of their role as members of the SPC, the science underlying the Source Protection Plan, as well as its policies and the range of partners involved in its implementation. I am very optimistic that we’ve added excellent new members to the committee who will contribute to the protection of municipal drinking water for years to come. Sharing our experiences with an international audience Last fall, two members of our SPC, Colin Elliot and John Hemsted, presented at an international conference on Sourcewater Protection at the University of Laval. They were participants in a session organized by Conservation Ontario and MOECC and were invited to present on their experience with the program as members of a Source Protection Committee. I have heard from numerous sources how well the session was received, and how well John and Colin represented the work done in the South Georgian Bay Lake Simcoe Source Protection Region. Based on the success of this session, Conservation Ontario is exploring the possibility of hosting a similar conference in Ontario.

MOECC Program Review At our most recent meeting, the SPC reviewed proposed changes to the Source Protection Program that form the first phase of the Province’s program review. These initial changes were relatively minor in nature, but did include a change to the volume threshold upon which fuel storage can be considered a significant threat, and changes to the vulnerability scoring methods for intake protection zones, which may assist in managing threats in the Severn Sound watershed. As these proposed revisions were both issues that the SPC felt had been poorly addressed in the original program, a letter supporting the proposal was submitted to the Province through the EBR. The SPC will be monitoring this program review as it proceeds to ensure that the concerns of our Source Protection Region are addressed. Annual Reporting By the end of 2017, everyone involved in implementing the Source Protection Plan will be required to report on the progress they are making on their objectives. This will continue on an annual basis. LSCBR staff is working with other SPAs to develop a reporting framework that will collect the information we need, without it being a heavy workload for those involved. Risk Management Officials (RMOs) are already required to report their activities on a yearly basis. Source Protection Region staff will provide reporting structures to the RMOs this fall. They will have a report to share with SPA at the next meeting. Moratorium on Water Bottling The Committee discussed the Province’s proposal for a temporary moratorium on new licences for water bottling facilities and a review of the fees associated with groundwater taking for that industry. The committee felt strongly that the Province was taking the right approach with this issue, and submitted a letter of support through the EBR. Thank you for your time. Lynn Dollin

Officials’ 2016 Annual Reports be received for information. Purpose of Staff Report The purpose of this Staff Report No. 01-17-SPA is to provide the Risk Management Official (RMO) 2016 Annual Reports submitted under Section 81 of the Clean Water Act where municipalities have delegated a RMO. Background: The South Georgian Bay Lake Simcoe (SGBLS) Source Protection Plan (SPP) has been in effect since July 1, 2015. The local Source Protection Authorities (SPAs) are required to monitor and report on the implementation of the SPP policies. A primary objective of monitoring and reporting is to assess if threats to municipal drinking water sources (municipal systems) are being reduced through the implementation of the SPP policies. This information will help support any future amendments to the SPP and provide accountability and transparency to stakeholders. The Clean Water Act (Section 46) requires that the SPA report to the Director (MOECC) on the implementation of all policies by May 1st of each year, with the first annual report being due in 2018. The Source Protection Committee (SPC) will review and comment on the SPA report prior to the May 1st deadline (March/April timeframe). SPA staff members, in conjunction with the SPC, MOECC, and municipalities, are currently preparing a reporting framework in preparation for the first annual report.

In support of annual reporting, the Clean Water Act also requires that all RMOs report to the local SPA on an annual basis. While the first SPA annual report is not due until May 2018, the first RMO report is due February 1st in the year following the year in which the RMO was appointed. To support the RMOs, Nottawasaga Valley SPA staff developed and provided an online survey/database in January 2017 for RMOs to use to report on both the legislated reporting requirements and additional information staff felt was pertinent to understanding the current state of implementation. This online survey/database is known as the Source Protection Annual Reporting (SPAR) tool. We are the first source protection region to use an online database to collect data for source protection reporting. Ultimately, using the secure SPAR database for source water protection reporting will result in significant efficiencies and cost savings for all stakeholders. Considerable positive feedback has been received from RMOs and municipal staff who have used SPAR for reporting, as well as from MOECC staff who participated in a demonstration of SPAR’s capabilities. We are pleased to advise that all 2016 RMO annual reports from across the source protection region have been received and a summary report (by SPA) is appended to this report (Appendix A: 1-3). All of the individual RMO Annual Reports will be made available upon request. An analysis of the RMO Reports shows that the transition to implementation is progressing well. Essential implementation actions such as establishing a Risk Management Office have been completed across the source protection region. Restricted Land Use policies are being implemented and many municipalities have started preparing risk management plans (RMPs). The reports are also helping identify areas where SPA staff can further assist in supporting implementation efforts, such as providing educational materials and workshops to municipalities, developing a source water protection web-mapping tool, and implementing a screening process for planning and building proposals. Key findings of the 2016 RMO Annual Reports are summarized below for the source protection region: • There have been zero (0) prohibitions of future activities where the activity would be a

significant drinking water threat. • York Region is leading the way in threats verification and RMP development. To date they

have removed 537 threat sites (that were previously identified as potential threat sites in the Assessment Report) and completed 58 RMPs.

• Some RMOs representing municipalities outside York Region have just started to establish RMPs or have zero (0) RMPs completed to date.

• Only one (1) development proposal required a risk management plan (RMP) for a future activity that would be a significant drinking water threat. This potential future threat was brought to the RMO’s attention through the s.59 Restricted Land Use screening process.

• Most municipalities have completed or are nearing completion of their mandatory inspection program for small on-site sewage systems (septic systems).

• Of the septic systems inspected, less than 2.5% of them required a major repair (such as a tank or tile bed replacement) to be brought back into compliance.

Issues: There are two key findings from the RMO annual reports that require the attention of the SPA at this time: 1. For RMOs representing municipalities that have no RMPs complete - or have just begun

developing RMPs - the rate of RMP establishment may need to increase to meet the 2020 deadline.

2. Municipalities that have not fully completed their mandatory septic inspection program

need to be encouraged to complete these inspections as soon as possible. Many RMOs have been focused on threats verification work since the source protection plan came into effect; a logical first step in removing potential significant drinking water threat sites. Although the number of RMPs complete is low at this time, most RMOs have a plan in place to tackle the number of RMPs that are estimated to be required by 2020. The SPA will continue to work with RMOs, particularly those who may have limited time and resources to dedicate to source water protection. This may include: facilitating the sharing of RMP templates, guidelines and standard operating procedures, making annual reporting a more efficient process, and providing workshops for certain threat types (such as agricultural threats). Although the onus is on the RMOs to implement the necessary RMP’s, the SPA will work with RMOs to assist those that need it, and facilitate information sharing. The SPA recognizes that there has been some misunderstanding with regards to the deadline to complete septic system inspections. The upper tier municipalities and SPA staff will work with Part 8 sewage system inspectors and Chief Building Officials to make completing necessary inspections a priority, and the SPA may be able to facilitate the sharing of information and tactics used by those municipalities that have been successful in getting the required septic inspection completed in a timely fashion. Summary & Recommendations: RMOs within the SGBLS Source Protection Region have submitted their 2016 RMO annual reports to the SPA, as required under the Clean Water Act. The reports show that transition to implementation of policies is currently progressing as required. It is therefore RECOMMENDED THAT Staff Report No. 01-17-SPA which presents a summary of the 2016 Annual Reports from Risk Management Officials be received for information.

**York Region provides Risk Management services on behalf of Bradford for their well located in York Region.

*York Region has notified the lead Source Protection Authority of its plan to add two replacement wells within the Yonge Street Aquifer complex. A Class Environmental Assessment to add a new well in East Gwillimbury (on Green Lane between Yonge St. and 2nd Concession - outside of the existing wellhead protection areas), and a new well located in Aurora (at St. John's Sideroad and Old Yonge St. - within 15m of an existing well) was submitted to the MOECC in late 2016. It is important to note that no increase in water taking is being sought. This process will result in the redistribution of the current taking from older wells that have lost some capacity over time.
