Subject: Action Taken Report on the resolution passed by the
Finance & Contract Committee w.e.f. January, 2012 to December,

The action taken reports on the resolutions passed by the Finance
& Contract
Committee have been received from the different wings of the
Corporation for inclusion in the list
of business to be transacted in the 237th meeting of the F&CC
which have been compiled and
placed below for information of the Finance & Contract
Committee.

AGENDA ITEM NO. 237.3
Subject: Hiring of chain dozer for maintenance and upkeep of
dumping ground.
It is submitted that an agenda was placed before F&CC in its
234th meeting held on
17.12.2013 for the approval to extend present contract for hiring
of chain dozer upto 31.03.2014
on the previous terms and conditions from the existing contractor
and in the meantime tender will
be floated through e-tendering for hiring of chain dozer. The
committee resolved as under:-
“The committee resolved to extend the present contract upto
31.03.2014 and in the meanwhile tender would be floated through
e-tendering for hiring of chain dozer.”
As approved above, this office floated e-tender on 21.1.2014 for
hiring of chain
dozer for maintenance and upkeep of dumping ground. Only two bids
have been received. In
which, one firm was not found technically eligible for the said
tender as examined by official
committee.
As such, only one bidder was found technically qualified since the
instant tender
has been floated for the first time and only one bidder was
technically eligible. Therefore, for
healthy competition, office is of the view that fresh tender be
called on the same terms &
conditions. Due to the model code of conduct till 16th May, 2014
this office asked Sh. Krishan
Singh (existing contractor) to continue the services of chain dozer
at Dumping Ground in public
interest upto 31.7.2014 with the prior approval of CMC subject to
the ex-post facto approval of F
& CC.
In view of the above, Agenda is placed before the F &CC meeting
for ex-post facto
approval of the existing contract for hiring of one chain dozer for
the period from 01.04.2014 to
31.07.2014 on previous terms & conditions or till the
finalization of fresh tender whichever is
earlier. The total financial involvement for 04 months i.e. upto
31.07.2014 will be Rs. 10,73,600/-.

Subject : Purchase of 02 No. of Dog Van (Mahindra Bolero Campher
2WD BS3) on DGS
& D rates.
It is submitted that as per the direction of Hon’ble Punjab &
Haryana High Court in
Civil Writ Petition N o. 9902 of 2012 a Comprehensive Scheme for
management of stray dogs in
the year 2012 was formulated.
Now, in Civil Writ Petition No. 7849 of 2014 in case of Gurmukh
Singh Vs. U.T.
Chandigarh, Hon’ble Punjab & Haryana High Court has given
directions to implement the Point
No. VI and IX of the Scheme.
It is pertinent to mention here that the point no. VI and IX of the
Scheme is already is
being implemented except Sr. No.3 of Point no. VI which is as under
:-
3) Three Dog Vans with announcement system for capturing,
transportation
and release after operation from various zones.
At present only 1 dog van is available whereas 02 more dog vans are
required
to implement the above Sr. No.3 of the point VI of said
scheme.
In this context, it is submitted that Mahindra Bolero Campher 2WD
BS3 is available
on DGS & D rates at the rate of Rs. 499036.36 each subject to
100% advance payment, a copy
of DGS & D rates may kindly be seen at Flag ‘A’.
It is further submitted that the said vehicle are to be fabricated
in such a way to
transport the stray dogs in a safe manner. The tentative cost for
the fabrication of Mahindra
Bolero Campher 2WD BS3 is Rs. 3.00 lac each.
As such, total expenditure for purchase of 02 No. of Dog Van
(Mahindra Bolero
Campher 2WD BS3) on DGS & D rates comes to Rs. 16.00 lacs
approx with fabircation for which
the agenda is placed before the meeting of F &CC for
consideration and approval.

Subject: - Special Repair of Street Light on V-4 Road, Sector 30,
Chandigarh.
(Amount Rs. 18.48 Lac.)
The agenda has been framed for Special Repair of Street Light on
V-4 Road,
Sector 30, Chandigarh. The Street Light on V-4 Road was provided
way back more than fifteen
years ago. The Street Light Fittings has outlived their useful life
with the passage of time. There
is insufficient illumination on the road at present. The existing
cables feeding to the Street
Lights have been damaged during the excavation along the road
during fixing of Tiles/Paver
Blocks.
Therefore this estimate amounting to Rs.18.48 Lacs for augmentation
of Street
Light has been framed for seeking administrative approval under
head 4217 (Plan)
Electrification.
The Scope of work including provision of Supply and Erection of 150
Watt Street
Light Luminary including Lamps (IP-66), Supply & Laying of
underground cable in DWC Pipe
and allied accessories.
Agenda is placed before the Finance & Contract Committee for

Subject: - Renewal of License (Agreement) of Chandigarh Washerman
Workshop
Cooperative (Regd.) Industrial Society Ltd., Sector 15-D,
Chandigarh.
The Modern Laundry Mart alongwith Coin Operated Washing Machines
in
Sector 15, Chandigarh was handed over to Chandigarh Washerman
Workshop Cooperative
(Regd.) Industrial Society Ltd., Sector 15-D, Chandigarh at a
monthly rental charges of Rs.
8,000/- per month in compliance to the decision of F&CC meeting
held on 03.05.2009 and
CMC office order No. 65 dated 08.06.2012 for the period 01.04.2012
to 31.03.2014. The
meeting of F&CC could not held due to enforcement of model code
of conduct. Therefore, this
office have requested for extension in time limit till the
completion of Election process. The
extension in time limit has been granted by the Worthy
Commissioner, M.C. Chandigarh as
issued by the Superintending Engineer (B&R) vide RD No. 2503
dated 15.05.2014 for two
months i.e. upto 31st May, 2014 (copy enclosed). The existing
agreement period is going to
expire on 31.05.2014. It is brought out that the Society is paying
monthly rent on time and no
payment is pending against the Society.
The Chandigarh Washerman Workshop Cooperative (Regd.) Industrial
Society
Ltd., Sector 15-D, Chandigarh vide their letter dated 23.12.2013
have requested to extend the
period further for three years.
It is therefore, requested that the contract period may be renewed
for next three
years on the existing terms and conditions from 31.05.2014 to
30.05.2017 and ratification of
the extension as granted by the Worthy Commissioner, Municipal
Corporation, Chandigarh of
existing Agreement upto 31.05.2014.
In view of above the matter is placed before the F&CC for
consideration and
decision regarding renewal of contract period for next three years
on the existing terms and
conditions.

Subject: Engagement of 04 Nos. of Pharmacists and 02 No. of ward
servants in the Civil Dispensaries under Municipal Corporation,
Chandigarh.
It is submitted that 20 dispensaries were transferred to the
Municipal Corporation,
Chandigarh along with 24 pharmacists and 24 ward servants and other
staff.
Out of 24 pharmacists, 03 pharmacists were called back by the
Director Health Services
and one pharmacist retired. Whereas out of 24 ward servants, one
ward servant was called back and one
ward servant expired whereas no replacement was provided for 04
Pharmacists and 02 Ward Servants by
the Director Health & Family Welfare, Chandigarh
Administration.
An agenda was placed before the F&CC in its 227th meeting held
on 11.02.2013 to engage
04 Nos. of pharmacists from M/s Keshav Security Services Pvt. Ltd
and 02 Nos. of ward servants from M/s
Punj Security & Housekeeping Services Pvt. Ltd. who were
supplying Pharmacists and Ward Servants to
the Director Health & Family Welfare, Chandigarh Administration
on the same terms and conditions i.e. in
case of Pharmacists, minimum wages + 4.50% administrative charges,
total Rs. 10,109/- per month & in
case of Ward Servant, Minimum wages + 4.99% administrative charges
total Rs. 9318/- per month
respectively for the period of one year or till the regular
appointment whichever is earlier.
F&CC has considered and allowed to engage 04 Nos. of
Pharmacists and 02 nos. of ward
servants as proposed in the agenda.
As per the decision of F&CC meeting, 04 No. of Pharmacists were
engaged through M/s
Keshav Security Services and 02 No. of Ward Servants were engaged
through M/s Punj Security and
House Keeping Services for a period of one year.
The contract of one year was going to expire on 19.02.2014,
therefore, Director Health
Services was requested vide this office Memo. No. 1061 dated
23.1.2014 to provide 04 No. of
Pharmacists and 02 No. of Ward Servants for the Civil Dispensaries
so that work of Civil Dispensaries may
not suffer.
Director Health Services intimated vide their Memo. No. 3429 dated
12.2.2014 that Health
Department, U.T. is already facing shortage of manpower, therefore,
no person on outsourced basis can
be spared for Civil Dispensaries under Municipal Corporation,
Chandigarh.
It is pertinent to mention here that this office is not able to
fill up the 04 vacant posts of
pharmacists and 02 vacant posts of ward servants on regular basis
as the salary of the staff of civil
dispensaries is being paid by the Director Health & Family
Welfare, Chandigarh Administration and as no
salary head is maintained by this office.
In view of the position explained above, the contract period for
supplying of 04 Pharmacists
from M/s Keshav Security Services Pvt. Ltd and 02 Nos. of ward
servants from M/s Punj Security &
Housekeeping Services Pvt. Ltd. for Civil Dispensaries was extended
upto 30.6.2014 on the previous terms
& conditions, subject to the approval of the Committee as
approved by the Mayor, Municipal Corporation,
Chandigarh. The approx. expenditure for the period 20.2.2014 to
30.6.2014 will be Rs. 2.50 lacs.

approval for engaging 04

30.6.2014 which involve approx.

Subject:- Amendments/Elaborations in the existing terms and
conditions of Paid Parking
Areas.
In this connection, it is submitted that vide office orders issued
under Endst. No. MCC/SDE
(HQ)/JA/2014/391-394 dated 21.03.2014 (copy annexed as Annexure
‘A’) the committee consisting of
the following officers was constituted to re-consider all the terms
and conditions of Fully Automatic/Semi
Automatic/Without Automatic Paid Parking Areas as well as General
Instructions to Applicants keeping in
view all the aspects & submit its report for the amendments of
the conditions, within a period of 15 days to
enable the Parking Branch to place the same before the Finance
& Contract Committee for its
consideration:-

The above said Committee has recommended the following clauses of
terms and
conditions of paid parking areas:-

be refunded to concerned bidder after deposit of security deposit
(bank guarantee + 2 months’ license fee) and completion of other
formalities.

38. Termination of license: -The license shall stand terminated
automatically on completion of license period.
The licensee can request, after running the Paid Parking Area at
least a minimum period of three months from the date of taking over
possession, for premature termination of license by giving 3 months
notice or by depositing money equivalent to 3 months licensee
fee.
In case of default, the licence fee of three months shall be
forfeited.
If the licensor wants to terminate the licence deed before the
expiry date then the licensor will give at least one month notice
or pay money equal to one month licence fee.
The licensee who surrenders the PPA shall not be permitted for
bidding in the re-auction of the same PPA immediately after the
surrender.
38.Termination of license: -The license shall stand terminated
automatically on completion of license period.
The licensee can request for premature termination of license by
giving 3 months notice or by depositing money equivalent to 3
months licensee fee. However, it is made clear that no such request
should be entertained before an expiry of 3 months period from the
date of taking over the possession.
In case of default, the licensee shall be liable to deposit an
amount equivalent to 3 months license fee within 3 days of demand
raised by the Licensor, failing which, the Licensor shall be at
liberty to recover the same from the Bank Guarantee of the
Licensee, lying with the Licensor.
In addition to above, it is also made clear that such a licensee
who surrenders the PPA prematurely i.e. before completion of
license period as per initial allotment or subsequent extension,
he/she shall not be permitted to participate in any subsequent
auction of any paid parking area for a period of one year from the
date of handing over the possession back to the Licensor in respect
of surrendered PPA.
If the licensor wants to terminate the licence deed before
the
expiry date then the licensor will give at least one month notice
or pay money equal to one month licence fee. In an event of making
payment as above, the Licensor will be entitled to take over
possession within 24 hours thereafter.
A copy of minutes of the Committee, constituted to reconsider all
the terms and conditions
of paid parking areas as well as General instructions to
Applicants, held on 27.03.2014 is also annexed as
Annexure ‘B’.
In view of the position explained above, the matter is placed
before the Finance &

Subject: - To consider the request dated 21.04.2014 of Shri Harbans
Singh, License,
PPA of Piccadilly Multiplex(I),Sector 34-A, Chandigarh for allowing
him to run
the PPA for the remaining period of 1st year’s license i.e. from
23.05.2014 to
21.11.2014 by allowing him to withdraw his notice dated 20.02.2014
of three
months for premature termination of license w.e.f. 23.02.2014
.
In this connection, it is intimated that vide request dated
21.04.2014, (copy
annexed as Annexure ‘A’), Shri Harbans Singh, Licensee, Paid
Parking Area of Piccadilly
Multiplex (I), Sector 34-A, Chandigarh, has submitted that he is
ready to run the above said PPA
at the same rate of license fee i.e. Rs.10.85 Lac per annum for the
remaining period of 1st year
i.e. from 23.05.2014 to 21.11.2014 as per terms and conditions of
contract. He has requested to
allow him to run the above said Paid Parking Area for the remaining
period of 1st year by treating
the premature notice as withdrawn.
In this connection, it is submitted that the paid parking area of
Piccadilly
Multiplex(I), Sector 34-A, Chandigarh stands allotted to Shri
Harbans Singh S/o Raghbir Singh,
House No. 248, Phase 3B-I, Mohali (Punjab) as Licensee @ Rs.10.85
Lac per annum. The above
said Licensee of PPA of Piccadilly Multiplex (I),Sector 34-A,
Chandigarh had earlier given three
months’ notice to the Corporation for premature termination of
license on 20.02.2014 w.e.f.
23.02.2014 & with the approval of Commissioner, Municipal
Corporation, Chandigarh, the above
said Licensee stands intimated that his notice for three months for
premature termination of
license of PPA Piccadilly Multiplex (I), Sector 34-A, Chandigarh
has been accepted by the
Corporation subject to the condition that all the dues of license
fee, interest, penalties and Service
tax etc. must be cleared/settled by him with the Corporation well
in time. It may also be ensured
by him that due TCS must be deposited with the Income Tax
Department according to the due
dates of instalments of license fee. He also stands requested to
handover the vacant possession
of the above said PPA completes in all respects to the Area Junior
In-charge either on
22.05.2014 at 12.00 P.M. (midnight) or 23.05.2014 at 8.00 A.M.,
accordingly, the period of notice
for three months for premature termination of license is going to
expire on 22.05.2014.
There is no expressed provision dealing with withdrawal of notice
of premature
termination of license in the terms and conditions of paid parking
areas. Normally it is not open for
CMC to review his own orders, provided there is material change in
the circumstances, which
should be just and reasonable and in the interest of public as well
as the Corporation has already
passed for accepting the notice of the Licensee of the above said
PPA for premature termination
of license.
In view of the position explained above, the matter is placed
before the Finance &
Contract Committee to consider the request dated 21.04.2014
(Annexure ‘A’) of Shri Harbans
Singh, Licensee, Paid Parking Area of Piccadilly Multiplex (I),
Sector 34-A, Chandigarh, for
allowing him to run above said PPA for the remaining period of
license for 1st year i.e. from
23.05.2014 to 21.11.2014 at the same rate of Rs.10.85 Lac per annum
as per terms and
conditions of original contact by allowing him to withdraw his
notice dated 20.02.2014 of three
months for premature termination of license and take the
appropriate decision as deems fit.

of condemned vehicle Gypsy No. CH01G1-0146 under the charge

Chandigarh.
The M.C. P.H. Division No.3 is looking after the mtc. of water
supply of whole of the Chandigarh
alongwith villages, Reh. Colony & slums colony etc. water
supply . The inspection vehicle Maruti Gypsy is very old
(Model 1999). The estimate of purchase of 1 no. Maruti Gypsy
against the condemned vehicle CH01G10146 was
approved by the F&CC of M.C. Chandigarh in its 203th meeting
held on 24-12-2010. The Administrative approval
was issued by the C.M.C. vide his endst no. 681-87 dated 28-01-2011
amounting to Rs.5.23 lacs. The vehicle could
not be purchased as the rate contract has since been expired on
31-10-2010.
Now, the revised estimate for the purchase of 01No. Gypsy Hard Top
Euro 4 Model inspection
vehicle in lieu of condemned vehicle CH01G1 0146 has been prepared
amounting to Rs. 6,31,300/- on basis of
new rate contract of Maruti Suzuki India Limited.
As such, an estimate amounting to Rs.6,31,300/- duly allowed by the
competent authority is
placed before the Finance & Contracts Committee for its
consideration and approval. The expenditure shall be
chargeable to the Head:- “4215-(P) Aug. of water supply in
Chandigarh.”

expenditure involve comes
to Rs. 22,56,000/- for one year i.e. the date of acceptance and

Due to the implementation of model code of conduct, the Worthy CMC
has accorded approval to
procure Dry fodder form previous contractor on already approved
rates w.e.f. 01.04.2014 to
31.05.2014, for which ex-post facto sanction is required.
The proposal is placed before F&CC for its consideration and
approval, to procure
6000 Qtl. Green fodder from M/s U.K. Biswas being L-1 for which
total expenditure involve

Subject: Engagement of Data Entry Operators on contract basis in
the Municipal
Corporation, Chandigarh.
The various branches of the Municipal Corporation, Chandigarh are
facing acute
shortage of staff. The office has already relieved the Clerks
engaged through NIELIT.
The office requested to the SPIC (Society for Promotion of
Information Technology,
Chandigarh) to verify the availability of the Data Entry Operator
and to intimate the amount/salary
to be paid including the other charges. In reply to our request to
the SPIC (Society for Promotion of
Information Technology, Chandigarh), the authority has sent the
following terms & conditions for
the deployment of manpower services on contract.
1. The manpower services are provided purely on contract initially
for minimum period of one year
through SPIC.
2. The monthly consolidated contractual amount for the post of Data
Entry Operator for the non
sanction post will be Rs. 13,500/- p.m. and for the sanctioned post
will be Rs. 16,300/-
p.m. as per Deptt. of Personnel notification No.
28/54-IH(7)-2012/17126 dated 7.9.2012.
3. Society for Promotion of Information Technology, Chandigarh
(SPIC) admn. charges @ 10% and
service charges thereon as per rules would also be charged over and
above the monthly consolidated
contractual fixed amount.
4. The advertisement cost will also be borne by your deptt.
5. Any Govt. levies and Statutory obligations (PF/ESI etc.) if
applicable will also be borne by your
deptt.
6. The monthly contractual amount will be released only upon
receipt of same alongwith other charges
as notified at point-3 & 5 from your deptt. for which performa
invoice will be issued every month
well in advance
7. The contract will be further extendable keeping in view the
requirement of the services to be
forwarded by deptt before the expiry of contract period. No
official correspondence in this regard
will be sent from SPIC prior to expiry of the contract
period.

9. The contract shall be terminated as and when manpower services
are not required by the dept
without any prior notice.
10. The services rendered on contract basis shall not count towards
the benefit of pension or gratuity
etc.
11. The offer of appointment will not count as service and will not
bestow upon resource any claim for
regular appointment against any post in SPIC and/or
Department.
12. The attendance of the concerned may be considered upto 25
th
of every month to enable SPIC to
forward the invoice well in advance so that salary may be released
timely only upon receipt of same
from your department.
13. The office timings will be as per the directions of the Deptt.
from time to time.
14. No official accommodation shall be provided.
15. No leave of any kind shall be admissible except the holidays
observed by the department.
However, one may avail one day casual leave per month with prior
approval of Deptt.
16. In case resource will be required to take any journey in
connection with official work, TA/DA shall
be paid as admissible in department.
17. The resource will give a one month notice in case does not wish
to continue working with the
Department.
The SPIC (Society for Promotion of Information Technology,
Chandigarh) has clarified that
manpower services will be provided for minimum period of one
year.
As per provisions of section 71A (4) of the Punjab Municipal
Corporation Act, 1976 as
extended to the Union Territory, Chandigarh, the CMC may create any
post of Group B, C & D for the
period of 06 months.
At present, the Municipal Corporation, Chandigarh has no vacant
post of Data Entry
Operator but 13 posts of Clerks are lying vacant. Most of the
branches have requested to provide Data
Entry Operators. The SPIC (Society for Promotion of Information
Technology, Chandigarh) authorities
have also intimated that an amount of Rs. 13,500/- required to be
paid. In addition to above10%
Administrative Charges & service charges is to be paid as per
rules. The Municipal Corporation has
recently introduced the Tax on the residential building of the
Chandigarh. Many important projects like IT
Governance are being introduced and staff is not available for such
projects.
Keeping in view of the situation explained regarding the shortage
of staff of various
branches, the W/CMC may be authorized to create 22 posts of Data
Entry Operator of various branches
through the SPIC (Society for Promotion of Information Technology,
Chandigarh) who will be paid salary
of Rs. 13, 500/-. The SPIC (Society for Promotion of Information
Technology, Chandigarh) shall charge
10% Administrative charges and service charges/other taxes as per
rules for the period of one year. The
expenditure for the engagement of above said staff will be met out
from the contingency head of CMC
office from the current budget provisions.
The matter may be placed before the F & CC Committee for
consideration please.
