APPROVAL OF THE SEPTEMBER 17, 2015, MEETING MINUTES Jeremy Tobias made a motion to approve the September 17, 2015, meeting minutes. Alissa Thome seconded the motion. All Ayes. The motion carried.

LA COO PERA TIV A CAMPESINA DE CALIFORNIA ENERGY EFFICIENCY AND RENEW ABLE ENERGY (EERE) GRANT

Anne Meert explained to members that Employers' Training Resource (ETR) was recently informed that La Cooperativa Campesina de California (La Cooperativa) has received additional Workforce Innovation and Opportunity Act (WIOA) funding in the amount of$172,267 from the State of California Employment Development Department (EDD) for an Energy Efficiency and Renewable Energy (EERE) Grant. This Grant would begin October 1, 2015, and end September 30, 2016. She explained that nothing has been finalized yet. Stacy Ferreira made a motion to recommend to the Workforce Development Board to accept the $172,267 from La Cooperativa for the Dislocated Agricultural Worker EERE Program and to authorize the Assistant County

Administrative Officer to execute the necessary documents. Alissa Thome seconded the motion. All Ayes. The motion carried.

MARKET ING PRESENTATION

Danette Scarry updated members on what ETR's Marketing Department does to help employers and job seekers. She handed out two folders to members - one that is given to employers and another that is given to job seekers. She showed quick guides that are given to employers and job seekers. Lori Castro will send the two folders to Eric Cooper who was attending the meeting via conference phone.

She also explained the many types of flyers that are made for job recruitments, the different ways and methods used for advertising jobs and recruitments. She explained the department also provides marketing materials for our partner agencies.

Danette explained that there are only three full time marketing staff members in that department and they do all the graphics for flyers, signage, business cards for staff and set up and tear down of all meetings.

AMERICA'S JOB CENTER OF CALIFORNIA PARTNER UPDATE

Teresa Hitchcock gave members an update on the monthly meetings that the mandatory partners of America' s Job Center of California have had. Teresa explained a soft-skills sub-committee has been formed and with the help of the employer forums have created the top ten soft skills that employer's feel that job seekers need to work on. Bryan Mathews asked if there was a list that members could see. Lydia Rogers and Danette Scarry will provide an update on soft skills at the next Workforce Development meeting.

LEGISLATIVE UPDATE

Elaine Basham updated members about the current appropriations for Fiscal Year 2016. She explained that now appropriators have final budget amounts and can begin to renegotiate appropriation Bills. Elaine explained that the current House Bill keeps WIOA formula funding level at the expense of the National Emergency Grant (NEG) which got reduced by more than 65%.

WORKFORCE INNOVATION AND OPPORTUNIT Y ACT UPDATE

Elaine Basham stated that although final regulations for WIOA are supposed to be issued in January 2016, it is rumored that they may actually be issued in February 2016. The State Board intended to issue a draft WIOA State Plan in October 2015, but as of today, nothing had been issued.

In December 2014, the Workforce Development Board chose to retain the existing membership, even if it meant adding more Business members to be in compliance. Under WIOA the composition is changing. Elaine explained a chart that compared the Local Board membership under WIA and WIOA. Elaine stated that if we added a Labor member and a couple of Business

Members or Community-Based Organizations (CBO) that we could be in compliance. She will address this with the Workforce Development Board in December 2015.

COMMITTEE MEMBER COMMENTS

Ali Morris asked if a business member could also count as a CBO member. Elaine said yes that was possible, but each situation would have to be looked at individually to see if the member actually qualifies for both.

MISCELLANEOUS FILINGS

The Committee received copies of the First Quarter Enrollment Plan vs. Actual Report, First Quarter Budget vs. Actual report, and the Workforce Development Board and Committees' Meeting Schedules for 2015 and 2016.

REQUEST FOR PROPOSAL FOR WORKFORCE INNOVATION AND OPPORTUNITY ACT ADULT, DISLOCATED WORKER AND COMBINED PROGRAMS

Dear Committee Member:

It is time to begin the procurement for Workforce Innovation and Opportunity Act 0/\JIOA) Adult, Dislocated Worker and Combined Program in Kern County beginning Program Year 2016-17 (July 1, 2016 through June 30, 2017). However, due to the lack of final WIOA regulations (now expected to be out June 2016), the uncertainty of which services will be provided by partner agencies and unknown funding levels, we are seeking broad authority in the issuance of this Request for Proposals (RFP).

Status of WIOA and Final Regulations

WIOA was signed into law on July 22, 2014, and most WIOA provisions took effect on July 1, 2015. While many Workforce Investment Act (WIA) requirements remain under the new law, the Department of Labor and the State of California continue to provide technical assistance, tools, resources and guidance on WIOA implementation. As the goal of WIOA is to improve job and career options for workers and job seekers through enhanced, streamlined and stronger partnerships, we expect the role of each one-stop partner to impact which services we need to procure under the RFP. As the Memorandum of Understanding (MOU) is negotiated with each partner, it will become more evident which workforce services are needed. These MOUs will describe operations, services provided and coordinated, funding and referrals in two phases:

Phase I: Service Coordination

For Phase I, Local Boards are expected to work with all of the required and optional partners in their Local Area to develop an agreement regarding the operations of the local one-stop system as it relates to shared services and customers. Phase I of each MOU must be completed no later than June 30, 2016.

Phase II: Shared Resources

For Phase II, Local Boards should build upon the agreements established in Phase I and determine how to best support their established service delivery model through the sharing of resources and costs. Phase II of each MOU must be completed no later than December 31, 2017.

Training to begin the development of the MOU was held on February 2, 2016, in Sacramento. Key stakeholders participated in this training, and MOUs are in the process of being developed.

Funding

The WIOA allocation for Program Year 2016-17 has not yet been announced. We are hopeful that funding for Adult and Dislocated Worker programs will remain near the current level. This year, we will again be applying with the Department of Labor for the National Farmworker Jobs Program (NFJP) which would be for Program Years 2016-2019. Employers' Training Resource has been the NFJP recipient for Kern County since 1981. The outcome of that application will not be known until late spring.

Request for Proposal Process

The procurement will be for programs and services which are in addition to those already provided by Employers' Training Resource and other mandated America's Job Center of California (AJCC) partners. The RFP application will identify the types of programs and services which will be targeted. It will not include Youth programs since those are covered under a separate Request for Refunding process under the responsibility of the Youth Committee, and it will not include programs specific to the NFJP since those providers will be part of the application that, if funded, will be the presumptive providers of those services.

In addition, sole source awards will be allowed when there is only one possible provider of a service. For instance, the California Employment Development Department (EDD) is the only agency which has access to wage data used to determine if a WIOA client is working. Entered Employment Rate and Six Month Average Earnings are WIOA performance indicators, so knowing if a client is employed helps gauge our success.

As with WIA, providers of training services must be on the Eligible Training Provider List (ETPL) or meet the exception criteria. These providers must be registered in the ETPL data base, and agreements on behalf of the County of Kern will be issued to facilitate payments. Funds will be set aside for ETPL training services in a pool and accessed as clients receive training. Beginning Program Year 2016-17, Local Boards must spend at least 30 percent of the combined total of their Adult and Dislocated Worker WIOA formula fund allocations on training services. Up to 10 percent may come from designated leveraged resources. Likewise, funds will be set aside for On-the-Job Training contracts with employers.

The RFP will include the provision that awarded programs may be renewed, upon successfully meeting goals, for up to three years. The availability of the RFP will be

posted in the newspaper and accessed from our website. Interested applicants on our RFP mailing list will also be sent notice of its availability.

If needed, a subsequent RFP could be issued to ensure compliance with WIOA's final regulations and the needs of the AJCC system.

Current Economic Climate in Kern County

The downturn in the oil industry has resulted in hundreds of layoffs. Services specifically targeted to those dislocated workers may be included in the RFP.

Recommendation

We hope to have a clearer picture of the RFP at your Workforce Development Board meeting on March 17, 2016. It is your Committee's decision whether to agree to the issuance of a broad RFP today or defer the decision to the full Board .

Therefore, IT IS RECOMMENDED that your Committee either approve the issuance of a Request for Proposal for Adult, Dislocated Worker and Combined programs beginning Program Year 2016-17 or defer this decision to the full Board to act on at its March 17, 2016, meeting.

WORKFORCE STRATE GIES TO SERVE THE LONG TERM UNEMPLOYED IN CALIFORNIA PROJECT - PHASE Ill

Dear Committee Member:

In November 2014, Employers' Training Resource (ETR) entered into an agreement with the Southeast Los Angeles County Workforce Investment Board (SELACO WIB) to participate in a pilot project to serve primarily older (40+ years of age) long-term unemployed (26+ weeks) dislocated workers in four Workforce Development Areas (Kern, Monterey, Southern Los Angeles and San Mateo/Santa Clara Counties). The Workforce Strategies to Serve the Long Term Unemployed in California Project (LTU Project) provided employment and training activities for 48 participants in Kern County. ETR's allocation was $188,250, and the grant term was October 1, 2014, through September 30, 2015.

We were recently notified that the grant term was extended by the State, and a new Phase Ill of the project was added. Phase Ill targets 15 dislocated workers in each of the four Workforce Development Areas who have been unemployed at least 10 weeks and who have regular use of a computer with Internet access. These participants will be referred to one of two Internet-based placement companies - Career Arc and HireMojo. The placement companies will be responsible for on-line job search using career assessment, coaching, video interviewing, resume development and other services. The vendors will be paid by SELACO WIB with grant funds, but ETR will be responsible for enrolling its 15 clients, assisting those who need additional services, and administering a client satisfaction survey at the close of the grant. Phase Ill will end June 30, 2016, and an additional $10,000 was provided to ETR for this phase resulting in a total LTU Project budget of $198,250. As this was a unilateral amendment, no signatures were necessary.

LEGISLATIVE UPDATE

Dear Committee Member:

WORKFORCE INNOVATION AND OPPORTUNITY A CT (WIOA)

The Departments of Labor and Education, in collaboration with other Federal partner agencies, published five Notices of Proposed Rulemaking (NPRMs) in April 2015. In addition, the Departments and other Federal partner agencies published several proposed new Information Collection Requests (ICRs) in summer 2015 to inform stakeholders of new data elements that would need to be reported under WIOA The Departments received thousands of public comments, all of which must be considered in the development of final rules and ICRs. Given the complexity of these issues, the Departments are working toward making the final regulations publicly available in June 2016. Until then, the Departments intend to provide necessary information through guidance, notification of information collection requirements, and technical assistance.

APPROPRIATIONS UPDATE

The Fiscal Year 2016 Omnibus Appropriations Act restores WIOA Governor's Reserve Funds to 15 percent. While WIOA authorizes 15 percent funding as did WIA, this is the first time since 2010 that Congress has not included language in the appropriations act modifying the statutory level. Among other uses, WIOA requires Governors to use these funds to provide assistance to "local areas by providing information on and support for the effective development, convening, and implementation of industry or sector partnerships."

WORKFORCE INNOVATION AND OPPORTUNITY ACT (WIOA)

Dear Committee Member:

As was indicated in the legislation update, the release date for final WIOA regulations has been pushed out to June 2016. However, the federal agencies, as well as state agencies continue to issue guidance in order to meet specific milestones.

The State issued its draft Unified Plan for review and comments. The draft plan is available at: http://cwdb.ca.gov/WIOA Unified Strategic Workforce Development%20 Plan.htm Local planning will take place after the State issues guidance to the Local Areas.

The State also issued a directive regarding the mandated Memorandum of Understanding (MOU) required between One-Stop System Partner agencies. A list of those programs is attached. The State is implementing the MOU process in two phases. Phase I of the MOU is to develop the local one-stop system service delivery model, including shared customers and shared services. It is due to be completed by June 30, 2016. Per the State, this does not mean that Phase I must be fully implemented by this date, but rather shared customers and services defined, signed copies of the MOUs in place, and a joint effort towards implementation of Phase I underway.

The State Board, the Employment Development Department and the California Workforce Association are holding training for decision makers of local core partner agencies during February. Those agencies include Title I/Local Board, Title II Adult Education and Literacy, Title Ill regional Employment Development Department, Title IV local Vocational Rehabilitation, and local Human Services representing the Temporary Assistance to Need Families (TANF) known as CalWORKS.

Phase II , which is the financial agreement on infrastructure and funding (or in-kind) shared services; to be completed by December 31 , 2017.

The State Board has also released a directive on re-certifying the Local Board for Program Years 2016 and 2017 (i.e. July 1, 2016 through June 30, 2018). In the draft the State did not identify how they would measure that the "Local Board had demonstrated substantial progress towards implementing" the WIOA elements listed in the directive. This was amended to "Local Board provided status updates on key WIOA provisions". Important changes included, for example, changing "establishing MOU with local partners" to "completing Phase I of the MOU development process". Items about operator and provider procurement that are inconclusive at the federal level were also withdrawn as the State itself does not have final direction on implementing.
