ORDINANCE

ORDINANCE OF THE TOWNSHIP OF EDISON IN THE COUNTY OF MIDDLESEX, NEW JERSEY, VACATING PORTIONS OF CERTAIN RIGHTS OF WAY PURSUANT TO N.J.S.A. 40:67-19. WHEREAS, pursuant to N.J.S.A. 40:67-19 (the “Act”), the municipal council (the “Township Council”) of the Township of Edison (the “Township”) may determine that a dedication of lands as a public street that has not been accepted or opened by the Township may be released by ordinance if it appears that the public interest would be better served by releasing those lands from such dedication; and WHEREAS, various properties or portions thereof, which properties are identified in Exhibit A attached hereto (the “Properties”), have been dedicated for use as public rights of way but have never been opened as such; and WHEREAS, the Township has determined that vacation of the Properties would be in the best interests of the community as those Properties will not be used as public roads or rights of way and, as such, would not otherwise service the community. NOW, THEREFORE, BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF THE TOWNSHIP OF EDISON, AS FOLLOWS: Section 1. The foregoing recitals are hereby incorporated as if set forth in full herein. Section 2. In accordance with the provisions of the Act, the Township Council hereby vacates the Properties identified in Exhibit A attached hereto and releases such Properties from the dedication of the land for public streets or rights of way and extinguished the public right arising from such dedication; provided, however, that all rights and privileges possessed by public utilities, as defined in R.S. 48:2-13, and by any cable television company, as defined in the Cable Television Act, P.L. 1972, c.186, to maintain, repair and replace their existing facilities in, adjacent to, over or under the street, highway, lane, alley, square, place or park, or any part thereof, to be vacated, are expressly reserved and excepted from the vacation set forth herein. Section 3. The Mayor or Business Administrator, in consultation with Township staff and professionals, shall take such steps as may be necessary for the Township to deed the vacated Properties to private entities for the development of same. Section 4. The introduction of this Ordinance shall be advertised pursuant to N.J.S.A. 40:49-2; provided, however, that notice as to introduction and public hearing shall be made, pursuant to N.J.S.A. 40:49-6, at least ten days prior to the public hearing and adoption hereof. Section 5. Notice of the introduction of this Ordinance and the time and place when and where this Ordinance will be further considered for public hearing and final passage, including a copy of this Ordinance, shall be mailed to every person whose lands may be affected by this Ordinance, so far as same may be ascertained, directed to the last known post-office address, in accordance with the provisions of N.J.S.A. 40:49-6. Section 6. Within 60 days after adoption of this Ordinance, the Township Clerk shall cause this Ordinance, certified by her, under the seal of the Township to be filed in the office wherein conveyances of lands are recorded in the County of Middlesex. Section 7. This Ordinance shall take effect as provided by law.

ORDINANCE

ORDINANCE OF THE TOWNSHIP OF EDISON IN THE COUNTY OF MIDDLESEX, NEW JERSEY, AUTHORIZING THE SALE OF CERTAIN TOWNSHIP PROPERTIES PURSUANT TO N.J.S.A. 40A:12-1 ET SEQ. WHEREAS, pursuant to the Local Lands and Buildings Law, N.J.S.A. 40A:12-1 et seq. (the “Act”), the municipal council (the “Township Council”) of the Township of Edison (the “Township”) may sell any real property, capital improvement or personal property, or interests therein, not needed for public use, as set forth in an ordinance authorizing the sale; and WHEREAS, various properties currently owned by the Township, which properties are identified in Exhibit A attached hereto (the “Properties”), are each less than the minimum size required for development or are odd-sized and unsuitable for proper development; and WHEREAS, the Township has determined that sale of such Properties would be in the best interests of the community as those Properties could be made available for private ownership and development. NOW, THEREFORE, BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF THE TOWNSHIP OF EDISON, AS FOLLOWS: Section 1. The foregoing recitals are hereby incorporated as if set forth in full herein. Section 2. In accordance with N.J.S.A. 40A:12-13, the Township Council hereby authorizes the sale and conveyance of the Properties, identified in Exhibit A attached hereto, to private individuals and/or developers. Section 3. The Mayor or Business Administrator, in consultation with Township staff and professionals, shall take such steps as may be necessary for the Township to effectuate the sale of the Properties by open public sale or by private sale, in accordance with the provisions of the Act. RESOLUTION R.219-042016

Authorizing refund for redemption of tax sale certificates WHEREAS, the Tax Collector of the Township of Edison, Lina Vallejo, reports and advises that at various sales of land for delinquent taxes held by the Edison Township Collector of Taxes, Middlesex County, New Jersey, the attached listing of tax sale certificates were sold; and WHEREAS, the Tax Collector further reports that the said tax sale certificates have been redeemed thereof, and further advises that the purchasers of said property are legally entitled to a refund of monies paid at the time of redemption.

NOW THEREFORE, BE IT RESOLVED, by the Municipal Council of the Township of Edison, that the aforementioned recitals are incorporated herein as though fully set forth at length.

BE IT FURTHER RESOLVED, by the Municipal Council of the Township of Edison, that the appropriate official of the Township is hereby authorized to draw checks to the noted parties in the amounts specified on the attached listing, totaling $306,104.59.

RESOLUTION R.220-042016

Authorizing a tax exemption/refund for a disabled veteran for 32 Cambridge Rd. WHEREAS, pursuant to N.J.S.A. 54:4-3.30, the dwelling of a disabled veteran shall be exempt from real property taxes; and WHEREAS, Frank Yuhas is a veteran who has been determined to have suffered a 100% service-related disability; and WHEREAS, the determination of said disability is retroactive to October 20, 2015; and WHEREAS, real estate taxes on this property known as Block 1149 Lot 27, have been billed for 2015 and 1st half of 2016; and WHEREAS, pursuant to N.J.S.A. 54:4-3.32, the governing body of a municipality may by resolution cancel taxes due on a property which would have been exempt had the claim been made at the time they were due. WHEREAS, as permitted by N.J.S.A. 54:4-3.32, Township Code Section 5-7(d) also authorizes the return of property taxes for the current year and prior year but not greater than for a twenty-four (24) month period in the aggregate, or, should the Veteran's Administration determine that a veteran's disability date is greater than twenty-four (24) months from the date the applicant submits his/her application with the Tax Assessor's office, the Township will only be obligated to return taxes for a period of no greater than twenty-four (24) months from receipt of a completed application to the Tax Assessor. WHEREAS, pursuant to Township Code Section 5-7(d) the applicant is also due a refund of property taxes paid in prior year(s) from October 20, 2015 to March 31, 2016; and NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Edison that property taxes due on 1149 Lot 27, assessed to Frank Yuhas, be cancelled for 73 days of the 4th quarter of 2015 and the 1st and 2nd quarters of 2016 and also refunded for the municipal property taxes already paid for the time period of from October 20, 2015 thru March 31, 2016 in the amount of $2,711.98; and BE IT FURTHER RESOLVED that the Chief Financial Officer of the Township of Edison draw a check to the order of Frank Yuhas, taxes already paid during the applicable exemption periods set forth above in the total amount of $2,711.98.

WHEREAS, the Local Budget Law, specifically N.J.S.A. 40A:4-20, requires that the governing body of a municipality shall by Resolution make appropriations if any contract, commitments or payments are to be made between the beginning of the Calendar year and the adoption of budget; and

WHEREAS, the Local budget Law and the Optional Municipal Charter Act of 1950

provide for the adoption of municipal budget by March 20, 2016 (revised to April 22, 2016) unless said budget calendar is extended according to law; and

WHEREAS, in accordance with the authority set forth in N.J.S.A. 40A:11-12 of the Local Public Contracts Law, public bidding is not required when the purchase is under a state contract; and WHEREAS, the total amount of this contract for a twelve month period, not to exceed $125,000.00 (for cell phones and for air cards), cannot be encumbered at this time; and

WHEREAS, the Gladys Brooks Foundation has grant funds available, through its Grants for Libraries Program for library-related facility, material, equipment and associated costs in its established service areas; and

WHEREAS, the Edison Public Library intends to apply for grant funding for a maximum request up to $250,000.00 from the Gladys Brooks Foundation Grants for Libraries Program, for capital repairs and renovations to its facilities as it will help to further strengthen its mission, focus and vision through effective and diverse library services, programs, projects, events and activities; and

WHEREAS, on March 10, 2015, the New Jersey Supreme Court issued its decision, In the Matter

of the Adoption of N.J.A.C. 5:96 and 5:97 by the New Jersey Council on Affordable Housing, 221 N.J. 1

(2015)(the "2015 Case"), which transferred primary jurisdiction over affordable housing matters from the

New Jersey Council on Affordable Housing (“COAH”) to the New Jersey Superior Court, and established a

transitional process for municipalities, like the Township of Edison, to file declaratory judgment actions

seeking to declare their Housing Element and Fair Share Plans (“HEFSP”) as being constitutionally

compliant and seeking judicial protections and immunity; and

WHEREAS, pursuant to N.J.S.A. 52:27D-313 and the 2015 Case, the New Jersey Superior Court has

the authority to enter an Order granting protection and repose against exclusionary zoning litigation to a

municipality that is in compliance with its affordable housing obligations under the Fair Housing Act,

N.J.S.A. 52:27D-301, et seq.; and

WHEREAS, on July 7, 2015, the Township of Edison (the “Township” ) filed a declaratory

judgment action with the New Jersey Superior Court seeking to declare its HEFSP as being constitutionally

compliant and seeking protection and repose against exclusionary zoning litigation for a ten (10) year

period (the “Declaratory Judgment Action”). In that filing, the Township also sought a determination from

the Superior Court with respect to the Township’s future use and disposition of the Township’s Affordable

Housing Trust Funds, as directed by the New Jersey Appellate Division in the case, In Re Failure of the

Council on Affordable Housing to Adopt Trust Fund Commitment Regulations ; and

WHEREAS, the Superior Court of New Jersey has ordered that municipalities that filed declaratory

judgment actions must submit an updated HEFSP that address their affordable housing obligations as

calculated by municipal experts; and

WHEREAS, the Township’s Planning Consultant, Shirley M. Bishop, PP, has prepared an updated

2016 HEFSP (the “2016 HEFSP”) and will be preparing an updated Spending Plan, that addresses the

Township’s affordable housing obligations, based on a proposed settlement with the Fair Share Housing

Center (“FSHC”) and the Intervenors/Defendants in the Declaratory Judgment Action (the “Settlement

Agreement”); and

WHEREAS, the Settlement Agreement sets forth the 2016 HEFSP and other terms and conditions of

settlement to resolve and settle the Declaratory Judgment Action; and

WHEREAS, since a decision has not yet been rendered on the methodology to calculate

municipal affordable housing obligations, the New Jersey Superior Court advised that it is acceptable if the

Planning Board does not undertake all of the formal, procedural requirements involved with adopting the

2016 HEFSP as an amendment to the Township’s Master Plan, if the Planning Board instead adopts a

Resolution accepting the 2016 HEFSP and commits to promptly comply with the formal, procedural

requirements for the adoption of the 2016 HEFSP, as an amendment to the Township’s Master Plan, if the

2016 HEFSP is approved by the Court; and

WHEREAS, Council desires to request that the Planning Board adopt such Resolution at its April

18, 2016 Meeting, and after such adoption, Council anticipates that it will take action to adopt a Resolution

at its April 27, 2016 Meeting, to approve the Settlement Agreement and authorize the submission of the

Settlement Agreement and the 2016 HEFSP to the New Jersey Superior Court for its review and action, to

settle the pending Declaratory Judgment Action.

NOW THEREFORE, BE IT RESOLVED by the Municipal Council of the Township of

Edison, County of Middlesex, New Jersey that:

1. The aforementioned recitals are incorporated herein as though fully set forth at length. 2. The Municipal Council hereby authorizes the submission of the 2016 HEFSP to the

WHEREAS, in 2008, the Township of Edison (the “Township”) and the Edison Memorial Tower Corporation (the “Corporation”) successfully applied to the County of Middlesex (the “County”) for a $375,000 grant from the Open Space, Recreation and Farmland Preservation Trust Fund (the “Trust Fund”) to assist with the restoration of the Edison Memorial Tower (the “Project”); and

WHEREAS, on May 16, 2011, after determining the actual cost of the Project, the Township and

the Corporation requested from the County an additional Trust Fund grant in the amount of $300,000; and WHEREAS, on or about June 9, 2011, the County and the Township entered into a grant

agreement, wherein the County agreed to provide the Township with a grant in the amount of $300,000 (the “2011 Grant”); and

WHEREAS, the Project was managed by the New Jersey Department of Environmental

Protection (the “DEP”); and WHEREAS, the Project has since been completed but funds from the 2011 Grant have not been

remitted to DEP; and WHEREAS, the Township now desires to transfer back to the County the 2011 Grant funds,

which will be held by the County in a reserve account and which funds the County will be obligated to remit to DEP upon its request.

NOW, THEREFORE, BE IT RESOLVED by the Municipal Council of the Township of Edison, County of Middlesex, State of New Jersey, as follows:

Emergency Generator Program in accordance with COAH’s directives, which set forth the application process for applicants to comply with in order to participate in the Program and receive a grant for such work under the Program; and

WHEREAS, an application to participate in the Program was submitted by the Housing Authority

of the Township of Edison and was reviewed and deemed complete and in compliance with the Program requirements; and

WHEREAS, the Township Council desires to award a grant to the Housing Authority of the

Township of Edison in the amount of $45,301.55 for the purchase and installation of an emergency generator and additional charges from Elizabethtown Gas for Robert Holmes Gardens under the Township’s Emergency Generator Program and to authorize the execution of an Agreement between the Township and the Housing Authority of the Township of Edison with respect to such grant.

EXPLANATION: With this resolution, the Township Council approves the receipt of the FY2016 Community Development Block Grant in the final amount of $535,448 and approves the projects and activities funded by this grant.

RESOLUTION OF THE TOWNSHIP COUNCIL OF THE TOWNSHIP OF EDISON APPROVING THE FISCAL YEAR 2016 COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM AND THE FILING OF THE FISCAL YEAR 2016 CONSOLIDATED ANNUAL ACTION PLAN

WHEREAS, under Title I of the Housing and Community Development Act of 1974, as amended, the Secretary of Housing and Urban Development is authorized to extend financial assistance to communities for the elimination or prevention of slums or urban blight, or activities which benefit low and moderate income families, or other urgent community needs; and

WHEREAS, the U.S. Department of Housing and Urban Development has advised the Township of its willingness to provide a Fiscal Year 2016 Community Development Block Grant in the amount of $535,448;

WHEREAS, the Township can budget a total of $535,448 to fund eligible 2016 activities that are attached and listed on the Amended Proposed Summary of FY16 Annual Action Plan Allocations, that will be carried out during the 2016 Program Year;

WHEREAS, A Public Hearing was held on February 17, 2016 to provide citizen participation in the development of the Consolidated Annual Action Plan for Fiscal Year 2016;

NOW, THEREFORE, BE IT RESOLVED BY THE TOWNSHIP COUNCIL OF EDISON THAT:

Section 1. The application for the Consolidated Annual Action Plan for Fiscal Year 2016 Community Development Block Grant Program for the Township of Edison is hereby in all respects approved.

Section 2. It is cognizant of the conditions that are imposed in the undertaking and carrying out of community development activities with federal financial assistance under Title I, including those relating to (a) the relocation of site occupants; (b) the prohibition of discrimination because of race, color, creed, national origin, or handicap and other assurances set forth under certifications.

Section 3. The Mayor of the Township of Edison, on behalf of the Township Council, is authorized to file an application for $535,448, which the U.S. Department of Housing and Urban Development has indicated its willingness to make available to carry out the Community Development Program’s activities that are attached as the Proposed Summary of FY16 Annual Action Plan Allocations and listed in the 2016 Fiscal Year Consolidated Annual Action Plan, and act as an authorized representative of the Township of Edison.

Section 4. The Mayor of the Township of Edison, on behalf of the Township Council, is hereby authorized to provide such assurances and/or certifications as are required by the Housing and Community Development Act of 1974, as amended, and also any supplemental or revised data which HUD may request in connection with the review of this application.

Section 5. The Mayor of the Township of Edison, on behalf of the Township Council, is hereby

authorized to enter into Agreements with the Sub-Grantees (Subrecipient) listed on the attached Proposed

WHEREAS, Georgia-Pacific has grant funds available, through its Bucket Brigade Grant Program for fire-related equipment and associated costs of qualified public-safety organizations in communities where it has established facilities; and

WHEREAS, the Edison Division of Fire intends to apply for grant funding for a maximum request up to $10,000.00 from the Georgia-Pacific Bucket Brigade Grant Program, as it will help to further strengthen its mission, focus and vision through effective programs, projects, events and activities; and

WHEREAS, no matching funds are required in order for the Edison Division of Fire to apply for grant funding from the Georgia-Pacific Bucket Brigade Grant Program; and

WHEREAS, the Edison Division of Fire will utilize all grant funds awarded to it by the Georgia-Pacific Bucket Brigade Grant Program, as described in its application for said funds and in compliance with all applicable Municipal, Middlesex County, New Jersey and United States federal requirements, guidelines, regulations and statutes; and

RESOLUTION AWARDING CONTRACT/PURCHASE ORDER TO KUSTOM SIGNALS, INC., FOR THE PURCHASE OF NINE (9) IN CAR MOBILE VIDEO RECORDERS FOR THE POLICE DIVISION

WHEREAS, the Edison Police Division is in need of nine (9) new in car mobile video recorders; and WHEREAS; these recorders are designed to provide an audio and video recording of traffic stops, pursuits, D.U.I. tests, etc.; and

WHEREAS, we currently own approximately fifty eight (58) Kustom Signal brand mobile video recorders and this equipment is proprietary to KUSTOM SIGNALS, INC., 9652 Loriet Blvd., Lenexa, KS 66219 and Kustom Signals, Inc., is the sole vendor for this equipment; and WHEREAS, KUSTOM SIGNALS, INC., has submitted a proposal to provide the nine (9) video recorders, installation, antennas, warranty and software for $63,378.00; and

WHEREAS, this shall be awarded as a non-fair and open contract pursuant to the provisions of N.J.S.A. 19:44A-20.5 et. Seq.; and

WHEREAS, the Purchasing Agent has determined and certified in writing that the value of the acquisition

will exceed $17,500.00; and

WHEREAS, KUSTOM SIGNALS, INC., has completed and submitted a Business Entity Disclosure Certification which certifies that they have not made any reportable contributions to a political or candidate committee in the Township of Edison in the previous one year, and that the contract will prohibit KUSTOM SIGNALS, INC. from making any reportable contributions through the term of the contract.

(“Seller”) to Seasons 52 Holdings, LLC (“Applicant”) to be used at Applicant’s business location at 217 Lafayette Avenue, Edison; and

WHEREAS, the Applicant’s submitted application form is complete in all respects, the transfer fees have

been paid and the License has been properly renewed for the current license term; and

WHEREAS, the applicant is qualified to be licensed according to all standards established by Title 13 of the New Jersey Statutes, regulations promulgated thereunder, as well as pertinent local ordinances and conditions consistent with Title 33; and

WHEREAS, the applicant has disclosed and the issuing authority reviewed the source of all funds used in the purchase of the License and the licensed business and all additional financing obtained in connection with the licensed business; and

WHEREAS, public notice of this transfer has been published in the Home News Tribune, a New Jersey publication, in accordance with law; and

WHEREAS, no legally valid objections have been received nor made as to why this transfer should not be granted to the Applicant.

NOW THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE TOWNSHIP

3. The Township Clerk is hereby directed to endorse the Applicant’s current license certificate as follows: “This license, subject to all of its terms and conditions, is hereby transferred to Seasons 52 Holdings, LLC at business premises to be located at 217 Lafayette Avenue, Edison, New Jersey.”

4. This Resolution shall take effect immediately.

WHEREAS, it is the duty of the Municipal Council to appoint a Deputy Municipal Clerk for the Township of Edison; and WHEREAS, Marlena McCray currently is a Processing Clerk in the Clerk’s office and has already completed one of the courses toward her Registered Municipal Clerk’s certificate; and

NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Edison that Marlena McCray be appointed to the position of Deputy Municipal Clerk of the Township of Edison, term to be effective April 13, 2016 through April 13, 2019.
