3.1 Warilla Library Aboriginal Heritage Impact Permit & Aboriginal Heritage Archaeological Assessment Final Report

The purpose of the Report is to provide an update on the Aboriginal Heritage Archaeological Assessment (Assessment) on the new Warilla Library site located on the corner of Woolworths Avenue and Commerce Drive, Warilla. As previously advised Austral Archaeology have been engaged to conduct a Preliminary Aboriginal Archaeological Assessment and a draft copy of the Preliminary Assessment (and the recommendations contained within the report) were provided to the AAC at its meeting on Tuesday 5 May 2015. Austral Archaeology recommended that the Preliminary Assessment could not conclusively identify where the shell deposit originated and therefore recommended a full Aboriginal Heritage Archaeological Assessment be conducted. Council’s ACLO was then provided the draft Assessment on Tuesday 29 March 2016, seeking review and comment from Council’s Project Delivery Officer. The ACLO sought clarification on the registered Aboriginal stakeholders (stakeholders) comments. The ACLO was advised that as per the Office of Environment and Heritage ‘Aboriginal Cultural Heritage Consultation Requirements for Proponents 2010’ the stakeholders have a minimum of 28 days to make submissions on the draft Assessment before the Consultants could provide the final report.

A copy of the final Aboriginal Heritage Archaeological Assessment was then provided to Council’s ACLO on the 19 May 2016 who was advised that there were no comments or contributions from the stakeholders within the 28 day review period. Basil Smith from GDPL had indicated he would review and comment but did not do so within the review period. In addition, fieldwork was conducted over four days between the 27 January and 1 February 2016 with Aboriginal stakeholder participation from James Davis, Richard Dutton, Duncan Falk, Kayla Williamson and Paul Cummins. Based on this information, Council’s ACLO advised Council’s Project Delivery Officer that it appears that none of the registered stakeholders (including the Illawarra Local Aboriginal Land Council) provided any response to the Draft Report which was provided to them according to the Consultation Log on 18 April 2016. It is unfortunate that there was no follow-up on the draft Aboriginal Heritage Archaeological Assessment from the registered Aboriginal stakeholders during the 28 day consultation period. Council’s ALCO has read the conclusion and recommendations and in the absence of no response from the Aboriginal registered stakeholders, Council is satisfied that the proponent has fulfilled the requirements and statutory obligations under the National Parks & Wildlife Act 1977 and the Aboriginal Heritage Impact Permit (AHIP) No. C00001497 regarding Aboriginal Culture and Heritage of the proposed development site on Lot 16 & Part of Lot 15, DP 717959 (Cnr of Woolworths Ave & Commerce Drive, Warilla). To finalise the Warilla Library Aboriginal Heritage Impact Permit process a copy of the final Report has been provided to the Office of Environment and Heritage. Austral Archaeology will submit a site impact form and deregister the site from the Aboriginal Heritage Information Management System (AHIMS) database as per the recommendation within the Report. Recommendation: The AAC receive and note the Information Report provided by Shellharbour City Council and the recommendations made by Council’s Aboriginal Community Liaison Officer. Attachment:

3.2 Membership Update - Aboriginal Advisory Committee

(10742792) The Aboriginal Advisory Committee recommended on Tuesday 1 March 2016 to fill the casual vacancies. To ensure compliance with procedural fairness processes, those members who failed to fulfil the requirements under Rule 7 of the AAC’s Terms of Reference, were advised of their failure to attend three or more consecutive AAC meetings without submitting an apology and offered an opportunity to provide reasons as to why they should remain a Committee member. A Report was then provided to the last AAC Meeting held on Tuesday 3 May 2016 regarding the outcome of this process. At the AAC meeting held in May, it was recommended that because Jodi Edwards was on the waiting list that she be offered one of the two vacancies and the other be filled through way of advertising. Unfortunately, this was not recorded in previous minutes and needs to be ratified at the AAC meeting to be held on Tuesday 26 July 2016. The advertisement to fill the AAC vacancies was published on the 1 June 2016 and closed on Friday 1 July 2016. No applications were received. Placing another advertisement in the paper would come with further advertising costs. It is therefore proposed that the AAC approach previous AAC Members and ask them to submit an expression of interest in the current AAC vacancy. To ensure the AAC can maintain their quorum it is important the two vacancies be filled as soon as possible. Recommendation: The AAC endorse Jodi Edwards to fill one of the current vacancies on the Aboriginal Advisory Committee as discussed at the AAC meeting held in May. The AAC recommend we approach previous members of the Committee to submit an expression of interest for the vacancy and that the AAC make a decision at the next scheduled meeting to be held on Tuesday 27 September. 3.3 Environment Services - Windang Walks (10742790) The purpose of this report is to advise the AAC of Council’s desire to run the guided nature walks at Windang and around Windang Island again due to the previous popularity of the walks. To follow protocol and to overcome any concerns raised by the local Aboriginal community regarding the nature walks, Council’s ACLO advised Council’s Environmental Services that an Information Report be provided to the AAC to keep AAC members informed in the event they are questioned about why the walks are being conducted. The proposed dates for the nature walks are Sunday 14 August and Monday 29 August 2016. The following is an extract from the Information Sheet on the Windang nature walks. Exploring Windang Island Come and explore this unique coastal environment on a guided nature walk from 9:30am – 12:30pm on Sunday 14th August or 10am – 1pm on Monday 29th August. Located at the entrance to Lake Illawarra and linked to the mainland by a sand spit, Windang Island has high conservation significance and a fascinating history. Hear about the threatened grasslands, talk about the geology and history of the island, see the wheels and rails remaining from a failed attempt at making a harbour in the 1890's and spot life in the rock pools and surrounding beach area. Bring your binoculars if you have them and we will take some time to look for whales and sea birds from the great vantage point at the end of the Island. This is an easy walk but you must have a reasonable level of fitness and agility as there is some walking on wet rocks, stair climbing and walking on sand. Children aged over 12 years are welcome if accompanied by an adult. Places are limited and bookings are essential, call Council on 4221 6111 or email [email protected]. Council’s Environmental Services would like to know whether the AAC have suggested changes to the above description or the attached information sheet which reflects and respects Aboriginal heritage. Recommendation: The AAC endorse the attached Information Sheet on Windang Island which includes information on Aboriginal heritage. Attachment:

3.4 Development Control Plan Chapter 27 - Aboriginal Culture and

Heritage (10742794) The purpose of this Report is to provide the Aboriginal Advisory Committee members an update on the changes to Shellharbour City Council’s Development Control Plan (DCP) which includes a new Chapter on Aboriginal Culture and Heritage. At the last AAC meeting held on 3 May 2016, Michael Tuffy, Council’s Senior Planning Officer presented on the proposed changes to Council’s DCP and the Aboriginal Heritage chapter. This chapter has been modified to incorporate the relevant components of the Council endorsed Aboriginal Cultural Heritage Development Assessment Toolkit (the Toolkit). The AAC were also advised the DCP will be on public exhibition from Wednesday 6 April to Thursday 5 May 2016. The draft DCP was provided to relevant Aboriginal stakeholders during the exhibition period for their feedback and comment which included the Illawarra Local Aboriginal Land Council. No responses were received within the 28-day public exhibition period from Aboriginal stakeholders. The Office of Environment and Heritage (OEH) did make a submission on Chapter 27 of the DCP. Council officers met to discuss the OEH’s comments and made variations to Chapter 27 based on their feedback. A copy of the draft Shellharbour Development Control Plan including the changes based on their submission was provided to OEH. Council endorsed the Shellharbour draft Development Control Plan (Amendment 1) on 28 June 2016 and the DCP came into effect on Wednesday 6 July 2016. Council officers are currently working on DCP fact sheets as recommended by the AAC Members in May. A copy of the draft fact sheets will be provided to members at the next meeting of the AAC on Tuesday 26 July 2016 for review and comments. Recommendation: The AAC receive and note the report on the Shellharbour City Council Development Control Plan Chapter 27 – Aboriginal Culture and Heritage. 3.5 NSW Local Government Aboriginal Network Conference

(10742695) The NSW Local Government Aboriginal Network (NSW LGAN) has been operating since 1988. The conference provides information exchange and acts as a forum for discussion on Local Government issues relating to Aboriginal communities, business and the wider community. The aim of the conference is to provide an exciting and interesting forum for enhancing the profile of Aboriginal communities, their skills and culture and discussion on current issues such as employment strategies, enterprise and cultural development and policies. The 28th Annual NSW LGAN Conference will be hosted by Tweed Shire Council at the Twin Towns Clubs & Resorts, Tweed Heads. The Conference will be held from Wednesday 24 August to Friday 26 August 2016 inclusive. The theme for the NSW LGAN Conference for 2016 is ‘Our Living Culture – Past, Present and Future’. Sessions include:

• Aboriginal culture and heritage • Local government policies and procedures for Aboriginal communities and

organisations • Keynote Address from The Hon. Leslie Williams, Minister for Aboriginal Affairs • Social and relevant issues for Aboriginal communities • Question and Answer panel on Aboriginal people running for Local

Government The Program is attached and as follows: Wednesday 24 August Cultural Tour 9.30am to 4.00pm Evening Welcome Function 4.00pm to 6.00pm Minjungbal Museum and Cultural Centre Thursday 25 August Conference Day 1 - 9.00am to 3.30pm LGAN Conference Dinner and Awards Twin Towns Clubs Showroom Friday 26 August Conference Day 2 - 9.00am to 4.00pm (includes Indigenous Constitutional Recognition Forum 1.00pm to 3.00pm).

Each year, two members of the committee are invited to represent the AAC at the conference. It is then requested that the members provide a report back to the AAC following the conference. Recommendation: That the AAC recommend two representatives to attend the 2016 NSW Local Government Aboriginal Network Conference which is being hosted by the Tweed Shire Council. 4. General Business

4.1 NAIDOC Week

4.1.1 2016 Local Government Regional NAIDOC Awards Dinner (10703167).

Local Government Regional NAIDOC Awards Dinner The Local Government Regional NAIDOC Awards Dinner Organising Committee (Organising Committee) have had weekly meeting scheduled during June in the lead up to the Awards Dinner. The NAIDOC Awards offer the regional communities the chance to celebrate our talented Indigenous brothers and sisters and shine a spotlight on their achievements. The event continues to be supported and embraced by the community, this is testament to the amount of sponsorship raised, the nominations received and number of tickets sold, which have exceeded our expectations. The following provides an update on the preparation regarding the WIN Entertainment Centre (WEC), entertainment and ticket sales. Venue: The venue hire agreement has been finalised. Shellharbour City Council are in daily contact with the venue to coordinate the venue logistics. The menu selections have been finalised, with special dietary requirements met. Arena AV have been engaged for sound and lighting and the cost has been negotiated at a reduced rate of $8,000. Ticket Sales: The original target set for the event was 400 guests. We are likely to exceed that number with 387 tickets purchased to date. Ticketmaster continue to sell tickets online and daily reports are received. To date 47 tickets have been sold via Ticketmaster. Shellharbour City Council staff have concentrated on selling directly to organisations to purchase whole tables. This has been extremely successful and also contributed to subsidizing the Elders tickets. Entertainment: The program has been finalised and coordinated with the venue caterers to ensure minimal disruption during artist’s performance. All performers previously reported are confirmed and a rehearsal of local performers will be held the weekend prior to event.

We have sought to include local traditional dance groups as a whole community approach to the traditional presentation. A traditional smoking ceremony will welcome guests and aims to set the tone of the event. Community Engagement: Significant work has been undertaken with a number of community groups and local schools in the preparation of table centre pieces for the event. The creation of these pieces received local media attention and have been praised. Twenty-five of the centrepieces will be returned to the participating schools following the event with the remaining twenty-five sold at the dinner. The funds will be donated back to the community groups that created the pieces to recoup costs. Nominations: A total of 25 nominations were received across the categories. An independent panel assessed these against a set criterion. Winners have been selected for each category and will be announced on the night. Nominators have been notified of shortlisted nominees. Graphics: Final material for the dinner is been developed by Shellharbour City Council Graphic Designer these include; event tickets, event program, table cards, table menus, table allocation arrangement and posters. Recommendation:
