Summary:
The first term of Kane County’s Electrical Power Aggregation Program will end in August 2017. As the County pursues options for renewing the program for a second term, authorizing the County Board Chairman to sign a contract with a certified Retail Electric Supplier is necessary for implementing the program and obtaining the best electrical rate for residents and small businesses in unincorporated Kane County. Due to the fluctuation in the electrical supply market, Retail Electrical Suppliers will not hold any quoted price for longer than 24 hours. Kane County follows this same practice of authorizing the County Board Chairman to sign electric supplier contracts when securing electric rates for many of its own facilities.

AUTHORIZING THE BOARD CHAIRMAN TO SIGN A POWER SUPPLY AGREEMENT FOR THE KANE COUNTY ELECTRICAL POWER AGGREGATION PROGRAM
WHEREAS, Section 1-92 of the Illinois Power Agency Act allows for the aggregation of electrical loads by municipalities and counties, provided the municipality or county adopt an ordinance under which it may aggregate residential and small commercial retail electrical loads located within its jurisdiction in accordance with this Section; and
WHEREAS, Kane County presented a referendum on March 18, 2014, asking voters if the
county should have the authority to arrange for the supply of electricity for its residential and small commercial retail customers who have not opted out of the program, and a majority voted in the affirmative; and
WHEREAS, on August 12, 2014, the Kane County Board adopted Ordinance 14-234 to
approve the Kane County Electrical Power Aggregation Plan of Operation and Governance; and WHEREAS, the current two-year contract with a Retail Electric Supplier for the Electrical
Aggregation Program expires in August 2017, so the County needs to solicit bids for a new contract, anticipated to begin in August 2017; and
WHEREAS, the County is working with a qualified electrical utility consultant to receive and
review bids through a process which allows real-time submittal and to award the purchase of electricity on the day of opening said bids, a practice the County has previously utilized when securing electric rates for its own facilities.
NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that the Chairman of
the Board or his designee in writing be given the specific authority to award the contract to a Retail Electric Supplier under the Kane County Electrical Aggregation Program, without further action by the County Board. Final terms of said contract will be determined by the most favorable electric rate for the Program.

WHEREAS, Kane County currently holds a (5) five-year contract with Advanced Disposal for trash and recycling service for Mill Creek SSA (as per resolution #15-234, passed by the County Board on September 8th, 2015) ; and
WHEREAS, the service provided by Advanced Disposal to date (over the last 11 years) has
been exceptional and had no fault; and WHEREAS, the 2015 Kane County Solid Waste Plan encourages separation and collection
of food scraps for composting on commercial and residential levels; and WHEREAS, there are over(20) twenty similar food scrap collection programs in the region in
Lake, Cook, and DuPage Counties; and WHEREAS, Advanced Disposal has offered to add the additional service of food scrap
collection to the existing collection service at no additional cost; and WHEREAS, the same food scraps that have been at the curb in the trash cart will instead be
placed in the yard waste cart voluntarily by residents; and WHEREAS, there will be no additional cost to County or residents of Mill Creek. NOW, THEREFORE, BE IT RESOLVED that the contract (Bid #36-015) be amended as
outlined in attached Rider for Acceptance of Amendment to Scope of Service food Scrap Collection Pilot (Optional Program).

Food Scrap Collection Pilot (Optional Program)
This RIDER made this ______ day of __________, 2017 is part of and is to be attached to the Offer to Contract Form (Bid 36-015) made on September 8, 2015, per Resolution 15-234, by and between County of Kane and Advanced Disposal Services Solid Waste Midwest, LLC of Batavia, IL.
It is the intent of the Kane County, in accordance with the Kane County Solid Waste Plan, to
promote a food scrap collection program per Scope of Work, Section 37. Food Scrap Collection
Pilot (optional) and General Specification if feasible under the same contract terms and
conditions.
The Contractor agrees and offer to provide the food scrap collection program at no additional cost
to the County, and residents of Mill Creek. This collection program to commence on May 15th,
2017 for the duration of contract, expires on or about October 31, 2020.
The County hereby agrees to accept and incorporate the attached Amendment (Exhibit 1 -
Amendment to Refuse and Recycling Services for the Mill Creek SSA Contract) to the
County’s Offer to Contract, accepting of Advanced Disposal Services Solid Waste Midwest, LLC
agreement for the pilot food scrap collection program.
The parties hereto mutually agree that the aforesaid Amendment, of which this RIDER is made part, is and shall be and remain in full force and effect in accordance with all the terms and conditions thereof, modified only as in this RIDER specifically provided.

Amendment to Refuse and Recycling Services for the Mill Creek SSA Contract

III. General Specifications, Section 2 – Definitions & Section 37 - Food Scrap
Collection Pilot
2. Definitions, Food Scrap: for the purpose of a potential food scrap collection pilot program (Section 37), is defined as organic matter such as vegetable scraps, fruit peels, bread, dairy, and other plant matter. It may or may not also include compostable non-food items such as napkins, paper towels, waxed paper, and paper plates/cups. 37. FOOD SCRAP COLLECTION PILOT (optional) It is the intent of the Kane County Recycling Coordinator, in accordance with the Kane County Solid Waste Plan, to promote food scrap diversion in Kane County. During the term of this contract, the Contractor agrees to discuss the feasibility and logistics of conducting a voluntary food scrap collection pilot program for the residents of Mill Creek, and be willing to implement same. See Section 2. Definition for Food Scrap. Ideally food scrap would be included with yard waste and delivered to a transfer station or composting facility that can receive mixed organic waste. There will not be an additional cost to the County or the Residents for this add on service. Specifications for this program have been developed jointly between the Contractor and the Recycling Coordinator, as below. By this Amendment the following terms are incorporated into the contract. Terms - Food Scrap Collection Pilot
Start Date of Pilot: May 15th, 2017
Beginning May 2017, Advanced Disposal will begin accepting food scraps as a part of
the yard waste program for Mill Creek. Acceptable items will be mixed in with traditional
yard waste items - grass, leaves and branches, in a yard waste cart. This is called a ride-
along program because the food scraps ride along with yard waste that is already being
collected.
Placing food scraps into the yard waste cart is no different than having them in the trash
cart at the curb; the material is the same as always but it is just a different cart.
All of the size, weight and payment requirements will remain the same as in the
contract. There will be no additional charge to residents for this ride-along food scrap
recycling program. If residents want to participate, but do not yet have a yard waste
cart they may choose to move to option 3 (Three-cart Program) as per the contract.
Yard waste is collected weekly between April 1 and November 30 under the current
contract. That remains the same.

Combined organics (yard waste, food scraps, food-soiled paper items generated by the
residents of Mill Creek) will be delivered to Compost Supply, a permitted commercial
compost processing facility in LaSalle County for composting.
Acceptable food scrap items that may be added to the yard waste cart in this program
include: Fruits & Vegetables including unpainted holiday pumpkins; Dairy & Eggs
including egg shells, but no liquids; Breads, Grains, Pasta & Cereal; Coffee Grounds &
Filters; Teabags; Paper Products and may include paper towels, napkins, & tissues.
Items not accepted in the program include: Meat, Poultry and Seafood; Bones and Shells;
Fats, Grease and Oil; Liquids; Packaging; Paper Plates, and any other service ware;
Plastics, Styrofoam, Glass, Metal, Diapers, and Pet Waste.
Residents may be advised to:
Place their cart out weekly for collection if they are adding food waste to the yard
waste.
Place yard trimmings or newspaper at the bottom of the cart as a lining.
Place food scraps directly into the cart, layered with yard trimmings.
Wrap food scraps in paper towels, newspaper or Kraft paper bags for a cleaner
cart.
Rinse cart with a garden hose when necessary. Periodically rinse with soap and
water. Sprinkle in baking soda as needed. Keep lid closed and store in a shaded
area.
