This section of the Agenda is titled Requests and Petitions of Citizens. This is an
opportunity for public comment, and we thank you for coming to the Board ofAldermen meeting tonight to share your views. We value all citizen input.
Speaker comments are limited to a maximum of 4 minutes during the publiccomment period. At the conclusion of 4 minutes, each speaker shall leave thepodium. Comments will be directed to the full board, not to an individual boardmember or staff member. Although the board is interested in hearing yourcomments, speakers should not expect any comments, action, or deliberation fromthe board on any issue raised during the public comment period.
In the board' s discretion, it may refer issues to the appropriate city officials or stafffor further investigation. If an organized group is present to speak on a commonissue, please designate one person to present the group' s comment, which shallbe limited to a maximum of 4 minutes.

4. Consider Approving a Proclamation Memorializing Joseph " Jay" Mattingly.
Joseph " Jay" Mattingly, a former City of New Bern Alderman, passed away onSeptember 24, 2020. The proclamation will memorialize his life and service to thecitizens of New Bern.
5. Consider Approving a Proclamation for Hispanic Heritage Month.
George Hendrix, Advocacy Director with the Association of Mexicans in NC, Inc.,has requested a proclamation recognizing Hispanic Heritage Month, which is
celebrated annually from September 15th through October 15tn
6. Approve Minutes.
Draft minutes from the September 22, 2020 regular meeting and September 29,2020 special meeting are provided for review and approval.
7. Presentation of Proclamation to HistoriCorps.
The Board approved a proclamation for HistoriCorps on September 8, 2020.
Jeannie Tyson has requested that the Board personally present the proclamationto a representative from HistoriCorps at this meeting. She will be in attendance
along with Bill McCrae, Executive Director of Tryon Palace, and a representativefrom HistoriCorps.
8. Presentation by Craven County Alcoholic Beverage Control Board.
Chip Chagnon, Chairman of the Craven County ABC Board, will present a check tothe City for its portion of ABC sales. He will also provide an annual briefingregarding the ABC Board.
9. Presentation on Parks and Recreation " Rec Card".
Foster Hughes, Director of Parks and Recreation, will share a PowerPointpresentation to review the new "Rec Card". He will provide information on why theprogram is being implemented, how it will be utilized, and how citizens can obtaina card.
10. Conduct a Public Hearing and Consider Adopting an Ordinance to AmendSection 15- 79 for Major Subdivisions of the Land Use Ordinance.
Staff is proposing an amendment to Section 15- 79 " Major Subdivision ApprovalProcess" of the Code of Ordinances. The proposed changes would require three
18"x24" and one digital copy of final plats to be submitted to Development Services,and that complete applications with estimates for performance guarantees be
submitted to the department three weeks prior to the next regularly scheduledPlanning and Zoning Board meeting. This public hearing has been properly calledfor and advertised. A memo from Jeff Ruggieri, Director of Development Services,is attached.
11. Consider Adopting a Resolution to Fund COVID- 19 Nonprofit Grant Program.
As discussed at the October 6, 2020 work session, $ 50, 000 will be utilized to fund
a grant program for nonprofits in the City of New Bern to aid with their COVID- 19efforts to assist citizens who have been impacted. The program will be
administered by a third party, and terms and conditions of the program will beestablished with respect to the application process, qualifications, etc. Grants will
be issued in the amount of $ 1, 000 each, and any unused funds will be returned tothe City.
12. Consider Adopting a Resolution Approving a Settlement and Limited MutualRelease with Pike Engineering, LLC.
During installation of the new transformer at the Trent Road Substation, a disputearose regarding control system wiring diagrams developed by the utilitiesengineering consultant. The errant wiring diagram caused $ 18, 143. 18 in damages
to utility equipment. Repairs have been completed, and the equipment is in service.The proposed agreement settles the dispute and provides that the utility consultantpay the cost of the associated damages. A memo from Charles Bauschard,Director of Public Utilities, is attached.
13. Consider Adopting an Amended Resolution Approving a Grant from the NCGovernor' s Highway Safety Program.
On August 25, 2020, the Board adopted a resolution approving a grant from the NCGovernor's Highway Safety Program in the amount of $ 24,995. The grant is
actually for$ 25,000, and an amended resolution needs to be adopted to reflect thecorrect amount. A memo from Police Chief Toussaint Summers is attached.
14. Consider Adopting a Resolution Accepting Ownership and Maintenance ofRichard Court.
Ward 4) A request has been received for the City to accept ownership andmaintenance of Richard Court, which is located within Pinecrest Estates. Public
Works has performed an inspection and confirmed that the street has beenconstructed to meet the City's street design standards. A memo from MattMontanye, Director of Public Works, is attached.
15. Consider Adopting an Ordinance to Amend Chapter 70 " Traffic and Vehicles".
Wards 1, 2, and 3) The ordinance amending Chapter 70 will achieve the following:a) change Nunn Street, which is a 12- foot street, to a one-way street and removethe existing stop sign at the intersection of Nunn and Main Streets; b) reduce thespeed limit along Old Airport Road between Tyler Ryne Trail and the bridge located
near Stonewall Circle from 35 mph to 25 mph; c) designate both sides of SouthFront Street along the " loop" behind Tryon Palace as a no parking zone. A memofrom Mr. Montanye is attached.

WHEREAS, Joseph " Jay" Mattingly, who was born in 1934, lead a full life that was
deeply rooted in public service; and
WHEREAS, after graduating from high school and attending the University of Maryland,Jay joined the National Guard at the age of 18 and later joined the ArmyReserve where he served for 42 years; he was a MP who retired with therank of Colonel; and
WHEREAS, Jay also worked for the US Postal Service for 36 years; as an employee inthe Computer Systems division, during his career he personally witnessedmany state-of-the- art variations in how the post office processed mail andadvanced their operations to keep up with the demands of an ever-changing industry; and
WHEREAS, after retiring from the US Postal Service in 1992, he moved to New Bern in1993; while residing in New Bern, he became actively involved in thecommunity; he was elected as an Alderman and served in that capacity for12 years; during his tenure, Jay saw the City transformed in many areas,including major changes to Broad Street, the erection of a main fire stationas well as a new Police station, and the construction of a public swimmingpool; and
WHEREAS, Jay was also active in the senior softball arena and was a member of theKnights of Columbus New Bern Council 3303.
NOW, THEREFORE, I, Dana E. Outlaw, Mayor of the City of New Bern, do herebyproclaim and acknowledge JOSEPH " JAY" MATTINGLY was a civic
and community-oriented person, and on behalf of the citizens of the City ofNew Bern, I extend to Jay' s family an expression of deep sympathy fortheir loss.

WHEREAS, each year from the 15th of September to the 15th of October, NationalHispanic Heritage Month is celebrated throughout the United States; and
WHEREAS, Hispanics comprise roughly 9. 8% of the population of the State of North
Carolina as of 2019, and have both an integral and necessary communityin our state; and
WHEREAS, Hispanics currently comprise 7. 6% of the population of Craven County; and
WHEREAS, the City of New Bern openly welcomes and supports its distinct culturaldiversity; and
WHEREAS, we are further inspired by the economic, social, and cultural contributionsof the Hispanic community within the City of New Bern and Craven County;and
WHEREAS, we understand that although this national recognition lasts each year for
one month, we work endlessly to create a more socially- inclusive anddiverse society with equality for all populations.

WHEREAS, HistoriCorps is a 501( c)( 3) nonprofit that provides a workforce of volunteers with all skill levels
and hands-on experience for the purpose of preserving historic structures that have falleninto disrepair on public lands across America; this action ensures America' s cultural andhistorical resources will exist for generations to come; and
WHEREAS, the mission of HistoriCorps is to save and sustain historic places for public benefit through
partnerships that foster public involvement, engage volunteers, and provide training andeducation; and
WHEREAS, in its first decade, HistoriCorps has logged 187, 908 volunteer hours across 268 preservation
projects in 31 states and territories; New Bern has been fortunate to experience the benefitsof HistoriCorps' efforts; and
WHEREAS, the New Bern Academy was established in March of 1764 when the North Carolina legislatureauthorized New Bern to build " a house for a school and residence for the school master";
work began in 1765 and was finished by April of 1767; this public school quickly earned areputation as "one of the best regulated schools of its kind in America"; and
WHEREAS, the New Bern Academy's original building was destroyed by fire in 1795; leaders convincedthe legislature to authorize the raising of funds for a new schoolhouse, and in 1810 theacademy moved into a handsome, new brick building and continued to serve as a school until1971; it now houses a Civil War museum; and
WHEREAS, HistoriCorps recognized the importance of this structure and has undertaken total restoration
of the building as one of their projects; the project will include complete restoration of the brickand mortar, repair of the wooden parts of the structure — including the window sills and thenow copula and entrance portico of the building itself; the project was broken down into threephases, and the final phase will be completed by the end of October in this year; and
NOW THEREFORE, I, Dana E. Outlaw, Mayor of the City of New Bern, on behalf of the New Bern Boardof Aldermen, do hereby proclaim the importance and significance of the work perFormed byHistoriCorps and acknowledge their invaluable contribution to historical preservation in New
Bern.

Backqround
The Mayor and Board of Aldermen are requested to Conduct a Public Hearing andConsider Amending Section 15- 79 of the Code of Ordinances for Major Subdivisions.
Staff is proposing the following changes to the major subdivision approval process:
The submittal of three 18" by 24" copies and one digital copy of final plats to theDevelopment Services department.
The requirement that complete applications be submitted to Development Services
three weeks prior to the next regularly scheduled meeting of the Planning and ZoningBoard.
The requirement that all estimates for performance guarantees be submitted at the
time of application three weeks prior to the next regularly scheduled meeting of thePlanning and Zoning Board.
Recommendation

AN ORDINANCE TO AMEND APPENDIX A " LAND USE" OF THE CODE OF
ORDINANCES OF THE CITY OF NEW BERN
THAT WHEREAS, the Planning and Zoning Board of the City of New Bern
unanimously recommends that certain amendments be made to Appendix A " Land Use" of the
Code of Ordinances of the City of New Bern; and
WHEREAS, the City' s development services staff further recommends approval of said
proposed amendments; and
WHEREAS, the Board of Alderman of the City of New Bern deems it advisable and in
the public interest to effect said revisions to Appendix A ` L̀and Use'" of the Code of Ordinances
of the City of New Bern.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE
CITY OF NEW BERN:
SECTION 1. That Section 15- 79. " Major subdivision approval process." of Part II.
Major and minor subdivisions" of Article IV. " Permits and final plat approval" of Appendix A
Land Use" of the Code of Ordinance of the City of New Bern be and the same is hereby
amended by deleting subsection ( b)( 2) in its entirety and inserting in its stead the following:
2) The final plat shall be at the same scale ( one inch equals 100 feet or larger) and onthe same sheet size as the general plan ( 18 inches by 24 inches or larger) and shall conformsubstantially to the general plan as approved. The applicant shall furnish three 18'" by 24" copiesand one digital copy ( in a format to be specified by the secretary of the planning and zoningboard) for distribution to the planning and zoning board no less than three weeks prior to theregularly scheduled meeting of the planning and zoning board. The final plat shall constituteonly that portion of the approved general plan which the applicant proposes to record and
develop at the time, provided, however, that such portion conforms to all requirements of thisordinance. The final plat shall show:
a) The lines of all streets and roads.
b) Lot lines and lot numbers.
c) Building envelopes in the case of PUDs.
d) Reservations, easements, alleys, and any other areas to be dedicated topublic use or for conservation purposes, or sites for other than residential use with notes statingtheir purpose and any limitations.
e) Sufficient data to determine readily and reproduce on the ground, thelocation, bearing, and length of every street line, block line, and building line, whether curved orstraight, and including true north point. This should include the radius, central angle, and tangent

distance for the centerline of curved streets and curved property lines that are not the boundary ofcurved streets.
All dimensions should be to the nearest one- tenth of a foot and angles to the
nearest minute.
g) Accurate location and description of all monuments and markers.
h) The names and locations of adjoining subdivisions and streets, and thelocation and ownership of adjoining unsubdivided property.
i) Title, date, name, and location of subdivision, graphic scale, and true north
point.
j) Name of owner, surveyor and land planner.
k) Written approval by the Corps of Engineers with reference to wetlands, ifapplicable.
1) Postal enumeration of each lot in the subdivision."

a) A draft of all restrictive covenants whereby the subdivider proposes toregulate land use in the subdivision and otherwise protect the proposed developinent.
b) ln subdivisions where limited access streets are constructed, the final plat
shall show a restricted easement of access along the entire length of the street as it is to beconstructed denoting all connections to the street allowed for ingress and egress to propertieswhether improved or reserved for future improvement.
c) All documents establishing compliance with section 15- 59 regardingperformance guarantees."
SECTION 3. That Section 15- 150. " Accessory uses." of Article X. " Permissible Uses"
of Appendix A " Land Use'' of the Code of Ordinance of the City of New Bern be and the same ishereby amended by deleting subsection ( c) in its entirety and inserting in its stead the following:
c) Without limiting the generality of subsections ( a) and ( b), the following activitiesare specifically regarded as accessory to residential principal uses so long as they satisfy thegeneral criteria set forth above:

1) Hobbies or recreational activities of a noncommercial nature; except that
the repair of automobiles owned by persons who do not reside on the premises, is prohibited.
2) Yard sales or garage sales, so long as such sales are not conducted on thesame lot for more than three days ( whether consecutive or not) during any 90- day period.''
SECTION 4. This ordinance shall be effective from and after the date of its adoption.

RESOLUTION TO FUND COVID- 19 NONPROFIT GRANT PROGRAM
THAT WHEREAS, the New Bern Board of Aldermen recognizes the roll certain
nonprofits are playing in assisting citizens with the challenges brought on by the COVID-19 pandemic, and the Board desires to initiate a grant program (" Program") to assist
nonprofits to continue these efforts; and
WHEREAS, the Board of Aldermen desires to contribute $50, 000 to the Program,
which shall be distributed in the form of grants to nonprofits within New Bern' s city limitspursuant to the terms and conditions of the Program; and
WHEREAS, the Program shall be administered by a third party, BEFCOR, and anyunused funds at the end of the Program term will be returned to the City of New Bern.

The City of New Bern Department of Public Utilities staff requests your considerationtowards executing a " Settlement and Limited Mutual Release" agreement.
During installation of the new transformer at Trent Road Substation, a dispute aroseregarding control system wiring diagrams developed by the utilities engineeringconsultant. The errant wiring diagram caused $ 18, 143. 18 of damages to utility equipment.Repairs are complete and the equipment is in service.
This attached agreement settles the dispute, which will be paid by the utility' s consultantand at no cost to the utility.
RESOLUTION
BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF NEWBERN:
That the Settlement and Limited Mutual Release Agreement dated October 13,2020 by and between the Pike Engineering, LLC and the City of New Bern, a copy ofwhich is attached hereto and incorporated herein by reference, be and the same is
hereby approved, and the Mayor and the City Clerk are hereby authorized and directedto execute the same, in duplicate originals, for and on behalf of the City.

SETTLEMENT AND LIMITED MUTUAL RELEASE
THIS SETTLEMENT AND LIMITED MUTUAL RELEASE ( the " SettlementAgreement") is made by and between the CITY OF NEW BERN ( the " City"), and PIKEENGINEERING, LLC (" Pike") ( each is a " Party" and together are the " Parties"). The Effective
Date of this Settlement Agreement shall be the date on which it is executed by both the Parties.
RECITALS:
A. The City and PowerServices, Inc. (" PowerServices"), entered into a ServicesContract dated October 19, 2010 ( the " Services Contract"), governing engineering consultingservices to be performed by PowerServices for the City on various projects.
B. The City issued Purchase Order No. P 1900687, dated August 17, 2018 (the" P. O."),for engineering services to be performed by PowerServices on the Trent Road Substation ( theProject"). Together, the Services Contract and the P. O. are the " Project Contract."
C. Disputes arose between the Parties regarding performance by PowerServices underthe Project Contract, including alleged defective design issues involvin wirin drawin s byPowerServices for the control panel for transformer T1 on the Project and correction of the wiringissue ( collectively, the " Disputes").
D. Pike is the successor to PowerServices as to the Project Contract.
E. The Parties now desire to settle any differences they have or may have betweenthem arising from or relating to the Project Contract and the Disputes. It is understood that this
Settlement Agreement is made in compromise of disputed claims and is not an admission ofliability by any Party.
NOW, THEREFORE, in consideration of this Settlement Agreement and other good andvaluable consideration, the receipt and sufficiency of which is acknowledged, the Parties agree:
1. Recitals. The above recitals are hereby incorporated herein and made a part of thisSettlement Agreement.
2. Settlement Payment. Pike shall pay a total of Eighteen Thousand One HundredForty-Three and 00/ 100 Dollars ($ 18, 143. 00) ( the " Settlement Payment") to the City' s contractorWEG Transformers USA LLC (" WEG") within ten ( 10) business days of execution of this
Settlement Agreement by all the Parties. The Settlement Payment shall be made by Pike directlyto WEG in one payment, by check or wire pursuant to instructions provided, if any.
3. Limited Mutual Release. Except for obligations under this Settlement Agreement,the City and Pike and their respective successors, assigns, parents, owners, affiliates, subsidiaries,directors, officers, members, managers, employees, agents, contractors, attorneys, insurers andeach of them, hereby release each other and their respective successors, assigns, parents, owners,affiliates, subsidiaries, directors, officers, members, managers, employees, agents, contractors,

attorneys, insurers, and each of them from any and all actions, causes of action, claims, demands,damages, and liabilities of whatever kind or nature, in law or in equity, whether known orunknown, now existing or hereafter arising out of or relating solely and specifically to the Disputes,and to no other services or work performed under the Project Contract.
4. Confidentialitv. Each of the Parties agrees to keep confidential the terms of thisSettlement Agreement, except ( a) as needed to effectuate and enforce the terms hereof; (b) asrequired by law, court order, subpoena, or compulsory governmental process; ( c) as may berequired to taxing authorities for purposes of providing required information to said authorities; ord) or as may be required by counsel, accountants, or tax preparers for the Parties in order to enable
them to prepare financial statements or tax returns for the Parties.
5. Entire Agreement. All prior negotiations, representations and promises made byany Party to the other regarding the subject inatter contained herein, whether in writing orotherwise, are understood and agreed to be superseded by and merged into this SettlementAgreement. This Settlement Agreement, including specifically this Section 5, may not bemodified unless any such modification is in writing, signed by all the Parties hereto.
6. Miscellaneous. This Settlement Agreement is the product of negotiation and shallbe deemed to have been drafted by no Party individually but as a joint effort of the Parties. The
Parties represent that they have carefully read and understand all of the provisions of thisSettlement Agreement, that they entered into this Settlement Agreement voluntarily, that each ofthe undersigned has the authority to execute this Settlement Agreement on behalf of his/ herrespective Party, and that the claims being released herein have not been conveyed or transferredto a non-party to this Agreement. This Settlement Agreement may be executed in counterparts,original or PDF, each of which shall constitute an original and which taken together shall constituteone agreement.

Backqround Information
Over the past several weeks, the Public Works Department has received several requests
to evaluate certain items as it pertains to Section 70 ( Traffic and Vehicles) of the City ofNew Bern Code of Ordinances. After reviewing these requests, the Public WorksDepartment is recommending changes to Section 70- 78 ( One-way Streets), 70-99 ( StopIntersections), 70- 132 ( Maximum Speed Limit — Twenty-Five Miles per hour) and 70- 225Prohibited Parking Zones).
Nunn Street is an existing two-way street located behind the George Street spray groundsand intersects with Cypress Street and Main Street. The existing road is 12- feet in widthand does not meet the requirements for two-way street, and it is being recommended thatSection 70- 78 be modified to add Nunn Street as a one-way street. Because of the
recommendation to make Nunn Street a one-way street, it is also necessary to modifySection 70- 99 to remove the existing stop sign at the intersection of Nunn Street and MainStreet.
Over the past couple of years, the developers of the Bluewater Rise Subdivision haveconstructed approximately 150 new homes and has a projected total build out of over 900homes. The increase of single-family homes has/will cause a significant increase in trafficalong Old Airport Road and through some existing residential neighborhoods. The Cityhas received several requests to reduce the speed limit along Old Airport Road ( fromTyler Ryne Trail to the bridge located near Stonewall Circle). After reviewing this issueand discussing this with the Board of Aldermen we are recommending that Section 70-132 be modified to reduce the speed limit along Old Airport Road ( between Tyler RyneTrail and the bridge located near Stonewall Circle) from thirty-five miles per hour totwenty-five miles per hour.
Several years ago, the Public Works Department made modifications to the "loop" behindTryon Palace along South Front Street to create a more pedestrian- friendly area alsoknown as Palace Point Commons. This section of South Front Street has also become a
popular place to fish and is starting to cause issues with vehicles parking along the "loop"behind Tryon Palace. The Public Works Department has received a request to make
this section of South Front Street a " No Parking Zone". After reviewing the City of NewBern Code of Ordinances, it was discovered that this section was already designated asa " No Parking Zone" under its former name of Tryon Palace Drive. The Public WorksDepartment is recommending that Section 70- 225 be modified to remove the "No ParkingZone" on Tryon Palace Drive and to add a " No Parking Zone" on South Front Street alongthe " loop" behind Tryon Palace.

Recommendation

AN ORDINANCE TO AMEND CHAPTER 70 " TRAFFIC AND VEHICLES" OF THE
CODE OF ORDINANCES OF THE CITY OF NEW BERN
THAT WHEREAS, the Director of Public Works of the City of New Bern recommends
that certain amendments be made to Chapter 70 " Traffic and Vehicles" of the Code of
Ordinances of the City of New Bern; and
WHEREAS, the Board of Aldermen of the City of New Bern deems it advisable and in
the public interest to effect said revisions to Chapter 70 '` Traffic and Vehicles" of the Code of
Ordinances of the City of New Bern.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE
CITY OF NEW BERN:
SECTION 1. That Section 70- 78. " One- way Streets Established'' of Division 1.
Generally" of Article III. '`Operation of Vehicles" of Chapter 70 " Traffic and Vehicles" of the
Code of Ordinances of the City of New Bern be and the same is hereby amended by deleting
Section 70- 78 in its entirety and inserting in its stead the following:

The following streets are established as one- way streets in the direction indicated:
First Avenue, between Broad Street and Cedar Street: Traffic shall be limited to a
southerly direction.

AN ORDINANCE TO AMEND CHAPTER 70 " TRAFFIC AND VEHICLES" OF THE
CODE OF ORDINANCES OF THE CITY OF NEW BERN
THAT WHEREAS, the Director of Public Works of the City of New Bern recommends
that certain amendments be made to Chapter 70 '` Traffic and Vehicles'' of the Code of
Ordinances of the City of New Bern; and
WHEREAS, the Board of Aldermen of the City of New Bern deems it advisable and in
the public interest to effect said revisions to Chapter 70 " Traffic and Vehicles" of the Code of
Ordinances of the City of New Bern.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE
CITY OF NEW BERN:
SECTION 1. That Section 70- 78. " One-way Streets Established" of Division 1.
Generally" of Article III. '`Operation of Vehicles' of Chapter 70 " Traffic and Vehicles" of the
Code of Ordinances of the City of New Bern be and the same is hereby amended by deleting
Section 70- 78 in its entirety and inserting in its stead the following:
Sec. 70- 78. One-way streets established.
The following streets are established as one- way streets in the direction indicated:
First Avenue, between Broad Street and Cedar Street: Traffic shall be limited to a
southerly direction.
Second Avenue, between Broad Street and Cedar Street: Traffic shall be limited to a
northerly direction.
Third Avenue, between Broad Street and Cedar Street: Traffic shall be limited to a
southerly direction.
Bay Street, between Miller Street and Third Avenue: Traffic shall be limited to a westerlydirection.

Unnamed short street through Craven Terrace, located on the south side of Cedar Street,
the west end of said street beginning at a point 260 feet east of the eastern curb line of MillerStreet; the east end of said street beginning at a point 260 feet west of the western curb line ofOak Street.
Unnamed street through Craven Terrace, running from Miller Street to Roundtree Street,and being the first such street north of Broad Street: Traffic shall be limited to an eastwardlydirection.
Unnamed street through Craven Terrace, running from Miller Street to Roundtree Street,and being the second such street north of Broad Street: Traffic shall be limited to a westwardlydirection."
SECTION 2. That the traffic schedule identitied as " Stop Intersections" adopted by theboard of aldermen and referenced in Section 70- 99. " Stop intersections." of Division 2. `' Right-
of-way" of Article IIL " Operation of Vehicles" of Chapter 70. " Traffic and Vehicles" of the
Code of Ordinances of the City of New Bern be and the same is hereby amended by deleting the
stop intersection at Nunn and Main Streets.
SECTION 3. That the traffic schedule identified as " Maximum Speed Limits" adopted
by the board of aldermen and referenced in Section 70- 132. " Maximum speed limits on specific
streets." of Division 4. " Speed" of Article III. " Operation of Vehicles" of Chapter 70 '` Traffic
and Vehicles" of the Code of Ordinances of the City of New Bern be and the same is hereby

SECTION 4. That Article VI. " Stopping, Standing and Parking" of Chapter 70 '` Trafficand Vehicles'" of the Code of Ordinances of the City of New Bern be and the same is herebyamended by deleting Section 70-225. `` Prohibited parking zones." in its entirety and inserting in
its stead the following:

a) When signs are placed, erected or installed in each block giving notice thereof, noperson shall park a vehicle for longer than two hours at any time between the hours of 9: 30 a. m.and 5: 00 p.m. on any day except Saturday, Sunday and public holidays, upon any of thefollowing streets, and the changing of the position of a vehicle from one point directly to anotherpoint, within the same block, shall be deemed one continuous parking period; each hour which avehicle shall be parked in violation of the terms hereof shall constitute a separate offense.
