DEFINING PUBLIC I2ECORDS
All records kept by Mahoning County are public unless they are exetnpt fromdisclosure under Ohio law. A record is defined to include the following: Adocument in any fornxat- paper, electronic (including, but not limited to, businesse-mail)-that is created, received by, or comes under the jurisdiction of MalioningCounty that docutnents the organization, funetions, policies, decisions,procedures, operations, or other activities of the office.

Public records are to be available for inspection during regular business hours,witli the exception of published holidays. Public records must be made availablefor inspection proinptly. Copies of public records must be made available withina reasonable period of time. "Proanpt" and "reasonable" take into account thevolume of records requested; the proximity of the location where the records arestored; and the necessity for any legal review and redaction of the recordsrequested.
HANDLING REQUESTS
No specific language is required to malce a request for public records. However,the requester must at least identify the records requested with sufficient clarity toallow the office to identify, retrieve, and review the records. If it is not clear whatrecords are being sought, the office must contact the requester for clariiication,and should assist the requester in revising the request by informing the requesterof the manner in which the office keeps its public records.
The requester does not have to put a records request in writing, and does not haveto provide his or her identity or the intended use of the requested public record. Itis this office's general policy that this information is not to be requested.However, the law does pertnit the office to ask for a written request, therequestor's identity, and/or the intended use of the information requestecl, butonly (1) if a written request or disclosure of identity or intended use wouldbenefit the requestor by cnhancing the office's ability to identify, locate, ordeliver thc public records that have been requested; and (2) after tellitig therequestor that a written request is not required and that the requester tna.y deelineto reveal the requestor's ideatity or intended use.

An electronic record isdeemed to exist so long as a computer is already progranlmed to produce therecords through simple sorting, filtering, or queiying. In processing a request for inspection of a public record, an office employee mustaccoanpany the requester during inspection to make certain origiaai records arenot talcen or altei-cd.
A copy of the most recent edition of the Ohio Sunsh.ine Laws maiuaI is availablevia the Attorney General's internet website {www ohioattorneygeneral aov) forthe purpose of.keeping employees of the office and the public educated as to theoffice's obligations under ttie Ohio Public Records Act, Open Meetings Act,records retentiai laws and Personal Inforination Systems Act.
DEi NIAL OR RIJDACTION OF RECORDS
If the requester makes an ambiguous or overly broad request or has difficulty inmaking a request for public records, the request may be denied, but the denialmust provide the requester an opportunity to revise the request by informing therequester of the maimer in which records are maintained and accessed by the
office.
Any deuial of public records requested must include and explauatiou, includinglegal authority. If the initial request was made in writing, the explanation mustalso be in writing. If portions of a record are public and portions are exempt, theexenipt portions may be redacted and the rest released. When inaking publicrecords available for public inspection or copying, the office shall notify therequester of any redaction or make the redaction plaiuly visible. If there areredactions, each redaction niust be accompanied by a supporting explanation,including legal authority.
COPYING AND MAILING COSTS
Those seeking public records may be charged only the actual cost of makingcopies, not labor. The charge for copies is .10 cents per page. The charge forelectronic files downloaded to a conipact disc is $1.00 per disc.
A requester may be required to pay in advance for costs involved in providing thecopy. The requester may choose whether to have the record duplicated uponpaper, upon the sanie mediuin in which the public record is Icept, or upon anyother mediom on which ttie office determines that the record can reasonably beduplicated as an integral part of thc office's normal operations.
If a requester asks that doeuments be inailed, he or she may be charged the actualcost of the postage and mailing supplies. There is lio ch.arge for documents e-

and the Maholung County Sheriff, grand jury subpoenas were issued to various public
offieials and oClaers. The undersigned duly elected Mahoning County Prosecutor, in
•consultatioa -with the investigating agencies involved, ltas determined that the
inYestigation has now progressed to a point whcre it is in.the public interest to appoint
specinl prosecutors to assist these investigative agencies witli the ongoing investigation
In Hendeison, the Supreane Coutt indicated that a court of common pleas •
possesses inherent power to appoint counscl to assist the grand jury in crinrinal matters,
The court further noted that a proper exercise of ihat power would be in sihtations where
neither the prosecuting attomey nor his appointed assistants could perform necessary
proseeutorial duties. Id at 479 and 480, 175 N.E. at 867. Special prosecutors may bo
appointed in accordance wiih IZ C. §2941,64 and R. C. § 309.10 (staiutory), or mder the
inherent power of the Court Where a special prosecutor is appointed pursaant to the
aforementioned statutes, the special prosecutor serves in an "assistory" Tole. State ex rel.

conceming the psosenntion or lack; of prosecution are tn.tly independent• A. special
prosecutor with authority independent of the proseeutor's office will avoid any
appearance of impropr'tety. And a special proseculor aciing independenkly cannot be

appointed in accordance with .B.C. § 2941.64 and 12.C. § 309.10 (statutory), or under the
inlxer'ent power of the Court. Where a special prosecutor is appointed pursuant to the
aforementioned statutes, the special prosecutor serves in an "assistory" role. State ex rel.
Willtarns v. Zalesld (1984), 12 Oliio St.3d 109, at 113. Where special prosecators are
appointed under the inherent power of the Court, the special -prosecutors act independent
of the duly elected prosecutor.
Due to the eircumstanoes Sturounding this particular investigation it is necessary
to appoint a special prosecntor who ean aet iudependent of the duly eleeted prosecutor.
The investigation involves mmerous elected and appouited public officials who inay be
witnesses or potential targets.

In addition, at least one retired Mahoning County Common Pleas Judge, as we1I
as two current Mahoning County Comnion Pleas Judges are identified as potential
witnesses.
Consequently it is in the public interest to appoint the aforenientioned special
prosecutors under the inherent power of the Court, thereby ansudng that any decisions
concerning the proseeutioiu or lack of prosectttion are truly independent: A special
.prosecutor with authori.ty independent of the prosecutor's office will avoid any
appearance of nnpropriety. And a special proseeutor acflng independently carmot be
accused of engaging in a vengeful prosecution, or, conversely, of favorable treatment.
Prosecutor Will, Assistant Prosecutor Cillo, Assistant Prosecutor Belcher, and
Chief Investigative Attorney Paul M. Nick have consented to this appoinhnent at no cost
other than reimbursement of reasonable expenses, inclnding mtleage incurred, and, if in
the sole judgment of the spedial prosecutors clerical support is reqpired, Mahoning

witnesses.
Conseq.tently it is in tlte public interest to appoint the aforementioned special
prosecutors under the irizerent power of the Court, thereby ensuling that any decisions
conceming the ptosecntion or lack of prosecution are truly independent: A speEial
prosecutor with authority independent of the prosecutor's office will avoid any
appearance of impropriety. And a special proseeutor acting independently cannot be
accused of engaging in a vengeful prosecution, or, conversely, of favoraUle txeatlnent.
Prosecutor Will, Assistairt Prosecutor Cillo, Assistant Prosecutor Belcher, and
Chief Investigative Attorney Paul M. Niclc have cousented to this appoinhnent at no cost
