PREAMBLE

01 The wage structure and other conditions of service rncluding fringe bene'fits of theemployees in the Coal Industry are at present covered under ,n" i".orirn"nJations ot tnecentral wage Board for coar Mining rndustry as accepted by the Government oi India andmade applicabre with effect f rom 15th August, 1967, the Nationar coal wage Agreemenr-r, lr, Ur. rv & V dated 11th December, 1974. 11th August, 197g, 11th No"vem"ber, tg83,27th July, l989 and 19th January, 1996 respectivery. The provisions of NCWA-l were rnoperatron with effect from 1st January, 1975 to 31st Decembel .1978,

0.2 As the operation of the National coal wage Agreement-v was upto 3orh June, .r996, JoinlBipartite Committee for the Coal Industry {JBCCI Vl) was re-constituted in terms oi letterNo. 5501 1/3/96-lR dated 28.02 1997 from the Gov1. of India, Ministry of coat, New Delhi.Further, the delrberation continued rn the core group set up by the JBCCI to arrive at anamlcable settlement on wage structure & allowances. 0.3 The Charter of demand submitted by the aforementioned unions were integrated. neutralisation of DA for 10 years as well as 5 year wage agreement vide O.M. No. F No.2(1 1)/96-DPEWc)-GL xxvll dated 26-07-2000 placed at "Annexure-preambte-c.,. Govt'sctarification on Variable DA dated 6-11-2000 and g-i2-2000 are enclosed as,,Annexure_Preamble-D" and "Annexure-Preamble-E" respectively. In terms of DpE's letter datedB-1?-?o:9, it has been agreed to pay the vDA on revised basis on an index above 1 562 ason 1-7-96, subject to adherence to DpE,s jnstructions dated 26,7_2000.

In the core Group meeting of JBCCT, an Mou was arrived at between the parties which isannexed at "Annexure-preambre-F". The wage structure of various categories ofemployees as finalised by the sub-committee tog;rher wirh Mou dated t3.09.i000 wasratiiied in the JBCCI meering herd on 25.1 1 .2000 oy truruc, Arruc HMS & BMS.

The members continued to hord rhe discussions on wages & other issues not covered bythe Mou dated 13-09-2000 and after protracted negotiations, another MoU dated 13_r2_2000 was arrived at covering afl the demands of thJUnions. This MoU dated 13_12-2ooowas signed by the four Unions viz. TNTUC, Arruc, HMS & BMs. This MoU is annexed at"Annexurs-Preamble-G".

The tuloU ,dated r3-12-2000 was praced for ratificarion before rhe JBCCI herd on 23-i 2-

/UUU and the same was ratified by the four unions.

ln terms of the Mou dared 13-09-2ooo & 13-12-2000, it is now agreed between the parriesto revise the wage structure and a|owances as set out under t-he fo owing ctrapters.

Chapter - |

1.0 ScoPe and Coverage

1.1 This Agreement shall be called rhe NATIoNAL coAl, WAGE AGF EEMFNT _ vl andwrlbeeffective fronl 1 .7.1996 to 30.6.2001 .

1.2 This Agreement shall cover ali categories oi employeet rn the coai Industry who havebeen covered by National coal wage Agreement - l, ll, lll, lV and v and also employees otthose establishments which are functioning and may be functioning under the coalCompanies.

1 .3 The Scope of agreement covers the wage str!cture including Dearness allowances. f itmentin the revised scale of pay, pension, frrnge benefrts, service conditions and olher atiredmatters including welfare/safety measures as contained in the dtfferent Chapters of thisAoreement.

Chapter - ll

Wages, Wage Structure andDearness Allowance

2.O Component of Wage

2.1 The wage structure of employees in Coal Mining Industry shall consist of(a) Basic Wage

(b) Special Dearness Allowance {SDA) at the rate of 17.gsyo of Attendance Bonus or1.795o/o ol basic wage representjng computed fringe benefits of attendance bonus,such as contribution to provident fund, payment in lieu of profit sharing bonus, gratuityetc.

{c) Variable Dearness Allowance linked to the All India Consumer Prrce lndex Numbertor lndustrral workers (Base 1960 = 100) (here after called lndex Nurnber) adjustablequarterly depending on variation in consumer price index number above 1562.

2.2.0 Minimum Wage

2.2.1 The revised minimum wage for the lowest paid employee on surface in the coal MiningIndustry covered by this Agreement shail be Fs.3689.23 per month or Rs.141 .89 per davat the All lndia Average Consumer price index number for Industrial workers (Base j 960 =100) at 1562. This amount includes the minimum guaranteed benefit ol Rs.414.b3 permonth or Rs.15.94 per day inclusive of Interim Relief.

2.2.2 The break up of the minrmum wage of Rs.3689.23 per month or Rs.'141 .g9 per day as on1 st July 1996 linked to AICP Index No. 'l 562 wlll be as indrcated below :

2.2.3 rhe Variable Dearness Allowance wrll vary according to ihe shift of the Consumer priceIndex Number over 1562 as detailed 'rnder Clause 2.7.0.

2.3.0 Basic Wage Structure

2.3.1 The revised basic wage structure for dil{erent categories, skills and grades, coverrng dailyrated and monthly rated employees as worked out on the basis of this Agreement aredetailed under Annexure - llA.

2.3.2 The revised basic wage structure ior different categories, skllls and grades covering bothdaily rated and monthly rated employees for Assar8 (North East) Coalfields includinqExcavation are incorporated rn Annexure - llB.

2.3.3 Wages of Piece-Rated Workers

The rates of basic wages of different group of Piece-rated workers together with the ratesof fall back wages etc. are incorporated in Chapter - lll.

2.4.0 Attendance Bonus

2.4.1 The attendance bonus will contrnue to be paid quarterlv at the rate o{ 10% o{ basrc wage.

2.4.2 As computed, fringe benefits on Attendance Bonus arq being paid as Special DearnessAllowance alongwith wages, the quarterly bonus shall not attract any other f ringe ben ef ils.

2.5.0 Special Dearness Allowance

Special Dearness Allowances shall attract f ringe benef its such as Provident Fund, paymentin lieu of profit sharing bonus and gratuity etc., the compllted fringe benefits whrch havebeen worked out at the rate oI 17.95ok of Attendance Bonus or 1 .795% of the basic wageof ihe employee, will continue to be paid and the same will be called Specral DearnessAllowance. This amount at the lowest minimum basic wage of Rs.3300/- as computedwould be Rs.59.23. The computed fnnge benefits on Attendance Bonus called SpecialDearness Allowance will also attract ali fringe benefits applicable to dearness allowance.

2.6.0 Fixed Dearness Allowance

The elemeit of Fixed Dearness Allowance will not be there under this Aoreemenr.

2.7.O Variable Dearness Allowance

The Variable Dearness Aliowance at AICPI 1562 (Base 1960 = 100) shall be "NlL" as on1 .7. 1996. The VDA will be revised quarteriy and paid on and f rom 1st March, 1 st June, 1 srSeplember and 1st December of every year on the basis of average of AICPI Number forthe quarter ending December (OctDec), March (Jan-March), June (April-June) & September(July-Sept) respectively.

'The workers drawing basic pay upto Rs.6550/- p.m. shall be entitled for Dearnessneutralisation at the rate of 1007o of Basic Pay and those drawing basic pay beyondRs.6550/- p.m. shall be entitled for Dearness neutralrsation at the rate of 75o/o. Howevelthose drawing a basic above Rs.6550/- per month will not be paid less DA than those whoare drawing a basic of Rs.65501."

The rate of VDA payable w.e.f. 1 .7.96 is tabulated under "Annexure-2.7.O - VDA".

2.8.O Minimum Guaranteed Benefit

All employees covered by thjs agreement who were on the rolls of different units of CoalCompanies as on 30th June, 1996 and continued to be on the rolls on 1.7.1996 will begiven a mrnimum guaranteed benefit o{ 12% o1 Basic Pay Plus F.D.A. as on 30.6.96 andRs.181.95 per month i.e. Rs.414.53 per month which is inclusive of Interim Relief paidw.e.f . 1 .7.96.

2.9.0 Fitment in the Fevised Scale of Pay for Time Bated & Monthly Pay Scales

2.9.1 For the purpose of fitment in the revised scheme of pay/wages to the existing total

emoluments of an employee as on 30.6.96, compnsing of basic wages including stagnationincrements. FDA, VDA, Special DA, Attendance Bonus and Interim Relief will 6e aooeo anamount of Rs.1Br g5 in the case of monthry rated employees or Rs,6.gg per day in thecase of daily rated employees. scale in the revised wage structure on 1 st July, 1996 or reach the maximum of the revlsedscale at any time during or after the period of this agreement wrll be alloweo annuarincrement equivalent to the last incremental raie in the revised scales on the oue dateevery year till the next settlernent.

3.0 WORK NORMS AND JOB DESCRIPTION

3.1 .0 The grouping of piece rated workers, the work norms and job description for thenr shall beas laid down under the National Coal Wage Agreement-l and lmplementation lnstructronNo. 69 dated 8th October, 1986 (vide Booklet on "Nomenclature, Job descriptron andCategorisation of coal employees") as amended from trme to time

3.2.0 The rates of wages and workload for different groups of piece-rated workers are given inAnnexure-lllA, B & D.

3.3.0 Workload and Rates of Wages for Piece-Rated Miners and Loaders in Madhya Pradeshand Maharashtra Coalfields.

3.3.1 The existing workload for miners and loaders of Madhya Pradesh and Maharashtra Coalf ields

would remain unaltered.

3.3.2 The'following shall be the revised rates of wages for workload of 100 cft. and 1 18 cft.respectively in Madhya Pradesh and Maharashtra Coalfields.

3.3.3 The Fall Back wages in respect of piece-rated miners and loaders in Madhya Pradesh and

Maharashtra Coalfields would be lojvo of the revised rates mentioned above.

3.4.0 Wages for work above the workload for piece-rated workers.

3.4.1 For work in excess of the prescribed workload, a prece-rated worker shall be paid pro-rata

increase in the basjc piece-rate as well as Special Dearness Allowance and Variable D.A.

3.5.0 Fall Back Wages

3.5.1 Basic fall back wages in respect of different piece-rated groups shall be as indicated in

Annexure-lll A & B. In addition, they will get SDA, VDA, SPRA etc. as applicable to themon full work norms.

3.5.2 There will be a daily review of earnings ol piece rated workers to ensure payment of iallback wages which will be inclusive of lead and lift, but not tub pushing allowance. The fallBack wages is payable in case the Piece-rated workers fail to fulfil the work norms on

. account of factors for which they are not responsible, ior example, insufficient supply ornon supply of tubs or breakdown of haulages or power shut down. No fall back wages is,however, payable if a worke.r farls to fulfil the work norms due to his fault.

3.5.3 The case where Fall Back wages are paid continuously, the case will be monitoredoeriodicallv to ensure effective control.

3.6.0 Mechanised Face crew/Multiskilled iob

The workload and wage rates of Mechanised Face crew and group of work of multiskilledjobs will be as per the guidelines formulated by the Sub-Committee of Multlskill constitutedby JBCCI-Vl which will submit its recommendation within 6 months.

3.7.0 P. R. Trammers

3.1 .1 ln case of revision of unit rate of trammers eff ective f rom 1 st July, 1996, the workload andthe rate per tub for them should be fixed at Unit level by bi-partite negotiation in such away that the normal basic earnings of trammers is not less than Rs. 1 39.14 (basic per day).The workload and rate of payment would be reviewed periodically when changes incondition of work occur.

3.7.2 The piece rated trammers will be given an increase in their consolidated emolumentsconsisting of basic wage, attendance bonus, variable dearness allowance, special DA andlR so as to give them a minirnum benefit of Rs. '181 .95 per month or Rs. 6.99 per day (overand above lR payable) on the average total emoluments inclusive of basic, attendancebonus, VDA and SDA. ln evolving the piece rate, the average number of tubs trammedduring the six months period from 1st January, 1996 to 30th June. 1996 will be taken intoconsideration.

3.1 .3 (a) Where the work performance of trammers for a perrod of six months with effectfrom 1st January, 1996 ls more or less the same as compared to the working norm/standard f ixed before the NCWA-VI comes into force i.e. prior to 1.7.1996, the revisronof tramming rates will be made according to the above clauses.

ib) Where the work performance is below the norms, the norms will be so revised soas to give them the benefit as stipulated above.

(c) Where there are wide variations in the work performance on the^ higher srde againstthe work norms as referred to above, the workload should be so adjusted as toensure that increase in basic earnings does not exceed 94.12o/o of the basic ea rn ingsas on 30th June, 1996.

3.8.0 Other Pi€ce-rated workers

In respect of other piece rated workers for whom no specific workload and group wagehas been fixed, it is agreed that their wage rates will be revised by giving them the samepercentage increase in the group wages of the relevant group. Where there rs no suchgroup wage the same percentage of increase as in the case of miners/loaders (g[oupvA)will be given subject to a minimum increase of Rs. 61 .88 in basic wage per day.

Joint Committee at the Company level will decide the work load and wages in respect ofslurry/pond piece rated workers.

3.9.0 Lead & Lift and Tub Pushing Rates

3.9.1 Lead, iift and tub push ng rates for min-ors and loaders shall be revised as ndicated inAnnexure-lll C(il.

3.9.2 Lead & lift for Overburden removal r,vorkers shall be revised as indicated in Annexure-lllc{iil.

3.9.3 Lead and lift rates for piece-rated workers other than miners and loaders includino waoonloaders will be as rndicated in Annexure-lll C (iiil.

3.10.0 Lead & Lift Payments to be Basic Wages

Lead and lift payment will be treated as basic wages for all purpose.

3.1 1.0 Minimum Guaranteed Benefit, Special Piece-Rate Allowance/Fitment of Piece-RatedWorkers in the Revised Group Wages

3.1 1.4 Special Piece-Rate Allowance

Piece-rated workers who were on the rolls on 30th June, 1996 and continued to be so on1 st July, 1996, the foilowing amount, as indicated against each group, will be pard asSPRA annually in addition to their existing SPFA, to provide motivation for achieving higheroroductivitv. Other Allowances

5.1.0 WashingAllowance

Employees who will be-provided with uniform by the Management will be paid a washingAllowance at the rate of Rs. 40/- per head per month wjth eff ect from j .7.1 999. ln respecrof nursing staff , however. the amount of washing Ailowance payable to them will be Rs.50/- per head per month with effect f rom 1 .7.'l 999. Where washing of u niforms is arrangedby the Management, the Washing Allowance wjll not be paid.

5.2.O TransportSubsidy

5.2.1 Employees who do not utilise Company's transport either free or on pavment o{ nomlnalor subsidised rate will be paid transport subsidy at the rate of Rs. 5/- oer dav of actualattendance from 'l .7.'1999.

5.2.2 In case of an employee transferred to another colliery, if such employee is requrred toreport at the old place of work from where he is required to report to the new place ofwork for duty the existing arrangement for transporting them from the old colliery to thenew colliery will continue. He will, however,_get Rs. S/- per dav of actual attendance wrrneffect from 1.7. 1 999 as long as he is required to report to the old place of work.

5.3.0 AdditionalTransportSubsidy

Additional Transport Subsidy/Night Shift allowance at the rate ofRs., 7/- per dav or worrwill be paid f rom 1 .7.1 999 to those in the lasl shift in night whether it is called niqht shiftor third shift or C shift commencing from 10.00 pM onwards.

5,3.1 ConveyanceBeimbursement

Scooter/Moped/Motor cycle (TWo wheeler) conveyance rermbursemenl will be paid atthe rate of Rs. 1 2/- per day of altendance. Employees getting conveyance Rermbursementshall not be entitled for Transport Subsidy. The existing employees who are having validdriving licence with ownership of the vehicle will be eligible for conveyance reimbursementwith effect from lst January 2001.

5.t1.0 DifficultyAllowance

5.1.1 Thin Seam Allowahco

Considering the special difficulties of piece-rated and time ratedlmonthly rated workers lnthe face underground in thrn seams the following payment shall be made :

Rate of Payment :

(i) Seams above 1.5 m thickness - NIL

(ii) Seams of 1 metres to 1.5 metres thickness :

(a) An amount equal to 5% of revised basic for basket loading and2.so/o of revisedbasjc for sfrovelling on to conveyor.

(b) An amount equar to 2o/o or revised basrc for time rated, monthiy rated andother prece-rated workers required to work at a place where height is between1 to 1.5 m.

(iii) Seam below 1 metre thickness:

The management assured that seams below 1 .metre thickness will not be workedtill the signing of the nexl agreement.

5.4.2 Working in Heavy Watery Conditions - Underground

Rain coats, gum boots and hoods shall be provided tb such of the workmen who areexposed tO heavy watery conditions in underground mines.

5.,1.3 Travelling over Steep Gradients

Where travelling over steep gradients exceeds 1000 metres and the average gradient is inexcess of 1 in 3, an allowance of Rs. 1.90 per shift will be paid to each;f ihe workersworking in such a mine or district or section with eff ect f rom 1 .7.1999. Where such traverrrngexceeds 2000 metres, thls allowance will be Rs. 3.BO per attendance with eflect fromi .7.1999

Note : For this purpose, the average gradrent means the level di{ference between bottomof pit or incline mouth to the relevant working place divided by the plan distance berweenthe two places.

5.4.4 Dust

Workmen exposed to heavy dusty conditions at the place o{ work wrll be provided with"Dust Mask".

5.5.0 City Compensatory allowance

Thelayment of CCA will be decided within one month including rates and date of payment.

It was decided that CCA will continue to be paid and/or be payable as per Govt. of lndia'sorder/direction issued from time to time.

NOTE:

It is clarified that the employees of Coal Compa n ies/establish ments stationed for duty inDhanbad and other coalfield areas, who are in receipt of concessions such as free fuel/Jree house etc. will not be entitled to City compensatory Aliowance.

House Rent Allowance

8.1.0 HOUSE RENT ALLOWANCE

8.1 .1 The Existing house rent allowance of Rs. 60/- per month will be increased to Rs. 75l- permonth with effect from 1.7.1999 and will be paid to those employees who have not beenprovided with residential accommodation.

8.1 .2 Payment of house rent allowance will be regulated as indicated below:

(a) Employees excepting those who have been allotted the folrowing types of housesindividually will be eligible for house rent allowance at the rate of Rl. 75l- per month.

(i) Any pucca house consisting of one or more rooms wrth common or seDaratetatn ne and bath.

(ii) House under New Housing scheme, Low Cost Housing Scheme or single room,arch type tenements with latnne and bath.

lf a double roomed house has been allotted to two workmen, both the allottees shallbe entitled to 50o/o of house rent allowance each i.e. Rs. 37.S0 per month per head.

lf single roomed house is ailotted to more than one person 6r if a double roomedhouse rs allotted to more than two persons, all the allottees shall be eliqible forhouse rent allowance at the rate of Rs. 7bl- per month.

Employees who have been alrotted a seat in the barracks or mess or hoster shalr beeligible for house rent ailowance at the rate of Rs. 7Sl- per month. ,. ^.

Where husband and wife both happen to be employees and where any one of themis allotted the same house of the type referred to in clause (a) above, thev shall notbe entitled to house rent ailowance.

Employees who have been allotted single room or Arch type tenement however willbe entitled to ho.use rent aliowance rf the house is not provided with separate orcommon latrine/bathroom.

8.1.3 House Rent Allowance for Employees in Urban Areas

The govt. classification on the subject will be followed. The rate and date of pavment wrllbe decided within one month

8.2.0 House Rent Recovery

8.2-1 {n respect of recovery of house rent from the employees provided with resrdentralaccommodatjon, status qruo will be maintained, excepi in case of workmen provideo wrthmtners type or lower type quarters where no recoverV of house rent will be made.

8.3.0 Recovery of Electricity Charges

8.3.1 In the Coalfield areas where the employees are provided wrth quarters by the Managemenrand also electricity from the bulk supply obtained by them from the electricitv boards orother agencies, the employees shall be entitled to a free consumption of 30 KWH perquarter per month on a uniform basrs. For consumption beyond this limit, the employeeswill be required to pay at the same rate at whlch the EFctricity Supply Undertakjngs chargethe Coal Companies.

A3.2 Supply of Fuel

Free supply of coal on the prescribed norms will continue. However, an endeavour will bemade to reimburse the cost of about 14.5 kg of Liquid Petroleum Gas (L.PG.)The Companywill make efforts to arrange supply of gas in phased manner.

unmarried daughter, son and legally adopted son. lJ no such direct dependant rs

available for employment, brother, widowed daug hte r/wrdowed daughter-in-law orson-in-law residing with the emploYee and almost wholly dependent on the earnrng

of the employee may be considered.

- In so far as {emale dependants are concerned, their employment would be governed*' by the provisions of clause 9.5.0.

(iv) The dependants to be considered tor employment should be phystcally f it and suitable

for employment and aged not more thar 35 years provided that the age limit rn case

of employment of iemale spouse would be 45 years as given in Clause 9 5 0 ln so

9.5.0 Employment/MonetarY compensation to female dependant

9.6.0 Pension

contribution and benefrts will be regulated as per coal Mines pension Scheme, 1998.

9.6.1 The decisjon of CMPF Trust to cover NCDC/CCL pF and CMALSpF employees in the CoalMines Pension Scheme 1998 will be pursued.

9.6.2 lt is agreed to take up the matters with cMpF Trust regarding the coverage of employeesin the Coal Mines Pension Scheme who contributed to the pension f und iriterms of NCWAlll/lV & V and for modification of minimum qualifying service of 5 years instead of 10 yearsfor eligibility to pension.

9.6.3 lt is agreed to take up the matter with cMpF Trust regarding the coverage of workmen,who were contributing towards family pension scheme since the year t-9gg and retiredafter31.3.1994, in the Coal Mines pension Scheme.1998.

9.6.4 lt is agreed to notify the pension scheme of Ex-NCDC employees who were recervrngpension under the central Government scheme and whose cases were covered by thedecisron of Hon'ble High Court ln case No. LpA No. 67 of 1994 (R) order dated 15.1 .1ggland W,P No. 2043 of 1992 with Wp of g31 of 1993 order dated 30.1 1.1998.

Chapter - X

Housing, Water Supply, Medical &Educational Facilities

10.1.0 House

i0.1.1 All efforts will be made to meet the stipulatron made by Department of Public Enterpnsesfor construction of Houses. The aforesaid houses will not be lower in standaro rnanprescribed by DPE. All ef{orts will be made to get adequate {unds from Governmenr,Bank, LlC, HUDCO. etc. for this programme and aiso for getting allotment of land fronrState Governments.

10.1 .2 All the standard houses to be constructed will be provided with electricity, water tap andfan.

10.1.3 The standard houses which have not yet been provided wlth electricity, water tap and fanwill also be provided with the same. Other houses, belonging to the companies for whichthe occupants are not entitled to house rent allowance will also be provided with fan.

10.1.4 All quarters/hutments belonging to coal companies will be repaired and maintained by therespeciive management. Adequate fund will be provided {or this purpose.

10.1.5 All out efforts will be made to provide land for Co-operative Housing with infrastrucrure.

10.1 .6 lt is also agreed that in case the workers construct houses by obtaining loan from financialinstitutions like Bank, LlC, HUDCO or any other recognised financial institution, themanagement will give guarantee regarding deduction in suitable instalments and remittancethereof towards repayment of the loan amount to the lending institution. In case the workerstake loan both from Company and financial institutions the employees will be allowed formortgaging the property concurrently in respect of financial institutions and the Company.

10.1.7 Town Administration

There wjll be a separate Town Administration Department in each Company with theresponsibility of maintaining the houses, water supply and sanitation. A Public HealthEngineerlCivil Engineer will be incharge of maintenance of water supply system in eachArea. The Town Admlnistration set-up is to become operative in three months' time fromthe date o{ signing the Agreement.

10.2.0 Water Supply

10.2.1 lt is reiterated that water supply scheme wiil be provided so as to ensure supply of 15gallons of water per employee per day in quarters. Steps will be taken to ensure that shortterm schemes are made to supply water till long term schemes become operative. lt wlllalso be ensured thal potable water is made available at work sites. Steps will be taken toensure that filtration plants are operative.

10.3.0 Medicat facilities

10.3.1 Every endeavour will be made by the Management to achieve the rate of one hospita I bedfor 100 employees. However, it will be ensured that the ratio of 1 to 100 will be achievedduring the period of the agreement. lt is agreed that efforts will be made to improve thequality o{ medical services by providing infrastructural iacilities and taking other sultablemeasures including handing over the medicai services to reputed agencies for Medicare.

The recommendation of the Kumaramangaiam committee will also be kept in view.Budgetary provision would be made for medical services at a rate not less than Rs. g0O/-per employee per annum excluding capital expendrture and establishment costs for nextfive years.

10.3.2 The Ayurvedic system of treatment will be marntained and improved upon to providemedical facilrties to employees.

10.3.3 The unanimous recommendations of the Sub Commrttee on Medical Attendance Ruleswill be implemented.

10.4.0 Ambulances

Each colliery/large establishment will be provided at least with one Ambu{ance. A[ theambulances will be kept in working order and made available whenever necessary.

10.5.0 Pneumoconiosis

10.5. 1 In order that pneumoconiosis is detected and facilitjes for arresting and cure of the d jseaseare created, adequate machrnery for the same wiil be eStablished in each comoanv. Wheresuch machinery has not been established in each coal producing company a Medical Boardto deal with the problem of pneumoconiosis will be kept operational and will startfunctioning. These Medical Boards would examjne the cases of penumoconiosis wlthin 7days of receipt of detection of pneumoconrosis.

10.5.2 lf an employee is stopped from work by any competent authority because of detection ofpneumoconiosis and on the ground that his continuance in work will lead to deteriorationand if the findings of Medical Board are to the effect that he was sufferrno frompneumoconiosrs, he will paid wages for the entire period of idleness..

'10.5.3 The MedicalAttendance Rules under consideration of the Managerient would be finalisedwithin six months oi the execution of the agreement in consultatron with the unronrepresentatives. Any alternative arra ngement/system in vogue will continue till revision ofthe M.A.R."

10.6.0 Educational Facilities and Workers Education

General

12.1 .0 The Unions agree to extend their co-operation and support in achieving the targets set folproduction productivity and reduction in cost a1 all levels. 12.3.0 Wages for Weekly Day of Rest

Workers iruthe mines and establishments governed by Mines Act or Factories Act calledupon to work on the weekly day of rest of the colliery/esta blishme nt shall be allcwedtwlce the normal wages.

12,3.1 Encashment of Earned Leave

The workmen will be entitled to get encashment oi earned leave at the rate of 15 days peryear. On discontrnuation o{ service due to death, retrrement, superannuation, VRS etc. thebalance leave or 100 days whichever is less will be allowed for encashment f rom theweek ending from the date ot signing of the agreement.

12.4.0 Contract Labour

The provisions as prescribed in NCWA-V with regard to Contract Labour will be followedas under :

(i) Industry shall not employ labour through Contractor or engage Contractors' labouron jobs of permanent and perennial nature

Jobs of permanent and perennial nature which are at present being donedepartmentally will continue to be done by regular employees.

The Management as a Prrncioal employer shall continue to monitor and supervrsethe implementation of the various provision of labour laws including payment ofcontractor's workers by contractors at counters specified by the principal employer.

have been receiving SLU/SLI on 1 1.1997 and thereafter will be placed in the A-1 Scaleof Pay.

Date of Retirement

lf the date of birth of an empioyee falls on lst day of the month, then the retiringemployee will superannuate on ihe last day of the previous month. In all other casesemployee will retire on last day of the month.

The emplovees covered under NCWA who were on the rolls of the companv as on 1 .7.1996or thereafter shall be paid interim relief at the rate oI 12o/o ol basrc wage and {rxed DA ason 30.6.1996 on pro-rata attendance basis. In pursuance of the representation received on the condition of 1o-year periodicity for wagerevision in the central PSUs, as mentioned in this Department's oM of even number dated 14.1 .gg.Govt. have reviewed the matter. lt has now been decided, in partial modification of the guidelineson the subject, that the unronized employees governed by iDA pattern, would have the option toopt for either :

1. a 10 year periodicity on wage revrsion with 100% neutralisation of DA as set out in theguidelines issued on 14.1 .99, OR

2. a five year periodicity on the basis of graded neutralization as did exist previouslv i.e. from1.1 .92 Io 31.12.96.

The workers drawing basic pay uplo Rs.6550/- p.m. shall be entrtled for neutralization ot DAat 100o/o of basic pay and those drawing basic pay beyond Fs.6550/- p.rfl. shall be entrtled for7 5o/o neutalizalion of DA.

The above guidelines may please be brought to the notice of the public enterprises underthe administrative control of different Min istries/Depa rtments.

The undersigned is directed to refer to DPE's OM of even number dated 25.6.99. U nder the

extant provisions,- the employees of Central PSUs who are on IDA pattern scales have been

allowed to adopt 1 oo% DA neutralization w.e.f . 1 .1 .97 above quarterly index average of 1 708.

The above neutralization of DA@100% would also be applicable to the unionized staff/work-

ers of the Central PSUS where the agreements for revrsion of wages have already been con-

cluded by the Management on the basis of the guidelines issued vide DPE's oMs dated 14.1 .99

and 26.7.2OOO. lt is further clarified that wherever the quarterly index average on 1.1.97 is nol1708, the DA would be calculated as per DPE's OM dated 1 9.7.95 and 26.7.95 till the quarterly

index average reaches Upto 1 708. Above quarterly average index of '1 708, DA would be calculated

as per the DPE',s OM dated 25.6.99 in the case of staff/workers (rn case the tenure of wage

agreement is for 10 years) and as per DPE's OM dated 26.7.2000 (if the tenure of agreement is

for 5 years).

All the admihistrative Ministries/Departments of the Government of India are requested tobring the foregoing to the notice of PSUs under administrative control for their necessary action.

Employees who are provrded with uniform will be paid washing allowance @Rs.40/- permonth (es against the existing rate of Rs.32/- p.m.) with effect from 1.1 .2OO0. The amount of

8. Periodicity ol the Agreement

The term of NCWA - Vl would be for f ive years commencing f rom 01 .07.1 996 to 30.06.2001 .

9. Gommencement of payment of revised wages

The revised wages and allowances shall be paid from the month of Oct.'2000 payable inNov. '2000. As regards payments of arrears of wages & allowances, the same will be separatelydiscussed in the Core Group and Modalities decided.

All other issues raised by the unions will be discussed and finalised separately.

10. A Drafting committee will be constituted for finalising the draft Memorandum of Agree-ment for NCWA - Vl. The committee should finalise the draft by 1sth October, 2000.

11. All other provisions which have not been revised will continue to be in force.

12. The unions have requested the management to make revision of allowances w.e.f . 1.7.99 instead of 'l .1.2000 proposed earlier. The unions have further requested that an amount of Rs.1800/- deducted from basic pay as against the earlier proposal of Rs.1 900/- for payment of under-ground allowance. The management informed the unions that the approval of Ministry of Coal forrevision of allowances f rom '1 .1 .2000 and deduction of Rs.1 900/- f rom basic pay for payment ofunderground allowance have already been taken. Howevel keeping in view the request of theunions the management agree in principle however it will be placed for approval of the Ministry ofCoal immediately.

For handling the sensitive situation arising out of the proposed strike in coal seclor a Groupof Ministers was constiruted vide oM No. 2381/1/2000-Calr dated 11.12.2000. In continuationthereof, a meeting of GOM chalred by Frnance Mrnister on 14.12.2000 at 2.30 PM. List of panict-

2. Four oi the Unions (INTUC, AITUC, BMS and HMS) have issued a notice tor going on

slrike irom '181h to 23th December, 2000 and conveyed their Charter of Demands. ln all it

contained 39 demands. Except tor items 22 to 29, the rest pertain to problems relalrng toemoluments, benefits, service conditions etc. ln a series of meeting held by Chairman

CIL and his officers these issues have been harmoriously and amicably resolved How-

ever, the issues f rom 22Io 29 rerate to items of national policy f or which the unlon ieaders

have requested to have an lnterface with the Government. On Ministry of Coal's iniliative,

PM has kindly agreed to constitute a GOM. Hon'ble FM Was kind enough to convene the

f irst meeting of the GOM today.

He also informed that some preliminary discussions were held in the Ministry of Coal withthe union ieaders the previous day. After prolonged consultations with them, certain draft

formulations on the contentious issues have been drawn up

He informed that all the coal companie. In Eastern Part of India, i.e. BCCL. ECL and ccLhave been losing right from the beginning of nationalization. No investmenVreorga nization

has b'een done rn a proper manner. He stressed the need of budgetary support from the

Government. The report of lClCl which has suggested closure of large number of mines is

not in the overall rnterest of coal industry as many mines in the list to be closed have a

reserve of b0-132 years. He also re-affirmed that the reduction of import duty will kill the

Indian coal industrY.

6. Shri Rajendra Prasad, President, INTUC

He thanked the FM for increasing the duty on import of non-coking coal from 15 to 25ok

and requested it to be brought up to a level of 85%. he reiterated that ECI and BCCL are

having reserves of good quality non-coking and coking coal. coal sector should be allo-

cated;dequate funds for development of mines. He also suggested that surplus coktng

coal washery should be converted into non-coking coal washery

Even for sustaintng the present production some rnvestment is required which needs

Giving a brif resume, Secretary (Coal) informed that ECL, BCCL and CCL are losisng aboutRs. 1000 crores annually. The revival plan of lClCl for ECL encompasses closure of 64mines. MOC will be approaching the Cabine for the approval of revival plan of ECL. Crosssubsidizatron is a{iecting the Profit Making Companies (PMCs) investment plans. Wjththe new duty structure and the present exchange rate, imported coal has become constlierin many of the prots. Coal companies are having around Rs. 6.000 crores of coal dueswhich need to be securitised.

Finance Minster briefly dwelt upon the Govt's polocy guidelines on revival of sick unirs,

. We are not intersted in privatization for sake of privation. lt will be on a rational basis.

. Revival of sick units will be examined on unit to unit basis,

. lf revival is not possible then only will the unrts be closed.

. Workers interest will be protected.

. lmport duty is a very complex exercise due to confilicting interests of various sec-tors but the Govt. wiil ensure that the "Be5t" interest of the country are secured

. We should like to protect the lndian lndustry, but the Government also has someconstrianrs.
