We design and manufacture to meet your specific requirements Monitors for extinguishing agent capacities of 200 to 60,000 lpm, including branch pipe and nozzle equipment matched to each individual case. In addition to hand wheel and hand lever operated devices, we also supply a wide range of remote controlled monitors.
Being suitable for flexible retrofitting and attachments, our devices can have their branch pipe equipment and method of operation adapted at any time to account for changed risks. Supple-menting our complete range of monitors is a number of control systems, valves & fittings and admixing systems.

Each costumer requirement may differ in terms of function and material but in all cases they are extremely exacting. Whether it be rock chips, the impact of seawater or chemicals, or extreme temperature fluctuations – with original Alco monitors you are always perfectly equipped.
To minimize both pressure losses and wear at the same time, we pay particular attention to the design of the guidance arrangement for the extinguishing agent in the monitor. Based on our decades of experience in the design, construction and maintenance of monitors, we only use materials which are of a particularly high quality for our production. Anodized or hard-anodized aluminium alloys (with additional catalytic dipping lacquer coatings on the inside and outside in some cases) or copper alloys provide unparalleled resilience.
When it comes to the coating of our devices, you‘ll also get top quality. On top of the polyacrylic-based two component primer we apply a high acrylic-based two component top coat in two further stages of spraying. The standard colours are: flame red (RAL 3000), white (RAL 9001) and silver (RAL 9006). Would you prefer different colours? Just ask us!

This monitor is equipped with a jet/spray nozzle and is therefore suitable for delivering water and foam (AFFF).
The monitor is set in horizontal oscillating motion with the help of a pressure cylinder which is actuated by a small amount of the extinguishing water. The reversing points for the oscillating motion can be adjusted to the specific requirements of each assignment. It is also possible to turn off the oscillating function altogether and operate the monitor in manual mode only.

Having a very low overall depth, the basic unit of the PowerFighter 2-E is particularly suitable for deployment as a bumper monitor on fire engines. The path of the water is optimized in hydraulic terms by flow guidance fins, which makes it possible to achieve long throw distances with only low pressure losses. All the moving parts of the motor are protected by an extremely sturdy cover made of glass-fibre reinforced plastic, which also gives the device an attractive appearance at the same time.
The PowerFighter 2-E is supplied wired up and ready for installation. On request we can fit the device with electric limit switches, potentiometers and a lever for emergency operation by hand. The swivelling angles can be adjusted at the factory to your specific requirements, subject to the limits of the maximum swivelling ranges.
Based on the basic device, a wide range of application-specific adaptations are possible.
APF 2-E
Service-proven over many years, the Power Fighter 2-E is equipped with reliable geared motors for 24 V DC and is also a highly versatile device, especially on vehicles, but also for permanent installation in facilities. The stand-ard device comes with an integrated jet/spray nozzle with a maximum capacity of 1,200 lpm.
The range of variations includes adaptations to make it a water, foam and powder monitor with a capacity of up to 2,000 lpm (extinguishing powder up to approx. 25 kg/s).

The basic unit of the PowerFighter 3-C is extremely compact relative to the inner diameter of the water guidance arrangement. The path of the water is optimized in hydraulic terms by flow guidance fins and the elliptically shaped cross-section, which makes it possible to achieve long throw distances with only low pressure losses.
With the basic device as the starting point, a wide range of optional and accessory components are available to enable the device to be adapted to specific assignment requirements. This applies to both the choice of method of operation and the type of branch pipe and nozzle equipment.
The Power Fighter 3-C series is comprised of moni-tors designed to meet requirements in the field for versatile water, foam and powder monitors for capaci-ties of up to 4,000 lpm and powder of up to 50 kg/s.

Alco PowerFighter APF 3-C
This monitor is turned and swivelled by a hand lever. The device has an ergonomically positioned swivel lever to enable it to be friction-locked in all positions. This pre-vents any possibility of the monitor coming loose from its fixed position, e.g. as a result of vibrations.
Since the device does not have a gear unit it can be directed towards the target very quickly by the hand lever when unlocked. The angle of the hand lever can be adjusted via a toothed lock washer, which helps the operator save ener-gy and avoid physical fatigue while working.

This device was specifically developed for installation on vehicles and can be operated by remote control. It is adjusted vertically and horizontally by electric motors with direct current and self-locking gear units. The monitor is supplied ready to connect and fully wired up to a terminal box. On request we can also supply you with a controller and operator‘s controls.
A facility for emergency operation with an open-end or ring wrench (wrench width 10) is also provided as stan-dard. On request we can fit the device with limit switches, potentiometers or electric position sensors. The worm gears for the monitors are fully enclosed. The swivelling angles can be adjusted at the factory to your specific requirements, subject to the limits of the maximum swivelling ranges.

This monitor is turned and swivelled by hand wheels. The hand wheels are positioned ergonomically and arranged logically in relation to the axes of movement to ensure that operation is made as easy as possible. The completely enclosed worm gear units lock the device in every selected position without the need for any further locking opera-tions. Even vibrations associated with use on vehicles or ships and boats will not cause it to move out of position of its own accord.

This device was specifically developed for use in industrial facilities with particularly high requirements in terms of ruggedness and resistance to corrosion, or where there is a risk of explosions. In combination with a hydraulic unit and a controller the monitor can be operated by remote control. It is adjusted vertically and horizontally, within the range of the hydraulically adjustable limit switches, by service-proven, maintenance-free hydraulic motors and self-locking gear units. Where a hydraulic system is already available, this version can be used to achieve a coordinated concept. The device is supplied complete with piping to the selector unit for switching between manual and hydraulic operation. On request we can also supply you with a hydraulic unit and corre-sponding electric controller.
The closed hydraulic system and a short-circuit valve ensure that the operator can switch smoothly to the emer-gency manual operation facility, included as standard, whenever required. This can be done with an open-end or ring wrench with a wrench width of 10. The worm gears for the monitor are fully enclosed. Designed for permanent installation in industrial facilities, this is a highly versatile device particularly in combination with remote control from central monitoring units. It is adjusted vertically and horizontally by electric motors with 220-770 V three-phase alternating current and self-locking gear units. The monitor is supplied ready to connect and fully wired up to a terminal box. On request we can also supply you with a controller and operator‘s controls.
The standard device comes with hand wheels for emergency manual operation and infinitely adjustable limit switches. On request we can fit the device with potentiometers or electric position sensors. The three-phase alternating current drives and worm gears for the monitors are fully enclosed. With the basic device as starting point, a wide range of optional and accessory components are available to enable the device to be adapted to specific assignment requirements. This applies to both the choice of method of operation and the type of branch pipe and nozzle equipment.
Service-proven over many years, the Power-Fighter 3-u series consists of universal de-vices for delivering water, foam and powder with capacities of up to 4,000 lpm with all standard types of operation.

This monitor has all the technical features of the PowerFighter 3-u series and also has in addition a central throughfeed system which runs through the monitor itself. This reduces the maximum capacity to 3,200 lpm.
APF 3-UZ
The injector on the branch pipe or nozzle is supplied from there via a permanently connected hose line. This connection hose is part of the basic device and swivels with the monitor when the monitor is rotated, raised and lowered. This means that there is no need for the suction line between the monitor and the foaming agent to accommodate any movement when the monitor is in operation.
When working with self-priming foam branch pipes and jet/spray nozzles, the suction line for the foaming agent restricts the horizontal swivelling range. With the PowerFighter 3-u series the suction line can be permanently re-routed as far as the foaming agent inlet on the static lower section of the monitor. From there the suction line runs along the axis of rotation and ends with an outlet bend on the swivelling upper section of the PowerFighter. A short flexible hose connects it from here to the foam inductor on the foam branch pipe or nozzle.

In combination with a hydraulic unit and a controller the monitor can be operated by remote control. It is adjusted vertically and horizontally, within the range of the hydraulically adjustable limit switches, by service-proven, maintenance-free hydraulic motors and self-locking gear units. Where a hydraulic system is already available, this version can be used to achieve a coordinated concept. The device is supplied complete with piping to the selector unit for switching between manual and hydraulic operation. On request we can also supply you with a hydraulic unit and corre-sponding electric controller.
The closed hydraulic system and a short-circuit valve ensure that the operator can switch smoothly to the emer-gency manual operation facility, included as standard, whenever required. The inlet flange on the APF 4-uZ has connections for connecting the hydraulic lines to the drives. These lines run centrally in a tube bundle along the vertical axis of rotation of the monitor. This means that the pressure oil can be supplied to the drives for the monitor and for adjusting the nozzles without the need for hoses on the outside. The hydraulic hoses are not exposed to any torsional strain and you save the extra lengths of hose normally required in order to compensate for the turning movements.

This PowerFighter 6-uZ has all the technical features of the PowerFighter 6-u series and also has in addition a central foaming agent supply system which runs through the monitor itself. This reduces the maxi-mum capacity to 12,000 lpm.
APF 6-UZ
When working with self-priming foam branch pipes and MZ nozzles, the suction line for the foaming agent restricts the horizontal swivelling range. With the PowerFighter 6-uZ series the suction line can be permanently re-routed as far as the foaming agent inlet on the static lower section of the monitor. From there the suction line runs along the axis of rotation and ends with an outlet bend on the swivelling upper section of the PowerFighter. A short flexible hose connects it from here to the foam inductor on the foam branch pipe or nozzle.
This connection hose is part of the basic device and swivels with the monitor when the monitor is rotated, raised and lowered. This means that there is no need for the suction line between the monitor and the foaming agent to accommodate any movement when the monitor is in operation.

The autonomous FIFI 1, 2 or 3 extinguishing systems are fully integrated in the firefighting boat. Each of the classifications describes the firefighting capabilities of the firefighting boat. These include, for example, speci-fied minimum requirements in respect of flow rate, height of the throw curve for a defined distance from the boat/ship, and absolute throw distance.
The monitor is a highly important component of every FIFI system, because its water delivery rate is intended to enable firefighting work to be carried out at the large distance required. The APF 7 is suitable for installation in a FIFI 1 system.

For safe operation in special applications, such as on a trailer for instance, it is possible as an option to block movement in the vertical direction at approx. +30 degrees with a mechanical stop. The blocking lock can be released manually for the downward movement. It then engages again automatically at +30 degrees for the upward movement.

In combination with a hydraulic unit and a controller the monitor can be operated by remote control. It is adjusted vertically and horizontally, within the range of the hydraulically adjustable limit switches, by service-proven, maintenance-free hydraulic motors and self-locking gear units. Where a hydraulic system is already available, this version can be used to achieve a coordinated concept. The device is supplied complete with piping to the selector unit for switching between manual and hydraulic operation. On request we can also supply you with a hydraulic unit and corre-sponding electric controller.
The closed hydraulic system and a short-circuit valve ensure that the operator can switch smoothly to the emer-gency manual operation facility, included as standard, whenever required. Oscillating units DN 80 and DN 100
The Oscillating units DN 80 and DN 100 are designed for making the attached monitor oscillate horizontally. They are installed immediately in front of the monitor and can be operated with both water and a mixture of water and foaming agent.
In operation a small amount of the flow of extinguishing water is drawn off and redirected through a tur-bine in the oscillating unit, which drives a hydraulic pump. This supplies a working cylinder, by means of a closed oil circuit, which in turn sets the oscillating unit in motion. The direction of motion is reversed by a 4/2-way pilot valve.
The lines for supplying the water to the turbine and leading it off again are fixed. The water supply line from the extinguishing water flow has a dirt filter which can be flushed and an additional ball valve with an open inlet (G3/8) to which a supply line can be connected. This means it is also possible to check the oscillating unit without the monitor running.
The swivelling range of the oscillating unit can be infinitely adjusted within the maximum range of 180°. The swivelling speed can be reduced to a complete stop by a 3-way ball valve in the oil circuit. To ensure that you can rely on guaranteed maximum work safety, all moving parts in the oscillating unit are covered by a hood.

Albach trailers with fitted monitors are completely mobile firefighting units which provide a stable, trans-portable basis for assignments requiring large volumes of extinguishing agent. It is possible to use either water or a water and foaming agent mixture (AFFF, FFFP) with these trailers.
Equipped with four lowerable supports or, for larger units, a lowerable axle operated by a manual hydraulic pump, the vehicles can be lowered on their spring-loaded outriggers with wear-resistant tips made of hard metal. These ensure that the trailer stands securely on both hard and soft ground. The filling of the water guidance arrangements provides additional stability for the trailer during operations.
The water guidance arrangement is equipped with an automatic drainage valve and empties automatic-ally at the end of operations.

Admixer
During assignments it is often the case that foaming agent has to be admixed with the extinguishing water. This is required either to change the physical properties of the water or to produce foam for smothering liquid-based fires or for cooling purposes. The wide range of different foaming agents means that there is a need for fittings for helping admix the agents to the extinguishing water in preset dosages and with sufficient accuracy.
Admixing concentrations for the generation of foam are generally 3% and 6%. An admixing concentration of 1% is used in order to reduce the surface tension of the water and thereby wet the object on fire more effectively with the extinguishing agent.
When it comes to the choice of the foam inductor fitting, the first point to check is whether the foaming agent is supplied by a pump, i.e. under pressure, or whether it is made available without pressure in a con-tainer. In the first case a pressure foam inductor has to be used, whereas in the second case a suction foam inductor is required.

Firefighting facilities used in industry often have the foam supplied through pressure lines, because of the size of the plants involved. The pressure in the foam lines is maintained by foam pumps.
The pressure foam inductor serves to admix the pressurized foaming agent to a pressurized water line. It has a mechanism which allows foaming agent and/or water pressure to be supplied at a constant rate, as long as there is a minimum pressure difference of 2 bar between the foaming agent line and the water line. It is also possible to switch between several different admixing rates during operation.
The admixing regulator supplies the same amount of foaming agent to the water at all times at practically any pressure level, even when the pressure fluctuates. If more water is supplied when the pressure is high-er, which is the case with most foam generators, the resultant foam-to-water mix is „thinner“. Conversely, if the amount of water falls in response to lower pressure, the mix is „heavier“. The admixing rate only remains constant if the flow rate does not change either when the foam is being generated. Where there is a strong increase in pressure with just a low flow rate, a gradual shutoff valve should be used to maintain the nominal flow rate.

This pump premixing system is comprised of a pump and mixing unit and a measuring and dosing appliance, which is fitted to the pressure pipe joint of the pump. It delivers an exact, preset mixture across the entire flow range, regardless of the number of consumers connected.
The entire flow of extinguishing agent being delivered by the vehicle initially flows through the measuring and dos-ing appliance. As it does so it moves a dosing cylinder which regulates the flow of foam concentrate to the suction fitting on the water jet pump and mixing unit. To operate this unit a certain amount of the pressurized water flow from the centrifugal pump is drawn off and used in the water jet pump to draw up foaming agent. This sub-flow be-comes mixed with the foam concentrate and is then fed back to the main flow of water again at the suction fitting in the centrifugal pump. In the process the foam and water mixture is produced in the preset percentage ratio. Fed through the centrifugal pump again, the mixture then arrives at the end consumer.
The system described above is available in two sizes: > Type AZ4 for a flow rate of 250 lpm to 4,000 lpm> Type AZ5 for a flow rate of 500 lpm to 5,200 lpm
In terms of principles of operation, suction foam inductors are similar to water jet pumps. Depending on the way in which the device is installed in the overall system, the terms inline foam inductor or bypass foam inductor are used.
Inline foam inductors are installed ahead of the foam generator in the supply lines or integrated in the foam generator itself (self-priming foam branch pipes and MZ nozzles). The entire flow of extinguishing agent flows through them, which is why this type of use is more suitable for smaller volumes of extinguishing agent.
In bypass admixing only part of the flow of the extinguishing water is used for drawing up the foaming agent. A concentrated mixture is generated from a preset amount of foaming agent and water. When the sub-flow and main flow are brought together again, the desired mixing ratio for the generation of the foam is created. Given the high pressure loss in the foam inductor, the foaming agent concentrate has to be admixed with the main flow of extinguishing fluid by a self-priming end fitting. An alternative is to install a bypass foam inductor opera-ting as a pump premixer or „around the pump“ (RP). In this form of line supply the pressurized water flow has a sub-flow drawn off after the pump (at the pressure pipe joint) for drawing up the foaming agent. At the drawing up side of the pump the mixture of foaming agent and water is then fed to the main flow again.

Pneumatic extensions are installed in fire engines to enable monitors to be raised from a low standby posi-tion to a higher operating position. With the monitor retracted, the overall height of the vehicle is lower. When raised to the operating position, the monitor has a much bigger vertical swivelling range and the operating position is also optimized for the operator as well. The extension is comprised of a telescopic extension tube with two pneumatic cylinders to the right and left on each side. These cylinders are supplied with compressed air at between 5 bar and 8 bar. Movement in and out is dampened by retardation elements.

Folding joints are designed for folding monitors down from the firefighting position to an idle position to enable them to be transported or stored away. Although they are used primarily on vehicles, they are also used in industrial facilities such as, e.g. thermal power stations.
used on vehicles they allow monitors to be permanently installed without increasing the overall height of the vehicle. When swung out during assignments, the raised position of the monitor provides a much greater vertical swivelling range downwards while also making it possible to operate without physical fatigue. The joint is secured, with positive locking and vibration resistance, by a spring-loaded lock in both the set up position and the folded down position.
Folding joints are used in industrial facilities for moving monitors from their working positions to an idle position. This is particularly important in thermal power stations, because it ensures that they are then protected from the grabs on the waste crane, from projecting objects and also from heavy pollution.
Depending on the weight of the monitor and specific use, the folding movement is performed either by hand or with the aid of motor power.

Field experience shows that the outlet fitting attached to the monitor has a critical influence on the effectiveness of extinguishing operations. you can choose from a range of different „nozzles“ to meet your specific requirements:
Switching attachments are three-way ball valves which are attached to the outlet flange of a monitor to allow two different branch pipes to be fitted to it. This means that when different extinguishing agents are being used it is always possible to select the branch pipe which is most suitable for the specific extinguishing agent or job at hand. Given repulsive force of the upper branch pipe, which is eccentric in terms of impact, it is always advisable to install the branch pipe with the lower capacity in the upper position.

Accessories:you can also fit a spray attachment to the jet nozzle, which will spread the jet open. Jet/spray nozzles are equipped with a baffle which deflects the flow of extinguishing agent at the nozzle outlet so that it comes out through a ring-shaped slit. The resultant hollow jet is then deflected again at the so-called jet forming sleeve to be bundled into a compact jet. It has a shorter range than a full jet. However, by pulling back the jet forming sleeve it is possible to infinitely adjust the opening angle of the jet by as much as to make it a conical spray. A spray jet of this kind is capable of absorbing large amounts of energy and heat radiation. Moreover, the fine drops which make up the spray are also ideally suitable for washing noxious substances out of the air. Jet/spray nozzles create up to triple expansion of type AFFF foaming agents without any additional auxiliaries.
Foam branch pipes a comprised of a nozzle with an attached throw pipe. The jet effect causes air to be drawn in from the surroundings. When the air mixes with the extinguishing agent in the throw pipe it forms foam. Depending on the foaming agent used it is possible to achieve expansion ratios of up to 15. The range of the jet is somewhat smaller than with a full jet or jet/spray nozzle. Foam branch pipes can also be used just with water, in which case the throw distance will be slightly greater.
Self-priming foam branch pipes are a combination of foam inductor and foam generator. A regulating apparatus on the foam inductor allows you to set the admixing or pick-up rates to a maximum of 6%.
Extinguishing powder is used for a wide range of applications and can be combined with other extinguishing agents for enhanced effectiveness. Powder pipes are therefore not just made as self-contained units but can also be combined on the monitor with other nozzles or integrated in foam branch pipes or jet/spray nozzles. With the latter it is possible to apply a combined powder and fluid jet to the source of the fire.

Where the customer is a fully qualified merchant as defined by the German Commercial Code (HGB), a legal entity subject to domestic public law or a trustee of public funds, the respective registered place of business of the company shall be the place of jurisdiction for any disputes arising from or in connection with the delivery transaction – including actions for assertions of claims concerning payment of a bill of exchange or cheque – unless an alternative place of fulfillment or jurisdiction applies because of man-datory legal requirements. This shall also apply if the customer has no general place of jurisdiction in Germany, or if the permanent residence or habitual place of residence during the bringing of an action are unknown.
4.SeverabilityThe invalidity of any part of any provision in these Terms and Conditions of Delivery and Payment shall not affect the validity of any part of the remaining provisions or agreements. The invalid provision shall be replaced with a provision which comes as close as possible to the commercial intentions of the previous invalid provision.
II. Terms and Conditions of Sale and Delivery 1.Offers,OrderConfirmationsandContractConclusionOur offers are non-binding and without obligation. All documents included with the offer and the order confirmation, such as drawings, illustrations, weights and dimensions or any other technical data, are non-binding unless explicitly described as binding. Declarations of acceptance and all orders must be confirmed by us in writing or by telex, otherwise they shall have no legal validity. The same applies to supplements, amendments and subsidiary agreements. For immediate deliveries, the invoice can be accepted as a substitute for written confirmation. Our order confirmations shall be used as the authoritative definition of the nature and scope of our obligations. This also applies where reference is made to the order.2.Pricesa) All prices are deemed to be ex-works, excluding packaging, freight, postage and
insurance, and excluding applicable statutory Value Added Tax at the valid rate on the day of dispatch. All orders delivered to third parties on behalf of the cus-tomer shall be subject to a handling fee of 5 percent – or not less than EUR 12.00.
b) The minimum invoice sum is EUR 200 net. No orders below this invoice sum can be accepted. 3.TimeforDeliverya) Times and deadlines for delivery shall be non-binding unless explicitly agreed
otherwise in writing. Compliance with any specific times and deadlines for delivery given by us shall be subject to our suppliers and sub-contractors fulfill-ing their duties with regard to proper and timely delivery.
b) The time for delivery shall commence upon issue of our order confirmation, but not before all details relating to the execution of the order and all other conditions to be met by the customer have been fulfilled. Deliveries before the expiry of the time for delivery are permitted, as are partial deliveries.
c) A delay in delivery or performance due to force majeure or other unforeseea-ble event which presents a major obstacle to our ability to complete delivery, or renders delivery impossible, and which is not in our responsibility (such events include, in particular, acts of war, war-like conditions, government order, non-issue of export, import or transit permits, national measures to restrict trade, or other interruptions to operations of any kind, irrespective of whether these events occur with us, our suppliers or their sub-contractors, we shall be entitled to receive an extension of time, corresponding to the duration of the hindrance plus a reasonable starting up time, for fulfillment of delivery or performance, or to withdraw from the contract – if not yet fulfilled – either fully or partially. Where the customer himself should be in default with regard to fulfillment of his contractual duties, the time for delivery shall also be extend- ed by the corresponding amount of time.
d) If the duration of the hindrance is longer than 3 months, the customer shall be entitled, after setting a reasonable further extension of time (at least 14 days), to withdraw from the contract, if not yet fulfilled, either fully or partial-ly. Where, in accordance with Section 3. c), the time for delivery is extended or we should become freed from our duty, the customer shall not derive any entitlement to any claims for compensation for damages as a consequence. We shall only be entitled to claim relief by reason of the aforementioned cir-cumstances if the customer was informed without delay.
4.TestProcedures,AcceptanceInspectiona) If the customer wishes us to carry out required tests, he must inform us accord-
ingly. The type and scope of the test must be agreed before the contract is concluded.
b) If an acceptance inspection is required, the scope and conditions must be spe-
cified before the contract is concluded. The acceptance inspections shall be carried out at the supplier plant, at the expense of the customer, immediately after notice has been given of readiness for the acceptance inspection. If the acceptance inspection does not take place, does not take place on time or is not fully completed, we shall be entitled to dispatch the goods or to place them in storage at the risk and expense of the customer; in this case the goods shall be deemed to have been accepted.
5.DeviationsfromDimensions,WeightsandQuantitiesDrawings, illustrations, dimensions and weights contained in catalogs, offers, promotional material, etc., are to be considered as only approximately definitive. Changes in accordance with ordinary trade usage are permissible. A quantity tol-erance of plus/minus 10 percent relative to the order quantity is permissible for special productions. 6.Packaginga) The type of packaging shall be decided by the supplier, whereby it shall be based on the requirements of the Packaging Regulations. We draw specific attention to the fact that we accept the return of transportation packaging where delivery is free of charge (including truckage), but shall not pay for any costs of disposal which may be incurred. b) If the Collico, Bahnblätter, mesh, Euro or wooden pallets used for packaging are not returned within two weeks, the supplier reserves the right to charge for the costs incurred. 7.Deliverya) The customer shall pay for the costs of delivery.b) If no specific instructions are given otherwise, the shipping method, means
of transportation and shipping route shall be decided by us, with all liability excluded.
8.TransferofRisk/TransportationInsurancea) The risk shall pass to the customer upon dispatch from the factory in Frank-
furt. The shipping of the goods is at the risk of the customer. We shall only arrange for transportation insurance if specifically requested to do so by the customer, and only at the expense of the customer.
b) Where shipment is delayed at no fault of ours, the risk shall pass to the cus-tomer on the day the customer is notified by us that the goods are ready for shipment or for picking up.
9.ReturnDeliveriesWhere goods are returned at no fault of ours, we shall levy a fee of 20 percent of the value of the goods, or not less than EUR 15.00, for warehousing them again. The goods must be returned to us at no charge to us. Any freight, packaging, post-age or other ancillary costs incurred shall be paid for by the sender of the return delivery. All return deliveries require our express prior agreement. The return of goods with a net value of less than EUR 200 shall not be accepted. 10.TermsofPaymenta) Our invoices are due for payment without deduction within 30 days after the
invoice date. In the case of orders with an invoice value of more than EUR 5,000, one third of the purchase price shall be due for payment upon receipt of our order confirmation, a further one third on delivery, or no later than when notifi-cation that the goods are ready for delivery is given, and the final one third within one month of the time for payment of the second third, without any deductions in each case and regardless of whether an invoice for installation costs has been issued.
b) Interest shall be charged on payment in arrears. Any such interest charges shall be charged at the applicable bank rates for credit, but at not less than 8 percent above the base interest rate of the European Central Bank.
c) We shall be entitled, notwithstanding any stipulations of the customer to the contrary, to appropriate payments in the first instance to older debts of the customer. We shall inform the customer about the way in which the payment has been set-off. Where costs and interest have been incurred, we shall be entitled in the first instance to appropriate the payments to the costs, then to the interest, and lastly to the principal performance.
d) Partial deliveries and partial performances can be charged separately. e) There shall be no entitlement to set-off or retention, unless the counter-claim
has become legally effective or has been accepted by us. f) In the event of non-compliance with terms of payment, all of our accounts
receivable, including those for which we have accepted a bill of exchange, shall become due for immediate payment.
g) If the customer should be in default on his payment obligations, or stops pay-ments, or a bank fails to honor a cheque, we shall be entitled, after setting a time limit, to withdraw from the supply contract and from any agreements relating to the extension of the term of payment. We shall also be entitled to exclude the customer who is in default of payment from any further deliveries, even if concomitant supply contracts have been concluded.
h) We are entitled to assign our claims for payment. i) Our invoices shall be paid free of charges to us. Any bank charges or other
ancillary costs associated with monetary transactions shall be borne by the customer. Invoices shall only be deemed to have been paid when the equiva-lent value has been credited to the full amount set out in the invoice.
11.ReservationofTitlea) We shall retain ownership of the delivered goods until payment of all out-
standing and future accounts receivable, regardless of type or legal basis, arising in connection with the business relationship with the customer, has been made in full. In the case of a running account, the reserved title shall be deemed to provide security for the account balance receivables.
b) Any processing or working of the goods which have been delivered by us and which remain in our ownership shall be carried out for and on behalf of us, without giving rise to any liabilities for us.
c) Where the goods are installed by the customer in goods of third parties, we shall acquire co-ownership of the resultant products in the proportion of the value of the goods supplied by us relative to the value of the goods used from third parties.
d) Where the goods delivered by us are commingled with or connected to other objects, the customer herewith agrees to assign his rights of ownership/co-ownership of the commingled object or new object, and shall hold the object in custody for us at no charge to us and with due care.
e) The customer shall be entitled, within the framework of the customer‘s ordi-nary business, to process and to sell the goods subject to reservation of title as long as he is not in default. The goods may not be pledged or ownership transferred by way of security.
f) The customer shall not assign any claims accruing to him from the resale of the reserved goods supplied by us unless it is an assignment pursuant to
genuine factoring of which we must be informed in advance and where the factoring proceeds exceed the value of our secured claim for payment. Our claim for payment shall become due for payment as soon as the factoring proceeds are paid. g) All claims for payment (including all account balance receivables from an open
account) arising out of the resale of the reserved goods or arising for any other legal reason (insurance/unlawful acts) relating to the reserved goods, are as-signed to us in full, here and now, as a precaution. We authorize the customer, subject to revocation, to collect on our account and in his own name the claims for payment assigned to us. The authority to collect may only be revoked if the customer should be in default of properly meeting his payment obligations.
h) In the event of any attachments being made on the reserved goods by third parties, the customer shall advise the third party of our ownership and also advise us immediately, to enable us to take judicial or extra-judicial action to protect our interests. The judicial or extra-judicial costs incurred in this con-nection shall be borne by the customer.
i) The customer shall resist attachments from third parties. Where the customer is in breach of contract – in particular where the customer is in default on payment – we shall be entitled to reclaim the reserved goods or to demand the assignment of the purchaser‘s claims for return in respect of a third party. Notwithstanding § 449 II of the German Civil Code (BGB), this shall not be subject to the condition of withdrawal from the contract.
j) The reclamation or seizure of the reserved goods by us shall not constitute a withdrawal from the contract, unless a consumer is involved.
k) Where a cheque is not honored, the customer undertakes to return the received goods to us on demand, for the outstanding amount, at his own risk and expense.
l) On request from the customer, we shall release securities if the value of the retained securities exceeds our claim for payment by more than 20 percent; the choice of securities to be released shall be made at our discretion. The cus-tomer shall be responsible for furnishing evidence that the retained securities exceed the 20 percent figure.
12.Guaranteea) We guarantee that the parts as manufactured and supplied by us are free
of defects in accordance with the agreed technical delivery instructions. For conformity of the condition of the goods with the contract, the time of the passing of risk shall be definitive.
b) The guarantee period is 1 year from the date of dispatch of the goods. c) We shall, in the first instance, choose between repair and replacement to
fulfill the guarantee covering defects in the goods. d) Transportation costs and traveling expenses incurred in connection with reme-
dial performance shall be borne by the customer if these should be dispropor-tionately high relative to the costs of repair or the replacement part(s).
e) The customer must notify us in writing of the discovery of any recognizable defects immediately or within 1 week at the latest after the receipt of the ob-ject of delivery. Defects which cannot be discovered within this deadline, even after thorough examination, must be reported to us in writing immediately or, again, within 1 week after discovery at the latest. Otherwise the claim under the guarantee shall be rendered void. The deadline shall be deemed to have been met if notification is dispatched within due time. The customer is solely responsible for furnishing proof that the conditions for the claim are met, in particular proof of the defect itself, when the defect was discovered and proof that notification of the defect was given within the due time.
f) The replacement of parts, sub-assemblies or whole devices shall not lead to the start of new guarantee periods. No guarantee is given for wearing parts or for the improper use, storage and handling of devices. Claims under the warranty shall be rendered void in the event of tampering by third parties.
g) Where three attempts at remedial performance have been made without success, the customer shall be entitled, at his discretion, to choose between demanding a reduction in payment (lowering) or cancellation of the contract (withdrawal). However, in the case of only a minor breach of the contract, in particular only minor defects, the customer shall not be entitled to withdraw from the contract.
h) If the customer chooses to withdraw from the contract as a consequence of a legal or material defect after the failure of remedial performance, he shall not be entitled to any claims for damages in relation to the defect. If the customer chooses to demand compensation for damages after the failure of remedial performance, the goods shall be retained by the customer if this can be rea-sonably expected from him. Compensation for damages shall be limited to the difference between the price and the value of the defective object. This shall not apply if the breach of contract was caused by fraudulent behavior.
i) The customer is not given any guarantees in the legal sense. Manufacturer‘s warranties are not affected by the above provision.
13.CustomerService We have set up a customer service unit which checks all devices to ensure that they are ready for service. We only have a duty to perform tests if a written test contract has been concluded. Unless agreed otherwise in a test contract, every test performed by our technicians is subject to the following provisions: Following the test our technicians provide attestation of confirmation of readiness for ser-vice. The test fees shall be agreed separately. Replacement parts shall be charged at the list price. Where the devices listed in the test certificate should be found to be damaged or do not function properly after the issue of the test documentation and evidence is furnished that this is the result of a negligent oversight on the part of the tester, we shall replace parts at no charge or undertake repairs. If repair should not be possible or is not carried out by us within a reasonable time, the customer shall be entitled to withdraw from the contract. All other contrac-tual or non-contractual claims arising from or in connection with completed or omitted inspections or repairs, including those arising from or in connection with contractual collateral duties, in particular claims of any kind for compensation for consequential or direct damages, shall be precluded, subject to the limits of clause 10. No liability shall be accepted if we do not receive written notification of the defect immediately after its discovery, if the device is tested or handled at any time by anyone other than one of our authorized technicians, or in the event of fail-ure to comply with operating or handling instructions for devices or accessories..14.DataProtectionWe shall be entitled to use the information received about the customer in the course of or in connection with the business relationship, regardless of whether it is received from the customer or a third party, within the terms of the German Federal Data Protection Act. This notice is provided in place of the notice required in accordance with the German Federal Data Protection Act to advise that person-al information about the customer may be stored and processed in EDP systems
