Todd Magnuson Caribou Productions PO Box 91316 Sioux Falls, SD 57107 December 06, 2005 Federal Communications Commission Disabilities Rights Office 445 12th Street SW Washington, DC 20554 Dear Sir: I and a group of friends produce a locally aired sketch comedy show called the Caribou Show. We are currently on a television station in Sioux Falls, SD. Our program is a 30 minute comedy dealing with local South Dakota topics and the skits reflect the local humor. It airs weekly Sunday morning at 12:30am local time. I am writing to you to request an exemption from the closed captioning requirements for 2006 and 2007. Currently it is costing us $250 per broadcast to pay to air the show, of which we try to get sponsors to help cover that cost. But in the 5 years we have been on the air, more often than not, the guys and I who put the show on have to chip in and cover the cost to air the show. We make absolutely no money from the show, and we only do it for fun. The cameras and editing gear is all privately owned by the cast of the show. We all work full time jobs, none of which have anything to do with television or video production. To purchase the needed editing software to add closed captioning to our show alone would cost us $1995.00. That at least is the cheapest I could find. But not only is the cost out of the question for us, we would also have to actually type in the closed captioning ourselves. I personally edit the show myself, and being a full time daycare provider, I barely have enough time to edit a show, let alone take the time to insert the closed captioning. Our show again is a fun comedy, that is mostly ad-libbed, thus making typing in the closed captioning impossible as far as time is concerned. So because of the added expense and time that would be required to close caption our show, we ask that you review our request for being exempt from the closed captioning requirements for 2006, in addition to 2007. Without the exemption, we would be forced to stop the show entirely. Please contact me at (605) 332-4596 should you have any questions. I look forward to hearing from you in the near future. Sincerely, Todd Magnuson cc:KDLTTV

Dear Sir:

I and a group of friends produce a locally aired sketch comedy show called the Caribou Show.We are currently on a television station in Sioux Falls, SD. Our program is a 30 minute comedydealing with local South Dakota topics and the skits reflect the local humor. It airs weeklySunday morning at 12:30am local time.

I am writing to you to request an exemption from the closed captioning requirements for 2006and 2007. Currently it is costing us $250 per broadcast to pay to air the show, of which we try toget sponsors to help cover that cost. Dear Sir:

Per the request of more detailed information and affidavits showing what a burden it would be toprovide closed captioning for our show the Caribou show, financially and time-wise, I haveenclosed the following documents that should help prove that our show is made for fun, notprofit. And that because I work full time, I would not have time to actually do the closedcaptioning. Also with the financial information provided, it should show that we have no meansto hire service to get the close captioning done.

First the financial aspect of the show.

• Enclosed is my tax return, showing that my only source of income is the income I receivefrom the daycare I operate full time, and my wife's income from her part time job. Thisshows what a burden spending money on software to close caption would be, and thathiring someone to do the closed captioning would not be an option for me. (Our 2005taxes have not yet been filed, but if such is needed I will be glad to provide it, since it willshow that again last year no income is made from this show. Our 2005 taxes should beprepared in February.)

• Enclosed are copies of software costs for closed captioning.

• Enclosed is an Ebay bid for the lowest cost I could find to have someone else do theclosed captioning for us. This however does not let me know what the turnaround wouldbe to get the show back if they did do the closed captioning for us. The show is based onlocal current event humor also, and if it takes even a week to get something like this backto us to air, it will compromise current event humor, since the news event we eare makingfun of isn't current anymore.

• Enclosed is a statement from the shows sole sponsor explaining that I don't make anymoney form the show, and that they pay for the show not only for the advertising Iprovide, but mainly they sponsor the show in exchange for the other work I provide.

1",

• Statements from the cast saying they make no money from the show.

Then the time aspect for me to actually do the closed captioning.

• Enclosed is a daycare form showing my hours of operation, showing that doing daycarefull time, and editing, writing, and shooting a show makes the extra burden of closedcaptioning an impossibility for me.

• A handwritten statement from my wife (the one person who can attest to the time I putinto my hobby of the show) explaining the time I already put into editing and creating theshow.

• Sample scripts from the show, showing that the skits are basically ad-libed, again makingthe burden of close captioning so difficult for me.

Also enclosed is the original letter sent to you requesting the exemption.

I hope these documents fulfill the requirements you need to consider us for exemption based onundue burden. Feel free to contact me for any other needed information. Also, I invite you to seethe show. This should show you that it is a no budget show..done for fun only. You can seesamples at our website www.cariboushow.com

To Whom It May Concern:

My name is Amanda Bumann, I am an actor on the Caribou Show. Since being involved in highschool theater and some minor college productions I have come to love acting and I willingly do it forfree. When the opportunity to appear on a television show arose I jumped at the chance and have beenvolunteering my time to the the Caribou Show, free of charge. I have never made any money from theshow, nor have I been offered any. My payment is the joy I get from making people laugh and for anexperiance that many people will never have an opportunity to get. Thank you for your time.

I have worked with Todd on the Caribou Show since March of 2002. Formost of that year, it cost me approx. $25 a week to be on the show. This money went towards buying the airtime so the show could air. Thenin about October of that year, the guy who had the camera quit the showand we were without a camera. I then bought one for approx. $2500.Which we use to tape the show. I also bought the tripod that we use aswell. I still spend money on tapes, and also usually am the one thatdrives when we go out shooting, costing me money for gas and wear andtear on my car. This is strictly a hobby, not a money making venture.Scott Pearson

A handwritten statement from my wife explaining the time Ialready put into editing and creating the show. This shows thatmy time is already stretched, and having to close caption would

not be possible for me.

Sample scripts from the show, showing that the skits arebasically ad-Iibed, again making the burden of close captioning

so difficult for me.

Munson's beach party.

Hello I'm MM. And it's come to my attention, after the zip feed conspiracy to keep me frombuilding my event center, and after the voter conspiracy keeping my rec center from being built, that you people don't like me out there. Now I thought that because I had my own tv show...be hind the scenes, that everyone must likeme. I mean everyone likes mitch krebs, and I can only assume it's because he has his won tv.So then I thought maybe it's not me so much as this show behind the scenes. I mean it could bethat reed holson is holding back my tv persona. So to get you people out there to like mebetter. ..and just in time for the upcomeing election season, I MM have decided to change theformat of behind the scenes from a dull information show about city politics, to MM beach party.

At beach.

Here we are at the MM beach part, with the MM dancers. And we are at the preceved location ofwall lake, which as soon as the city of SF expands west and overtakes wall lake, this is what itwill look like after I get my beach impovment plan in place.Well enough taIkng let's dance.Dance.Now let's bring in my newest consultant...who is consulting me on the new MM beach party. MRhelper. Now MR h you have somehow kept that awful caribou show on the air now for 6 years wil topratings...how do you do it, and how are you going to work your magic here on the all new MMbeach party.Mr h: well, i'll tell you bout it...the secret it to wear a bucket on your head with your name onit...now let's dance...Dance. (mayor gets mad mr h is dancing with his dancers...tells him to leave.)MM: now let's visit with the MM dancers...(ask name and where from, discover neither are fromSF so can't vote for you)wrap up saying next time will have dancers from SF that can actually vote for you.

Case # CGB-CC-0035

Dear Sir:

I and a group of friends produce a locally aired sketch comedy show called the Caribou Show. We are currently on atelevision station in Sioux Falls, SO. Our program is a 30 minute comedy dealing with local South Dakota topics andthe skits reflect the local humor. It airs weekly Sunday morning at 12:30am local time.

I am writing to you to request an exemption from the closed captioning requirements for 2006 and 2007. Currently itis costing us $250 per broadcast to pay to air the show, of which we try to get sponsors to help cover that cost. But inthe 5 years we have been on the air, more often than not, the guys and I who put the show on have to chip in andcover the cost to air the show. We make absolutely no money from the show, and we only do it for fun. The camerasand editing gear is all privately owned by the cast ofthe show. We all work full time jobs, none of which haveanything to do with television or video production. To purchase the needed editing software to add closed captioningto our show alone would cost us $1995.00. That at least is the cheapest I could find. But not only is the cost out ofthe question for us, we would also have to actually type in the closed captioning ourselves. I personally edit the showmyself, and being a full time daycare provider, I barely have enough time to edit a show, let alone take the time toinsert the closed captioning. Our show again is a fun comedy, that is mostly ad-Jibbed, thus making typing in theclosed captioning impossible as far as time is concerned.

So hecause of the added expense and time that would he required to close caption our show, we ask that you reviewour request for being exempt from the closed captioning requirements for 2006, in addition to 2007. Without theexemption, we would be forced to stop the show entirely.

Please contact me at (605) 332-4596 should you have any questions. I look forward to hearing from you in the near future.

Sincerely,

Todd Magnuson
