Wilson: The Court ORDERS asfollows: Plaintiffs alternative proposals to expand the classwide issues to includeinmates experiences of verbal abuse or to define a subclass of inmates who wereesposed to verbal abuse are DENIED for the reasons expressed in the Courts order ofMarch 12, 2014. (See Dkt 232: Order at 11−13.) Membership in such a subclass (or inan expanded class encompassing these allegations) would not be reasonablyascertainable in view of the difficulty of defining what constitutes abusive languageand the significant variation in deputies behavior. See Keegan v. American HondaMotor Co., 284 F.R.D. 504, 521 (C.D. Cal. 2012). However, the Court DEFERS rulingon whether subclasses should be certified for inmates who experienced unsanitaryconditions, extreme weather conditions, or inadequate privacy protection. The partiesshall file supplemental briefs. (SEE ORDER FOR DETAILS.) Plaintiffs shall file asupplemental brief of no more than 25 pages addressing the foregoing questions notlater than August 4, 2014. Defendants shall file a responsive brief of no more than 25pages not more than 14 days after plaintiffs brief. Plaintiffs may file a reply of no morethan 15 pages within 7 days of the filing of defendants brief.
