Virginia: Help Support Repeal Of Obsolete Gun Buyer Check

Fairfax, VA --(Ammoland.com)- In 1989, Virginia passed its first-in-

the-nation state instant check statute. Nine years later, the national

instant check system (NICS) became available. Since 1998, there has

been a federal requirement for purchasers of any modern firearm from

any gun dealer in every state to undergo a criminal history records check.

So, for the past twelve years, the Virginia Firearms Transaction Program

(VFTP) has been obsolete and unnecessary. For all gun purchases, the

VFTP requires additional paperwork (Virginia State Police Form 65 in

addition to the federal Form 4473), imposes a two dollar fee (state gun

tax – no fee for NICS) and causes inordinate delays, particularly on

weekends at gun shows and gun stores since the Virginia State Police is

not adequately staffing this operation to meet demand.

The solution to this persistent problem is not to increase the state gun

fee/tax or appropriate more state government funds that Virginia

taxpayers cannot afford, especially in these tough budget times, to

perpetuate this antiquated and duplicative program. Instead the VFTP

must be repealed so that only NICS will be required for gun purchases in

Virginia as in 35 other states.

With your help, pro-gun Attorney General Bob McDonnell was elected

the 71st Governor of Virginia nine months ago. When he was

inaugurated on January 16, Governor McDonnell signed Executive Order

#2 establishing the Governor’s Commission on Government Reform and

Restructuring. Its stated purpose is to “conduct a thorough review of

Virginia state government” and to “identify opportunities for creating

efficiencies in state government, including streamlining, consolidating,

or eliminating redundant and unnecessary agency services, governing

bodies, regulations and programs.”

The Virginia Firearms Transaction Program has certainly become

redundant and unnecessary since NICS took effect in 1998.

Governor McDonnell has scheduled several Town Hall Meetings across

Virginia in August that he will attend to explain his efforts to reform

state government and also solicit public comment on ideas for him and

his government reform commission to consider, recommend and pursue.

For NRA members in the Richmond area, your town hall meeting will be

held tomorrow night.

ABC News Falsely Claims “Three in Four” Guns in Mexico

numbers circulated that 80 percent of the guns used by Mexican cartels

came from the United States, but then the numbers were examined more

closely.

That 80 percent number was in fact only counting guns that were

actually sent back to the United States for confirmation. In other words,

not all the guns confiscated in Mexico even were actually submitted to

American authorities, yet the 80 percent number stuck, and it was

reported over and over again.

We note this because now ABC News is now reporting that “as many as

three out of four guns used in crimes in Mexico can be traced to guns

stores just across the border in the U.S.” This sounds all too familiar.

So let’s take a close look at what ABC News says, and more

importantly what they don’t say.

First, the news organization notes: “the study, based on Bureau of

Alcohol Tobacco and Firearms (ATF) data and prepared by the

advocacy group Mayors Against Illegal Guns, shows that three out of

four guns used in crimes in Mexico and submitted for tracing were sold

in the four U.S. states that border Mexico.”

What they said, “and submitted for tracing,” meaning we’re back to the

situation a year and a half ago, or in other words this is pretty much a

revised ”80 percent of guns” statistic.

What they didn’t say was how many guns are not submitted for tracing,

which could be substantially higher than the number of guns seized. The

news story noted some “19,000 guns used in crime in Mexico were

traced to an original sale at a US gun dealer.” That’s amazing, but

19,000 for a border war this big sounds like a small number of firearms.

Of course, there is no mention of the TOTAL number of guns seized in

Mexico.

What they also said was that this study was based on ATF data BUT

“prepared by the advocacy group Mayors Against Illegal Guns.” Do we

really believe that this group would want to say “less than 20 percent of

seized guns in Mexico are even sent to the United States for tracing?”

The story fails to note that this was hardly the most scientific of studies

either.

ABC News adds, “…the bulk of the guns came from Texas, New Mexico,

Arizona and California.” The story later continues by stating, “The

numbers showed that Arizona, Texas and New Mexico had an export

rate 169 percent greater than any other states, which the authors

suggest may be due in part to less-restrictive gun laws in those states.”

So why wasn’t California mentioned in the second quote, if that was the

other border state where “the bulk of the guns came from,” except that it

doesn’t fit so nicely with the study’s finding, or it doesn’t fit with the tone

the authors at ABC News intended. In other words, California has fairly

strict gun control laws, so it is noted for being a border state when it is

convenient to make a point, but disregarded when another point needs

to be made.

The fact that guns are coming from border states shouldn’t even be a

surprise. Is it really the respective states’ laws on gun ownership, or the

fact that it is easier to drive to Texas than say New Hampshire? There are

probably more illegal immigrants in the border states, and probably

more illegal drugs from Mexico in those four states than say Alaska or

Maine! Why is promixity mentioned when it fits, but disregarded other

times? The answer: biased reporting.

Finally, we have to question why the primarily source for the story was

the group Mayors Against Illegal Guns, and yet the only “color”

commentary for the piece actually comes from the groups founder, New

York City Mayor Michael Bloomberg, who was quoted as saying, “[It]

again proves it is too easy for criminals and traffickers to get guns.”

Citing data and then having the author of the data saying, “it proves the

point,” hardly proves the point. This story thus lacks any credible

counterpoint on the above statement or the study. Talk about a stacked

deck and a highly biased story!

Inaugural 2011 Mammoth Sniper Challenge January 7-9, 2011.

This long range precision rifle competition will be open to military, law

enforcement, professional and civilian shooters with a maximum

participation set at 100 competitors.

Match Director and Course Designer Joe Harris said, “Eight

stages will be set amongst the 2,000 acres of Rockcastle’s

Shooting Center because of its natural terrain in the south

central area of Kentucky with shooting distances up to and

over 1,000 yards.

Rockcastle Shooting Center is the only shooting center on the

east coast providing competitors with long distance tactical

shooting ranges that will not only challenge their shooting

skills but their ability to neutralize targets.”

The Mammoth Sniper Challenge www.MammothSniperChallenge.com

will be a practical field competition with 100 percent reactive targets,

night and low light stages, scenario based stages and offer high angle

shooting up and down the various ridges on the property.

Targets will vary in size from ½ MOA to 2 MOA, with the possibility of

¼ MOA for an added surprise. The overall course will include shooting

from prone positions to being placed 20 to 30 feet above ground and will

run despite weather conditions. Details of the scenario based stages will

be revealed in the match program upon onsite registration.

Nick Noble, CEO of Rockcastle Shooting Center said,

because our property already has so many natural surface

features to physically challenge even the most seasoned

competitor. The nation’s best will convene to this dynamic

setting and have to adapt to the unsteady footing of the steep

precision rifle shooter wants in a shooting sports

destination.”

Vermont Carry

Is our goal and RMGO has long held the belief that training should be

voluntary, not mandatory. No other group — none — can lay claim to

opposing government-mandated training for concealed carry for the

decade-long battle for concealed carry. In fact, we’ve been advocating for

true freedom — a Vermont-style concealed carry law (if you can legally

possess a firearm, you can carry, without a “big-brother-may-I”) — since

the group’s inception, and will continue to push for it.

Voluntary vs. Government-mandated training — That doesn’t mean we

are opposed to training. Anyone who owns a firearm should get as much

quality training as they can possibly afford. We are, however, opposed to

government-mandated training. And one of the reasons we are

conducting concealed carry classes is that we believe citizens already

have to jump through too many hurdles to obtain a concealed handgun

permit. Therefore, we offer the least onerous class the law will allow

while still covering everything a citizen needs to know before acquiring a

permit.

Monthly Northern Colorado classes — We are currently scheduling

monthly concealed carry classes in the Fort Collins area on the second

Monday of each month.

that. Colorado law (C.R.S. 18-12-201.3) stops Sheriffs from

implementing rules and/or actions that place a burden on the applicant

beyond the law. 18-12-202.5(c) defines a “Handgun Training Class” as “A

firearms safety course or class that is offered and taught by a certified

instructor.”

sentenced for illegally killing three antelope in the Gildford area during

the 2007-hunting season.

Mack Jones, 59, of Palm Springs, Calif., was charged with a

misdemeanor count of killing an antelope buck without a license in the

case. Jones was recently ordered by Hill County Justice of the Peace

Terry Stoppa to pay a $535 fine and $500 in restitution. Jones also lost

his hunting, fishing, and trapping privileges for two years in all 34 states

involved in the Interstate Wildlife Violators Compact.

Another Palm Springs man, Eric J. Urban, 47, was charged with killing

an antelope buck without a license at the same private property south of

Gildford during the 2007 season. Urban also was charged with a

misdemeanor count of “accountability for the conduct of another” for

allowing his teenage son to kill an additional antelope buck without

having a valid license.

Court records show Urban paid a $1,070 fine and $1,000 in restitution

and lost his hunting, fishing, and trapping privileges for two years in all

wildlife compact states. All three antelope bucks were recovered in

California and were returned to Montana.

“The apprehending of Jones and Urban was made possible

when a concerned citizen contacted the local warden and

expressed his concern that antelope bucks might have been

killed and were likely tagged with Region 7 doe tags,” said

FWP Criminal Investigator Lennie Buhmann.

“Without the help of concerned citizens, violations like these

would often go undetected.”

HAVRE, Mont. --(Ammoland.com)- A Kremlin-area man has been

sentenced in connection with the out-of-season killing of six antelope.

Cody J. Meltzian, 18, on Aug. 23 pleaded guilty in Hill County Justice

Court to 12 misdemeanor criminal counts in connection with the

poaching of six antelope north of Kremlin and Gildford in FWP Region 6.

Meltzian pleaded guilty to six counts of hunting during a closed season

and six counts of wasting antelope meat. Justice of the Peace Terry

Stoppa ordered Meltzian to pay $2,820 in fines and $1,800 in

restitution.

In addition, Meltzian is required to serve 30 days in jail and will lose all

hunting, fishing, and trapping privileges for five years in all 34 states

involved in the Interstate Wildlife Violators Compact.

The case was investigated by Havre-based FWP Warden Wes Oedekoven,

who said it would not have been resolved without help from area

landowners.

Malta Mont Hunting Outfitter Sentenced on Multiple Criminal

MALTA, Mont. --(Ammoland.com)- A Malta-based hunting outfitter,

Larry L. Olson, has pleaded guilty to nine misdemeanor counts of baiting

game animals with supplemental feeds and two misdemeanor counts of

submitting false and inaccurate client report logs.

In a plea agreement entered into with the State of Montana in Phillips

County Justice Court, Olson, 60, acknowledged that he aided and

abetted illegal hunting-related activities committed by members of a

Minnesota family that owns a ranch south of Malta. Olson also was

found to have submitted false records to the Montana Board of Outfitters

in 2008 and 2007.

The landowners were convicted earlier this year for illegally baiting big-

game animals, hunting without licenses and/or permits, improper

outfitting and other wildlife-related crimes. Olson was the license

sponsor for the operation.

Olson was ordered to divest himself of his outfitting license and forfeited

any future right to work as an outfitter or guide in Montana. He was also

given a three-year suspended sentence with the following conditions:

Forfeit ownership in property seized during the warrant searches; not

accompany hunters in Montana during his suspended sentence; pay

$1,985 in fines and lose his Montana hunting, fishing, trapping privileges

for three years.

These cases were initially developed by Malta-based FWP Warden Dirk

Paulsen and then a team of state investigators.

technique, equipment, mental concentration and self-improvement. To

Austin TX --(Ammoland.com)- In Federal District Court on July 20,

2010, the ATF won a conviction from an Austin jury that defies logic and

reason.

In a trial before Federal Judge Sam Sparks, government lawyers

conceded Texas resident Paul Copeland did not know his buyer was an

illegal alien, but the jury they should convict him anyway because he

“had reasonable cause to believe” he was selling to an illegal alien

because the two men and a boy who were present at his table at the time

of the sale: 1) were Hispanic, 2) spoke Spanish, and 3) wore cowboy

clothing.

And the jury did as asked. Assistant U.S. Attorney Jennifer Freel acted as

lead prosecutor in the case.

The firearm transaction at issue occurred on January 16, 2010, at a

gunshow at the North Austin Events Center, at 10601 N. Lamar Blvd., in

Austin, Texas. Undercover ATF agents followed Mr. Huerta, his son, and

another Hispanic male, Hipolito Aviles, around the “Texas Gunshow”

that day, and claimed to observe Huerta’s transaction. Austin P.D. used

Copeland’s case as the reason to close down the gunshow, leading to a

protest by Austin residents in front of APD headquarters on January 25.

Mr. Copeland is a 56 year old Cedar Creek resident and Vietnam veteran

who liked to buy, sell, and trade firearms as a hobby. On January 16,

however, he had the misfortune to sell a handgun to Leonel Huerta Sr.,

who spoke both English and Spanish. Huerta Sr. negotiated his purchase

from Copeland in English, showing Copeland his Texas Driver’s License.

At Copeland’s trial Huerta admitted on the witness stand, that he is in

the country illegally, (Huerta Sr. had previously admitted this fact to

Immigration & Customs Enforcement (ICE) Special Agent Leo

Buentello). ATF Agent Shawn Kang claimed he saw Huerta later hand off

the gun to Aviles. Despite these admissions, Huerta Sr. was never

arrested, charged, or deported. Instead, his presence at the gunshow was

used to entrap an American citizen into an unwitting violation of a

federal gun control law. Huerta Sr., who is a resident of the City of

Austin, appeared as a witness at the trial, admitted he was in the country

illegally before federal prosecutors and a federal judge, yet he was

allowed to leave the courtroom under his own power.

To date Huerta Sr. has not been prosecuted for his purchase,

possession, or disposition of the handgun he bought from

Copeland, while Copeland is now a convicted felon.

“Instead of busting the illegal alien for buying, they bust the citizen for

selling,” commented Paul Velte, attorney and founder of Peaceable

Texans for Firearms Rights, a gun-owners rights advocacy group from

Austin.

Velte asked, “who was in a better position to know the buyer’s

immigration status, the buyer or the seller?” He also said,

“What happened to Paul Copeland should enrage all

Americans. The Federal Government is using illegal aliens to

entrap citizens lawfully exercising their right to sell firearms.

The illegal alien walks free, but the citizen gets convicted. The

same government charged with controlling immigration is

the one using illegal immigrants to attack its own citizens.

Does this make any sense? It makes no sense unless the

purpose is to discourage attendance at gunshows and frighten

citizens from selling their firearms to other citizens.”

Velte pointed out that “There is no way for a citizen to know

who is here legally or not. In fact, under Austin’s ‘sanctuary

city’ policy, not even the police officer at the door of the

gunshow was allowed to ask a person’s immigration status,

yet the average Texan inside the show is expected to assume

that a person standing before them with a Texas driver’s

license is in the country illegally just because they look

Mexican and speak Spanish.”

Velte noted that the federal government’s lawsuit against Arizona was

based on that very type of conduct: Concluding someone could be here

illegally based on their looks or their language.

Velte said gun owners in his group are outraged, and they

want to know:

1. Why is the illegal alien who purchased the gun, Leonel Huerta Sr.,

still living in Austin?

2. Why does he still have a Texas Driver’s license?

3. Why is ATF using illegal aliens to set up and convict American

citizens?

4. What has he been promised for his cooperation?

5. Why has he not been prosecuted? He committed three distinct

crimes: he purchased a firearm knowing he was an illegal alien, he

possessed the firearm, and he transferred the handgun to another

illegal alien (Hippolito Aviles, who was convicted and given time

served on June 30, 2010).

6. Why has Huerta Sr. not been deported?

Judge Sparks sentenced Copeland on August 27 to six months

confinement and 24 months of probation, and called Copeland “a liar”

for not admitting guilt. ATF confiscated Copeland’s entire gun collection

and initiated forfeiture proceedings. Copeland was also fired from his job

due to the indictment, and he would have lost his home to foreclosure, if

not for his family stepping in to pay his mortgage while he serves his

sentence.

Designed for heavy gunners, light enough for offensive roles and suited

perfectly for defense, the Tacamo RPK takes Tacamo’s proven open-bolt

receiver and adds accessories that transform it into a woodsball

sensation.

The RPK machine gun was designed as a force-multiplier for the Red

Army. Armorers built AK47 receivers into RPKs by attaching longer,

more accurate barrels that achieved higher velocities, as well as the

characteristic bipod and hatchet-style machinegun stock. The result was

a squad automatic weapon with the same ergonomics, controls, and

internals as the standard AK47, but also with the increased range,

accuracy, and stability of a light machinegun. A 75 round drum finished

it off, adding much higher onboard ammunition capacity between

reloads than the standard rifle.

Tacamo remains faithful to this precedent both in cosmetics and

function.

The 20″ long RPK barrel features a protected front sight and muzzle

break, and provides the attachment point for the retractable bipod. The

wooden handguards, pistol grip, and RPK stock are dark-stained to

blend into the shadows and disappear at night, and are identical to those

used on real RPK machine guns. The 75 round drum mounted forward of

the trigger guard completes the look of the Tacamo RPK, and provides

excellent protection for your hands as you fend off hailstorms of

incoming paint.

The Tacamo RPK has a standard hopper adapter that accepts hoppers of

any size, from limited-paint 75 round hoppers that replicate the capacity

of the RPK’s drum magazine, to full- and plus- sized hoppers that hold

hundreds of rounds. When you get into position with the Tacamo RPK,

stabilizing your shots with the bipod and aiming them with the authentic

sights, you will command the most authentic RPK experience available.

TRENTON, NJ --(Ammoland.com)-So, now that the NJOA has helped

you to be able to bow hunt within a lesser perimeter (150’) and also bow

hunt on Sundays (in authorized areas) we hope you’ll be out enjoying

your expanded privileges and in doing so help our state to better manage

We continue to work on agreements to improve our forests, we are

unwavering in our commitment to have commercial gear removed from

artificial reefs, we continue to try to have legislation passed that will

reduce drug use and introduce our children to the great outdoors.

as your outdoor advocate.

But we can’t do it without your support and membership. There are

9000 bills that are written each year in NJ and only 100 or so become

law. It takes effort, commitment, passion, education, timing, support and

a stiff “wind-at-our-backs” to get legislation signed into law.
