Lance Green, the founder of viaggio, has travel in his blood, with his earliest memories being of his grandparents coming home from exciting travels abroad and being transfixed by their slide show of far-off places.

Lance has now been in the travel industry for over 35 years, and applies his knowledge, passion and extensive travel experience to every one of the vacations that viaggio creates.

He is joined by his business partner and wife Lisa, who also has traveled extensively, and they will be your hosts on this very unique vacation.

This will be the Inaugural sailing of LE LYRIAL , the newest ship for French 5 Star Boutique cruise line Compagnie Du Ponant which adds a very unique element to this once-in-a-lifetime vacation.

The cruise vacation is timed to coincide with the 100th Anniversary of ANZAC Day, April 25, 2015, the anniversary of the commencement of the Battle of Gallipoli.

ANZAC CentenaryThe Battle of Gallipoli was a campaign of World War I that took place on the Gallipoli Peninsula in the Ottoman Empire between 25 April 1915 and 9 January 1916. The peninsula forms the northern bank of the Dardanelles, a strait that provides a sea route to what was then the Russian Empire, one of the Allied powers during the war. Intending to secure it, Russia's allies Britain and France launched a naval attack followed by an amphibious landing on the peninsula with the eventual aim of capturing the Ottoman capital of Constantinople. The naval attack was repelled and, after eight months of fighting, with many casualties on both sides, the land campaign also failed and the invasion force was withdrawn to Egypt.

The campaign was one of the greatest Ottoman victories during the war and a major Allied failure. In Turkey, it is regarded as a defining moment in the nation's history: a final surge in the defense of the motherland as the Ottoman Empire crumbled.

The struggle formed the basis for the Turkish War of Independence and the founding of the Republic of Turkey eight years later under Mustafa Kemal Atatürk, who first rose to prominence as a commander at Gallipoli.

The campaign is often considered as marking the birth of national consciousness in Australia and New Zealand and the date of the landing, 25 April, is known as "Anzac Day". It remains the most significant commemoration of military casualties and veterans in those two countries

April 25, 2015 marks 100 years since the landing of New Zealand and Australian soldiers – the ANZACs – on the Gallipoli Peninsula in 1915.

For many New Zealanders & Australians then and since, the Gallipoli landings meant the beginning of

something else – a feeling that New Zealand and Australia had a role as distinct nations.

Lest we forget them...

A day of remembrance for those, that 100 years ago, traveled the distance, some losing their lives in a battle to secure the Gallipoli Peninsula. And also for those that served and returned home, we will remember them all on this day with the respect and honor they deserve.

We will also remember those that have fought in the battles over the past century for the freedoms we now enjoy. All these courageous soldiers are deserving of so much respect for they have served our countries and made us proud.

Prior to arriving at ANZAC Cove, there will be a series of lectures and events onboard leading up to 25 April.

Our vessel will be positioned within the vicinity of ANZAC Cove for the dawning of April 25, 2015, and you will be able to experience the rising of the sun

with the outline of the Peninsula and the beaches of Gallipoli as your backdrop.

You will take part in our private Dawn Service together with just 244 privileged guests.

This will be followed by breakfast and then the re-playing of the service which will have taken place on the beach that morning. Our vessel will then cruise to the Greek Island of Lemnos which was where the New Zealand and Australian troops were based prior to the invasion.

On April 26, we dock at Cannakale for the day. This is the access point for us to disembark and make our way to the Gallipoli Peninsula. We will have available our private fleet of 20 seater deluxe vans, each accompanied with private guides.

Highlights will include visits to Brighton Beach, Beach Cemetery, ANZAC Cove, Ariburnu Cemetery, ANZAC Commemorative Site, Respect to Mehmetcik Statue, Lone Pine Australian Memorial, Johnston's Jolly, (Turkish and Allied trenches and tunnels), Turkish 57, Infantry Regiment Cemetery, The Nek, and the Chunuk Bair New Zealand Memorial.

ANZAC Day, like Memorial Day in North America, is a time to reflect not only on those who fought or lost their lives at this particular battle, it is also a day to reflect on all those who have served and are serving to provide and protect the freedoms we enjoy today.

Important noticeThese clauses are the terms and conditions applicable to your travel and/or cruise agreement. There are two parts to the agreement.Part 1. relates to the terms and conditions for the vacation management and organising company Viaggio Lifestyle Vacations and Part 2. relates to the conditions of carriage onboard the cruise ship provided by Du Ponant. Please read them carefully.

PART 1.THE VACATION MANAGEMENT & ORGANISING COMPANY Terms & Conditions for travelThis agreement is entered into between CCG Management Limited t/a Viaggio Lifestyle Vacations Company (hereinafter referred to as " Viaggio" or "the organiser"), and the passenger.

We have made every effort to ensure that the ship, ground transportation, airlines, meals, beverages, photographs, pricing, excursions and all other services will be as represented and detailed in the brochure. Please note that we cannot be respon-sible for the acts or omissions of suppliers or services, or for any misrepresentation made by the suppliers or third parties. The services are subject to the conditions imposed by the suppliers and their liability may be limited by their tariffs, conditions of carriage, international conventions and agreements, or customs and their businesses. Therefore, Viaggio does not assume responsibility for any claims, losses, damage, costs, or ex-penses of any nature arising out of injury, accident or death, loss of or damage to or delay in connection with luggage or other property, delay, inconvenience, upset, disappointment, stress, frustration or loss of employment or loss of holiday time resulting from:a) The act or fault or omission of any party other than Viaggio and its employees; andb) The passenger’s failure to obtain related documentation.The passenger will not be entitled to any refund if the passenger fails to follow the instructions of Viaggio or its representatives. We reserve the right to alter or cancel any services you have purchased and inclusions may vary depending on weather, tour operator’s arrangements, or other uncertainties, and are subject to change. The images appearing in published material (bro-chure, website other forms of printed media) are representa-tional only and are not a guarantee that everything will be exactly as depicted at the location upon arrival. Every endeavor will be made to provide the nominated sightseeing, however no guarantees can be made. The Organizer & Du Ponant the owner and operator of the chartered cruise ship, reserves the right to change or amend itineraries nominated in the published information without notice to the passengers.

2. Vacation Pricing.The prices quoted for the vacation are in USD per person as at the publish date of 1 Sept 2014.

Pricing has been set based on a minimum number of 55 staterooms being sold on the departure. In the unlikely event that this number is not achieved Viaggio reserves the right to review the price and if necessary adjust the program to fall within the budget perimeters set by Viaggio.

Port taxes & fees. Port taxes and fees are additional and will be invoicedseparately on the vacation invoice.

4. Payment Schedule.All vacation prices quoted are in USD per person and payments are to be made in USD. USD Bank account details will be provided with your Confirmation/Invoice.

5. PAYMENT SCHEDULEInitial Deposit Indicated on Confirmation Invoice 30% of vacation fare (excluding taxes, flights) within 7 days of issue of the Confirmation/Invoice.

Final Payment 15 Jan 2015 - Balance including any taxes.

Invoices will be issued by Viaggio and emailed and/or posted to guests 14 days prior to the due date of each payment.

Funds.

On payment of your initial deposit an administration fee is deducted by Viaggio which is equivalent to 30% of the deposit paid. The balance is then transferred into the Joint Escrow account owned by Viaggio / Du Ponant.

6. Cancellation ConditionsThe following cancellation fees apply.

Period 1. Deposit date up to and including 17 April 2014 - 30% of the deposit paid is non-refundable.

Period 2. 18 April 2014 - 30 June 2014 - 30% of the total vacation fare (excluding taxes) is non-refundable.

Period 3.1 July 2014 - 1 October 2014 - 40% of the total vacation fare (excluding taxes) is non-refundable.

Period 4.2 October 2014 - 15 January 2015 - 70% of the total vacation fare (excluding taxes) is non-refundable

Period 5.16 January 2015 to date of cruise departure 18 April 2015 - 100% of the total vacation fare (including taxes) is non-refundable.

IMPORTANT - IT IS RECOMMENDED THAT TRIP CANCELLA-TION INSURANCE IS PURCHASED AT THE TIME YOU COMMENCE PAYMENTS.

7. Transferability.In the event of cancellation, Passengers may transfer their reservation free of charge to a Third Party providing this transfer happens 60 days prior to the commencement of the cruise. Inside 60 days and up until 31 days prior to departure an administration fee may be applied of USD500 per stateroom. Inside 30 days prior to departure it is not possible to transfer the reservation to a third party.

8. Passports/Visas /Health information.At the time of boarding the cruise ship passenger passports must be valid for six months following disembarkation as well as contain any necessary visas and vaccination certificates which may be required in the destination ports where the ship calls.

It is the passengers responsibility to ensure that they meet the necessary passport, visa and health requirements.

9. Pre or Post Cruise Arrangements.Pre or Post cruise arrangements will have their separate terms and Conditions and will be detailed as part of the specific vacation arrangements

10. Flight ArrangementsYour flight arrangements can either be made1. Direct with your airline carrier of choice2. Via your preferred travel agency or3. With Viaggio

Should you elect to have Viaggio make your flight arrange-ments, please note that all arrangements are made on your behalf direct with the airline. Tickets are issued by the airline. Viaggio does not charge a ticketing fee and airfares, taxes, airline fees are passed on at the cost provided by viaggio’s preferred airline partners.

11. Travel InsuranceAll passengers must provide confirmation that they have purchased a comprehensive travel insurance policy at the time of final payment. Details will be required as per the Guest Information From provided.

12. Solo TravellerViaggio does not offer the service of matching solo travellers to share accommodation. Solo travellers staterooms are limited on this vacation.

13. Unused ServicesNo refunds can be given for unused or partially used services during the tour program.

14. Participation in the vacation.Reservations are accepted on a first-come first-served basis. Viaggio reserves at their absolute discretion to accept reserva-tions. While on the vacation any behaviour which is deemed detrimental to other passengers at any time during the vacation, viaggio reserves the right to cancel the passengers participation in the vacation, in which case any refund will be made on a recoverable cost basis..

15. Vacation Management Viaggio acts as the Management and organiser of the cruise vacation. Viaggio has an exclusive charter of the cruise ship being provided by Compagnie Du Ponant. Viaggio has contracted with Compagnie Du Ponant to provide the ship inclusive of onboard services from commencement of the cruise on 18 April 2015 in Istanbul until the morning of disembarkation in Venice on 9 May 2015. Accordingly all passengers are bound by the Terms and Conditions as detailed in Part 2 of these Terms & Conditions provided by Compagnie Du Ponant.

16. JurisdictionThe terms and conditions of this agreement are subject to and interpreted according to New Zealand legislation. Without prejudice to required legal regulations, any actions related either to the interpretation, or execution of this agreement shall be brought before the competent courts of New Zealand

PART 2.THE SHIPPING COMPANY DU PONANT Terms and Condi-tions for the Passenger or Cruise Ticket.

Definitions:1. The "passenger ticket" is the transport document delivered by the Company to the traveller whenever the former is the carrier only, and not the cruise organiser.2. The "cruise ticket" means the document delivered by the Company whenever it is both carrier and cruise organiser. 3. "The seller" (viaggio) is the service provider which sold the entirety of the services included in a cruise directly to the passenger, including the various methods of transportation, (land, sea, air).

By accepting the passenger or cruise ticket, or by using same, the ticket purchaser accepts all sales terms and conditions within the terms defined in this agreement.This agreement is entered into between the Iles du Ponant Company (hereafter "The Company" or "the carrier"), and the passenger.Passengers should be particularly aware of the rights of the carrier to dismiss and limit its liability, as well as to the provisions of Article 6, which stipulate the timeframes and conditions according to which a claim must be submitted and a proceeding undertaken.Use of this ticket by the purchaser or the passengers intending to board the ship, entails the full compliance with all of the general and specific sales terms and conditions, acknowledged and accepted by them by obligation when they registered. The Company enters into this agreement as much under its own name as under the name of and on behalf of its land and sea representatives and officials and any person having taken part in the service provided by the cruise organiser, who could benefit from the provisions of this ticket with respect to the purchaser and intended passengers.

Article 1: APPLICABLE LEGAL TEXTS1.1. If the Company is the carrier only, only the provisions in Act No. 66.420 dated 18 June 1966, the Enforcement Decree dated 31 December 1966 and possibly the London International Convention dated 19 November 1976 apply to the effects of this agreement and govern the relationship between the passengers and the Company in its capacity of the carrier. 1.2. If the Company is both carrier and cruise organiser, regula-tions contained in Article 1.1. and provisions of Act No. 92-645

dated 13 July 1 9 9 2 a n d o f t h e E n f o r c e m e n t D e c r e e d a t e d 1 5 June 1994 shall apply to the services offered by the Company in its capacity of cruise organiser.1.3. The passenger ticket delivered by the Company is only valid for the cruise and the boat stipulated on the ticket. The subject of this agreement is the transportation of passengers and their luggage from boarding at the port of departure until disembarka-tion at the destination. The carrier waives all liability outside of this period.In the event where a provision in this agreement conflicts with a mandatory statutory provision, said provision will be considered as void, however this nullification will not invalidate other clauses of this agreement.

Article 2: PRICE-RELATED TERMS AND CONDITIONS

The price of the passenger ticket and/or cruise ticket must be fully paid to the seller at the latest 90 days before boarding or earlier as stipulated by viaggio. In all cases, the ticket price is non-refundable if the trip is ended by the passenger and/or because of his/her actions after boarding.The seller shall not increase the price of the ticket after reserva-tion provided that the total amount on the invoice confirming the reservation has been fully paid.However, under the following exceptional circumstances; government action, variation in the American Dollar, Euro exchange rate or in the special drawing rights, increase in oil prices or any other cause affecting the initial agreed price for reasons beyond the Carrier's control, the seller may raise the price of the cruise. Any such price shall be calculated with respect to the cost overrun incurred by the organiser divided by the maximum estimation of the number of passengers con-cerned.In addition, any increase in ticket price shall include broker commissions.After having been informed of the increase in ticket price by the seller by registered letter with acknowledgement of receipt with advanced notice of 30 (thirty) days before the departure date, the purchaser may cancel the agreement and be immediately refunded the sum paid without penalties by notifying the seller in writing within 7 (seven) days after receipt of the notification of increase.Unless indicated in the cruise programme, excursions are not included in the price of the cruise ticket. They are only sold and invoiced on board and governed by the general conditions applicable to the agreement of the local operator who provides the services. These excursions are non-refundable in the case of cancellation by the customer after their registration.Any purchases made on board by or on behalf of the passenger are not included in the ticket price; they must be settled immedi-ately and in all cases before the passenger leaves the ship.

Article 3: BOARDING AND TRANSPORTATION TERMS AND CONDITIONS3.1. The passenger must be present for boarding within the conditions provided for in the programme and at least 2 (two) hours before the planned departure time.The passenger must be present for boarding within the condi-tions provided for by the passenger ticket.Should the passenger be late or forgo the trip, he/she is still obliged to pay the ticket price.3.2. The passenger may transfer the ticket to a third party, who shall fill the same conditions as the passenger to perform all purchased services, as long as the agreement has not rendered any effect. The transferor and/or transferee must settle any fees which result, and inform the Company and the seller of this decision by registered letter with acknowledgement of receipt within 31 (thirty one) days at the latest before the beginning of the cruise.The Company reserves the right to refuse access to passengers holding a transferred ticket for reasons detailed in Articles 3.3 to 3.7 below.In the event where the passenger transfers his/her ticket without informing the Company and the seller as per the terms de-scribed above, this ticket transfer will be invalid and the ticket will be cancelled without any possible refund.3.3. All passengers must carry a valid passport as well as the visas and vaccination certificates which may be required at the ship’s ports of call and port of arrival.

Each passenger is personally responsible for complying with the required legal regulations required before departure. The Company may refuse the boarding or disembarkation of any passenger who does not hold the document authorising disem-barkation at the port of arrival and ports of call.

3.4. During the trip, the passenger must comply with the rules on board.3.5. The Company and/or ship’s captain may, if deemed necessary, terminate the agreement and refuse to transport any passenger not complying with the conditions for entering the countries of the destination ports or whose presence on board may be detrimental to the comfort, health or safety of other passengers, to the crew or public order of the ports visited by the ship where they could render the Company liable for his/her maintenance, defence or repatriation. For these reasons, the Company and/or captain may decide to take the following appropriate measures: - Refuse to allow passenger(s) to board or disembark in any port visited by the ship; - Disembark the passenger(s) in any port visited by the ship;- Transfer the passenger(s) onto another ship;- Confine the passenger(s) to an on board medical cabin;- Have the physician or his team administer any drug, medica-tion or other accepted substances and/or confine the passenger to hospital or any other similar institution in the destination ports if the ship’s physician deems necessary; The passenger is responsible for treatment and medication on land or on board.The passenger is responsible for subscribing to insurance – for cancellation – luggage – assistance – repatriation – medical expenses.3.6. Passengers with reduced mobility, due to a physical handicap or a condition requiring special treatment and/or assistance, including those using wheelchairs, must inform the Company and the seller in writing a) upon reservation or b) as soon as the passenger becomes aware of his/her handicap if this occurs after reservation. It must be noted that the "Ponant" sail boat in particular does not allow access to persons with reduced mobility or in wheelchairs.The Company reserves the right to refuse access to persons who do not inform the Company and seller of these handicaps or need for assistance, or whose state of health is not compati-ble with the safety rules requiring treatments which the Com-pany is unable to provide. Disembarkation onto land in some ports may be difficult or even impossible for passengers with reduced mobility, particularly disembarkation from a sail boat and/or tender boats.Passengers using wheelchairs, must provide their own wheel-chair and be accompanied by a person able to assist them. The onboard wheelchairs may only be used in an emergency. Children under 6 months old (one year for a world tour) and women over 6 months pregnant are not authorised to board. As regards children less than 8 years old, authorisation to board must be requested preferably upon registration and in all cases must be presented upon boarding, failing which the Company will not be able to allow the child to board. In all cases, children and minors, once on board and/or on excursions, shall remain under the full responsibility of their parents or guardians.3.7. The passenger accepts civil and criminal liability for all damages caused to the Company, other passengers or third parties by his/her actions.He/she is solely responsible for any fine or penalty inflicted by the competent authorities due to his/her actions.

Article 4: CANCELLATION, INTERRUPTION OR MODIFICA-TION OF THE TRIP4.1. In the case of external events beyond the control of the Company or for any reason regarding the safety of travellers or the ship or due to an insufficient number of participants, accord-ing to that which is provided for by the terms and conditions of the trip programme, the Company may cancel the cruise and must inform the passengers and Charterers by registered letter with acknowledgement of receipt or by press release. At any time, the Company may decide to end the trip if this is deemed necessary. The refund or replacement conditions are provided for in Article 4.5.4.2. Notably in the case of unfavourable meteorological condi-tions or due to the political or social situation of the country of a

port of call or for any other event which may endanger the safety of passengers or the ship or in the case of orders imposed by public authorities, the Company may change the itinerary or ports of call or destination, delay the trip or end it, divert the ship, tow or be towed, transfer the passengers and their luggage

onto any other means of transport, and this even if a increase or shortening of the programme duration results therefrom.The passenger will be made aware as soon as possible of any cancellation or modification of any sort.4.4. Under any circumstances, the ship may provide assistance to any person or goods at sea, and will be not liable for the consequences of a modification to the cruise programme for this reason.4.5- With respect to the cruise ticket: In the event of cancellation or substantial modification of the agreement by the Company (for reasons other than those caused by the passenger), passengers will be able to choose from the following solutions:- A full refund of the price of the trip;- Another trip of an identical or higher value for the same price;- A trip of a lower value, and a refund of the price difference between the two journeys based on the prices announced.Passengers must inform the Company of their choice as soon as possible. 4.5.2. In the event of agreement modification by the Company subsequent to boarding, the passengers may not reclaim any compensation from the seller other than the refund of services not performed or replaced, or for the unused term of the ticket reduced by all fees incurred. However, they may be charged a supplement for services provided under the circumstances and for the cost of the trip on board in the event the trip is extended.4.5.3. If, before departure, the Company terminates the agree-ment not due to passenger actions***, all sums paid by the latter will be returned as final arrangement by the seller.4.6. Arrival and departure times are approximate and not definitive, and the Company cannot guarantee coincidence with corresponding schedules (plane, train) notably due to modifica-tion of the programme duration initially planned, which cannot incur any compensation, as the Company cannot be held liable for indirect damages.4.7. The Company may allocate passengers different cabins to those initially planned.

Article 5: LUGGAGEOn every item of luggage, the passenger must write his/her name and destination in permanent, visible letters.He/she is responsible for subscribing to insurance to cover luggage.5.1. All passengers are prohibited from transporting merchan-dise in their luggage whose content may threaten the health of other passengers, damage or contaminate their luggage on the boat. It is notably forbidden to board or pack animals or inflam-mable, explosive, corrosive, dangerous, scented or leaking materials in their luggage.Failure to comply with these rules will lead to payment of a lump sum penalty provided for by law.The passenger will in any case be responsible for any injury, loss or damages suffered due to the presence of these objects, and shall ensure that the Company is not sued due to such events.Such objects may at any time and in any place be disembarked, destroyed, thrown into the sea or made safe by the Company without any compensation.It is also prohibited to load objects as luggage other than those intended for personal use by the passenger, and notably goods in general, and objects whose importing is prohibited or which are not compliant with customs or police regulations.The passenger is responsible for all consequences, expenses, damages and penalties resulting therefrom, and the Company, in such cases, shall not be held liable for loss or damages.5.2. The passenger must watch over his/her luggage during their stay on board, as well as during boarding, transfer and disem-barkation procedures.The Company waives all liability for luggage left unattended by the passenger and for those where the passenger has not taken all necessary precautions to avoid theft, loss or damages.

Notably, the Company shall not be liable for money, cash, jewellery and other precious objects which the passenger has not declared as valuable, entrusted on board with a descriptive and estimative inventory, and for which the customer does not pay for the respective proportional safekeeping rights.

5.3. In the event where the Company is responsible for the transport of luggage for a period prior to boarding or after disembarkation, the Company acts as an agent on behalf of the passenger and its liability may not be substituted with that of the carrier effectively in charge of the transport.5.4. Unclaimed luggage upon the ship’s arrival remains in the port at the expense and risk of the passenger.5.5. Any delivery delay, detrimental to the passenger and engaging the liability of the Company, may only lead to payment of compensation not exceeding 20 % of the amount which would be due in the event of loss of luggage placed in the hold as per the terms of clause 6.1. The Company reserves a time frame of 3 (three) months to locate lost luggage.

Article 6: LIABILITY OF THE CARRIERThe Company waives all liability for material and immaterial damages caused by the interruption and/or modification of the trip due to and more particularly in the event of force majeure as provided for in Clause 6: -war or threat of war; blockade or closure of a port of departure, port of call or port of destination; detention of the boat by the authorities, for reasons out of the Company’s control; use of the boat for special needs of the Government;epidemics or quarantines; riots, strikes, layoffs or social unrest in general, of whatever cause and instigators; civil unrest of whatever nature; piracy; accident, fire, explosion, shipwreck, collision, and in general any nautical event or other circumstance capable of being detrimental to the safety of the ship or its passengers.6.1. The carrier may not be held liable in the event of injury or death of passengers or of loss or damages of any luggage or other personal effects unless it is established that it did not comply with obligations provided for by the Law, or if a serious error was committed by itself or one of its staff.In the event where it is nonetheless held liable, its liability will be limited: - with respect to bodily damages or death of a passenger to a maximum amount of 46.666 Special Drawing Rights, - in the case of loss or damage to personal effects and for luggage not checked-in, to a maximum amount of Euro €460 per passenger, - in the case of loss or damage to checked luggage: *in the hold: to a maximum amount of Euro €1,520 per passenger, *in the cabin: to a maximum amount of Euro €1,140 per passenger, - in the case of trip cancellation, if the carrier cannot establish that the event was not its fault, at half of the price of the trip.The carrier will benefit from all exonerations and liability limita-tions provided for by Law, enforcement decrees and interna-tional conventions as well as limitation periods.6.2. The carrier may only be held liable for any material or bodily damage suffered by the passenger may when the former is the consequence of:- a passenger fault;- unpredictable and unpreventable intervention by a third party to the cruise agreement and having no link with its execution;- unusual and unpredictable circumstances beyond the control of the Company;- A case of a force majeure, notably war or threat of war, riot, civil unrest, divine manifestations, terrorist activities, natural or nuclear disasters, fire, transport technical problems, port closure, strikes or social conflicts in general, or any other event beyond the control of the Company.6.3. No claims may be exercised against the Company without any prior written and detailed declaration of the accident presented in the form of complaints by registered letter with acknowledgement of receipt:For luggage: *In the event of apparent, evident and easily reparable losses or damages: upon disembarkation at the latest;

*In the case of non apparent losses or damages: within 7 (seven) days from disembarkation or the date when disembarka-tion should have taken place. For passengers:*In the case of bodily damage or damages other than that to luggage: within 30 (thirty) days from the day when the passen-ger disembarked or should have disembarked.

Failing this, the passenger will be presumed to have disem-barked healthy and without injury, and to have received his/her luggage in good condition.No legal proceedings against the carrier, for whatever reason with respect to the transport agreement may be filed, unless undertaken within 1 (one) year for material damages or 2 (two) years for bodily damages, from the day when the passenger disembarked or should have disembarked.6.4. Routing transportation at the departure port, ship transfers, water sporting activities, deep-sea diving from on board, land excursions including if necessary, hotel, restaurant reservations, and tours are provided by independent service providers, which are neither representatives nor employees of the Company.Passengers use these services at their own risk, and the Company intervenes only in its capacity of intermediary, and assumes no liability for these services.

Article 7: JURISDICTIONThe terms and conditions of this agreement are subject to and interpreted according to French legislation. Without prejudice to required legal regulations, any actions related either to the interpretation, or execution of this agreement shall be brought before the competent courts of Marseilles.
