S E C T I O N A . G E N E R A L C O N D I T I O N S•1. Duty to C o m p l y

T h e P e r m i t t e e must c o m p l y w i t h a l l c o n d i t i o n s o f t h i s p e r m i t . A n y p e r m i tn o n c o m p l i a n c e c o n s t i t u t e s a v i o l a t i o n of the Act and is grounds foren forc ement a c t i o n ; for p e r m i t t e r m i n a t i o n , r evoca t ion and re i s suance , orm o d i f i c a t i o n ; or f or d e n i a l o f a p e r m i t renewal a p p l i c a t i o n .2 . P e n a l t i e s f o r V i o l a t i o n s o f P e r m i t C o n d i t i o n s

a. S e c t i o n s 1095 and 1096 of the Act p r o v i d e tha t any person who v i o l a t e sthe terms of t h i s or any other e x i s t i n g water d i s c h a r g e permi t s h a l lbe sub j e c t to p o s s i b l e enforcement act ions under S e c t i o n 1073 of theA c t , i n c l u d i n g the assessment o f c i v i l p e n a l t i e s o f up t o $25,000 foreach day of c o n t i n u i n g n o n c o m p l i a n c e or v i o l a t i o n , a n d / o r the su spen-s i on or revocat ion of t h i s and other e x i s t i n g water d i s c h a r g e p e r m i t s .b. Any person who w i l l f u l l y or k n o w i n g l y d i s c h a r g e s , emits, or d i s p o s e sof any sub s tance in c on t raven t i on of the terms and c o n d i t i o n s of t h i sp e r m i t s h a l l b e s u b j e c t t o c r i m i n a l p e n a l t i e s under S e c t i o n 1073 o fthe A c t , i n c l u d i n g a p e n a l t y of not more than $100,000 per day of vio-l a t i o n , a n d / o r i m p r i s o n m e n t at hard l a b o r for not more than 10 years(when the substance is one which endangers or which could endangerhuman l i f e or h e a l t h ) , or a p e n a l t y o f $25,000 per day of v i o l a t i o na n d / o r i m p r i s o n m e n t for not more than one year (when the substancedoes or c ou ld not endanger human l i f e or h e a l t h ) .

3. P e r m i t A c t i o n s" T h i s p e r m i t may be m o d i f i e d , revoked and r e i s s u e d , or t e r m i n a t e d for causei n c l u d i n g , bu t no t l i m i t e d to , the f o l l o w i n g :a. V i o l a t i o n of any terms or c o n d i t i o n s of t h i s p e r m i t ;b. O b t a i n i n g t h i s permit by m i s r e p r e s e n t a t i o n or. f a i l u r e to d i s c l o s ef u l l y a l l r e l evant f a c t s ;c. A change in any c o n d i t i o n that requires e i t h e r a t emporary or per-manent r educ t i on or e l i m i n a t i o n of the authorized d i s c h a r g e ; or.d. V i o l a t i o n of any requirement of the A c t .The f i l i n g of a request by the Permit t ee for a permit m o d i f i c a t i o n , revo-ca t i on and re i s suance , or t e r m i n a t i o n , or a n o t i f i c a t i o n of p l a n n e dchanges or a n t i c i p a t e d noncompl ianc e , does not stay any permit c ondi t i on .

5 . 7 . The i s suance of t h i s p e r m i t does not convey any p r o p e r t y r i g h t s in e i t h e rmovab l e or immovable p r o p e r t y of any sort, or any e x c l u s i v e p r i v i l e g e s , ors e r v i t u d e s , nor does it au thor ize any i n j u r y to p r i v a t e or p u b l i c p r o p e r t yor any invasion of personal r i g h t s , nor any i n f r i n g e m e n t of F e d e r a l , S t a t eor l o ca l laws or r e g u l a t i o n s .10. S e v e r a b i l i t y

T h e P e r m i t t e e s h a l l a t a l l t ime s p r o p e r l y op era t e a n d m a i n t a i n a l l f a c i -l i t i e s and systems of treatment and control (and r e la t ed a p p u r t e n a n c e s )which are i n s t a l l e d or used by the Permi t t e e to achieve c o m p l i a n c e w i tht h e c o n d i t i o n s o f t h i s p e r m i t . P r o p e r o p e r a t i o n a n d m a i n t e n a n c e i n c l u d e se f f e c t i v e p e r f o r m a n c e , ad equa t e f u n d i n g , adequa t e opera tor s t a f f i n g a n dt r a i n i n g , and adequa t e labora tory and proces s c o n t r o l s , i n c l u d i n g a p p r o -p r i a t e q u a l i t y assurance procedures. T h i s p rov i s i on requires t h eo p e r a t i o n o f ba ck-up or a u x i l i a r y f a c i l i t i e s or s i m i l a r systems o n l y whennecessary to achieve c o m p l i a n c e w i t h the c o n d i t i o n s o f the p e r m i t . -2. Duty to Halt or Reduce A c t i v i t y

U p o n r e d u c t i o n , l o s s , o r f a i l u r e o f t h e treatment f a c i l i t y , t h e Permi t t e es h a l l , t o th e extent necessary to m a i n t a i n c o m p l i a n c e w i t h i t s p e r m i t ,control p r o d u c t i o n or all d i s charge s or both un t i l the f a c i l i t y is re-stored or an a l t e r n a t i v e method of treatment is prov ided . T h i s require-ment a p p l i e s , for e x a m p l e , when the pr imary source of power of the treat-ment f a c i l i t y f a i l s or i s reduced or l o s t . It s h a l l not be a d e f e n s e fora P e r m i t t e e in an enforcement action that it wou ld have been necessary toh a l t or reduce the p e r m i t t e d a c t i v i t y in order to m a i n t a i n compl iance wi thth e c o n d i t i o n s o f t h i s p ermi t .3. B y p a s s o f T r e a t m e n t F a c i l i t i e s

a. D e f i n i t i o n s(1) "Bypass" means t h e i n t e n t i o n a l d i v e r s i o n o f waste streams f r o many p o r t i o n of a treatment f a c i l i t y .( 2 ) "Severe p r o p e r t y damage" means s u b s t a n t i a l p h y s i c a l damage t op r o p e r t y , d a m a g e to the treatment f a c i l i t i e s which causes them tobecome i n o p e r a b l e , or s u b s t a n t i a l and permanent l o s s of naturalresources which can reasonably be expec t ed to occur in the ab-sence of a bypa s s . Sever e p r o p e r t y damage does not mean economicl o s s caused by d e l a y s in p r o d u c t i o n .

b. Bypass not Exc e ed ing L i m i t a t i o n sThe P e r m i t t e e may a l l o w any b y p a s s to occur which does not causee f f l u e n t l i m i t a t i o n s to be e x c e ed ed , but o n l y i f i t a l s o i s fore s s ent ia l maintenance to assure e f f i c i e n t operation. T h e s e bypas s e sare not sub j e c t to the prov i s i on s of P a r a g r a p h s 3.c and 3.d of t h i ss ec t ion.
