In exercise of the powers conferred by section 143 of the Bombay Prohibition Act, 1949 (Born. XXV of 1949); and in supersession of all the notifications in so far as they relate to the import, export, transport, sale, use or poss.ession of denatured spirit the Government of Bombay hereby makes the following rules, namely.--·

L (1) These rules may be called the Bombay Denatured Spirit Rules, 1959.

(2) They shall extend to whole of the State of Gujarat. 2. ln these rules unless there is anything repugnant to the subject

or context.· (1) "Act" means the Bombay Prohibition Act, 1949: (2) "denatured spirit" means rectified spirit denatured in accord"

(18) "Wholesale sale" means sale to .rel.all or wholesale licensees and includes sale to persons holding licences in From D.S. IV or D.S. V. in quantities not less than one gallon at a time;

(19) The expressions "ordinary denatured spirit", methylated in· dust.rial denatured spirit" and "special industrial denatured spirit mean ordinary denatured spirit, methylated industrial denatured spirit and special industrial.denatured spirit manufactured in accord· ance with the. prescribed by regulations made in that behalf by the Director under the Act;

(20) Words and expressions not defined in these rules shall have the meanings respectively assigned to them in the Act.

3, No person shall denature spirit except under a licence under these rules and ln · accordance with the process laid dovm in any regulations made in th:at behalf by the Director.

LICENCE FOR DENATURING SPIRIT

4. Any person desiring to denature spirit stored by him under bond and sell such spirit shall apply to the Director for a licence for the denaturation of spirit and sale thereof. The application shall contain the following particulars, namely.·

( l) Name and address of the applicant. (2) Place where spirit will be stored. (3) where is to be ctenatm

9. The licensee shall not remove any spirit from the warehouse for denaturation except with the v,ritten permission of the ofllcer in charge of the warehouse,

10. The licensee shall not absent himself at any time from the licensed premises unless he appoints a person, approved in writing in this behalf by the Director, to act on his behalf during his absence and .furnishes such person with a power of attorney authorising him to act on his behalf in all matters relating to the licence granted under rule 5. .

11. The licensee shall give a copy of the power of attorney to the officer in charge of the warehouse. ,

1_2. The licensee shall be liable to pay duty in respect of any loss of spirit due to leakage or otherwise. if such los.s ls in the opinion of the D.!rector excessive and has not been satisfactorily explained to him by the li.censee. ·

13. (1) The Director, the Officer in charge of the warehouse or any officer deputed by the Director in that behalf may at any time take samples of the spirit, denatured sp.irlt or denaturants used by the licensee for ana.lysis free of cost and send them to the Chemical Analyser to the Government of Gujarat for analysis. ·

17. (1) The licensee shall not sell any denatured spirit except by means of measures.

(2) The licensee shall provide such measures licensed premises as may be approved by the Director.

18. (l) Tb<c officer-in-charge of the warehouse shall maintain the accounts and submit monthly returns in such forms as specified ln sub-rule (2),in respect of a licence for the denaturation of Indian made rectified spirit including absolute alcohol under bond and for the. sale of denatured spirit from the warehouse. Such accounts and returns shall be initialled by t.h.e licensee ln token of verification by him.

(2) (a) Register of rectified spirit received under bound shall be in Form D-l.

(b) Vat account of rectified spirit shall be in From D·2.

(c) Stock account of rectified spirit shall be in Form D-3.

(d) Register ofdenaturatlon operations shall be in Form D-4.

(e) Vat account of denatured spirit shal.l be in From D-5.

m· Stock account of denatured sp1it shall be in From D·G.

(g) Register of issue of denatured spirit of shops or manufaetoctes shall be in h'orm D-7.

(h) Monthly retum of stock account of rectified spirit intended for the denaturntion shall be in From D·8.

He shall then have the spirit to be removed drawn from the storage Vat in his presence and that of the licensee or his agent and shaH examine, gauge and test It. 19. (1) The licensee shall employ at the warehouse in. which operations for denaturing spirit are earned on .such p<orsons as may be approved by the Ofikcr,!n'charge of the warehouse and shall issue to each such person a nokaxnama or certificate of appointment eounterslgned .in token of approval by such officer.

Licences for possession and use oi Ordinary Den.atured Spirit 23. Tue permit and licences of the following kind for the possession

and use of ordinary denature spirit may be granted under these rules, namely:-

(1) Permit for domestic purpm,es.

(2) Licence for medical purposes of registered medical practitioners.

(3) Licence for medical, scientific and educ.ati.onal purposes. (4) Licence for the purposes of any art, Industry or profession.

Permit for Domestic Purpose 24. (ll Any person "desiring to use ordinary denatured spirit for

domestic purposes shall apply to the Proh!b!tlonand Excise Inspector, Ahmedabad, ln the Ahme.dabad City Taluka and Daskroi taluka ln tbe Ahrnedabad District and Mamlatdar or Mahalkari, D/S elsewhere. The

application shall be made in Form ~!./ (2) On receipt .of the application under sub-rule (1), the officer

25. (1) Any registered medical practitioner desiring l:o use ordinary/ denatured spirit for medical purposes may apply to the Superintendent or the Distrtct Inspector, as the case may be, for a licence in that behalf. the application shall contain the folloWing particulars, namely:-

(i) The name and address of the applicant:

(ii) Place where the ordinary denatured spirit Will be kept and used:

(iii) Quantity of ordinary denatured spirit to he used per month: (iv) Registration number .or serial mn:nber of the applicant on

LICENCE FOR (I) MEDICAL SCIEN'rIFIC AND EDUCATIONAL PURPOSES AND

(II) PURPOSES OF ART, INDUSTRY OR PROFESSION

26. (l) Any person desiring to use ordinary denatured spirit for :;j bonqfide medical. scientific or educational purposes shall apply to the Superintendent or the District Inspector, as the case may be, for a licence in that behalf. The application shall contain the following particulars, namely:-

(i) Name and address o.fthe applicant with his designation; (ii) Purpose for which ordinary denatured spirit is required to

be used; (iii) Quantity of ordinary denatured spirit to be used per month;

(iv) Whether the ordinary denatured spirit ls required for the applicant's-(a) dispensary, clinic. hospital or dispensing home. or (b) laboratmy, museum, or research institu\:ion, or

(cl college, school. or any other educational institution: (vj whether the institution belongs to the Government. a

Municipality or a Panohayat;

(v) Place where the ordinary denatured spirit wlll be kept and used;

(vi) An undertaking in writing to the effect that the applicant will abide by the prov!sioni, of the Bombay Prohibition Act, 1949, and rules, regulations and orders made thereunder and the conditions of the lice.nee applied for.

(3) On receipt of an application under sub-rufe (1) or (2), the superintendent or the District Inspector, as the. case be, shall make such inquiries for verification of the particulars gtven in the application as he deems necessary and ifhe satisfie'd t,hat there is no objection to grant the licence applied for, the Supe:rlntendent may grant a licence in Form D.S. lv or D.S, V respectively, as the case may be, on payment of a fee of 1[Rs. 500)!-. for a licence in F'orm D.S. IV and according to the folloWing scale of lees for a licence in F'o.rm D.S. V. namely:-

grant the applicant. such licence !n Form D.S. V, for such quantity as the Collector deems fit on payment of the fee prescribed in sub-rule (3).

(5) No licence in Form D.S. V. shall be granted under this ru.le to any applieant unless he h;,.s executed a bond in Fonn B for an amount specified in sub-rule (6).

(6) The applicant for a licence in Form D.S. V. shall execute a bond for an amount of Rs. I 00 if the quantity ofdenatur-ed spirit permitted to be used by him does not exceed .25 lltres per month and for an amount of Rs. 1000 of ,:;uch quantity exceeds 25. lltres.

(7) The privileges of purchase. transport and possession ofordlnafy denatured splrit granted under the licence shall extend only so far they are inc!der1tal to use.ct in accordance With these rules and the condi-tions of the licence. '

(8) Whenever a licence !n Form D.S .. IV. is granted the authority granting theHcence shall issue a certlflcate in the forn1 specified in the licence as evidence of the. grant of the licence.

V, for possession and use of ordiriary denatured spirit or specially denatured spirit or both with a quota of 1000 litres or more he may by an order direct that. the said licensee shall use the ordinary denatured spirit or specially denatured spirit or both under the supervision of Prohibition and :ffxcise staff as may be appointed by the Director and also that he shaU pay to the Government cost of the said supervision at such rate as may be fJXed by him ..

29. Every person holding a permit in F'orm D.S. II or any of the licensees referred to in rule 28--

( l) shall allow every officer empowered under section 77(a) of the Act to inspect his permit or licence, as the case may be, the stock of denatured spirit held by him, the licenced premises where it is kept and the accounts and passes in respect of denatured spltit at all reasonable hours;

(2) shall abide by the provisions of the Act, and the rules, regulations and orders made thereunder;

(3) shall comply wlth all lawful orders issued by the Director, Collector, Superintendent or the District Inspector of Prohibil:ion and Excise. as the case may be. fromtime to time.

29-A A person holding a licence in Form D.S. Iv exceeding eight quart bottles per month "!hall mainta.in accounts in F'or:m D- lO in a hound register containing serially numbered .pages of stout. paper stamped with the seal of the Superintendent of Prohibition and Excise or the District Inspector of Prohibition and Excise, as the case may be. 31. Excise as permitted under a licence in l"onn D .. S. L granted under rule 5, no person shall sell denatured spilit without a licence in Form D.S. Vl or D.S. Vll.

WHOLESALE AND RETAJL LICENCE

32, Any person desW.ng to sell ordinary denatured spirit by wholesale shaH apply to the Collector for a llcense .in that beha.lf. The applicaHon shall contain the following particulars:-

( l) Name and address of the applicant.

(2) Place where the applicant's shop for selling ordinary denatured spilit is situated.

(3) Whether ordinary denatured spirit was sold in the past at the above place and the period during which it was sold.

(4) Whethe.r the applicant held any licence for the wholesale sale of denatured sp.irit in the past and if so, the period during which it was held.

(5) Whether the applicant holds any other licences for wholesale sale or retail s,1le of denatured spirit, or for manufacture of French polish, varnish or other like article,

(6) Q11antity of ordinary denatured spirit intended to be sold during the period of the licenc.e,

(7) Average yearly in the years immediately before the date of the application

34, Any person desiring to sell ordinary denatured spirit by retail shall apply to the Collector for a licence in that behalf. The application shall contain the following particulars:-

(1) Name and address of the applicant. (2) Place where the applicant's shop for selling ordinary denatured

spi1it lS situated. (3) Whether ordinary denatured spirit was sold in the past at the

above place and the period during Which it was sold. (4) Whether the applicant held ordinary denatured spirit retail sale

licence in the past and the period during which he held it.

(5) Whether the applicant holds any other licences for wholesale sale or retail sale of denatured spirit. or for manufacture of French po11sh varnish or other like article.

(6) Q1Jantity ofordlnary denatured spirit intended to be sold dnrff;;;

37. No licence under rule 33 or rule 35 shall be granted for a period beyond 31st March next following the date of the commencement of the licence.

38. A wholesale licensee shall not obtain his supply of ordinary denatured spirit from any place except from-

(a) an Excise or Customs bonded warehouse under a transpmt pass. or

(b) a place outside the State of Gujarat under an import pass. or

{c) a licertced manufacture or ordinary .denatured spirit or any ot:het wholesale Jjcensee,

on requisition in .Form D.S. VJIJ signed by himself and countersigned by the local Prohibition and Excise Officer and under cover of a transport pass.

situated in one and the same distti.d. The whole sale licensee shall on each occasion enter in such licence the details of the sale of ordinary denatured spirit and sign against ssich entry.

42. The wholesale licensee shall not sell ordlnaiy denatured spirits to retail licensees except in sealed quart bottles and to other persons except in bulk or sealed bottles in quantities not less than llve Htres at a time.

43. (1) The retail licensee shall not ordinary denatured spirit except-,--

(a) to a person holding a permit in Form D.S. ll; (b) to a person holding a licence in Form D.S. lll; (c) to a person holding .a licence in Form D.S. IV or D.S. V

granted in respect of a quantity not exceeding 6 quart bottles per month;

(d) to a registered medical practitioner holding a licence in Form D.S. lv of a quantity exceeding six quart bottles.

(2) The retail Hcensee shall not sell denatured spirit to--(i) any person holding a permit in Form D.S. !I, or a licence D.S.

44. (1) Ordinary denatured spirit shall not be sold or exposed for sale by a retail licensee or wholesale licensee except in sealed quart bottles.jars, drums or cakes. duly labelled in the manner provided in this rule.

(2) All bottles, jars, drums or casks containing denatured spirit intended for sale shall bear a label printed in red· and containing skull and. cross bones and on each of the four sides of the label the words "Polson not to be taken internally" in English and each regional language.

(3) The word "Poison" shall appear at the top in red in prominent letters and beneath shall appear the words "Not to be taken interna.Ily" in smaller letters in blank. The design and style of the label shall be such as may be approved by the Director.

(4) Each bottle, jar, drum. cask or receptacle. containing ordinary denatured spirit of Indian lvlanufacture kept for sale shall be conapiGuously labelled or branded with the words "Ordinary denatured spirit manufactured ln lndW."

45. The wholesale licensee or theretail licensee--OJ shall not. except with the written permission of the Collector,

the stock of ordinary denatured spirit kept therein for the inspection by the Director, Collector, Superintendent, District Inspector, or any other officer empowered under section 122 of the Act;

(6) shall keep a visit book at his licensed premises for the use of the inspecting officers, the book being paged and stamped with the seal of the Superintendent/Mam!atdar /Maha!kari;

(7) shall not, without the permission of .the .Collector sell, transfer or sublet the privilege of sale granted to him by his licence nor shall he in connection with the excise. of the said right enter into any agreement or arrangement which in the opinion, of the Collector, is of the nature of a sublease;

(8) shall not admit any person as his partner for the purpose of the licence unless the partnership has been declared to the Collector before the licence is granted and the names of the partners have been entered Jointly in the licence, or if the partnership is entered into after the granting of the licence, unless the Co Hector agrees on application made to him to alter the licence and to add the names of the partners in the Hcence:

46. The privileges of purchase and possession or ordinary denatured spirit granted under the licence to the wholesale licensee or the retail licensee.shall extend only soJar as they are incidental to its s.ale al. the licensed premises.

Notwithstanding anything contained in rule 36, the Collector may.with the previous permission of the Director, permit any whole· sale licensee to sell methylated industrial denatured spirit or special industrial denatured spirit as a special case by making an endorse .. ment to that effect on the licence, and the provisions of mies 38 or 46 and Form D.S. Vl shall, so far as may be, apply to the sale of such spirit.

Provided that no such pass shall be granted for the transport of denatl.lred spirit or specially denatured spirit as the case may be manufactured or stored in any distillery, bonded warehouse, bonded laboratory or bonded manufactory in the State of Gujarat for the transpprt of denatured spirit or specially denatured spirit as the case may be from any Custom House, at any port, Land C1.:1stom Station or Air port, unless a 1[admlnistrative fee at the rate of twenty paise per litre) of denatured spirit or specially denatured spirit as the case may be to be so transported has been paid by the applicant in addition to any duty leviable under the AcL

50A. ( 1) The transport of denatured spirit or specially denatured spirit by the transporter shall .be under the escort of Prohibition and Ecxcise staff as may be appointed by the Director, when quantity of such spirit transported by road ls 500 litres or more in the case of transport within. the State and in the case of through transport, for any quantity whatever shall it be and by any tr(\nsporter, when so transported by road or when so transported for through transport by road from the point of entry into the State of Gujarat upto its destination in the Gujarat or until it !eaves. the boundary of the State of Gujarat in the case of through transport.

IMPORT

51. Any person desiring to import denatured spirit shall apply to the Collector for an import pass. The application shall contain the following particulars:-

(1) Name and address of the applicant; (2) Form of the licence held under Act by the applicant and its

number and date; (3) Kind and. quantity .of denatured spirit to be imported; (4) Quantity of denatured spirit for possession under the licence; (5) Place from which denatured. spirit is to be imported; (6) Name and address of the person from whom denatured spi!it

will be purchased; (7) Place at which denatured spirit Will be kept after its import; (8) Period for which import pass is required; (9) Route; ( 10) Reasons for importing denatu.red spirit: ( ll) An undertaking in writing to the effect that

53. The Importer shall present Part H of the import pass to the Collector or the Chief Excise Authority of the place of export and shall obtain orders of such authority for the supply of denatured spirit to him.

54. The importer shall get his supply of denatured spirit in casks, drums or receptacles sealed with the seal of the officer of the place of export issuing the denatured spirit,. with the quantity and strength of spirit indicated thereon.

55. the seals on the casks, drums or receptacles contalning denatured spirit are found to be intact on arrival at the importer's shop or premises and that the strength of the spirit is not less than ,m0 O.P.:

Provided further notwithstanding the permission so . granted a sample shall be. taken from each cask,drum or receptacle and if such denatured spirit on being analysed and tested by the Chemical Analyser to the Government of Gujarat is found to be not properly denatured or to be ofless tban 60° O.P. in strength the importer shall not make any furthersale or use of such denatured spirit. All such cases shall be reported to the Director for orders for the further disposal of such denatured spirit.

EXPORT

57. Any person.desiring to export denatured spirit shall apply to the Collector for an export Pass. The application shall contain the following particulars, namely:-

The export pass shall be in four parts which shall be dealt with as under:-

Part l sha!l be kept for record in the office of the Collector granting the pass.

Part l! shall be handed over to the exporter for record with his accounts.

Part Ill shall be handed over to the exporter for sending with the consignment and thereafter to be kept by the person receiving denatured spirit, and

Part N shall be forwarded to the Collector or the Chief Excise Authority of the place to which denatured spirit is to be exported.

60. The exporter shall take all reasonable precautions so that the denatured spirit exported by hlm reaches its destination without being tampered with in transit,

CONDI'rIONS

I. The licensee shall not store and denature spirit at any place except in a room (hereinafter to as the "denaturing room") allotted for the purpose at the warehouse.

2. The door of the licensee's denaturing room shall have two locks, of which one shall be provided by the licensee and the key of it kept With him. The order shall be an excise revenue lock the key of which shall be kept with the officer in charge of the warehouse. The l!censee shall open his lock at any time when required to do so by the officer in charge of the warehouse.

3. (1) The licensee shall not keep anything in the denaturing room except spirits, denaturants, vats and their accessories and testing instrument's.

(2) The licensee shall not enter or allow any person to enter the denaturing room with a naked light.

(3) The licensee shall not use any lamp other than an electric safety lamp of a design approved hy tho Director.

4. (1) The license shall not keep denatured spirit in casks used for transport and shall transfer the spirit from such casks by pumping it into a storage vat or tanks having a capacity of not less than 2500 liters or such smaller capaelty as Director may permit.

(2) If the Chemical Analyser certifies that the spirit is insufficiently denatured, the licensee shall denature the spirit again by adding such denaturants as are necessary and send it to the Chemical Analyser for examination through the officer in charge of the warehouse and obtain a certificate from the Chemical Analyser that the spirit has been satisfactorily denatured.

(3) Where the Chemical Analyser reports that the spirit cannot be certified, as being satisfactorily denatured spirit shall be dealt with to the orders of the Director.

8. (l) Except with the permission of the Director or of the officer specially authorised by the Director in that behalf, the licensee shall not sell or supply from the warehouse ordinary denatured spirit in quantgies ofless than 250 liters at a time and of a strength lower than 60.00 O.P.

(2) The licensee shall not sell or supply ordinary denatured spirit to any person unless he produces a requisition countersigned by a Prohibition and Excise OffieeL The licensee shall carefully preserve the requisitions and give them to the Officer in charge of the warehouse on his next Visit to the denaturing room. All denatured spirit issued from the warehouse shall be accompanied by a permit signed by such officer.

14. The licensee may be suspended or cancelled in accordance with the provisions of the section 54 or 56 of the Bombay Prohibition Act, 1949.

15. It shall be entirely within the discretion of the Director whether he Will or will not renew this licence. lf this licence is not renewed. or if it be cancelled or suspended the vessels and utensils, denaturing materials.spirit and denatured spirit remaining on the premises, at the time of the expiration, cancellation or suspension of this licence shall be disposed of according to the orders of the Director. lf the licence is renewed, it shall he granted subject to such conditions as the Government may direct.

2. The permit holder shall not use the ordinary denatured spirit for any purpose except for the aforesaid purpose (s) of domestic use of his household.

3. The permit holder shall not obtain his supply of ordinary denatured spirit, except from a retail licensee of ordinary denatured spirit and. shall not remove the ordinary denatured spirit purchased by him from the shop of such licensee, unless he gets the details of the purchase entered on the reverse of the permit by the licensee or any person acting on his behalf.

5. The permit holder shall not have in bis possession more than one reputed quart bottle of ordinary denatured spirit at any one time.

3. The privileges of purchase, possession and transport of spirit granted under this licence shall extend only so far as they are incidental to its use stated in condition 2.

4. (1) The licensee shall not purchase his supply of spirit from any person except from a wholesale licensee or a retail licensee.

(2) The licensee shall not possess or use spirit of a strength less than 66° O.P. ·

5. The licensee shall not obtain h!s supply of spirit except from a retail licensee if such supply does not exceed 6 quart bottles and from a whole-sale licensee if such supply exceeds five litres:

Provided that if the registered medical practitioner he may obtain his supply of spirit exceeding 6 quart bottles from a retail licensee,

10. The licensee shall maintain the accounts and submit the returns in the forms prescribed and in the manner laid down under the rules;

11. The licensee other than a licensee who is a registered medical practitioner, shall maintain a visit hook on his premises for use of the inspecting officers. This book shall be paged and stamped with the seal of the Superintendent of Ptohlhltion and Excise or the Inspector of Prohibition and Excise as the case may be.

12. This licence may be suspended or cancelled in accordance with provisions of section 54 or 56 of the Bombay Prohibition Act. 1949.

3. Except wit,h the preVious pernlisslon of the Collector the llqmsed premises or the godown shall not be located. in the same building with any other shop for sale of potable spirit, rectified splrlt, medicated wines, tinctures, French Polish or for the sale of food or drink for consumption on the premises.

4, The licensee shall not bottle spirit in the licensed premises except in quart bottles only and under the supervision of a Prohibition and Excise Officer and on such conditions as the Collector may impose. Each quart bottle shall contain not less than 650 millilitres of spirit and shall bear the se';ll of the P:rohib!tion and Excise Ofllcer supervising the bottling operations.

5. The licence shall be hung up in· a conspicuous place in the licensed premises to the front of which shall be affixed a sign board bearing the following inscriptions in legible character ln F:nglish and in the language of the district in which the licensed premises are situated.

stored in premises whlch are sufficiently fire·proof and ·approved by the municipal authorities and which are not used or int.ended for human occupation.

3. Except with the special permission in writing of the Collector the licensee shall not sell more than 6 quart bottles of spirit at time to any licensee:

ProVided that he may sell to a registered medical practitioner holding a licence in Form D.S. rv of a quantity exceeding six quart bottles.

4. The licensee shall not sell, or offer or expose for sale spirit except ln quart bottles bearing the seal of the Prohibition and Excise Officer superVislng the bottling operations of the whole sale licensee from whom, it was obtained not shall he sell such spirit to persons who are minors. All such bottles shall contain not less than 650 millilitres of spirit.

5. The licensee shall not sell spirit at a price ln excess of the maximum price prescribed by the Director under the Bombay Prohibi-tion Act, 1949. ·

6. The licensee shall be hung up ln a conspicuous place in the J.ieensed premises· to the front of which shall be affixed a sign board bearing the follo,;rtng inscription in legible characters in f£nglish and in the language of the district in which the shop is Situated:
