law School, passed away onTuesday, June 4 at St. Luke'SMedical Center in Milwau-kee. Eisenberg suffered amild heart attack on May 23.He was readmitted to thehospital Monday, June 3.He was 55.

"I mourn Dean Eisen-berg's passing with the heartof a friend and the soulof a fellow teacher andlawyer," concluded Abraham-son. "He lived life, as do allgreat men and women, as ifhe would never have to die.He died far too young, buthe will live on through hisfamily, his students, and themany people whose liveshe touched."

"Howard was the heartand soul of the law school,"said Shirley Ann Wiegand,acting associate dean ofMarquette University LawSchool. "He was one of ahandful of truly great men,more generous of soul andspirit than anyone I'veknown. Funny, brilliant,respectful, caring, and fartoo hardworking; he cannotbe replaced. We will misshim always."

"Dean Eisenberg lived theconcept of serving the publicthrough pro bono represen-tation of the poor and thedisadvantaged, and wasalways willing to share hisvast knowledge and expertadvice with other attorneys,"said State Bar PresidentGerry Mowris. "My firstmemory of Howard waswhen I called him as a younglawyer facing a difficult legalissue. Howard not only hadan answer but quoted me acase and a citation frommemory. He was always will-ing to provide advice andguidance or suggestions toyoung lawyers. The citizens

of the State of Wisconsin andthe State Bar lost a truefriend."

"Dean Eisenberg willbe missed greatly by thelawyers and the staff ofthe State Bar of Wisconsin, "continued Mowris. "From hisservice as the state publicdefender through his serviceas dean of the MarquetteUniversity Law School,Howard has been a consum-mate professional."

Eisenberg joined theMarquette faculty as deanand professor inJuly 1995.A native of Chicago, he wasa Phi Beta Kappa graduateof Northwestern University.He attended UW Law School,after which he clerked forWisconsin Supreme CourtJustice Horace Wilkie. From1972 until 1978 he served asthe chief State Public Defen-der of the State of Wisconsinand wrote the current StatePublic Defender statute.Eisenberg left Wisconsin in1978 to become executivedirector of the National Aidand Defender Association inWashington, D.C. From 1983to 1991 he was professorand director of ClinicalEducation at SouthernIllinois University School ofLaw in Carbondale, Illinois.He served as dean and pro-fessor of law at the Univer-sity of Arkansas at Little Rockfrom 1991 until he joined theMarquette faculty.

Eisenberg argued morethan 300 appellate casesbefore state and federalcourts, including two casesbefore the United StatesSupreme Court. He wroteand presented dozens ofcontinuing legal education

programs in the areas ofcriminal procedure,legal ethics, elderlaw, andcivil rights.

Eisenberg received the1989 Outstanding Achieve-ment Award fromthe governor of Illinois forhis work in combating elderabuse and the first Walter J.Cummings Award in 1992 asthe outstanding courtappointed attorney in theSeventh Federal JudicialCircuit. He received theaward a second time in 2002.Eisenberg received severalawards recognizing hiscommitment to pro bonolegal services. He served as amember of the WisconsinBoard of Bar Examiners from1996-2001, and as chair ofthe board during 2001.

At the time of his death hewas chair of the State BarAppellate Practice Section,

and he served as Chair of theSeventh Circuit RulesAdvisory Committee since1998. Eisenberg was appoint-ed chair of a SpecialCommission to advise theArchbishop of Milwaukee onissues relating to sexualabuse by priests. Gov.McCallum recently appoint-ed him to co-chair a specialcommittee to recommendchanges to the Wisconsincorrupt practices act.Eisenberg was a fellowof the American Academyof Appellate Lawyers, theWisconsin Law Foundation,and the American BarFoundation. He taught crimi-nallaw, criminal procedure,professional responsibility,and appellate advocacy.

In addition to his wifePhyllis, survivors include adaughter Leah, and two sons,Nathan and Adam .•
