Introduction

The Govt. of India has launched ‘Integrated Child Protection Scheme (ICPS)’ in the year

2009 with aim to provide a protective environment for all the children in order to enable them to

develop into responsible individuals. It functions as a Government-Civil Society Partnership Scheme

under the overreaching direction and responsibility of the Central and State Governments. The

interventions include - inter-alia, financial support for setting up and/ or maintenance of Homes for

children in need of care and protection and those in conflict with law, setting up of child protection

structure viz., State Child Protection Society and District Child Protection Society, capacity building,

advocacy etc.

The Scheme is primarily an integration of components of three existing Schemes:

1. A Programme for Juvenile Justice

2. An Integrated Programme for Street Children (including Childline Services)

3. Scheme of Assistance to Homes (Shishu Greh) for children to promote in-country adoption

The Scheme comprehends ‘Child Protection’ as a ‘Right of every child’ to be protected from or

against any perceived or real danger or risk to their life, their personhood and childhood. It is about

reducing their vulnerability to any kind of harm and protecting them in harmful situations. It is also

about ensuring that no child falls out of the social security and safety net and, those who do, receive

necessary care, protection and support so as to bring them back into the safety net.

Objectives of the Scheme:

The Scheme is expected to significantly contribute to the realization of Government’s responsibility for

creating a system that will effectively and efficiently protect children. This will be achieved by the

following indicators:

i. Improved access to and quality of child protection services;

ii. Raised public awareness about the reality of child rights, situation and protection;

iii. Clearly articulated responsibilities and enforced accountability for child protection;

iv. Established and functioning structures at all levels for delivery of statutory and support services;

v. Introduced and operational evidence based monitoring and evaluation.

Guiding principles:

a) Child protection – a primary responsibility of family, supported by community, government

and civil society.

b) Loving and caring family – the best place for the child.

c) Right to Privacy and Confidentiality – to be protected through all the stages of service

delivery.

d) Non-stigmatization and non-discrimination – equal treatment in a dignified manner.

e) Prevention and reduction of vulnerabilities – central to child protection outcomes.

f) Institutionalization of children – the last resort.

g) Child centred planning and implementation – to ensure that the best interest of the child is

protected.

h) Technical excellence, code of conduct – services by skilled staffs and specialized care givers

adhering to an ethical and professional code of conduct.

i) Flexible programming, responding to local individualized needs – customized service

delivery approach.

j) Good governance, accountability and responsibility – An efficient and effective child

protection system.

Concerted approaches towards child protection:

a) Prevention: - through an outreach programme, convergence of services, strengthening community

capacity and integrating child protection concerns and safeguards.

b) Promotion of Family-based Care: through sponsorship, kinship care, foster care and adoption.

c) Financing: - by providing Grant-in-Aid to voluntary organizations under the different components

of the Scheme.

d) Integrated service provision: - into a range of services to cater to the multiple needs of children in

difficult circumstances through an interface with various sectors i.e. health, education, judiciary,

police and labour.

e) Care plan for each child: - availability of adequate services as long as the child is in need of care.

f) Community based service delivery: - increase access to child care services.

g) Decentralization and flexibility to focus on local needs: - allocation of human resource based on

protection service requirement for quality child protection services.

h) Partnership building and community empowerment: - developing close working relationships,

information sharing and strategy building between government structures and civil society

organizations including corporate and communities.

i) Quality care, standards for care and protection: - adherence to set standards pertaining to physical

infrastructure and human resource requirements, as well as protocols, methodological instructions

ad guidelines for services and operational manuals for functioning of statutory bodies.

j) Building Capacities: - training and capacity building of all service providers and functionaries to

equip and enhance their skills, sensitivities, knowledge on child rights and standards of care and

protection.

k) Monitoring and Evaluation: - setting up a child protection data management system to formulate

and implement effective intervention strategies and monitor their outcomes as well as regular

evaluation of the programmes and structures.

Expected Outcomes of ICPS:

The Integrated Child Protection Scheme is an attempt by the Ministry of Women and Child

Development to ensure that ALL children get the opportunity to grow to their full potential in a safe

enabling environment. Once put in place, we expect that the scheme would result in:

• Reduced vulnerabilities of children

• Increased availability and accessibility of a variety of children protection services

• Reduced number of children in need of care and protection

• Increase in the protection of children in family based non-institutional care services i.e. adoption

• Better quality care for children in institutional care

• Increase in the protection of children / young people leaving institutional care who are self sufficient

and gainfully engaged in protective activity.

Status of Implementation of ICPS in Delhi

Memorandum of Understanding was signed with the Ministry of Women

& Child Development, GOI on 17.3.2010.

State Child Protection Society has been registered on 5.8.2010.

The Governing Body of the Society is headed by Hon’ble Minister,

Women & Child Development (GNCTD).

The Executive Committee of the Society is headed by Secretary,

Department of WCD, GNCTD.

State Project Support Unit became functional in October, 2010.

Fund received under ICPS from Ministry of Women & Child

Development, Government of India in the year 2010-11 was Rs. 257.29

Lakhs and Rs.181.94 lakhs was utilized for the same in 2010-11. The

The Department has set up/recognised the following under Juvenile

Justice(Care & Protection of Children)Act,2000:

State Child Protection Society (SCPS): The State Child Protection Society, Delhi has

come into existence with its legal entity by registration (number S/009/2010) under Societies

Registration Act XXI of 1860 on 5th

August 2010. The registered office of the society is 1,

Canning Lane, K.G Marg, New Delhi-110001. It has completed its first year successfully and

has taken remarkable initiatives to strengthen the service delivery systems and also to

improve the institutional services by promoting implementation of the scheme.

State Project Support Unit (SPSU): The SPSU was set up and became functional in

October 2010 with a purpose to accelerate the implementation of the activities of Integrated

Child Protection Scheme effectively as envisaged in the guidelines. Some of required

structures and child protection mechanisms visualized under ICPS, viz. SCPS, SARA, ARC,

SAA etc have been set up and steps taken for establishment of State Child Protection

Committee, District Child Protection Committee and District Child Protection Units. The

District Child Protection Officers have been posted presently attached with all the District

Social Welfare Offices with assignments to develop networking with the District level

Statutory Bodies, Child Care Institutions and Civil Societies.

Child Welfare Committees (CWCs): As of now, 6 CWCs have been established under

section 29 of Juvenile Justice (Care & Protection) ACT, 2000 and another one CWC is

expected to come in place shortly. CWC is the competent authority to dispose of cases for the

care, protection, treatment, development & rehabilitation of children in need of care &

protection and to provide for their basic needs and to ensure protection of human rights.

CWC plays pivotal role in the process of inquiry of an orphan, abandoned and surrendered

child whereby a child is declared legally free for the purpose of adoption.

Juvenile Justice Boards (JJBs): The JJBs deal with matters relating to juveniles in conflict

with law to ensure restorative justice and developmental opportunity. In Delhi, two JJBs

were already functional and the 3rd

JJB has been constituted in the year 2010-2011. The JJBs

have been very instrumental in the rehabilitation of the children in conflict with law with

behavior disorders. Many children have been benefitted of community services, vocational

training & recreational engagements and treatment for Drugs addiction & Substance abuse.

Special Juvenile Police Units (SJPU): In order to coordinate & upgrade the police interface

with children, 14 Special Juvenile Police Units have been set up in the State of Delhi. Every

Police station has one Juvenile Welfare Officer available to attend the case of children in

need and conflict with law.

d) Institutional Services

i) Govt. run Services for Children in Conflict with Law: In Delhi, 6 homes including special

home, Observation homes & Place of Safety which are established for such children in conflict

with law who enter the juvenile justice system through the JJBs. List of these observation homes

is given in Annexure VII.

ii) Govt. run institutions for Children in need of Care & Protection: There are 21 institutions

for children in need of care & protection, notified under 34 & 37 sections of Juvenile Justice

(Care & Protection of Children) ACT 2000, Amendment Act 2006.

NGOs run institutions for Children in need of Care & Protection:

iii) 61 NGOs have been issued recognition certificates under Section 34 of JJ(Care & Protection of

Children) ACT 2000 by Department of Women & Child Development, Govt. of NCT of Delhi to

run the Child Care Institutions (CCI).

iv) 5 NGO run institutions have been granted recognition of Shelter Homes (SH) which have

capacity of keeping 450 children. By the end of the year, it served 427 children in need of care &

protection.

v) Specialized Adoption Agencies (SAAs): 11 NGO run Institutions (CCIs) have been issued

license and are recognized as Specialized Adoption Agencies u/s 41 (4) for in-country adoptions.

8 out of these 11 institutions have also been recognised for inter -country adoption along with in-

country adoption. The main function of the SAA is to make conscious efforts for placement of

orphaned, abandoned or surrendered children into adoption in accordance with the provisions of

various guidelines for adoption issued from time to time.

Alternative forms of child care:

Adoption: From October 2010 to March 2011, 143 adoptions have taken place as follows:

There were 377 children (145 male plus 232 female) present in the record of 11 SAAs by the end

of the year 2011.These are the children ,waiting for CWCs clearance, those who are under

process for in-country & inter- country adoption & the children who are hard to place.

Simultaneously, 1038 PAPs (Prospective Adoptive Parents)were waiting for child in adoption

both for male & female child as per the waiting list being provided by the agency .

Sponsorship: Ladli yojna launched in 2009 is a cash grants to the girl child students

promoting institutional birth and education. Scholarship is also given to children of minority

communities.

Foster Care: Department has set up a Foster Care Home Service (FCHS) in the Nirmal

Chhaya Complex, Hari Nagar promoting pre-adoptive foster care and adoption.

After Care Service: Children attained the age of 18 years but couldn’t be restored with their

respective families or found with no survival means are given shelter in the Government run

After Care Home with objective to facilitate for vocational skill development and support to

reintegrate in the mainstream of society.

Emergency outreach service through Childline (Dial 1098):

Plan of Action

a) Development of IEC Material for ICPS: In order to promote the ICPS scheme, there is a

strong need to develop some IEC material on child rights & protection. It will also help us to

raise public awareness at all levels on situation & vulnerabilities of children & families.

b) Training Need Assessment followed by Capacity Building of Care givers:

By keeping the statutory responsibilities & specific job requirement of the care givers & the

various stakeholders like JJBs, CWCs, Shelter Homes, SCPU, DCPU etc. in mind, Ideally, there

should be one proper training & capacity building structure through which systematic

programmes for the entire team of the home & the various stakeholders involved in the

implementation of JJ Act could be organised & all the components could be covered, for

instance no programme has been organised for the House Mother/Father / Caretaker which

equally needs attention to bring out the desired outputs.

c) Baseline Survey: For the effective implementation of the ICPS scheme & selection of the

priority areas where interventions are to be required on the utmost levels will be done through a

baseline survey. This baseline survey form will be developed with the help of NIPCCD.

d) Sensitisation of concerned Stakeholders: In coming year, Delhi State will be planning to

sensitize the concerned stakeholders like CCIs, JJBs, CWCs, SAAs etc. who are involved in the

implementation of the ICPS Scheme.

e) Setting up of State Adoption Resource Agency(SARA) & formation of SAAC & ARC:

In order to support CARA in promoting in-country adoption & regulating inter- country adoption

ICPS shall support setting up of a State Adoption Resource Agency which will coordinate ,

monitor & develop the work of adoption and render secretarial and administrative assistance to

the State Adoption Advisory Committee.

f) Setting up of 9 DCPSc (District Child Protection Society/units): In Delhi, initially one DCPS

will be set up in the year 2011-12. Later on other DCPSc will be established as a fundamental

unit for the implementation of the scheme.

g) Recruitment of Staff under DCPSs, SARA, SPSU & SCPS: As per the guidelines of the ICPS

staff will be recruited for each service delivery structure like DCPSs, SARA, SPSU & SCPS.

h) Innovative/Need based proposals :The State of Delhi will also look up for innovative/need

based projects for children in difficult circumstances. As per the ICPS guidelines, such

innovative intervention programmes may depends on the specific needs of a district /city and

may be initiated as pilot projects: for example, special programmes for children of prisoners,

children of sex workers etc.

i) Model home to be set up: Children home for Boys-1 at Lajpat Nagar has been selected to be

converted into model home with adequate infrastructures and facilities. The Proposal Approval

Board, Ministry of Women & Child Development, Government of India has already approved

the proposal. Estimate from the Public Works Department is awaited for sanction and release of

grant by the Ministry under ICPS.

j) Open Shelters for Children in need in Urban & Semi Urban area: In coming year few open

shelters will be opened in Delhi with the help of eligible NGOs which will cater to all children in need

of care & protection particularly beggars, street & working children, rag pickers, small vendors, street

performers, orphaned, deserted, trafficked & run-away children, children of migrant population & any

other vulnerable group of children.
