1. INTRODUCTION
DG ECHO is the Directorate General of the European Commission responsible for the European Union's effort in the area of humanitarian aid and civil protection.
DG ECHO is a donor supporting humanitarian interventions. It does not implement directly on the ground but fulfils its mandate by providing funding to about 200 partners, being (1) non-governmental organisations, (2) international organisations such as the International Committee of the Red Cross and the International Federation of National Red Cross and Red Crescent Societies and the International Organisation for Migration and (3) the United Nations organisations
It is important for DG ECHO to have a wide range of partners as this allows covering an ever-growing list of needs in different parts of the world often in increasingly complex situations.
DG ECHO has developed close working relationships with its partners in relation to both policy issues and management of humanitarian operations. DG ECHO-managed grants and contributions are made by selecting the best proposals received for covering the needs of the most vulnerable.
The present report focuses on the partnership between the DG ECHO and the United Nations Organisations working in the area of humanitarian aid.
As regards these Organisations, a framework agreement between the EC and UN entitled the "Financial and Administrative Framework Agreement (FAFA)" was signed in 2003, and is explained in more detail in section 3 below.
In 2010, DG ECHO implemented its operations through UN organisations for about 39% of its total funding, with an average amount of €1.9 million per agreement.
Of the top 25 partners working with DG ECHO, 8 are UN organisations, representing a total of €403 million. This means also that of the total of €417.3 million used to fund the UN category of partners in 2010, 96% are included in this top 25.

2. METHODOLOGY
The statistics given in this report are extracted from DG ECHO's database "HOPE". The agreements are categorised in the year when the initial agreement was signed. This means for 2010, agreements signed under decisions adopted in 2009 and 2010.

3. THE EC/UN FINANCIAL AND ADMINISTRATIVE FRAMEWORK AGREEMENT (FAFA) AND ITS IMPLEMENTATION IN HUMANITARIAN AID ACTIONS
The FAFA fixes the general legal framework for the relations between the Commission and these organisations in the area of humanitarian aid.
The UN Organisations concerned by this Agreement – known as FAFA – are indicated in the Preamble of the FAFA itself. DG ECHO's UN partners are listed in section 4 of this report where they are discussed in more detail.
The FAFA
• applies to all contribution-specific agreements between the Commission and UN organisations signed after 29 April 2003;
• replaces the "Agreement between the United Nations and the European Community on the principles applying to the financing or co-financing by the Community of programmes and projects administered by the United Nations" signed on 9 August 1999.
The FAFA is a framework agreement which contains detailed provisions on certain general matters but needs to be further implemented for specific humanitarian aid actions through "contribution-specific agreements". This is recognised in the text of the FAFA which states that any general conditions applicable to contribution-specific agreements shall fully conform to the provisions of the FAFA (Article 15.5, FAFA).
Pursuant to the Commission Decision1 approving the FAFA, in 2003 DG ECHO prepared legal templates providing contractual terms and conditions which are compliant with the terms of the FAFA and adapted to suit the specific needs of EU-funded humanitarian aid actions implemented by the UN.
The texts, which entered into effect on the 30 April 2003 include a model agreement and the related special and general conditions. They are supplemented by implementing measures such as a standard form for submitting funding proposals ('the single form') and related guidance documentation.
FAFA WORKING GROUP & JOINT REFERENCE GROUP
Article 13.1 of the FAFA has established a Working Group "to promote a regular exchange of information on all matters arising out of this Agreement. The Working Group will meet at least once a year to review the implementation of this Agreement. It may propose any appropriate action, including amendments to this Agreement, in the light of the results obtained or of changes in the regulatory framework of the Parties."
These annual consultations are an important means of clarifying the practical application of this agreement and contribute to strengthening the partnership between the EU and the UN.
They are supplemented by regular sub-group meetings as necessary and ad-hoc contacts throughout the year. A Joint Reference Group meets as necessary to discuss and resolve any recurring problems encountered in the interpretation or implementation of the FAFA.
The mandate of the FAFA JRG2 is as follows:

"...Given the absence of an effective mechanism to address problems, it was decided to establish a FAFA "Joint Reference Group", composed of EC and UN officials at appropriate levels, working together and meeting regularly as required ..., to whom issues broadly relating to the day-to-day implementation of the FAFA can be referred.
The "Joint Reference Group" would analyse FAFA-related issues brought to their attention and provide advice – intervening as necessary with the services/agencies involved. The Group would also systematise the information received, and issue updates and information documents (such as "Frequently Asked Questions") which would improve consistency within the EC and the UN, and help to clarify and strengthen the partnership."
One of the main tasks and accomplishments of the FAFA JRG is to agree on the text of answers to the FAQs for International Organisations posted on the website of DEVCO, http://www.cc.cec/dgintranet/ europeaid/contracts_finances/faq/faq_detail/faq_international_organisations_en.htm.
Some of the issues relevant to DG ECHO which were recently treated by these FAFA Working Group3 and Joint Reference Group are:
– Quality of reporting: in its performance audit on the EU assistance implemented through the UN, the European Court of Auditors made observations about the reporting done by the UN. Improvements could be made by following or supplementing the existing joint guidelines or the above-mentioned jointly agreed FAQs ,
– With regard to the obligation to publish information on beneficiaries is included in article 4.4 of DG ECHO's General Conditions, it was agreed that the obligation to provide ex-post publicity applies to grant and procurement contracts awarded for an amount of over USD 100,000, pending an assessment of the materiality of this threshold.
– Joint monitoring initiatives EuropeAid has already held discussions with a number of UN organisations (UNDP and UNICEF) as well as with the World Bank on their monitoring methodologies. Joint monitoring initiatives are important in the framework of aid effectiveness and a seminar on multi-donor monitoring, to which the UN was invited, took place in Brussels in April 2010. Joint monitoring initiatives are the first steps in launching a dialogue on this topic with a view to the development of joint monitoring methods and should be further improved.
– Verifications: In 2010, DG ECHO's External Audit Service staff participated jointly with EuropeAid Cooperation Office (DEVCO) colleagues, in the meeting of FAFA Working Group to review the implementation of the verification clause that is an integral part of the Agreement. DG ECHO also attended periodic sub-group and preparatory meetings throughout 2010 to brief DG DEVCO colleagues on important issues from DG ECHO’s perspective, particularly with regard to implementation of the verification clause of the FAFA. (see also section 8 on the controls on the use of funds).

5. TRENDS
5.1. General
As a whole, the funding to UN organisations is relatively stable over the last five years; with 37% in 2006 and 39% in 2010.
In 2008 the percentage of funding allocated to the UN was particularly high (46%) due to the food crisis, for which operations were mainly implemented by UN partners (mainly WFP). The 2010 figures are again in line with figures before the food crisis.

The main changes registered between 2009 and 2010 and the general trend over 5 years is reported below, under point 5.2.
Under point 9, the figures on funding are given for each UN agency as from 2006.
Point 10 focuses on general trends and details of contribution agreements signed with UN organisations in 2010.
5.2. By UN organisation
WFP is the UN organisation that receives most DG ECHO funding and is a strategic partner. In 2010, WFP received 46% of the total amount allocated to UN organisations or 18% of the total operations funded by the EU. In this respect, food assistance activities make up for the lion's share: WFP continues to be the most important UN partner of DG ECHO in this respect, accounting for 79% of the food aid allocations to UN partners.
UNHCR: is the 2nd partner of DG ECHO in 2010, with 7% of the total operations funded by the EU. UNHCR is mainly working in the sector of protection, representing 72% of its activities. The amount awarded in 2010 (€ 75 million) is above the average contribution over the 5 last years (+29%).
UNICEF: 4th partner of DG ECHO in 2010. Contribution agreements signed with UNICEF represented 5.5% of the total amount contracted in 2010. During the year, funding was mainly used in the field of nutrition, including for instance therapeutic or supplementary feeding (39%). The amount awarded in 2010 (€ 58.9 million) is significantly above the average contribution over a 5-year period (+57%).
FAO: This agency is DG ECHO 8th largest partner and accounts for 2% of DG ECHO's amount contracted. Since 2006, there has been an upwards trend in funding FAO; the amount awarded in 2010 is above the average contribution over the last five years (+16%). The main sector of intervention is food assistance, accounting for 79% of the total amount funded by the EU to FAO.
UNRWA: (9th ECHO's partner) was awarded €20.7 million mainly for food assistance activities. Over a 5-year period, the 2010 contribution is below the average contribution (-14%).
OCHA: agreements signed in 2010 represent 1.4% of the total agreements signed by DG ECHO and is an increase compared to 2009 and 2008, allowing reaching the highest level of funding since 2003. OCHA is the 20th partner of DG ECHO. Most of the funding was for coordination (93%) and the balance for disaster preparedness activities.
WHO: received €9.8 million in 2010 which represents a very slight decrease compared with 2009. The general trend over 5 years is downwards and the amounts funded as from 2008 are below the average. WHO is particularly involved in health and medical projects, representing 52% of its funding. The sector of nutrition, therapeutic feeding – linked to health – represents an additional 30% of WHO's funding. WHO is the 24th of all ECHO's partners.
UNDP: is ranked at the 54th position of ECHO partners. In 2010, funding was mainly used for disaster preparedness activities (48% of the total agreements signed with DG ECHO). Contributions vary from one year to another. EU's contribution in 2010 was €3.9 million, significantly below the average contribution given over a five year period (-34%).
UNOPS and UNISDR, respectively at 25th and 65th position, are new partners of ECHO in 2010 representing together 1% of the total amount contracted in 2010.
PAHO, UNFPA, UNCHS-HABITAT, UNESCO and UNESCAP are less frequent partners of DG ECHO. With the exception of UNESCAP, they have all signed contribution agreements in 2010.

Together they represent less than 2% of the contributions awarded by the EU to UN organisations in 2010 in terms of humanitarian assistance.
6. AID EFFECTIVENESS
6.1. Strategic Dialogues
DG ECHO has developed increasingly close working relationships with its partners at the level of both policy issues and management of humanitarian operations, with the aim to improve the quality of aid delivery.
DG ECHO continued also to promote EU-coordinated positions, resolutions and statements in UN bodies reflecting Commission policy.
In order to ensure a strategic and worthwhile dialogue between DG ECHO and UN organisations amongst others, regular high-level meetings and Strategic Dialogues (SDs) are organised with certain UN partners. In addition to dialogues at technical and field level, the regular SD represents an opportunity for DG ECHO to exchange views on key issues and developments with its main partners.
DG ECHO participates actively in the OCHA Donor Support Group through which main donors provide strategic advice to the organisation.
The European Union represented by DG ECHO is a permanent observer in the WFP Executive Board. A Memorandum of Understanding on the strategic partnership between the European Commission and WFP was signed in 2005. A high-level Strategic Dialogue is organised on an annual basis.
Finally, DG ECHO is an observer in the UNHCR's Executive Committee.
Participating in such meetings allowed DG ECHO to provide inputs to strategic decision making and guidance at these organisations.
6.2. Needs assessment
The Commission has been actively engaged in debates on setting-up better co-ordinated, more coherent common needs assessment.
During last 2 years, the issue of needs assessment has risen to the very top of the agenda in inter-agency discussions and in contacts between major humanitarian actors and donors. DG ECHO was instrumental in this, by putting needs assessment at the heart of its Co-Chairmanship of GHD and regular update of the COHAFA.
During 2010, the DG ECHO has pursued its active engagement in debates on setting-up better co-ordinated, more coherent common needs assessment. The EU delegation has participated in the work of the IASC Needs Assessment Task Force (NATF) and has contributed to a number of concrete activities i.e. the humanitarian dashboard roll-out efforts. An update on Common Methodological Framework for Needs Assessment has been provided by the EC to COHAFA meeting on 12 February 2010, where DG ECHO listed the recent positive developments on the work in this area but expressed the needs for Humanitarian donors to stay focussed on the process.
DG ECHO has pushed consistently for progress on ongoing OCHA-led work to finalize and roll out the dashboard, and to build capacity for reliable and (where possible) Joint/common needs assessment. All other major donors have fully subscribed to these objectives.

Progress has been made on making needs assessment more credible and more joined-up. The IASC Needs Assessment Task Force (NATF) has approved a package of guidance and tools designed to support a coordinated approach to assessments in emergencies. These include: (a) Operational Guidance on Coordinated Assessments in Emergencies, (b) Key Humanitarian Indicators and Guidance, (c) Multi-Cluster Initial and Rapid Assessment Methodology and (MIRA) (d) the Humanitarian Dashboard.
6.3. Capacity building
The Commission's commitment to working closely with international institutions in improving the global humanitarian response capacity in providing humanitarian assistance is demonstrated through its capacity building/thematic funding programme.
Funding allocations have helped aid organisations such as the UN organisations to strengthen their response capacity in humanitarian crises. In 2010, € 15 million were made available for EU humanitarian capacity building funding, of which € 13 million was allocated to UN organisations, with the aim of strengthening the global humanitarian preparedness and response capacity in the following areas:
– Humanitarian coordination, supporting the overall humanitarian coordination structures and specific cluster coordination structures, including support in the increasingly important area of civil-military coordination through UNOCHA;
– Continued support to ensure more consistent use of joint/common needs assessments;
– Logistics support, mainly through the UN World Food Programme (WFP), for building up and running strategic humanitarian response hubs with pre-positioned relief items, and greater capacity to deploy appropriate personnel to coordinate and execute cluster operations;
– Gender, through support to the UN Population Fund (UNFPA) together with the UN High Commissioner for Refugees (UNHCR) and UNICEF for joint action to build the knowledge and capacity of field humanitarian actors to address sexual and gender-based violence in a coordinated way;
– Emergency preparedness, disaster risk reduction and early warning, for example through the UNISDR, for strengthening partnerships to expedite implementation of the Hyogo Framework for Action (HFA);
– Coordination in the food and nutrition sectors, not least through establishment of the new Global Emergency Food Security Cluster and the Global Nutrition Cluster, as well as to the roll-out of the Humanitarian Food Assistance Policy through building partners' capacity in cash transfer programming.

7. MANAGEMENT SYSTEMS GOVERNING RELATIONS WITH UN ORGANISATIONS
The management system governing relations with UN organisations is "Joint management". This means that certain implementation tasks are delegated to the partner, in accordance with the implementing rules, in the following cases:
– Wherever the Commission and its UN partner are bound by a long-term framework agreement laying down the administrative and financial arrangements for their cooperation,
– Wherever the Commission and its UN partner elaborate a joint project or programme, – Where the funds of several donors are pooled and are not earmarked for specific items or categories
of expenditure ("multi-donor actions"). In DG ECHO, the budget under joint management is implemented through funding decisions, which are translated into one or more contribution agreements awarded to UN organisations who have signed the FAFA (UN). These agreements implement the objectives of a decision.
Due to the nature of humanitarian crises and their volatility, agreements are normally short-term in character, between 3 and 12 months, to enable DG ECHO to respond to quickly changing circumstances.
8. CONTROLS ON THE USE OF FUNDS
In recognition of the governing arrangements for joint management and the signature by the UN and EC of the Financial and Administrative Framework (FAFA) with, inter alia, a number of UN organisations, the Commission assures itself that the international organisations' control systems meet international standards. This is also known as the "four pillar" exercise because it covers four main areas of control: accounting, audit, internal control and procurement (article 53d Financial Regulation).
Some examples of controls carried out by DG ECHO:
DETECTIVE AND CORRECTIVE CONTROLS
During the implementation period of projects, a range of controls is foreseen to prevent errors and/or to correct them.
• Controls before signature of contribution agreement
o All project proposals are analysed by field experts and operational desks. Particular attention is paid to the definition of the specific objectives, expected results and indicators for each project;
o Draft contribution agreements are double-checked by both operational desk officers and by financial desk officers.
These checks are formalised through the use of operational and financial checklists to ensure that the contribution agreements comply with the financial rules, with DG ECHO regulatory terms and conditions and are recorded correctly in the accounting system.

• Checks and monitoring during the initial phases of the project
The main checks and monitoring performed by DG ECHO can be described as follows: o DG ECHO carries out regular controls of progress of projects. Throughout the whole project
cycle, each project is monitored by the desk and field expert via a project appraisal worksheet ("fichop");
o Project monitoring through a network of DG ECHO field experts (technical assistants) worldwide. These specialists are based in the field in order to facilitate and maximise the impact of the operations funded by the European Commission, regardless of the country or regions where the project is implemented. They monitor closely the projects and establish regular reports;
o Regular field visits of projects by geographical desks, controllers/verifiers and DG ECHO Management.
• Checks and monitoring during the final/closure phases of the project
As already mentioned above, DG ECHO's partners have the obligation to produce intermediate and final reports and to justify their expenses. These reports are analysed thoroughly by both DG ECHO's operational and financial desk officers, in order to ensure that the project has achieved the expected results and to control eligibility of expenditure. Various procedures, such as the use of check-lists and double checking, have been set up to ensure that final payments are in conformity with the financial rules, comply with sound financial management and are recorded correctly in the accounting system of the European Commission.
VERIFICATIONS:
EU-funded humanitarian aid activities implemented by UN organisations are subject to verification missions. These missions are carried out in accordance with the verification clause of the FAFA and meet the Standard Terms of Reference (ToRs) for verifications.
The standard ToRs adopted by the UN and the EC in July 2009 are adhered to as a matter of fact to when undertaking UN verifications. The issuance of these standard ToRs facilitated the undertaking of DG ECHO field verifications.
During 2010, no UN HQ verification visits took place but field verification visits were carried out in – Somalia (FAO), – Haití (UN OPS); – Ecuador/Peru/Chile/Colombia (UNESCO); – Peru (UNDP); – Chad (WFP) – Nepal (UNICEF) and – Central African Republic (OCHA).
Furthermore, the verification reports outstanding from 2009 have been finalised.
The Unit C/2 of DG ECHO summarised the results of DG ECHO's UN verifications and were reported to DG ECHO management. This report was finalised in the first quarter of 2011.
In the framework of the 2010 Declaration of Assurance (DAS), the European Court of Auditors have sampled four payments to WFP for control. Support was given by DG ECHO for the Court's visit to WFP and a draft report was received short before Christmas. The findings of the EAS of verifications carried out in 2008 / 2009 were confirmed by the Court and the outcome of this report shows that there is room

for further clarification of the agreed Terms of Reference and the verification clause. Therefore, the Commission continues to explore with the UN organisations, the measures which can and should be taken to reinforce and enhance assurance gained from existing checks including verifications.
During 2010 discussions started with WFP in making internal audit reports available to DG ECHO and where appropriate for WFP to undertake audits on EU funded projects based on an agreed common methodology. It is expected to get first results in the course of 2011. By responding in this way to the higher scrutiny of the ECA and the European Parliament on the EC-UN Partnership this is seen as an important confidence building-measure.
The European Court of Auditors has also undertaken an audit on the methodology applied by the EAS of the verifications of the UN-Family. The report has been finalised in 2009 and was made publicly available in January 2011. The outcome of this report confirms the results of the DAS 2010 audit.
EVALUATIONS:
DG ECHO has an evaluation programme which covers the evaluation of operations, partnerships and thematic issues. It focuses on ex-post, ex-ante and real time evaluations of operations (usually where more than €50 million have been committed or those which had not been evaluated for three years or more as far as the ex-post evaluations are concerned, and depending on operational priorities for the others) and on reviews/studies on sectoral issues. Such evaluations are an opportunity to learn lessons and improve overall effectiveness of aid. They globally confirm the appropriateness and relevance of EU funded projects and of the methodology for needs assessment. Evaluation reports are widely distributed and discussed in depth with stakeholders as they provide an important contribution to DG ECHO's operational strategy. During the last few years, the following UN organisations were evaluated: UNRWA in 2009, UNHCR in 2005, UNICEF in 2004 and WFP in 2002. 9.6. UN organisations and food aid
In line with the Commission's communication which has established the principle of "one instrument per policy area" so as to improve the efficiency of Community action as well as the Commission's communication on the financial perspectives 2007-2013, the responsibility for the management of humanitarian food aid was transferred from EuropeAid Cooperation Office (DEVCO) to DG ECHO, with effect from 1 January 2007.
Since then, DG ECHO manages the full portfolio of humanitarian aid, all actions being within the framework of its mandate to save and preserve life during emergencies and their immediate aftermath. The principle of needs assessment is applied to all interventions initiated by DG ECHO, be it food aid or humanitarian aid.
The link between emergency food aid and humanitarian assistance allows better coordination of short-term food security and food aid.
The need for humanitarian food aid continues to increase. Since the steep increase in food prices in 2008, international food prices have slightly declined but remain above past years' average.
However, needs continue to increase, with a higher number of natural disasters affecting more and more people, eroding their coping capacity further. In addition, food prices at the point of delivery in most food insecure countries remain high, which in turn keeps the cost of humanitarian food operations high and increases the number of vulnerable persons. Increased aid needs are also compounded by implementation difficulties in some countries.
Therefore, food aid continued to concentrate resources on the most immediate life-saving interventions, in order to respond to well-defined life-threatening risks and to support the most appropriate and effective combination of response options and tools. Global interest in addressing malnutrition increased in 2010, recognizing that the problem has to be tackled in a comprehensive manner, from both the humanitarian and development angles, and applying a multi-sectoral approach (health, food security, water and sanitation, etc).

At the end of 2010, the food aid budget line totalled €235 million. Besides the food aid budget line, food aid agreements are also funded under the main humanitarian aid budget line which has a substantial food component.
As a whole, the largest share of funding is for food with 39% of the total budget managed by DG ECHO.
Of this amount, the share of contribution agreements signed with UN organisations is 55% (or €232.5 million), the balance being shared between NGOs. The table below shows the share of UN organisations in the total amount awarded during the year with and without food aid.
