INTRODUCTION The Land Surveyors Licensing Board of Western Australia (the Board) is constituted under Section 4 of the Licensed Surveyors Act 1909 (the Act). In accordance with Section 25C of the Act the Board has prepared the following report of its activities for the year ending 31 December 2019.

THE BOARD The Board has six members. The Surveyor General is ex officio with one member nominated by the Chief Executive of Landgate to represent interests in relation to land registration matters. The WA Division of the Institution of Surveyors Australia nominates two members. The Minister nominates a member to represent the interests of the consumers of surveyors’ services and one member is nominated by Curtin University as the approved tertiary education institution offering a relevant undergraduate course in surveying.

CHARTER OF THE BOARD Land Boundary certainty is essential to a secure sustainable and cost-effective land tenure system. The community is entitled to the highest confidence in the training, qualification, skill and accountability of licensed surveyors who are responsible for the determination of land boundaries.

• To ensure that the education and training of licensed land surveyors state-wide isdemonstrably able to meet the community expectations of the land titling system.

• To ensure that the practice standards of licensed land surveyors meet the expectationand requirements of the community and the registering authority.

• To provide a fair, open and accessible process to deal with complaints against licensedland surveyors to the extent that the occurrence and impact of breaches of the Act areminimised.

To achieve these objectives the Board will effectively engage with government, industry, education and the community through the processes of:

• Setting and monitoring education standards of candidates seeking registration as licensedsurveyors

• Setting and monitoring training requirements of candidates for registration as licensedsurveyors.

• Demonstrating the adequacy of education and training through the process ofexamination.

• Setting and monitoring standards for the continuous professional development of licensedland surveyors.

• Consultatively developing and regulating standards to enable licensed surveyors’practices to meet community and registering requirements.

• Acting in the community interest when breaches of Acts and Regulations are found.• Maintaining reciprocity of registration throughout Australia and New Zealand.

CHAIRMAN’S REPORT

General

2019 was a very busy year starting with the retirement of Licensed Surveyor Graeme Holloway after 6 years as Secretary to the Board and over 35 years as a Licensed Surveyor. The Board thanks Graeme for the professionalism and technical expertise that he brought to the position of Secretary.

The Board welcomed a new Secretary – Craig Madden. Craig is the first Secretary to the Board who is not a Licensed Surveyor. Craig has brought additional skills to the position. He has over 14 years’ experience as a Company Director and is a Fellow of the Australian Institute of Company Directors.

The Board undertook a significant technological and digital upgrade during 2019. The major projects included: an overhaul and re-fresh of our website; the introduction of digital accounting, invoicing and pay-roll; and improved digital security and functionality for Board papers and documents. Future plans include development of a Customer Relationship Management (CRM) software which will include a Portal for Surveyors and Graduates through the website to enable actions such as application for annual Practicing Certificates and recording of Continuous Professional Development to be done more efficiently and effectively.

The annual Professional Training Agreement (PTA) seminar run by the Board took a new and fresh approach in 2019. The day commenced with a 90 minute pre-event breakfast for Supervisor Licensed Surveyors. This pre-event allowed, for the first time, targeted presentations to Supervisors; the opportunity for the Board to hear and understand specific issues faced by Supervisors; and the ability for Supervisors to network. Feedback from the pre-event was very positive with a unanimous request to hold such an event again in 2020.

The PTA seminar was attend by 20 Graduates and had the theme of ‘Professionalism in the Profession’. The agenda included guest presenters on the topics of Professionalism and Leadership. Additionally graduates were given advice on the standards required in Board examinations and projects. The day ended with a presentation from a recently appointed Licensed Surveyor who spoke about ‘Tips on a successful PTA and passing examinations’.

2019 also saw the completion of a comprehensive review of the Board’s Special Survey Area Guidelines. These Guidelines underpin the subdivision of greenfields land development in Western Australia, and enable the profession to make a significant contribution to the timely and economically viable release of land.

Through the Chairman, the Board also contributed to the Surveyors Working Group advising Landgate on the formulation of the Regulations to support the amended Strata Titles Act.

Investigations and enquiries undertaken by the Board

The Board received five formal complaints for the year. The Board dismissed two complaints as not falling under the Board’s jurisdiction; no complaints were referred to the State Administrative Tribunal, and three complaints were carried over to 2020.

The Board and Landgate continued to operate together under a Memorandum of Understanding (MoU) by which Landgate provides a full time Secretary, corporate services and separate office accommodation that is readily accessible to the public. The MoU was reviewed and updated in October 2018. The Board believes this working arrangement continues to enhance the effective administration of the Act and thanks the Chief Executive of Landgate for his commitment and the ongoing assistance of Landgate’s professional officers.

Trends

The decline in the number of licensed surveyors with Practising Certificates continued with 16 licensed surveyors from 2018 choosing not to renew their Practising Certificates for 2019. With the current age profile of licensed land surveyors skewed towards an age where retirement is an option, and the current economic environment in WA, this decline is expected to continue for several more years. On a positive note, the increase in numbers of surveyors under a training agreement provides expectation of some renewal in the coming years.

The LSLB is also actively working with industry groups in promoting the surveying profession within schools and career advisors, as well as increasing the awareness of STEM related learning in general.

FINANCE

A copy of the audited Financial Statement is included at Appendix A. The Board’s Auditor is Mr Dennis Yagmich of DB Yagmich & Co, 14 The Avenue, Midland WA 6056.

TRAINING AND REGISTRATION As at 31 December 2019, there were 660 licensed land surveyors on the register. The complete register is included in this report at Appendix B. 211 of the licensed land surveyors held a 2019 Practising Certificate. 205 of the practising licensed land surveyors were resident in Western Australia.

During 2019, no land surveyors were added to the register by way of practical examination. Two were added under reciprocal arrangements with other jurisdictions. Two licensed surveyors were removed from the register under section 14 (4) of the Act. As at 31 December 2019, there were 42 Professional Training Agreements (PTA) registered by the Board. Thirteen new PTAs were registered in 2019.

PERFORMANCE INDICATORS As part of a comprehensive strategic review, the Board has adopted the following performance indicators to ensure it is meeting its charter obligations to the community of Western Australia.

Objective: To ensure that the education and training of licensed land surveyors is demonstrably able to meet the community expectations of the land titling system.

Process

• Setting and monitoring education standards of candidates seeking registration as licensed land surveyors.

• Setting and monitoring training requirements of candidates for registration as licensed land surveyors.

• Demonstrating the adequacy of education and training through the process of examination.

Performance Indicator

• That the requisition rate for newly licensed land surveyors in the first year of registration does not exceed the industry average. This performance indicator has been met.

• The Board’s examination process is formally reviewed on a regular basis not exceeding three years. This performance indicator has been met. In years where formal reviews are not conducted, the Board constantly monitors the relevance of examination subjects and considers feedback from all sources.

• Each candidate is interviewed by the subject examiners to provide feedback and professional guidance. This performance indicator continues to be met with graduates offered an opportunity at the end of each exam round to receive feedback on their performance in the exams.

• Consultatively developing and regulating standards to enable land surveyors practices to meet community and registering requirements.

• Maintaining reciprocity of registration throughout Australia and New Zealand.

Performance Indicator

• In that the rate of serious requisitions on deposited plans does not exceed 3%. This performance indicator was met to the extent that advice from the survey auditors of Landgate showed a serious requisition rate of 0.23% for Crown deposited plans, 0.23% for freehold deposited plans and 0.11% for strata plans.

• Licensed land surveyors whose requisition rates are in the highest quartile shall be directed to demonstrate improvement of their business practices. Three licensed land surveyors were required to demonstrate improvement in their business practices.

• Licensed land surveyors who fail to meet performance requirements in successive reporting cycles will be required to demonstrate why their practising certificate should not be modified or withdrawn. No licensed land surveyors were required to demonstrate why their practising certificate should not be modified or withdrawn.

• The annual report of the Board will specifically address issues and trends relating to training, licensing and specific education. This performance indicator is addressed in this annual report.

• The Board will invite the Chief Executive of Landgate and a representative of the Department of Mines, Industry Regulation and Safety to advise on matters of concern on a regular basis. This performance indicator is being met to the extent that the Chief Executive of Landgate and a representative of the Department of Mines, Industry Regulation and Safety have an open invitation to Board meetings.

• The Board will assist the Minister in the nomination of a person to represent the interests of the consumers of land surveyors services. This performance indicator was met with Ms Rachel Chapman appointed as a member of the Board to represent consumers.

• The Board will actively participate in the professional forum of the Surveying and Spatial Sciences Institute and WA Institution of Surveyors. This performance indicator was met by Board members and the Secretary regularly addressing continuing professional development seminars, cadastral workshops and cadastral interest groups.

• The Board will encourage and support an annual regional conference of licensed land surveyors. This performance indicator was met by the Board attending a one-day conference in Bunbury. There were over 50 local land surveyors present.

• The Board actively supports the role of CRSBANZ to the extent that the Chairman or nominee attends each meeting. This performance indicator was met with the Chairman participating in all programmed meetings via teleconference and attending in person.

• The Board allocates adequate policy development and administrative resources to support the objectives of the CRSBANZ. This performance indicator was met by Board Members and the Secretary providing CRSBANZ with the support required to achieve its objectives.

• All applications for letters of accreditation and incoming registrations are dealt with at the first available Board meeting. This performance indicator was met.

• The register of licensed land surveyors be available on the Board’s website and be available for inspection at the Board’s office. This performance indicator continues to be met.

• Amendments to the register are made within three working days of Board authorisation. This performance indicator continues to be met.

• The Board will maintain a website providing information to the public on the process of lodging a complaint. This performance indicator continues to be met.

• All cases are dealt with in accordance with the published policy. This performance indicator was met.

• Each complaint is considered at the first possible Board meeting. This performance indicator was met.

• A decision for a referral to the State Administrative Tribunal (SAT) is dealt within two (2) months of the first consideration by the Board. This performance indicator was not met due to outstanding legal matters that had to be considered.

Sydney Stokes Award

This award made by the Board, honours Sydney John Stokes who was a member and Secretary of the Board for 37 years from January 1948 until December 1984. It recognises achievement of the high standard of excellence and professionalism demanded by Sydney.

The award is made to a graduate who has an excellent performance in all aspects of the examination and the professional interview.

It was not awarded in 2019.

Larry Heavey Prize

This prize awarded by the Land Surveying Commission of the Surveying and Spatial Sciences Institute (SSSI), recognises the career of Larry Heavey. Larry in 1970, was appointed to the position of Inspecting Surveyor, and in 1986 became Manager of the Survey Inspection Section in the Department of Land Administration. In these roles, he dedicated his life to the art and science of cadastral surveying and was a tireless contributor to the long-term success of the cadastral system in this state.

The prize is awarded to a graduate that shows excellence in the Field Survey and Practical Levelling examination.

It was not awarded in 2019.

Malcolm Evensen Prize This prize awarded by the Land Surveying Commission of SSSI, recognises the outstanding career of Malcolm Evensen. Malcolm was a long serving survey examiner in the Department of Lands and Surveys, Land Administration and finally Land Information. The integrity of this state’s cadastral system is due in no small part to Malcolm’s dedication and the strong alliance he fostered with practising land surveyors. The prize is awarded to a graduate and supervising surveyor presenting an outstanding urban cadastral project as part of the Board’s examinations. It was not awarded in 2019.

Neil Browne Prize This prize awarded by the Board, recognises the career and public service of Neil Browne. Neil, a member of the Board from 2000 to 2008, was elected as a representative of the members of the Institution of Surveyors WA. In 2005 Neil was elected the first non-government Chairman of the Board since its establishment in 1886. Both the community and practising land surveyors were well served by Neil’s expertise, his practicality and his articulate communication skills. The prize is awarded to a graduate and supervising surveyor presenting an outstanding rural cadastral project as part of the Board’s examinations. It was not awarded in 2019.

Independent Audit Report

To the members of Land Surveyors Licensing Board of Western Australia

We have audited the accompanying financial report, being a special purpose financial report, of the Land Surveyors Licensing Board of Western Australia, which comprises the Detailed Balance Sheet as at 31 December 2019, the Income and Expenditure Statement for the year then ended, notes comprising a summary of significant accounting policies and other explanatory information and the board declaration statement.

The board's responsibility for the financial report

The board are responsible for the preparation and presentation of the financial report and have determined that the basis of preparation described in Note 1 is appropriate to meet its requirements. The board's responsibility also includes such internal controls as the board determine is necessary to enable the preparation and fair presentation of a financial report that is free from material misstatement, whether due to fraud or error.

Auditor's responsibility

Our responsibility is to express an opinion on the financial report based on our audit. We have conducted our audit in accordance with Australian Accounting Standards. Those standards require that we comply with relevant ethical requirements relating to audit engagements and plan and perform the audit to obtain reasonable assurance whether the financial report is free from material misstatement.

We have conducted an independent audit of the statement of income and expenditure in order to express an opinion to the Minister of Lands on its preparation and presentation. No opinion is expressed as to whether the statement is appropriate to the needs of the Minister. The statement of income and expenditure has been prepared for submission to the Minister for Lands for the purpose of fulfilling the financial reporting requirements of the Licensed Surveyors' Act 1909. We disclaim any assumption of responsibility for any reliance on this report or on the statement of income and expenditure to which it relates to any person other than the Minister for Lands, or for any purpose other than that for which the report was prepared.

An audit involves performing procedures to obtain audit evidence about amounts and disclosures in the financial report. The procedures selected depend on the auditor's judgement, including the assessment of the risks of material misstatement of the financial report, whether due to fraud or error. In making those risk assessments, the auditor considers internal control relevant to the entity's preparation of the financial report in order to design audit procedures that are appropriate in the circumstances, but not for the purpose of expressing an opinion on the effectiveness of the entity's internal control. An audit also includes evaluating the appropriateness of accounting policies used and the reasonableness of accounting estimates made by the board, as well as evaluating the overall presentation of the financial report.

We believe that the audit evidence we have obtained is sufficient and appropriate to provide a basis for our audit opinion.

Independence

In conducting our audit, we have complied with the independence requirements of the Australian professional accounting bodies.

Opinion

In our opinion, the financial report presents fairly, in all material respects, the Detailed Balance Sheet of the Land Surveyors Licensing Board of Western Australia as at 31 December 2019, showing Total Members' Funds of $89,734, and its Income and Expenditure Statement for the year then ended on that date, showing a deficit of $30,370. It complies with Australian Accounting Standards to the extent mentioned in Note 1.

Notes to the Financial Statements For the year ended 31 December 2019

Note 1: Summary of Significant Accounting Policies

This financial report is a special purpose financial report prepared in order to satisfy the financial reporting requirements of the Associations Incorporations Act. The committee has determined that the association is not a reporting entity.

The financial report has been prepared on an accrual basis and is based on historical costs and does not take into account changing money values or, except where specifically stated, current valuations of non-current assets.

The following significant accounting policies, which are consistent with the previous period unless otherwise stated, have been adopted in the preparation of this financial report.

(a) Receivables

Accounts receivable and other debtors include amounts due from members as well as amounts receivable from donors. Receivables expected to be collected within 12 months of the end of the reporting period are classified as current assets. All other receivables are classified as non-current assets.

(b) Cash and Cash Equivalents

Cash and cash equivalents include cash on hand, deposits held at call with banks, and other short-term highly liquid investments with original maturities of three months or less.

(c) Revenue and Other Income

Revenue is measured at the fair value of the consideration received or receivable after taking into account any trade discounts and volume rebates all owed. For this purpose, deferred consideration is not discounted to present values when recognising revenue.

Interest revenue is recognised using the effective interest rate method, which for floating rate financial assets is the rate inherent in the instrument. Dividend revenue is recognised when the right to receive a dividend has been established.

Grant and donation income is recognised when the entity obtains control over the funds, which is generally at the time of receipt.

All revenue is stated net of the amount of goods and services tax (GST).

(d) Goods and Services Tax (GST)

Revenues, expenses and assets are recognised net of the amount of GST, except where the amount of GST incurred is not recoverable from the Tax Office. In these circumstances, the GST is recognised as part of the cost of acquisition of the asset or as part of an item of the expense. Receivables and payables in the assets and liabilities statement are shown inclusive of GST.

(e) Trade and Other Payables

Trade and other payables represent the liability outstanding at the end of the reporting period for goods and services received by the association during the reporting period, which remain unpaid. The balance is recognised as a current liability with the amounts normally paid within 30 days of recognition of the liability.
