promotion of optimum inter-sectoral

relationship; ·

(vi) Promotion of export-oriented industries;

(vii) Promotion of economic federalism

through equitable spread of investment

and dispersal of returns; and

(viii) Consumer protection against high prices

and bad quality

Noting the erosion in people's faith in the public

sector. it was decided to launch a drive to revive

the efficiency of public sector undertakings through

a time bound programme of corrective action on a

unit by unit basis. Effective steps would also be

taken to develop the management cadres of public

sector undertakings in functional fields such as

operations, finance. marketing and information

system.

In order to eliminate the artificial distinction of

conflicting interests between small and large scale

industry. the concept of economic federalism would

be promoted through the setting up of a few nucleus

plants in identified indu~trially backward districts.

The nucleus plant would concentrate on

assembling the products of the ancillary units falling

within its orbit, on producing inputs needed by a

large number of smaller units and making adequate

marketing arrangements. The nucleus plant would

also wor" ior upgrading the technoiogy of small

units. The Government would promote the

development ofa system of linkages between nucleus large plants and the satellite ancillaries.

To boost the development of small scale

industries, the investment limit in ihe case of tiny

units was enhanced to Rs.2 lakh, of a small scale

units to Rs.20 lakh and of ancillaries to Rs.25 lakh.

A scheme for building buffer stocks of essential

raw materials for the Small Scale Industries was

introduced for operation through the Small

Industries Development Corporations in the States

and the National Small Industries Corporation in the

Centre.

In order to ensure fullest utilisation of existing

industrial capacities, particularly in core industries

and in industries with a long term export potential,

the facility of automatic expansion of capacity of

5% per annum or 25% in a five year plan period to

be taken in one or more stages was permitted to all

Appendix I Industries. Requests for setting up 100%

export oriented units and for expansion of existing

units for purposes of export would also be

considered sympathetically.

Industrial processes and technologies aimed at optimum utilisation of energy or the exploitation of

alternative sources of energy would be given special

assistance, including finance on concessionaltcrms.

Similar benefits would be given to activities that

contribute directly to the improvement of the

environment and reduce the deleterious effects on

pollution of air and water.

Industrial Licensing Policy

i) Industrial Licensing will be abolished for all projects except for a short list of industries related to security and strategic concerns, social reasons, hazardous chemicals and overriding environmental reasons, and items of elitist consumption (list attached as

Annex II). Industries reversed for the small-scale sector will continue to be so reversed. ii) Areas where security and strategic concerns predominate will continue to be reversed

for the public sector (list attached as Annex I). iii) In projects where imported capital goods are requin:d, automatic clearance will be

given. (a) In cases where foreign exchange availability is ensured through foreign equity. or b) If the CIF value of imported capital goods required is less than 25% of total value (net of taxes) of plant and equipment, up to a minimum value of Rs.2 crore. In view current difficult foreign exchange situation, this scheme (i.e. (iii) b) will come into force from April, 1992 In other cases. imports of capital goods will require clearance from the Secretariat of Industrial Approvals (SIA) in the development according to availability of foreign exchange resources.

iv) In locations other than cities of more than one million populations, there will be no requirement of obtaining industrial approvals from the Central Government excepts for industries subject to compulsory licensing. In respect of cities with population greater than I million. Industries other than non-polluting nature such as electronics, computer software and printing will be located outside 25 Kms. Of the periphery, except in prior designated industrial areas. A flexible location policy would be adopted in respect of such cities (with population greater than I million), which require industrial re-generation Zoning and Land Use Regulation and Environmental regulation will continue to

regulate industrial locations. Appropriate incentives and the design of investments in infrastructure development will be used to promote the dispersal of industry particularly to rural and backward areas and to reduce congestion in cities.

v) The system of phased manufacturing programmes run on an administrative case by case basis will not be applicable to new projects. Existing projects with such programmes will continue to be governed by them.

vi) Existing units will be provided a new broad banding facility to enable them to produce any article without additional investment

vii) The exemption from licensing will apply to all substantial expansions of existing units. viii) The mandatory convertibility clause will no longer be applicable for term loans from

the financial institutions for new projects.

Procedural consequences

i:\) All existing registration schemes (Delicensed Registration, DGTD registration) will be abolished.

x) Entrepreneurs will hence forth only be required to file an information memorandum on new projects and substantial expansion

1) Appro,·al "ill be given for direct foreign investment up to 51 percent foreign equity in high priority industries (Annex-Ill). There shall be no bottleneck of any kind in this process. Such clearance will be available if foreign equity covers the foreign exchange requirement for imported capital goods. Consequential amendments to the Foreign Exchange Regulation Act ( 1973) shall be carried out.

1i 1 While the imported of components. raw materials and intermediate goods, and payment of know how fees and royalties will be governed by the general policy applicable to other domestic units. the payment of other dividends would be monitored through the Reserve Bank of India so as to ensure that outflows on account of dividend payments are balanced by export earnings over a period of time.

iii) Other equity proposals. including proposals involving 51%foreign equity which do not meet the criteria under (i) above. will continue to need prior clearance. Foreign equity proposals need not necessarily be accompanied by foreign technology agreements.

iv) To provide access to international markets, majority foreign equity holding up to 51% equity will be allowed for trading companies primarily engaged in export activities. While the thrust would be on export activities, such trading houses shall beat par with domestic trading and export houses in accordance with Import-Export Policy.

v) A special Empowered Board would be constituted to negotiate with a number of large international finns and approve direct foreign investment in select areas. This would be a special programme to attract substantial investment that would provide access to high technology and world markets. The investment programmes of such firms would be considered in totality. free from pre-determined parameters or producers.

C. Foreign Technology Agreements

i) Automatic permission will be given for foreign technology agreements in high priority industries (Annex Ill) up to a lump sum payment of Rs. I crore, 5% royalty for domestic sales and 8% for exports, subject to total payments of 8% of sales over I 0 year period from date of agreement or 7 years from commencement of production. The prescribed royalty rates are not of taxes and will be calculated according to standard procedures.

ii) In respect of industries other than those in Annex III, automatic permission will be given subject to the same guidelines as above if no free foreign exchange is required for any payments.

iii) All other proposals will need specific approval under the general procedures in force. iv) No permission will be necessary for hiring of foreign technicians foreign testing of

indigenously developed technologies. Payment may be made from blanket permits or free foreign exchange according to RBI guideline.

D. Public Sector

i) Portfolio of public sector investments will be reviewed with a view to focus the public sector on strategic. high-tech and essential infrastructure. Whereas some reservation for the public sector is being retained there would be no bar for areas of exclusivity to open up to the private sector selectively. Similarly the public sector will also be allowed entry in areas not reserved for it.

ii) Public enterprises which are chronically sick and which are unlikely to be turned around will. for the formulation of revival\rehabilitation schemes, be referred to the Board for Industrial and Financial Reconstruction (BIFR), or other similar high level institutions created for the purpose. A social security mechanism will be created to protect the interests of workers likely to be affected by such rehabilitation packages.

iii) In order to raise resources and encourage wider public participation, a part of the government's shareholding in the public sector would be offered to mutual funds. financial institutions, general and public workers.

iv) Board of public sector companies would be made more professional and given greater powers.

v) There will be greater thrust on performance improvement through the Memoranda of Understanding (MOU) system through which managements would be granted greater autonomy and will be held accountable. Technical expertise on the part of the Government would be upgraded to make the MOU negotiations and implementation more effective.

vi) The facilitate a fuller discussion a fuller discussion on perforn1ance the MOC singed between Government and the public enterprise would be placed in parliament while focusing on major management issues. this would also help place matters on day operations of pub18c enterprises in their correct perspective.

E. MRTP Act

i) The MRTP Act will be amended to remove the threshold limits of assets in respect of MRTP companies and dominant undertakings. This eliminates the requirement of prior approval of Central Government fo!· establishment of new undertakings, expansion of undertakings. merger. amalgamation and takeover and appointment of Directors under certain circumstances.

ii) Expansion will be placed on controlling and regulating monopolistic, restrictive and unfair trade practices. Simultaneously, the newly empowered MRTP Commission will be authorized to initiate investigations .tuo mota or on complaints received from individual consumers or classes of consumers in regard to monopolistic, restrictive and unfair trade practices.

iii) Necessary comprehensive amendments will be made in the MRTP Act in this regard for enabling the MRTP Commission to exercise punitive and compensatory powers.

The industrial undertakings shall also file another memorandum in prescribed form with the SIA at the time of commencement of commercial production. No payment will accomjl:rny this rncnul· randum.

7. NEW CLASSIFICATION SYSTEM

Industries under compulsory licensing have been notified in the Indian Trade Classification System. Entrepreneurs may note that the description of article(s) to be manufactured should be stated according to this classification in the application for industrial licences. Similarly. in the memoranda to be tiled with the SIA in respect of articles not covered by industrial licensing. the, description of the articles should be given according to the Indian Trade Classification (Based on Harm9n!scd Commodity Descrtption and Coding System). rublishcd by the Ministry of~~mmerce. Directorate General or Commercial lntellrgcrKC and Statistics. Calcutta.

Consequent on issue of Notification No. 477 (E)

dated 25.7.1991, all pending applications for issue of Letters of Intent will be scrutinised by the Sf!\ in the light of the notification. Those qualifying for exemption from licensing will not be processed further and the applicants would be advised to file memoranda as in para 6 above. A similar procedure would be followed in respect of applications for DLR, EJR and registrations with DGTD or other authority.

1 t. PENDING APPLICATIONS FOR CONVERSION OF LETTERS OF INTEI'\T INTO INDUSTRIAL UCENCr.

In cases where the article of manufacture is not covered by compulsory licensing, pending applications for conversion of LOis into ILs will not be processed further and SIA will advise the applicants to file a memorandum as in para 6 abuve before commencement of commercial production.

The Governmeni had further reviewed the list of industries covered under compulsory licensing in April 1993, and the motor car, white goods industry. raw hides and skins, leather and patent leather were de-licensed. After review of the Drug Policy in 1994, the Government delicensed all bulk drugs and their formulations and intermediates except few identified bulk drugs and formulations.

2. The Government has recently reviewed the list of industries retained under compulsory licensing and decided to remove entertainment electronics(includ ing Video Casettee Recorders, Colour Televisions. Compact Disk Players and Tape Recorders) from the list of industries requiring compulsory licensing in view of the considerations outlined below.

3. TI1e Indian audio visual system industry has now come of age. Nearly all components for

, assembling these are now being manufactured in India. Even the import contents of the components manufactured in India have sharply declined.

Moreover. all over the world, consumer electroics have been providing the dynamic thrust for the expansion of electronic industries. The latest

The delicensing ofthis industr:· will however be subject to locational conditions as given in the Press Note dt.::!nd August. 1991. ll1e de licensing is al\o not ntended to items exclusively reserved for manufacture in the small scale sector. Items rc~crvcd for small scale sector will continue to attract the I icensing provisions underthe Industries( Development and Regulation) Act. 1951.

5. The entrepreneurs who wish to avail of the liberalised facility of delicensing for the above mentioned industry are requested to follow the same procedure as laid down in the aforementioned Press Note dt. 2nd August, 1991 as amended from time to time.

6. The entrepreneurs who have been issued letters of intent for manufacture of items now falling under exempted category, the LOI holder need not file an initial memorandum. In such cases, the LOI holder shall enly file part 8 of the memorandum at the time of commencement of commercial production against the LOI issued to them. It is however open to entrepreneurs to file an initial memorandum (in lieu of the LOI/IL held by them) if they so desire, whenever any variation from the conditions stipulated in the

Letter of Intent/Industrial License is contemplated.

., On a review of the policy on foreign direct investment, it has been decided to include 3 categories of industries/items relating to mining activities for foreign equity up to 50%: 13 additional categories of industries/items for foreign equity upto 51% and 9 categories of industries equity upto 74% in the list of industries/items eligible for automatic approval by the Reserve Bank oflndia. These industries are listed under the heading "Par1 'A'. Pa11' B' and Part 'C' of A NNEXllRE-111" appended to this Press Note. These lists would be a supplement to the existing list of 35 industries (presently listed under Annex-Ill of the Industrial Policy) which qualify for automatic approval for foreign direct inves11i1ent. 4. The foreign equity limits for automatic approval as per the attached I ists would also be applicable to all proposals for Units in the Electronics Hardware Technology Park Schemes (EHTPs) and units under the Software Technology Park Schemes(STPs), wherever such proposals contain request for approval for foreign direct investment as well. The other parameters of eligibility with respect to these specific schemes(EHTPs. STPs) would be applicable in the same manner as they are applicable for proposals not containing any element of foreign investment under these schemes.

5. The attached lists are based on the National Industrial Classification of all Economic Activities(NIC), 1987. The entrepreneurs/investors should henceforth give description of their activities in this classification system while submitting their application to the RBI/ Government for various industrial approvals.

2. The above procedure will fom1 part of the fiPB Guidelines and paragraph ll(a) of the "Guidelines for the consideration of Foreign Direct Investment (FDI) proposals by the Foreign Investme-nt Promotion Board ( Fl PB )" notified vide Press Note No. 3 ( 191)7 Series) shall stand modified accordingly in respect of down stream investment by foreign owned Indian holding companies.

3. All investors and entrepreneurs may please take note of the aforesaid revision in the policy.
