I. INTRODUCTION

Minnesota Power (or the “Company”) submits this Notice Plan for approval by the Minnesota Public Utilities Commission (“Commission”) pursuant to Minn. R. 7829.2550.

Minnesota Power intends to submit a combined application for a Certificate of Need and a Route Permit for the Duluth Loop Reliability Project (“Duluth Loop Project” or “Project”). The Duluth Loop Project includes the construction of: (1) a new, more than 10-mile long, 115 kV transmission line connecting the existing Hilltop Substation, located in southwest Duluth, and the Ridgeview Substation, located in the northeast portion of Duluth; (2) an approximately one-mile long extension of the existing Hilltop 230 kV Tap to the Arrowhead Substation; (3) expansion and transmission line reconfigurations at the existing Hilltop and Ridgeview substations; and (4) associated upgrades at the existing Haines Road and Arrowhead substations. The Project is scheduled to be in service in 2025.

The proposed Project area and the existing transmission system are shown in Figure 1. The transmission system in the Duluth area has historically been supported by several coal-fired baseload generators located along Minnesota’s North Shore. For decades, these local generators have contributed to the reliability of the transmission system by delivering power to the local area and providing system support. As Minnesota Power and its customers have transitioned away from reliance on coal to increasingly lower-carbon sources of energy, the idling of the generators on the North Shore has led to an increased reliance on the transmission system to deliver replacement power and system support to the Duluth area and the North Shore. In order to maintain a continuous supply of safe and reliable electricity while replacing the support once provided by these local coal-fired generators, the Duluth area transmission system must be upgraded. To do this, transmission lines in an area known as the Duluth Loop are being connected to enhance stability and reliability.

The Duluth Loop is a network of 115 kV transmission lines and substations, which form two parallel connections between the main Duluth-area transmission source of power and system support (the Arrowhead 230/115 kV Substation) and the North Shore (beginning at the Colbyville Substation on the far northeastern end of Duluth). Many of the customers in the Duluth area are served from substations connected to the Duluth Loop, including customers in Hermantown, Duluth Heights, Kenwood, Woodland, Lakeside, Hunter’s Park, and Congdon and around the Miller Hill Mall, the Duluth International Airport, the universities, and the downtown hospital district, among others.

The Duluth Loop Project will replace the system support once provided by the North Shore coal-fired baseload generators and is needed to: (1) resolve severe voltage stability concerns; (2) relieve transmission line overloads; and (3) enhance the reliability of Duluth-area transmission sources.

A Certificate of Need is required to be granted under Minn. Stat. § 216B.243 before a high voltage transmission line of the voltages and lengths proposed for the Duluth Loop Project is constructed. Minnesota Rule 7829.2550 requires a Notice Plan to be

submitted for review by the Commission at least three months before filing a Certificate of Need application under Minn. Stat. § 216B.243. Minnesota Power, therefore, submits this Notice Plan for the Commission’s approval.

II. NOTICE PLAN PROPOSAL

This Notice Plan is prepared as an initial step in the Certificate of Need regulatory process. Preparation of a Notice Plan, and its review and approval by the Commission, will ensure that interested persons are aware of the proceeding and have the opportunity to participate. The area proposed to be included in notices under this plan (“Notice Area”) is depicted in Attachment A, Figure 1.

The Notice Area is approximately 1.25 miles to 6 miles wide. In general, the Notice Area is 1.25-mile-wide (buffer of 0.625 mi on each side) centered on the existing transmission lines and pipelines within the Project area. The Notice Area east of the Duluth Airport has been widened to include an area centered on Rice Lake Road from the existing transmission line to Martin Road to allow routing flexibility from the Ridgeview Substation traveling north to the northside of the airport, while also providing ample space to develop routes from the Ridgeview Substation south towards the Swan Lake Substation. In addition, the central Hermantown area appears wide due to multiple 1.25-mile-wide areas centered on both Lavaque Road and an existing transmission line corridor.

While the Notice Plan is the first step in the regulatory process, Minnesota Power has already begun gathering stakeholder, agency, tribal, and public input on possible route alternatives. This outreach has included two virtual community meetings on January 28, 2021, three live virtual chats with Project team members, a virtual open house, direct mail and published notice of these events, and a Project website that includes Project information.1

With this proposed Notice Plan, the Company will continue this public outreach and provide the notices listed below in compliance with Minn. R. 7829.2550.

A. Direct Mail Notice

Attachment A includes a letter that will be mailed to landowners, residents, local units of government, elected officials, tribal government contacts, and agencies within the Notice Area.

1. Landowners

Minnesota Rule 7829.2550, Subp. 3(A), requires an applicant for a Certificate of Need to provide direct mail notice to all landowners likely to be affected by the proposed transmission lines. Minnesota Power proposes to provide direct mail notice to all landowners who own property within the Notice Area. Minnesota Power has obtained

landowner names and addresses within the Notice Area using tax records from the St. Louis County geospatial (“GIS”) data hub.

2. Mailing Addresses

Minnesota Rule 7829.2550, Subp. 3(B), requires an applicant for a Certificate of Need to provide direct mail notice to all mailing addresses in the area that are likely to be affected by the proposed transmission line. Minnesota Power proposes to provide direct mail notice to all residential and commercial mailing addresses within the Notice Area. Minnesota Power has obtained a list of mailing addresses in the Notice Area from the St. Louis County GIS data hub.

3. Tribal Government Officials

Minnesota Rule 7829.2550, Subp. 3(C) requires an applicant for a Certificate of Need for a high voltage transmission line to provide direct mail notice to tribal governments whose jurisdictions are reasonably likely to be affected by the proposed transmission line. Minnesota Power has assembled a list of tribal organizations and other tribal government officials and administrators in Northern Minnesota and this list is included in Attachment B. Minnesota Power will provide direct mail notice to the tribal organizations and other tribal government officials and administrators listed in Attachment B.

4. Local Governments

Minnesota Rule 7829.2550, Subp. 3(C), requires an applicant to provide direct mail notice to governments of towns, cities, home rule charter cities, and counties whose jurisdictions are reasonably likely to be affected by the proposed transmission line. Minnesota Power proposes to provide direct mail notice to lead administration personnel in the towns, cities, and counties. The notice will also be provided to the elected officials of those local units of government and to those State Senators and State Representatives whose districts are within the Notice Area. A complete list of these government recipients is included in Attachment B.

B. Newspaper Notice.

Minnesota Rule 7829.2550, Subp. 3(D), requires an applicant to publish notice in newspapers in the areas that may be affected by the transmission line. Minnesota Power proposes to place notice advertisements in the following newspapers in St. Louis County:

Duluth News Tribune Hermantown Star Proctor Journal

In addition to the Notice Plan newspaper notice requirement, Minn. R. 7829.2500, Subp. 5, requires that after a Certificate of Need application is filed that an applicant publish newspaper notice of the filing in a newspaper of general circulation throughout the state.

The Company requests a variance of Minn. R. 7829.2500, Subp. 5 per Minn. R. 7829.3200 to waive this additional statewide newspaper notice requirement. The three requirements for a rule variance under Minn. R. 7829.3200, Subp. 1 are: (1) enforcement of the rule would impose an excessive burden upon the applicant or others affected by the rule; (2) granting the variance would not adversely affect the public interest; and (3) granting the variance would not conflict with standards imposed by law. These three requirements are met here. First, under the Notice Plan, the Company will publish notice no more than 60 days before the application is filed in three regional newspapers. It would be an excessive burden to require an additional newspaper notice to be published in a statewide newspaper at most, 60 days thereafter. Second, granting such a variance would not adversely affect the public as notice will be provided in three regional newspapers that are more likely to reach persons potentially impacted by the proposed Project than a statewide newspaper. Finally, the variance would not conflict with standards imposed by law as the statewide newspaper notice requirement is a Commission rule. The Commission recently granted a similar variance request for another regional project.2

C. Notice Content

Minnesota Rule 7829.2550, Subp. 4 sets forth the information that must be incorporated into the notice letter including: a map showing the end points of the line and existing transmission facilities in the area; right-of-way requirements for the proposed line and a statement of intent to acquire property rights for the right-of-way; notice that the transmission upgrade cannot be constructed unless the Commission certifies that it is needed; Commission contact information; utility website information that includes its biennial transmission projects report; a statement that the Minnesota Department of Commerce, Energy Environmental Review and Analysis (“EERA”) will prepare an environmental report; an explanation of how to get on the Project’s mailing list; and a list of applicable regulatory laws and rules that govern the request for Project approval. Minnesota Power’s proposed notice mailing meets these requirements.

The map (Attachment A, Figure 1) that will be included with the notice letter will depict the entire transmission line corridor area including end points, existing transmission lines and substations, counties, townships, and notable landmarks to aid in orientation. The map that will be sent with the notice letter will be updated from the enclosed Figure 1 to show the routes the Company is likely to propose in its Route Permit application. The Company will provide a copy of this updated map to Commission and Department of Commerce staff for review prior to mailing.

D. Distribution of Notice Plan Filing

As required under Minn. R. 7829.2550, Subp. 1, this Notice Plan filing has been sent to the EERA, the Office of the Attorney General – Residential Utilities Division, and to

NOTICE OF PROPOSED TRANSMISSION LINE PROJECT

Re: In the Matter of the Application for a Certificate of Need and Route Permit for the Duluth Loop Reliability Project MPUC Docket Nos. E015/CN-21-140; E015/TL-21-141

PLEASE TAKE NOTICE that Minnesota Power (also the “Company”) is applying to the Minnesota Public Utilities Commission (also “Commission”) for a Certificate of Need and Route Permit for the Duluth Loop Reliability Project (also the “Duluth Loop Project” or “Project”).

Project Description

The Duluth Loop Project includes the construction of: (1) a new 115 kV transmission line connecting the existing Hilltop Substation, located in southwest Duluth, and the Ridgeview Substation, located in the northeast portion of Duluth; (2) an approximate 1-mile extension of the existing Hilltop 230 kV Tap to the Arrowhead Substation; (3) expansion and transmission line reconfigurations at the existing Hilltop and Ridgeview substations; and (4) associated upgrades at the existing Haines Road and Arrowhead substations. A map of the area under consideration for the proposed Project is attached to this letter as Figure 1, which shows the end points for the proposed 115 kV line and existing transmission facilities and roads in the area.

Project Need

The Duluth Loop is a network of 115 kV transmission lines and substations, which form two parallel connections between the main Duluth-area transmission source of power and system support (the Arrowhead 230/115 kV Substation) and the North Shore

(beginning at the Colbyville Substation on the far northeastern end of Duluth). Many of the customers in the Duluth area are served from substations connected to the Duluth Loop, including customers in Hermantown, the Miller Hill Mall, the Duluth International Airport, Duluth Heights, Kenwood, the universities, the downtown hospital district, Woodland, Lakeside, Hunter’s Park, and Congdon, among others.

The Duluth Loop Project will replace the system support once provided by the North Shore coal-fired baseload generators and is needed to: (1) resolve severe voltage stability concerns; (2) relieve transmission line overloads; and (3) enhance the reliability of Duluth-area transmission sources.

Further information on the Project need is available on the Project website: www.duluthloop.com.

Regulatory Review Process

Before Minnesota Power can construct the Project, the Commission must determine whether the Project is needed (Certificate of Need) and if so, will determine the route along which the Project will be built (Route Permit).

The Certificate of Need process is governed by Minnesota law, including Minnesota Statutes section 216B.243, and Minnesota Rules Chapter 7849, specifically Rules 7849.0010 to 7849.0400 and 7849.1000 to 7849.2100. A copy of the Certificate of Need application, once submitted, can be obtained by visiting the Commission’s website at www.puc.state.mn.us in Docket No. E015/CN-21-140.

In addition to certifying the need for the Project, the Commission must also grant a Route Permit for the Project. The routing of the Project is governed by Minnesota law, including Minnesota Statutes Chapter 216E and Minnesota Rules Chapters 4410 and 7850. A copy of the Route Permit application, once submitted, can be obtained by visiting the Commission’s website in Docket No. E015/TL-21-141.

The Commission will not make these determinations until it has completed a thorough review process that encourages public involvement and analyzes the impacts of the Project and various route alternatives. This process includes preparation of an Environmental Assessment (“EA”) on the Project by the Minnesota Department of Commerce’s Energy Environmental Review and Analysis (“EERA”) staff.

Minnesota Power will be submitting an application for a Route Permit with one proposed route for the 115 kV transmission line and one proposed route for the 230 kV transmission line. Other routes can be proposed to be evaluated during the scoping process. The Commission and the EERA staff will decide which routes get studied and considered for approval. Routes that have been shown at public meetings are preliminary and subject to change. In addition, other, new routes may also be studied and considered for approval.

The Commission will review all of the data from the public process and will decide if the Project is needed and which route should be approved. Selection of a final route by the

Right-of-Way for the Project

Before beginning construction, Minnesota Power will acquire property rights for the right-of-way, typically through an easement that will be negotiated with the landowner for each parcel. Minnesota Power anticipates acquiring easements with a typical right-of-way of approximately 100 feet wide for the 115 kV transmission line and 130 feet wide for the 230 kV. Where these transmission lines parallel existing lines, less new right-of-way may be required because the new transmission line may share a portion of the existing right-of-way.
