1 OUTLINE OPERATIONAL NOISE COMPLIANCE METHODOLOGY

1.1 Introduction

1.1.1 The Environmental Statement (ES) submitted with the application for developmentconsent for the North Killingholme Power Project (“Project”) presents noise levelsrelating to the operational aspects of the Project at four specific noise receptors.However, these levels would not be measurable in accordance with BS 4142:1997 asthey are significantly below the background noise levels at the noise receptors.

1.1.2 The application of the standard means that sound pressure levels attributable to theProject could not be isolated hence the Project could not be controlled for the purposeof imposing requirements under the development consent order (“DCO”) proposed toauthorise its construction and operation.

1.1.3 An example of this would be where a given sound pressure level was required to beachieved at a specified location remote from the Project. If operation of the Projectwas constrained so that the levels could not be exceeded at the receptor and a louderintervening use was to commence, then the constraint of the Project by reference tosound pressure levels at the receptor would not be appropriate.

1.1.4 The purpose of this document is to establish a methodology, about interveningdevelopment, so that measurements at the boundary of the Operations Area can beused instead of measurement at the receptor. Therefore, provided the predictedmeasurements at the boundary of the Operations Area are achieved (or better) it canbe predicted that the measurements at the identified receptors will also be met. Ifother intervening development takes place then this should be constrained rather thanthe Project.

1.1.5 C.GEN therefore proposes a revised series of limit levels and locations around theboundary of the Operations Area, which would ensure adequate protection of theidentified noise sensitive receptors (NSR) through more accurate assessment.

1.1.6 The operational noise levels for all scenarios are not predicted to exceed a BS 4142rating level of 35 dB(A) at any of the residential NSR locations shown in Figure 1. Toensure that the predicted operational noise levels are not exceeded, and to ensurethat any breaches can be remedied, it is proposed that noise limits are set at specificmeasurement locations on the project boundary.

1.1.7 This document also contains the programme for the monitoring and control of noisewhich accompanies the proposed site limits, using the methodology set out inBS7225.

1.2 North Killingholme Power Project Boundary Noise Limits

1.2.1 In order to achieve a BS 4142 rating level of 35 dB(A) at the residential location(absent of other intervening development), the free-field equivalent continuous A-weighted sound pressure level caused by the operation of the North KillingholmePower Project during its normal commercial operation measured over a referencetime interval of 5 minutes shall not exceed the values in the following table:

1.2.2 If the noise at any of the above receptors shall have a tonal quality, then the noiselimits shall be 5 dB lower than the values in the above table. The noise shall beconsidered tonal if the level of a one-third octave band measured at any of the abovereceptors exceeds the level of both adjacent bands by 10 dB or more.

1.2.3 The locations of the monitoring positions on the boundary of the Operations Area areshown in Figure 2.

1.3 Derivation of Boundary Noise Limits

1.3.1 The boundary noise limits presented above have been extrapolated, using ISO 9613,from the noise models used in the assessment of operational noise from the Projectto be commensurate with a BS 4142 rating level at the residential locations of 35 dBor less.

1.3.2 The methodology can be illustrated by locating each proposed measurement locationon the contour plot presented as Appendix 10.4 of the ES. Each contour on the plotis at intervals of 5 dB thus enabling a reading of the Sound Pressure Level thatcorresponds with the results presented in Table 10.17 of the ES.

1.3.3 The noise limits referred to in the above table are derived from locations used in thenoise model which is included in the Environmental Statement for the Project. Thesound pressure levels presented in that table are appropriate to achieve a 35 dB limitat existing residential properties in the vicinity of the Project as a result of the Project'sactivities alone. This is based on survey data taken using a Class I sound meter andusing the methodology set out in BS 4142 and guidance published by theEnvironment Agency.

1.4 Ecological Noise Limits

1.4.1 In order to limit any potential impact to ecological receptors within the HumberEstuary SAC / SPA / Ramsar site (which incorporates the North Killingholme HavenPits SSSI) noise limits are also proposed at these receptor locations as shown inFigure 3. Given the short distance to the Project boundary from these receptors, anoff-site location for compliance monitoring is considered suitable as the dominantnoise source (be it the Project or other development) will be able to be readilyascertained. Compliance monitoring will require appropriate corrections to be madefor other increases of background noise.

1.4.2 The proposed rating levels (LAeq) for the Project at these locations are:

1.4.3 A noise limit for NSR 10 is not proposed on the basis of its distance from the NorthKillingholme Haven Pits and would not inform the levels of noise in any useful way incomparison to NSR8 and NSR9. Furthermore the baseline disturbance at NSR10from C.RO Ports activities has been demonstrated to have resulted in no adverseeffects to the interest features of the SPA and no increased cumulative or in-combination disturbance effect is predicted based on the CMACs survey data whichdemonstrates high levels of tolerance to the industrial activities.

1.5 Programme for the Monitoring and Control of Noise

Attended Noise Monitoring Procedure

1.5.1 It is proposed to undertake attended measurements (at points 1, 2, 3 and 4) every12 months to demonstrate compliance with the agreed permit levels.

1.5.2 The attended monitoring shall be undertaken by an organisation competent inenvironmental noise monitoring using calibrated Class 1 sound level meters. Themonitoring shall be generally compliant with the requirements of ISO 1996Part 2 (2007).

1.5.3 At each measurement position, ten measurements of LAeq,5min shall be undertakenduring normal commercial operation of the Project at a height of 1.2 m in a ‘free field’location. Measurement times shall be selected to ensure that sources not related tothe operation of the Project do not significantly influence the measurements. Theseextraneous events shall be excluded from the noise measurements. Noise levelsshall only be measured during suitable meteorological conditions, as set out inBS 7445.

1.5.4 Within 1 month of each survey a monitoring report shall be submitted to NorthLincolnshire Council and shall include, as a minimum, the following information:

a The details of the equipment used and calibration details

b Measured noise levels

c Comparison with previously recorded levels

d Comparison with agreed limit levels

e Qualitative description of noise levels

1.6 Periodic Site Noise Level Audit and Equipment Condition Reviews

1.6.1 During the commissioning of the Project, a number of external noise measurementpositions close to significant sources of environmental noise external to the site shallbe defined and approved by North Lincolnshire Council. Using a hand held Class I orClass II sound level meter, LAeq,1min levels shall be measured at these locations duringfull load operation. The detailed location and LAeq,1min noise level at eachmeasurement position shall be recorded.

1.6.2 Every month during the first year of operation, and subsequently every three months(and additionally in the event of a noise complaint), noise measurements at thesepositions shall be made by, or on behalf of, C.GEN. Records of these noisemeasurements shall be kept by C.GEN, and shall be made available to relevantregulatory authorities upon request.

1.6.3 If records show that the LAeq,1min noise level in the vicinity of any significant source ofenvironmental noise has increased by more than 2 dB since commissioning, C.GENshall instigate a review of the operating conditions of the relevant equipment to theextent that such equipment is within the control of C.GEN, with a view to reducingnoise levels to as low as reasonably practicable. Where such a review occurs, thisshall be recorded by C.GEN. Records of these equipment reviews shall be kept by

C.GEN at the site, and shall be made available to relevant regulatory authorities uponrequest.

1.7 Purchasing Policy

1.7.1 C.GEN shall ensure that the environmental noise levels associated with all potentiallynoisy equipment is as low as reasonably practicable for that equipment type.

1.8 Complaints / Grievance Procedure

1.8.1 In the event of a noise complaint being made either directly to C.GEN or to NorthLincolnshire Council, a review of on-site noise shall be conducted within 24 hours ofreceipt of the complaint. This review shall include a site engineer making a walkingtour of the site to identify unusual noise levels, and a review of the operatingconditions of equipment with the potential to cause noise complaints, to identify anyfaults.

1.8.2 Within three days of the complaint a noise audit (as described at Section 1.5 above)shall be undertaken using a hand held sound level meter.

1.8.3 Where the review or the noise audit suggests that on-site noise levels have increasedsince commissioning, C.GEN shall immediately attempt to identify the equipmentresponsible for the noise increase, and will implement such technical measures aimedat reducing the noise level as low as are reasonably practical.

1.8.4 Records of any complaints and associated reviews shall be kept by C.GEN, and shallbe made available to relevant regulatory authorities upon request.
