R e p o r t Description
1. Claremont Fan Court School (the School) is an independent co-educational day school for pupils aged from 2½ to18 years. It is owned and run by the Claremont Fan Court Foundation Limited and is committed to offering an education of the highest order. The School is a well-established private school and is located within the designated Green Belt.
2. The site contains and abuts a number of significant heritage assets, including the Claremont
Mansion building, which is a Grade I Listed Building, the Belvedere, the Walled Gardens, White Cottage and Milestone which are all Grade II* and The Close (Stable Court) and the Ice House, Lodges and Gate Piers which are Grade II. The lodges and access from Claremont Lane, Stable Pond, the Fan Court School site and the National Trust’s Claremont Landscape Gardens are designated as a Grade I Listed Park of Special Historic Interest. The view from the school entrance at Portsmouth Road is one of the few public views of the 18th Century Capability Brown landscaped park and house. Constraints

6. Listed Building Consent is being sought for demolitions, alterations and extensions to the existing listed Stable Block, Courtyard Walls and ancillaries (Stable Court) to be read in conjunction with Variation of Condition under Section 73, 2019/3588.
7. The proposed variations include:
• Variations to the internal arrangement of the floor plans to meet the Prep schools’ current neds.
• Omit previously consented additions to the North and South elevations. • A reduced new build proposal for the new entrance lobby which will relocate main
Prep school entrance via the courtyard. • Retention of previously consented demolition of existing accommodation adjoining
Stable Court. • Defer the Quad landscaping works into the Joyce Grenfell Centre phase in the
masterplan (next phase). • Provide a new central staircase within the Stable Block to improve circulation. • Central light wells to receive roof level roof lights.
8. The initial submitted plans included the construction of a Music Pavilion within the Walled
Garden. The proposed pavilion was considered to be of a contrasting design and added a further mass within the walled garden which appeared to be separated to create a courtyard within the walled garden. This was considered to be unwelcomed and following discussion with the Council’s Officers it was omitted from the proposed variation. Amended plans re-consultation letters have been sent under the S73 application to reflect the omission of the Music Pavilion and retention of the existing outbuilding. Consultations

Representations
29. The Council notified 155 properties and a site notice was displayed outside the main entrance to the site on Portsmouth Road.
30. 20 letters of objection and 1 observation received from 17 different households and Clare Hill (Esher) Association Ltd, in terms of this proposal and that of the S73 application 2019/3588, raising the following concerns:
• Concerns regarding the intention to use Claremont Drive for construction traffic, which
is a very narrow listed carriage way with no footpath not suitable for construction vehicles, and the amount of additional traffic to be generated.
• The use of Claremont Drive should be prohibited, and Portsmouth Road entrance should be used instead.
• Concern regarding the safety of the public and damage done to Claremont Drive as well as damage to listed assets.
• The School should be asked to build the haul road for access as stated in the 2013 application.
• The School should be asked to submit a Method of Construction Plan and Measures for Traffic Management Plan as required by Condition 14 of planning permission 2018/1170.
• The School should be asked to implement procedures as outlined in the 2013 Hybrid Planning Application to reduce school related traffic using Claremont Drive.
• The Council should consult with the Surrey County Council Highways Authority before deciding on this planning application.
• Concerns regarding the impact on the amenity of Claremont Park residents due to noise an unacceptable increase in emissions.
• Concerns that this application is being submitted as an alternative to 2019/3588 in trying to avoid conditions relating to previous consent made in the Hybrid Planning Application.
• Request for a TPO to protect a Cedar of Lebanon Tree.
Positive and Proactive Engagement
31. The National Planning Policy Framework requires local planning authorities to work with the applicant in a positive and proactive manner to resolve problems before the application is submitted and to foster the delivery of sustainable development. This requirement is met within Elmbridge through the availability of pre-application advice.
32. The applicant sought formal re-application advice (PreApp134868941) as well as informal
advice from the Council’s officers.
Planning Considerations
33. The main planning considerations in the determination of this application are:

34. This application seeks to vary Condition 1 (Approved Plans) of planning permission 2013/4029
for the refurbishment and alterations to Stable Court incorporating a single storey front extension, retention of the rear and side projections, entrance gates to a height of 1.7m, repair of the Courtyard Walls and associated landscaping. Stable Court
35. The proposed refurbishment and extensions include a new entrance as well as windows replacements and alterations. The proposed extension within the courtyard is a large reduction in volume over the approved scheme and the ‘wing’ elements of the stable are to be retained and screened which is considered to be acceptable. In addition, there are no concerns with regards to the internal alterations and the window replacements. Courtyard Historic Walls
36. The proposed works seek to repair the Kent and Vanburgh walls around the outside of the courtyard. These works are considered acceptable and are welcomed. Courtyard Landscaping
37. The proposed works seek to remove the vehicles from this area and to insert new/refurbished hard landscaping. The removal of the vehicles is welcomed; however, the works seek to also undertake resurfacing. The courtyard is currently made up of original fabric which would be lost. Whilst the resurfacing works are considered to be harmful when considered on their own, given the clear heritage benefits of the renovation of the building, on balance, it is considered that on this occasion the benefits would outweigh this harm. To reduce the potential harm, it is considered reasonable to impose a condition requesting that detailed drawings indicating what would be retained and what will be replaced as well as samples of the proposed materials to be
used in the resurfacing are submitted to for approval to the Council prior to any works taking part in this part of the scheme.
Coach Houses
38. The proposed works seek to remove the external streel frame. These works will improve the character of the courtyard and therefore considered to be acceptable.
The Quad Landscaping
39. These elements remain as in the approved scheme and this proposal seeks to defer the works to the next phase, which is considered to be acceptable. Stable Court Carpark
40. These elements remain as in the approved scheme and this proposal seeks to defer the works to the next phase, which is considered to be acceptable.
41. In light of the above, it is considered that the proposed alterations would be acceptable in heritage and design terms due to the benefits of the scheme. As such, the proposal would result in less than substantial harm to the heritage assets and the loss of fabric to the courtyard landscaping is considered to be outweighed by the benefits.
Matters raised in Representations
42. The issues raised largely relate to the S73 application and are therefore not material
considerations to this proposal. However, the concerns raised in relation to the impact upon the heritage assets have been addressed in the considerations above.
43. With regards to the comments stating that the School has said that it intends to use Claremont
Drive as the primary access road for construction traffic, it must be noted that this application does not seek to change any access requirements already established in the masterplan. If the school wishes to request the use of Claremont Drive, a separate application to discharge conditions by means of a Construction Management Plan needs to be submitted for approval to the Council.
44. The comments regarding this application being made as an alternative to 2019/3588 are noted. This is an application for Listed Building Consent in association with 2019/35mm and therefore not an alternative application.
45. The comments requesting a TPO to protect the Cedar of Lebanon Tree are noted. Whilst this is an application for Listed Building Consent and the issues of Trees is not dealt under this application, it must be noted that the part of the proposal closest to the said tree involved the construction of the Music Pavilion which has been omitted from the original proposal. In any event, the Council’s Tree officer was consulted on the initial submitted variation and considered that the construction of the Music Pavilion was not anticipated to have a major impact on the Cedar.
Conclusion
46. On the basis of the above and in light of any other material considerations, the proposal is
considered to be in accordance with the Development Plan. Accordingly, the recommendation is to Grant Listed Building Consent.

Conditions/Reasons 1 LISTED BUILDING CONSENT - TIME LIMIT
The work to which this consent relates must be begun not later than the expiration of three years beginning with the date on which the consent is granted.
Reason: To comply with Section 51 of Part 4 of the Planning and Compulsory Purchase Act 2004.
2 LIST OF APPROVED PLANS
The development hereby permitted shall be carried out in strict accordance with the list of approved plans detailed on the attached schedule of plans: TP(11)14 and TP(12)11 Rev A - received 11.03.2020. TP(00)02 Rev C, TP(10)11 Rev C, TP(10)11 Rev C, TP(10)14 Rev B, TP(11)11 Rev B, TP(11)12 Rev B, TP(12)12 Rev B and TP(12)13 Rev B - received on 21.05.2020. Reason: To ensure that the development is carried out in a satisfactory manner.
3 MATERIALS SAMPLES
NO DEVELOPMENT SHALL TAKE PLACE UNTIL SAMPLES OF THE MATERIALS TO BE USED ON THE EXTERNAL FACES AND ROOF OF THE BUILDINGS HAVE BEEN SUBMITTED TO AND APPROVED IN WRITING BY THE BOROUGH COUNCIL. DEVELOPMENT SHALL BE CARRIED OUT IN ACCORDANCE WITH THE APPROVED DETAILS.
Reason: To ensure that a satisfactory external appearance is achieved of the development in accordance with Policy DM2 of the Elmbridge Development Management Plan 2015. It is considered necessary for this to be a pre-commencement condition because the use of satisfactory external materials goes to the heart of the planning permission.
4 ARCHAEOLOGY - SCHEME OF WORKING (SITE OF HIGH ARCHAEOLOGICAL
POTENTIAL) NO DEVELOPMENT SHALL TAKE PLACE UNTIL THE APPLICANT HAS SECURED THE IMPLEMENTATION OF A PROGRAMME OF ARCHAEOLOGICAL WORK ON THE SITE IN ACCORDANCE WITH A WRITTEN SCHEME OF INVESTIGATION WHICH HAS BEEN SUBMITTED BY THE APPLICANT AND APPROVED IN WRITING BY THE BOROUGH COUNCIL.
Reason: The site is one of/within an area of high archaeological potential and it is important that the archaeological information should be preserved as a record before it is destroyed by the development in accordance with Policy DM12 of the Elmbridge Development Management Plan 2015.
5 RESURFACING OF COURTYARD
Prior to work commencing to this part of the development, detailed drawings showing what is retained and what is replaced as well details on how the new surface is going to be installed and material samples of the proposed materials to be used must be submitted to and approved in writing for approval by the Borough Council. The works must be then carried out in accordance with the approved details.
Reason: To ensure that a satisfactory external appearance is achieved of the development in accordance with Policies DM2 and DM12 of the Elmbridge Development Management Plan 2015.
