BMO threw down its mortgagegauntlet on Friday, with arock-bottom five-year fixed-

rate at 2.99% (down from 3.09%), effec-tive immediately.

The rate drop is reminiscent of thebank's 2012 attempt to win mortgageseekers during the busy spring real estateseason. The move sparked a mortgageprice war and prompted admonishmentsfrom an angered Finance Minister JimFlaherty.

This time is no different, withFlaherty issuing a harshly worded state-ment about the expectations of prudentlending by Canada's banking system.

The good news is that anyone cur-rently shopping for a mortgage will endup with even lower rates. And thatincludes me. Of course, there's more toselecting a mortgage than a low rate, butit does prompt the question: how muchhave rates shifted over the decades?

While data on discounted mortgagerates-the posted rates minus discountsoffered by banks and A-lenders to good,qualified credit borrowers-is not readilyavailable, the Canadian Mortgage andHousing Corporation collected data onposted mortgage rates going back to1951. Just to clarify the posted rate is therate banks offers before discounts. Thecurrent posted rate is 5.24%.

Below is the average posted rategoing back to 1951:

2011: 3.49% (posted rate minus 1.8%)

When you go to the bankto get a mortgage, you'llinevitably be asked to

take out mortgage insurance. The ideabehind mortgage insurance is simplythat if something happens to you oryour spouse then your loan will bepaid off which is good news for yourfamily and fortunately the bank. Mostbanks act like they are doing you afavor by offering you mortgage insur-ance through their own group plan, butare they?

The truth is that you could proba-bly get a much better deal and at leastan equal amount of protection byshopping around for your own privateinsurance policy. Mortgage insuranceis no different than term-life insur-ance, both policies only last for a spec-ified period of time and pays its bene-fits if something happens to you oryour spouse. The real differencecomes down to how much controlyou'll have over your policy and howmuch you'll pay for it.

If you choose to use the mortgageinsurance offered by the bank, youwill not be able to customize a policyto fit your needs and you will onlyhave limited control over your policy.For example, through a third partyprovider, you would be able to chooseyour own beneficiary, decide how tospend the proceeds if necessary, andcancel the policy at any time. Youwould not have these options with alending institution. Additionally, thebank maintains the right to not renew

your policy and to cancel the policywhen you sell the house. If you findyour own insurance provider, you canmake those decisions yourself.

The other major difference is cost.A third party insurance policy's premi-ums will not go up, so you would paythe same premium today that you'dpay ten or twenty years from now. Youwon't get that same guarantee from abank, which can and probably willincrease your premiums during the lifeof the policy. In most cases, you'llprobably pay more through a bankanyway. In fact, the policy you takeout through your bank will graduallydecrease and increase in price as youget older while a plan you select froman outside source will be worth thesame amount during the entire policyperiod.

The bottom line is that mortgageinsurance is important and should bepart of your home buying or refinanc-ing preparations, but that does notmean you need to pay more or let thebank make important decisions foryou. Why we need a Danish housing ‘Lemon Law’What we need in Ontario to

protect resale home buy-ers from hidden defects

is a lemon law like the one they have inDenmark.

Reader Anthony Caruso, living inAalborg, reminded me that the Daneshave a type of insurance — split equal-ly between buyer and seller — that pro-tects against unforeseen defects discov-ered after closing.

The policy costs between $1,200and $3,000, depending on the age of thehome, and is dependant on a homeinspection. It will last for up to 10years. The seller must not have doneanything to deliberately cover up adefect or they may be held responsiblelater.

The insurer will then pay for hid-den defects as they occur, as well as thecosts of suing a seller who may havecommitted a fraudulent act in coveringup any defects.

If Ontario had a similar process, Ihave no doubt it would result in sellersbeing more honest about the condition

of their properties — and buyers, inturn, being more satisfied and protect-ed.

But it won’t be easy. KevinHamilton of Moncton-based LuxResidential Warranty Program Inc. hasoffered a CMHC-approved new homewarranty plan for Atlantic Canada forthe past eight years. They are nowfinalizing a warranty plan that willsoon be available for resale home buy-ers in Atlantic Canada and Ontario.

Their website lists all the thingsthat could go wrong with your homeafter closing. There is also a detailedexclusion clause as to what will not becovered, including anything containingasbestos, flashing eaves, sewage back-ups or where there has been improperongoing maintenance.

The maximum liability for anyclaim under this policy is $500 to$2,500, depending on the problem; theaverage premium will be about $385.Most buyers who find serious issuesafter closing need to spend much morethan this. Still, this is a step in the right

direction and Hamilton says they hopeto increase these coverages as theylearn more.

The lemon law column prompted alot of mail from unhappy buyers,tradespeople, home inspectors andinsurers. They all agree the current sys-tem does not work and buyers needmuch better education and protectionwhen buying a resale home.

Doug McAllister, an electricianfrom Sudbury, commented that if heperforms shoddy work, he will be heldresponsible. He figures he is probablymore qualified than most home inspec-tors and says it is not right that anyonecan put out a home inspector sign aftertaking courses for two weeks.

I think the government should getthings going with regulations or a chal-lenge to the home-inspection industryto develop continuing educational stan-dards and avenues for consumer com-plaint. Insurers can help by developingproducts that protect resale homebuy-ers.

In the interim, I encourage everyresale homebuyer to include a clause inany contract that the seller representsand warrants that during their owner-ship they never experienced any waterpenetration, and if they have, to pro-vide details of any repair work done.

If the seller refuses to sign, thenask for a more detailed inspection by abasement water or mould specialist, oradjust the price of your offer.
