Each country around the world has their own mediationculture. The word “mediation” covers a wide range ofprocesses and practice standards. What can mediators doto synchronise different expectations participants may havefor a cross border mediation? How can mediators deal withdilemmas and strategic choices and identify some universalcommonalities? Finally, we will look at best practices andhelpful tools to manage the complexity of these fascinatingcases.

For many Asian jurisdictions, judicial mediations remaincommon even as more independent professionalmediators offering less evaluative approaches becomeavailable. “Directive co-mediation” has emerged as astrategic approach for mediators to amalgamate theadvantages of the different styles. Using interactive roleplays, participants will discuss ethical issues in thisapproach and explore new techniques for achievingenforceable solutions quickly.

Language is an intrinsic part of the mediator’s skillset.Being able to recognise the presuppositions in parties’language can assist mediators to gain a more completeunderstanding of the problem. They can then apply thepresuppositions in their own communication to moveparties toward more useful thoughts and directions.Drawing from the linguistic models of Neuro-LinguisticProgramming (NLP), participants will learn how torecognise and utilise presuppositions to support the goalsof mediation.

Culture defines the way we look at conflict and shapes ourapproach for conflict resolution. Having an accessibleframework to prepare for our negotiations can help usrespond appropriately to culture differences. This sessionwill engage participants to think deeply about how we canfoster greater mutual understanding in a cross-borderdispute and persuade a party from another culture toappreciate and embrace our priorities.

Thoughtful and early inclusion of mediation in the designof dispute resolution processes enables parties to achievemore efficient, cost-effective, sustainable and enforceablesolutions in complex international disputes. In this session,participants will learn the key principles for customisingthe mediation process by considering emotional, socialand rational heuristics and by diagnosing the proceduraland substantive norms that the parties may wish to applyto design customised ADR processes.

Emotions are often considered as hindering a possibleagreement. In fact, neuro-sciences show that theagreement is fundamentally an emotional process where“reasonable reasons” play a secondary role. This sessionwill explain why this is so and explain how emotions dohelp finding agreements in the mediation process.

Keynote Address

The Singapore Convention is reshaping conventionalthinking about mediation. In this session, we explore how itcould equally change mediation practice with effects onmediators, counsel, parties, and enforcing courts. Weconsider the impact of incomplete treaty coverage and therelationship between the Convention and revised modellaw. Through discussions and experiential exercises,participants will gain practical insights on how to benefitfrom the Convention and how to manage attendantenforcement risks.

China has commenced judicial reforms to assure users ofthe enforceability of mediated settlement agreements. Akey issue has been incorporating the best internationalpractices with the elements which are central to theChinese modalities of dispute resolution. In this session,participants will practice mediating a cross-border disputein a process influenced by Chinese norms and work atcrafting a settlement agreement that would be recognisedand enforced in China.

Increased digitization of mediation can lead todesensitisation of the human context and therefore oursenses. In this session, the trainer will bring into focus howunconscious human interactions lead to conflict. Throughguided practices, participants will be led to discover howthey can enhance their effectiveness in the virtual processby first mindfully resolving their own inner conflicts to beable to play the neutral role of a mediator.

Technology. Love it or hate it - we now live in a worldwhere it defines every aspect of our lives. As the platformsfor human interaction continue to evolve, mediators toomust follow suit. How can mediators ensure that their skillsare not lost in translation? Are mediators overlookingsome basic pointers that could dramatically improve theirmediation efficacy? Explore these questions - and more -and build a personalised console to mediate and trainbetter without compromises.
