the freedom of information request 18-09-2013-151538-006.’ As mentioned in earlier correspondence we are treating this as a request for information under the Freedom of Information Act 2000. First we must apologise for the delay in providing you with a response but as explained it has been more complicated than anticipated. Unfortunately, because of a combination of the number of documents and the size of some of them, we regret that we are still processing the information in scope of the third part of your request so at this stage we are only in a position to release information relating to the other parts. Please note that it is likely that some of the information will be redacted under Section 36(2). We recognise that this will be disappointing but we continue to work hard to resolve this and aim to complete our response to you by the end of September. The Information Commissioner’s Office is aware of this. Turning to the other information that you have requested in parts 1, 2 and 4, a schedule of the information provided is enclosed with this letter. Some of this information falls within the scope of Section 40(2) of the Act, which deals with personal information. Section 40 is an absolute exemption and an assessment of the public interest for and against disclosure is not required under the terms of the Act. In addition, at part 2 you requested copies of responses provided to request 18-09-2013-151538-006. The final response provided was not sent until 12 May and therefore was not information we held until after your request. However, we are in this instance waiving section 1(4) of the Act and providing the response to you. Finally, at part 4 you also requested ‘screen prints showing all data held on the Access to Information Toolkit’. The Access to Information Toolkit was closed down before your request was made and no information is now held on it. We have provided a screenshot of the case record of request 18-09-2013-151538-006 taken at the point of closure. The case was transferred onto a

AGENDA ITEM 1b – COMPULSORY DRUG TESTING POSITIVE - CANNABIS AND THE CORRELATION TO TOBACCO USE Issue 1. Subsequent to identifying positive CDT results at AJB, AG asked if there is a correlation between smoking tobacco and cannabis use. Recommendation. 2. AG is invited to note:

a. there are a wide range of papers reporting on this subject; all have differing findings; b. sldrs on notification of positive cannabis analysis were asked about their tobacco habits; and c. the data collected mirrors other reports.

Background 3. Over the first 6 months of 2013, sldrs returning positive CDT for cannabis were asked to comment on their tobacco intake or otherwise. Over the period 01 Jan – 30 Jun 13, 74 positive results were returned and data reflects these individuals. ||||||| |||||||| |||||||||| |||||||||||||||| |||||||||||||| |||||||||||||| ||||||| |||||| |||| ||||||||. Correlation to tobacco use? 4. 56 individuals reported regular use of tobacco products (76%), whilst 7 admitted experimentation through the use of non tobacco ingestion (9%) whilst the remaining 11 claimed passive ingestion or spiking; ||| |||||||| ||||||| ||| |||||| claimed ingestion through foodstuffs. 5. When researching academic papers and surveys it is not uncommon to find individuals who are regular cannabis smokers but do not use tobacco products. However, most indicate they have experimented with tobacco but found the effects nauseous. Summary 6. 1. The Chief Coroner of England and Wales has decided to create a cadre of coroners who will specialise in military deaths.

Background

3. The Chief Coroner has created a specialist cadre of coroners in England and Wales. Members of the cadre, who will be specially trained, will conduct investigations and inquests into the deaths of service personnel on active service. Active service also includes training and preparation for active service. Many of these deaths will occur overseas, but the jurisdiction of the cadre will also extend to such deaths in England and Wales.

Positive analysis has increased in 12/13 with mitigation increasingly reporting ‘NPS’ use. Background

3. Substance misuse has increased dramatically over the last 2 decades, with individuals joining the Armed forces having greater exposure to substance misuse than ever before. To change the cognitive behaviour of individuals, education must be provided in a timely manner that is also current and authentic.

a. Education and Publicity Campaigns. A collective PS2 and PS4 supplement misuse campaign was launched early 13, using various platforms including Army knowledge exchange, bespoke presentations delivered by DPS(A) staff, leaflet campaigns and radio interviews. Whilst it is difficult to gain analytical evidence of its effectiveness feedback identifies it has been well received and fills the identified gap.

b. Prescription Medicine Misuse. An education deficiency was identified in the misuse of prescription medication which is being addressed as a bolt on to the supplement misuse campaign. An example of prescription medicine misuse is the soldier who returns from a prolonged journey and to ensure a full nights sleep prior to catching up with family life the following day ingests one of his partners prescribed medicines. In legislation ingesting medication outside prescription is an offence under the Misuse of Drugs Act 1971 and will, if subject to CDT return positive analysis.

c. MATT 6 review. MATT 6 has been reviewed and amended since the last AJB. Amendments included the dangers from supplement misuse. Unfortunately the identification of prescription misuse was identified too late for this amendment.

d. Command Courses. All command course delivered by PS2 identify the risks posed from supplement, legal high and prescription medicine misuse.

5. The RMP Policing Priorities and Control Strategies for 2014 are as follows:

• Sex Offending and Child Exploitation

• Firearms, Ammunition and Explosives

• Theft Related Crime (including Fraud)

6. Sexual offending in particular remains a high profile issue that impacts significantly on victims over an extended period of time. The RMP are reviewing their training and policy for how we both investigate these types of offences and best support victims but we have identified a type of victim who could be particularly vulnerable to attack of this type. It would be useful if this information could be passed to COs and Units who could build it in to their duty of care to their personnel; particularly those who fit into this vulnerable group.

AGENDA ITEM 9 - DJEP UPDATE Iraq abuse claims The High Court gave its judgment on PIL’s demand for a Public Inquiry into all Iraq abuse cases on 24 May. As predicted the Court refused to order a full Public Inquiry, and it confirmed IHAT’s independence as it is now constituted. During the first phase of hearings (from 18 March to 4 July) the Inquiry has taken oral evidence from 60 witnesses, including 4 expert witnesses appointed by the Inquiry. The witness statements of a further 33 Iraqis and 6 locally-employed civilians have additionally been adduced into evidence. Most of the Iraqi witnesses have given



inconsistent accounts, and these inconsistencies have been carefully laid bare by Counsel to the Inquiry in the course of his questioning. While it will not be possible to persuade the Chairman to terminate the Inquiry, he has been persuaded to reduce the number of military witnesses from whom he will take evidence. This will shorten the final phase of hearings, which commenced on 2 September and could now finish by the end of the year. The report is expected towards the end of 2014 Afghanistan cases The legality of UK military operations in Afghanistan and the question whether the ECHR applies remain legally contested issues.
