COUNTY SACPA ALLOCATIONS
NOTICE OF RULEMAKING AND PUBLICCOMMENT PERIOD
NOTICE IS HEREBY GIVEN that the CaliforniaDepartment of Alcohol and Drug Programs proposesto amend Section 9525, Title 9, California Code ofRegulations (CCR).
INFORMATIVE DIGEST/POLICYSTATEMENT OVERVIEW:
The Department of Alcohol and Drug Programs(ADP) is proposing an emergency regulatory action tochange the formula used to calculate the allocation offunds to counties for implementing the SubstanceAbuse and Crime Prevention Act of 2000 (SACPA).This change will result in a fairer and more equitableallocation of funds. It places more emphasis ondemonstrated SACPA client treatment caseloads, yetavoids drastic annual changes in funding that mightotherwise disrupt SACPA programs.
For FY 2001–02, 2002–03, and 2003–04, ADPbased SACPA allocations on a base allocation (50%),county drug arrest data (25%), and total county drugtreatment caseload (25%).
For FY 2004–05 and following years, ADP pro-poses to change the allocation formula to a baseallocation (50%), county drug arrest data (10%), andcounty SACPA client treatment caseload data (40%).The portion of each county’s SACPA allocation basedon drug arrests is reduced and the portion based onSACPA treatment caseload is increased in order toencourage counties to place more SACPA clientsin treatment.
When SACPA was first adopted in 2000, ADP basedits methodology for distributing SACPA funds on totalcounty drug treatment caseload data (i.e., the numberof individuals receiving drug treatment in each county)because SACPA treatment caseload data did notyet exist.
A more recent review of county SACPA plans andexpenditures shows that some counties expendSACPA funds before the end of the fiscal year, whileother counties carry over funds from previousfiscal years.
Discussions between ADP and the SACPA State-wide Advisory Group indicated that this disparity wascaused in part by the fact that the allocation was basedon total county drug treatment caseload data, ratherthan on more specific county SACPA treatmentcaseload data.
As a result, stakeholders asked ADP to develop anallocation formula that would more accurately respondto a county’s treatment caseload needs. The allocationformula proposed in this regulation was developedthrough collaboration between ADP, the SACPAStatewide Advisory Group, and the County Alcoholand Drug Program Administrators Association ofCalifornia (CADPAAC).
This change is needed to distribute SACPA funds tocounties in proportion to their actual SACPA treatmentneeds, so that all counties will have sufficient SACPAfunds to provide SACPA treatment services through-out the fiscal year. Without this amendment, somecounties will not be able to provide drug treatmentinstead of incarceration, as mandated by the SubstanceAbuse and Crime Prevention Act of 2000.
While the computations contained in the regulationmay appear complicated, such complexity is needed toavoid large percentage increases or decreases in theallocation amounts counties would receive, therebyavoiding disruption to county SACPA programs.Additionally it is necessary to draft the regulation withsuch specificity so that counties can follow the processthat is used to develop their allocations. Simplifyingthe regulatory language to make it more user-friendlywould sacrifice specificity. A more simple explanationof the regulations is contained in the initial statementof reasons enclosed with this request.
Specifically, this regulatory change makes thefollowing amendments:
• Current Section 9525(a) requires ADP to reserve upto one half of one percent (0.5%) of total funds fromthe Substance Abuse Treatment Trust Fund(SATTF) for a long term evaluation of the SACPAprogram. Section 9525(a) is amended to requireADP to reserve such funds each year. This change isneeded for clarity.
• Current Subsection 9525(b) allows ADP to reserveup to five percent (5.0%) of total SATTF funds,subject to annual approval by the State Departmentof Finance. Section 9525(b) is amended to specifythat ADP may reserve such funds each year. Thischange is needed for clarity.
• No changes have been made to Section 9525(c).

• Section 9525(d), (e), and (f) have been deleted andreplaced with new subsections (d), (e), (f), (g), (h),(i), and (j)
• New Section 9525(d) bases fifty percent (50%) ofeach county’s initial SACPA allocation forFY 2003–04 and following fiscal years on countypopulation, approximately forty percent (40%) onannual county SACPA treatment caseload, anyapproximately ten percent (10%) of annual countydrug arrest data. Any remaining SATTF fundswould be distributed to counties as a supplementalallocation.
• New Section 9525(e) would distribute an allocationbased on population to each county for FY 2004–05and following years. A minimum of $146,278 wouldbe allocated to each county. That amount would beadjusted by the ratio of each county’s totalpopulation to the total Statewide population, accord-ing to Department of Finance population estimatesfor 2002. The $58,511,478 total to be distributedusing this formula is equal to fifty percent (50%) ofthe total amount ($117,022,956) distributed to allcounties for fiscal year (FY) 2003–04 for SACPAdrug treatment. This portion of the SACPA alloca-tion is frozen at the FY 2003–04 base amount toprevent wide fluctuation in county allocations yearto year, in order to facilitate county planning.
• New Section 9525(f) would distribute an allocationbased on county SACPA treatment caseload data toeach county for FY 2004-05 and following years.County SACPA treatment caseload data is beingused instead of county drug treatment data, becauseSACPA treatment caseload data is a more accurateindicator of county SACPA treatment needs than istotal county drug treatment data. The portion ofeach county’s SACPA allocation based on SACPAtreatment caseload was increased in order to providean incentive for counties to place more SACPAclients in treatment in lieu of incarceration, asmandated by the Substance Abuse and CrimePrevention Act of 2000.
• New Section 9525(g) would distribute an allocationbased on county drug arrest data to each county forFY 2004–05 and following years.
• New Section 9525(h) adjusts county SACPA treat-ment caseload data and county drug arrest data toplace the counties on the same measuring scale,using county SACPA treatment caseload data anddrug treatment caseload data per thousand of countypopulation (as shown in the most recent annualdata obtained from the California Department ofFinance). New Section 9525(h) also specifies thatthe standard deviation, a measure of variabilityaround the mean, shall be used to determine thedegree to which a county’s SACPA treatment
caseload data or drug arrest data actually deviatesfrom the statewide mean. In the calculations,numbers are rounded to two decimal places anddollars are rounded to the nearest dollar. The currentmethodology is structured so that the most populouscounties receive the bulk of funding, regardless ofthe actual rate of drug treatment caseload. Theproposed methodology seeks to minimize theweight of population, by standardizing SACPAtreatment caseload as a rate per thousand of eachcounty’s population. This change is necessary tofacilitate accurate county-to-county comparisons ofSACPA treatment caseload, regardless of countypopulation.
• New Section 9525(i) specifies that the county’sallocation based on population shall be added to itsallocations based on SACPA treatment caseloaddata and county drug arrest data, to determine theamount of the county’s initial allocation. If the sumof all county initial allocations is less than the totalavailable SATTF funds for the year, due to thecalculations specified in Section 9525(h), newSection 9525(i) specifies that any remaining fundsshall be distributed to counties as a supplementalallocation.
• New Section 9525(j) specifies that the county’sinitial allocation shall be added to its supplementalallocation to determine the county’s total SACPAallocation for the year.
• Current Sections 9525(g) and (h) have beenrenumbered as new subsections (k) and (l). Nochanges have been made to these two subsections.An example is given to demonstrate each of the
calculations in Section 9525.

Sections 11755 of the Health and Safety Code.

FISCAL IMPACT STATEMENTSAnticipated costs or savings in federal funding to
the State: ADP does not anticipate any costs to federalgovernment as the result of this regulatory action,because this regulation does not impact any federallyfunded State agency or program.
Anticipated costs or savings to any State agency:ADP does not anticipate any costs to the State GeneralFund, because this regulatory action does not expandthe scope of the implementing statute.
Anticipated costs to county or local government:The proposed formula would result in lower alloca-tions than the current formula for 29 counties, and

higher allocations for 29 counties. The range of lossfor counties would be 0.20% to 16.8%. The range ofgain for counties would be +0.25% to +23.3%. ADPanticipates a minimal impact on counties statewidebecause the allocation formula has been designed toavoid drastic annual changes in funding that mightdisrupt SACPA programs.
Significant, statewide adverse economic impactdirectly affecting business, including the ability ofCalifornia businesses to compete with businesses inother states: ADP does not anticipate an impact onbusinesses statewide, because statewide total fundsavailable to counties for purchasing treatment servicesfrom providers will not be impacted. ADP does notanticipate that this regulatory action will affect theability of California businesses to compete withbusinesses in other states. ADP does not anticipate thatthis regulatory action will affect the creation orelimination of jobs, the creation of new businesses, theelimination of existing businesses, or the expansion ofbusinesses currently doing business within the Stateof California.
Impact on Small Businesses: ADP does not antici-pate an impact on businesses statewide, becausestatewide total funds available to counties for purchas-ing treatment services from providers will notbe impacted.
Cost Impact on Representative Private Persons orBusinesses: None. ADP is not aware of any costimpacts that a representative private person orbusiness would necessarily incur in reasonable com-pliance with the proposed action.
Impact on Housing Costs: ADP does not anticipatethat this regulatory action will impact housing costs inany way.
Nondiscretionary cost or savings imposed on localagencies: None
LOCAL MANDATE DETERMINATIONADP has determined that this proposed regulatory
action will not impose any new mandates on schooldistricts or other local governmental agencies or anymandates which must be reimbursed by the Statepursuant to Part 7 (commencing with Section 17500),Division 4 of the Government Code.

Time, Place and Nature of Proceedings: TheSan Francisco Bay Conservation and DevelopmentCommission gives notice that it will hold a publichearing on Thursday, September 2, 2004, at 1:00 p.m.at the Port of San Francisco Board Room, SecondFloor, Ferry Building, San Francisco, Californiaconcerning the proposed amendment to the Commis-sion’s permit application form that is found inAppendix D, Division 5 of Title 14 of the CaliforniaCode of Regulations. INFORMATIVE DIGEST/POLICYSTATEMENT OVERVIEW
Currently, Appendix D to the Commission’s regu-lations contains the permit application form that isused by individuals, private entities and agencies thatwish to apply for one of three types of permit: a majorpermit, a minor (administrative) permit, or a region-wide permit. A major permit generally applies to Bayfill and shoreline development work within theCommission’s jurisdiction that is significant in its sizeand Bay impacts, or where the nature and location ofthe work raise significant policy issues. Minor permitsgenerally involve new work or repairs, enumerated inregulation section 10610, that do not raise significantpolicy issues. Regionwide permits cover very minorwork such as small repairs to, or replacement of,structures and utilities in the Commission’s Bay andshoreline band jurisdictions.
The application asks for information and docu-ments that are required to file an application with theCommission. The proposed changes to the applicationinclude new questions necessary to reflect changesto the Commission’s laws and policies that have takenplace since the last amendment to the applicationform in 2000. Additional changes would clarify thequestions, simplify the form and make editorialcorrections.

Penal Code § 3052 vests with the Board theauthority to establish and enforce rules and regulations

under which prisoners committed to state prisons maybe allowed to go upon parole outside of prison wheneligible for parole.
Penal Code § 5076.2 authorizes the Board topromulgate, maintain, publish, and make available tothe general public, a compendium of its rules andregulations.
Pursuant to PC § 3041, one year prior to theinmate’s minimum eligible parole release date a panelof the Board of Prison Terms (Board) shall meet withthe inmate to determine whether a parole date will beset. . . . ‘‘The release date shall be set in a mannerthat will provide uniform terms for offenses ofsimilar gravity and magnitude in respect to sentencingrules that the Judicial Council may issue and anysentencing information relevant to the setting of parolerelease dates.’’
The Board shall hear each case annually thereafter,unless for specific reasons that shall be stated on therecord, it is found that the prisoner would notreasonably be expected to have parole granted duringthe following years. In this instance, a prisoner’s casemay not be reheard for up to five years. (PC§ 3041.5(2)(A)–(B).)
Currently, CCR § 2253 allows prisoners to request acontinuance of their hearing on any ground, includingthat he or she had insufficient time to prepare for thehearing. Such request is to be submitted in writing,before the hearing, to department staff who will decidewhether to grant the continuance. A request during thehearing shall be made to the hearing panel who shalldecide whether to grant the continuance. Any requestand reasons for continuances shall be documented.Requests for continuances may be granted for goodcause. Continuances should not be granted when theprisoner is challenging his case in court, unless thecourt has specifically restrained further proceedings.
Proposed amendments to CCR § 2253 will deletecurrent language, redefine the request for continuancesand add two additional methods in which paroleesand prisoners may request delays of their hearings. Inaddition, Penal Code § 3052 has been added as anauthority reference citation under the ‘‘Note’’ section.
The first method for delaying a life prisoner hearingwould be for the prisoner to submit a request for apostponement at the earliest date in which the prisonerbecomes aware of the need for a delay. Such requestmay be granted for good cause as set forth in proposedCCR § 2253(b).
Pursuant to proposed CCR § 2253(c), a prisoner orparolee may request a continuance of the hearing forgood cause. Such request would be made after thecommencement of the hearing for reasons that wereunknown or reasonably could not have been known
prior to hearing. The Board shall weigh the need forthe request and any inconvenience to parties present atthe hearing.
Proposed CCR § 2253(d), will codify the currentprocess in which life prisoners may stipulate to beingunsuitable for parole at or before the hearing except atthe Initial Parole Hearing. Such offers shall beconsidered by the Board as early as possible. If theoffer to stipulate is submitted within 10 days of thehearing date, the Board will make a reasonable effortto vacate the hearing and have the affected partiesnotified. If the hearing date cannot be vacated insufficient time, the offer to stipulate will be consideredat the time of the hearing.
LOCAL MANDATESThe Board has determined that the proposed
action imposes no mandate upon local agencies orschool districts.

INFORMATIVE DIGEST/POLICYSTATEMENT OVERVIEW
Existing law, section 1712 of the Welfare andInstitutions Code, assigns responsibility to the Depart-ment of the Youth Authority (Department) to make andenforce all rules appropriate to the proper accomplish-ment of the functions of the Department. State andfederal constitutions grant the right of freedom ofreligion to all. Existing law, section 1705 of theWelfare and Institutions Code, states that it is theintention of the Legislature that all persons in thecustody of an institution under the supervision of theDepartment of the Youth Authority shall be affordedreasonable opportunities to exercise religious freedom.Regulations are needed in order for the Department tocomply with these state and federal constitutional andstatutory mandates. The proposed regulations are
required to ensure that the Department allows wardsthe reasonable opportunity to participate in religiousservices and programs as well as be afforded thereasonable opportunity to exercise religious freedomwithout discrimination or preference unless such isinconsistent with the safety and/or security of thefacility or promotes violence or illegal acts.
ASSESSMENT STATEMENTThe Department has determined that the proposed
regulations will not: (1) create nor eliminate jobswithin California; (2) create new businesses oreliminate existing businesses within California; or(3) affect the expansion of businesses currently doingbusiness within California.

NOTICE OF INTENT TO LIST A CHEMICALThe Safe Drinking Water and Toxic Enforcement
Act of 1986 (commonly known as Proposition 65),codified at Health and Safety Code section 25249.5et seq., provides two primary mechanisms for admin-istratively listing chemicals that are known to the Stateto cause cancer or reproductive toxicity (Health andSafety Code section 25249.8(b)). A chemical may belisted under Proposition 65 when a body considered tobe authoritative by the state’s qualified experts hasformally identified the chemical as causing cancer orreproductive toxicity. The following entities areidentified as authoritative bodies for purposes ofProposition 65, as it pertains to chemicals known tocause cancer: the U.S. Environmental ProtectionAgency, the International Agency for Research onCancer, the U.S. Food and Drug Administration, theNational Institute for Occupational Safety and Health,and the National Toxicology Program.
