feet per task in CA!

– Requires 2 hour Annual Refresher Class

Dear Mr. Sheehan:
Thank you for your request on an applicability determination on whether “pipe bursting” is a regulated
activity under the Asbestos National Emission Standard for Hazardous Air Pollutants (NESHAP).
EPA will normally regulate non-friable materials that undergo extensive damage when mechanical removal
methods are employed. In reviewing “pipe bursting” documentation it is apparent that non-friable Category II
asbestos cement pipe (transite) would undergo extensive damage and therefore become Regulated Asbestos
Containing Material (RACM) during the process. Transite pipe undergoing “pipe bursting” would have to be
characterized as RACM and therefore all notification, work practice, and disposal requirements of the Asbestos
NESHAP must be followed.
In a situation where the waste from the “pipe bursting” is brought to the surface, all asbestos containing
material must be treated as regulated waste under the Asbestos NESHAP when the original project exceeds 260 linear
feet of pipe.
In the situation you describe, where transite waste has been brought to the surface and mixed with existing
surface material, all waste must be collected and properly contained, labeled, shipped and disposed of according to
NESHAP requirements. The material presently on site may violate NESHAP waste disposal requirements, waste
facility requirements, and proper work practices when found dry on site. Additional days of violation for visible
emissions are also possible.
Asbestos NESHAP violations are considered “Significant Violators” under EPA penalty policy and can
involve penalties of up to $27,000 per day per violation or criminal prosecution. Please keep me informed of any
enforcement action the District may issue in order for EPA to determine the appropriateness of Federal Action.
