Introduction
Asbestosisanaturallyoccurringmineralfiberthathasbeenusedextensivelyinconstructionandmanyotherindustries.Manufacturershaveusedasbestosintheircommercialproductsbecauseasbestosisnoncombustible,noncorrosive,nonconductive,andhashightensilestrength.Asbestosfibershavebeenmixedwithbindingagentstocreateapproximately3600differentcommercialproducts.Theamountofasbestoscontainedintheseproductscanvaryfrom1to100percent.

Status of Asbestos-Containing Products
Asof1990,theEnvironmentalProtectionAgency’s(EPA’s)AsbestosBanandPhaseOut(ABPO)Rulehasbannedthemanufacturing,processing,orimportationofthefollowingasbestos-containingproducts:corrugatedpaper,rollboard,commercialpaper,andspecialtypaper.

Acourtdecisiondeterminedthefollowingasbestos-containingmaterialsarenolongersubjecttotheABPORule:asbestos-cementcorrugatedsheet,asbestos-cementflatsheet,asbestos-cementshingle,asbestos-cementpipe,asbestosclothing,millboard,pipelinewrap,roofingfelt,non-roofingcoatings,roofcoatings,andvinyl-asbestosfloortile.Thecourtdecisionmeanstheasbestos-containingmaterialsnolongersubjecttotheABPOrulecanbemanufactured,processed,importedandusedintheUnitedStates.Be aware these asbestos-containing materials may be encountered in any renovation/remodel project regardless of the age of the facility. Any building could still contain these materials and should be surveyed prior to renovation/demolition project.
Labeling of Asbestos-Containing Products
In1986,theU.S.ConsumerProductSafetyCommission(CPSC)requiredlabelingofproductscontainingasbestos.Theseproductsinclude:
• Asbestospaperandmillboard
• Asbestoscementsheet
• Dry-mixasbestosfurnaceorboilercement
• Centralhot-airfurnaceductconnectorscontainingasbestos
TheABPOrulerequiresmanufacturers,processorsorimporterstolabelasbestos-containingmaterialwhilethematerialremainsindistribution.TheEPArequiredlabelingofflooringfeltsinceAugust27,1990,forallstockonhand.TheEPArequireslabelingofcommercialpaper,corrugatedpaper,rollboard,andspecialtypaper.

Is Asbestos Dangerous?
Inhalationofasbestosfiberscanbedeadly.Evenshort-termexposuretoasbestosfiberscanbeharmful.Forexample,indocumentedcases,familymembersofasbestosworkershavecontracteddiseasefromexposuretoasbestosfibersontheworkers’clothing.Authoritiesbelievethereisnosafelevelofexposure,andmanyexpertsbelievethemoreyouareexposedtoasbestos,thehighertheriskofcontractinganasbestos-relateddisease.
Who Might be Exposed to Asbestos?
Constructionjobsinrenovation,demolition,andconstructionmayresultinexposuretoasbestos,eitherdirectlyorindirectly(i.e.,asaresultoftheactivityofnearbyworkersinothertrades).Thelistbelowdisplayssomeoftheconstruction-relatedworkerswhomaybeexposedtoasbestosonthejob:

How Does Exposure to Asbestos Occur?
Exposuretoasbestosoccurswhenasbestosfibersarereleasedintotheair.Thetypicalsizeofanasbestosfiberissosmallthatyoucannotseeitwiththenakedeye.Infact,asbestosfibersaresosmalltheypassthroughnormalvacuumcleanerfiltersandgetbackintotheair.Theasbestosfibersaresolightthattheycanstayairborneformanyhours.Thesepropertiesincreasetheextentofasbestosexposureforindividualswithintheaffectedarea.
Asbestos-containingmaterialiscalledfriableifitcanbecrumbledbyhandpressureorimpact,causingtheasbestosfiberstobecomeairborne.Theasbestosfiberscanbeinhaledandembeddedinthelungs.Yourbodyhasnonaturalmechanismtoremovethesefibers.
Levels of Exposure
Toprotectworkershandlingasbestos-containingmaterials,thefederalOccupationalSafety&HealthAdministration(OSHA)establishedtwolevelsofexposure:permissibleexposurelimit(PEL)andtheexcursionlimit.
Permissible exposure limit (PEL)-definedas0.1fiberspercubiccentimeterofair(f/cc)averagedoveraneight-hourday.
Excursion limit-definedas1.0fiberspercubiccentimeterofair(f/cc)averagedoverasamplingperiodof30minutes.
Classes of Work
Cal/OSHA classifies asbestos abatement work into four categories or classes (I, II, III, IV). Contractors should know which class of work pertains to their project.

Record Keeping-Completeandaccuraterecordsoftheproject’scompletioninaccordancewithCal/OSHAandEPAguidelinesmustbekeptandmaintainedforatleast30years.Theserecordsmustbemadeavailabletoemployeesandformeremployeesupontheirrequest.

Types of Diseases
Aworkercaneitherinhaleoringestairborneasbestosfibers.Onceinhaledoringested,asbestosfiberscaneasilypenetratebodytissues.Exposuretoasbestosmaycauseseveralseriousdiseases.
Asbestosis-aserious,chronic,non-cancerousrespiratorydisease,whichoccurswhenasbestosfibersbecomelodgedinthelungs.Thelungtissuesbecomeirritatedandthesmallairtubesandsacsinthelungsbecomeinflamed.Astheinflammationheals,permanentscartissue(calledfibrosis)remains.
– Early Symptoms:Shortnessofbreath,coughing,fatigue
– Treatment:Thereisnoeffectivetreatmentforthiscondition.
– Prognosis:Disablingorfatal
Lung Cancer-Malignantlungtumor(s),fivetimesmorecommoninpeopleexposedtoasbestosthaninindividualswhohavenotbeenexposed.Smokinggreatlyincreasesthisrisk.Asmokerwhoisheavilyexposedtoasbestosis30to90timesormorelikelytodeveloplungcancerthananon-smoker.

Mesothelioma-arareanddeadlyformofcancerthatmayoccurfromrelativelylightexposuretoasbestos.Thiscancerinvolvestheliningofthechestandabdomen.
– Early Symptoms:Shortnessofbreath,chestorabdominalpain
– Treatment:Thereisnoeffectivetreatmentforthiscondition.
– Prognosis:Fatal
Other Cancers-Exposuretoasbestosisalsothoughttoresultincancersoftheesophagus,larynx,stomach,colon,rectum,andgastrointestinaltract.Thesediseasesmaybeduetoingestingsomeasbestosfibersthatarecaughtintheupperairpassagesandthencarriedtothethroatinmucous.
– Treatment:Thereisnocure;however,ifdiagnosedearly,medicaltreatmentisavailable.
Individualswhocontractanasbestos-relateddiseaseoftendonotshowsymptomsfor10to30yearsafterexposure.Assuch,ifworkexposesyoutoasbestos,regularmedicalexamsarecrucialtotheearlydetectionofasbestos-relateddiseases.
Medical Examinations
Workerswhoarefrequentlyexposedtoasbestosshouldreceivemedicalexaminationsonaregularbasis.Allasbestosabatementworkersshouldbegivenafullphysicalwhenhiredandannuallythereafter.Thesemedicalexamsshouldincludethefollowingtests:
• Completemedicalandworkhistory(specificallysymptomsoftherespiratorysystems,cardiovascularsystems,anddigestivetract)

• Chestx-ray
• Pulmonaryfunctiontest
• Anylaborotherteststhedoctordeemsnecessary(e.g.,stoolsample)
Risk Factors
Theamountofasbestosexposure,thelengthofexposure,andnumberofexposuresallseemtoinfluencethelikelihoodofdevelopingasbestos- relateddisease.Thegreateryourtotalexposuretoasbestos,thegreaterchanceyouwillbecomeill.Inaddition,(asmentionedpreviously)smokinggreatlyincreasesone’schancesofcontractinganasbestos-relateddisease.
TheNationalInstituteforOccupationalSafetyandHealth(NIOSH)estimatesthatpersonsexposedtoasbestosmayhavefivetimesthechanceofdevelopingthediseasesdescribedinthisbooklet.Reducethisriskbytakingthenecessaryprecautionstolimityourexposuretoasbestosasmuchaspossible.

Introduction
Asacontractor,youarerequiredtobeawareofthepresenceofasbestosonajob.Theowner,employer,orcontractormustdeterminewhetherasbestosispresentbeforeworkbeginsonaproject.Theemployerorcontractormustassumethatasbestosispresentinanybuildingorstructurebuiltbefore1980unlesstheownercanproduceproofthatmaterialsareasbestos-free.Theowner’sresponseshouldbedocumented.Duringthepre-jobsafetyconference,theasbestoscontractormustprovideacopyofhis/herCal/OSHAregistrationtotheprimeorgeneralcontractorandanyotheremployersatthesitebeforethecommencementofanyasbestos-relatedwork.Theasbestoscontractorandothercontractorsonsiteshouldensurethatallindividualsonsiteareawareofasbestosabatementactivities.Yourhealth,youremployees’health,andyourprotectionfromliabilityalldependonyourawarenessofthepresenceofasbestosonajob.
TheCaliforniaLaborCodedefinesasbestos-related workas“anyactivitywhichbydisturbingasbestos-containingconstructionmaterialsmayreleaseasbestosfibersintotheair.”TheLaborCodefurtherdefinesasbestos-containing construction materialsas“anymanufacturedconstructionmaterialthatcontainsmorethanone-tenthof1percent(.1%)asbestosbyweight.”Assuggestedbythisdefinition,exposuretoasbestoscanoccurfromanumberofconstruction-relatedoperations.
Forexample:
• Whileremodelingahometoaddastairway,acontractorwhocutsthroughaceilingsectionmayencountersprayed-onasbestosinsulation.

• Whilereplacingpipesduringaminorrenovation,aplumbermaybeexposedtodeteriorated,asbestos-containingpipecovering.
Insulationcontractorsmaybeexposedtoasbestosfiberswhencuttingthroughasbestosshinglesidingtoinsulateawall.
Asbestos Abatement Certification and
DOSH Registration
AcontractormustbecertifiedandregisteredwithCal/OSHA(i.e.,DOSH-registered)foranyworkthatinvolves100squarefeetormoresurfaceareaofasbestos-containingconstructionmaterials.Certifiedcontractorsmustpassamorecompre-hensiveAsbestosCertificationExaminationadministeredbyCSLBandmustregisterwiththeAsbestosContractorRegistrationUnitoftheDepartmentofIndustrialRelations’DivisionofOccupationalSafetyandHealth(DOSH).ApplicationsforDOSHregistrationmustincludethefollowingdocumentation:
• CertificationbyCSLBforasbestosabatementwork
• Heathinsurancecoverage(ora$500trustaccountforeachemployee)
• Workers’compensationinsurance
• Evidencethatallemployeesaretrainedandcertifiedasrequiredbystateandfederalregulations
• Methodsandpoliciesforprovidingasafeplaceofemployment
• Verificationthatthecontractorhasthenecessaryequipmenttosafelyperformasbestos-relatedwork
Nocontractormayengageinasbestos-relatedworkof100squarefeetormoreiftheyhavenotpassedthecertificationexaminationandregisteredwithDOSH.The

penaltiesarestiffifacontractorperformsasbestos-relatedworkof100squarefeetormorewithoutCSLBcertificationandDOSHregistration.
Exceptions-AcontractordoesnothavetobecertifiedorDOSH-registeredtoinstall,maintain,repair,andremovelessthan100squarefeetofthefollowingmaterialsinanon-friablestate:
• Asbestospipe
• Sheetasbestosgoods
• Vinylasbestosfloor
• Asphaltsaturatedroofing
Ifthesematerialsbecomefriableduringinstallation,mainte-nance,orrepair,orifmorethan100squarefeetofmaterialsareinvolvedintheproject,aCSLB-certified,DOSH-registeredcontractormustperformtheabatement.

Identifying Asbestos
Whileitispossibleto“suspect”thatamaterialcontainsasbestosbyvisualinspection,actualdeterminationscanonlybemadebylaboratoryanalysis.Stopworkintheareaimmediately.Itisrequiredthatacertifiedindustrialhygienist,asbestosconsultantcertifiedbyCal/OSHA,orcontractorwhohascompletedAHERAinspectortrainingsampleanypre-sumedasbestos-containingmaterial(PACM).Iftheresultsofthesamplingrevealthepresenceofasbestos,acertifiedindustrialhygienist,asbestosconsultanttrainedbyCal/OSHAorcontractorwhohascompletedAHERAinspectortrainingmustmonitortheairtodeterminetheconcentrationofasbestosfibersintheair.

Buildingrecordsmayindicatethepresenceofasbestosonasite,buttheserecordsareofteninaccurateandshouldnotbeusedasasubstituteforprofessionaladvice.However,schoolsarerequiredtoidentifythelocationofallbuildingandconstructionmaterialthatcontainasbestosandtheymustmakethisinformationavailabletothepublic.
Determining the Presence of Asbestos-Theowner,employer,orcontractormustdeterminewhetherasbestosispresentbeforeworkbeginsonaproject.Theemployerorcontractormustfirstasktheownerwhetherasbestosispresentinanybuildingorstructurebuiltbefore1980.Theresponseshouldbedocumented.

Asbestos Standard for the Construction Industry-MostworkersandcontractorsinCaliforniafallunderthejurisdictionoftheFederalOSHAStandard,AsbestosStandardfortheConstructionIndustry,andTitle8oftheCaliforniaCodeofRegulations,section1529.Thesestandardsdescribethestate-of-the-artmethodsusedtosample,test,orremoveasbestos-containingmaterials.Finally,thesestandardsexplainthedocumentationproceduresnecessarywhenworkingwithasbestos-containingmaterials.Even if you are working with less than 100 square feet of surface area of asbestos- containing material, you must still follow the provisions of the asbestos standard for the construction industry.
Asbestos-Abatement Work
Asbestos-abatementworkincludesencapsulating,enclosing,andremovingasbestosatasite.Workersperformingthisworkmayhavehighpotentialforexposuretoasbestosfibers.Removingasbestosistheonlypermanentsolutiontoitsdangers.However,theEPArecommendsiftheasbestosisintact,enclosingorencapsulatingasbestosonsitetogetherwithperiodicmonitoring,maybethebestcourseofaction.Improperremovalofasbestos-containingmaterialcancreateadangeroussituationwherelittleornoriskpreviouslyexisted.
Asafetyconferencemustbeheldbeforethestartofworkonallasbestos-handlingjobs.Theconferencemustinclude:
• Representativesoftheownerofthecontractingagency• Employer• Employees• Employeerepresentatives
Suchaconferencemustincludeadiscussionoftheemployer’ssafetyprogramandsafeworkpracticestobefollowed.

Asmentionedpreviously,youmustmakeeveryattempttofindoutifasbestosispresentonasitebeforebeginningwork.Otherwise,youruntheriskofcriminalprosecutionifasbestos-relatedworkisdonewithoutproperCSLBcertificationandDOSHregistration.Bynotobtainingnecessarycertificationandregistrationandbynotfollowingproperabatementprocedures,youmayalsobeinviolationoflawsthatregulateasbestosexposureandmayruntheriskoflawsuitsfromemployeeswhohavebeenillegallyexposed.
NotethatFederalOSHAregulationsrequireapre-jobsiteassessmentforgeneralhealthandsafetyhazards,includingasbestos.Itisinyourbestinteresttodocumentthisassess-mentandanyothereffortstodeterminethepresenceofasbestosbeforeworkbegins.

Contract Protection
To protect against the costs and damages associated with delay if asbestos is discovered after work is already in progress, the contractor should include a “changes and extras” clause in any contract for repair and renovation of existing facilities.Suchaclauseshouldnotifyownersoftheirobligationtodetermineifthestructurecontainsasbestos.Theclauseshouldprovideforincreasedcompensationandanincreaseintimeforcompletionifphysicalconditionsatthesitearedifferentfromthosedescribedintheplansandspecifications.Any new conditions, such as asbestos discovered mid-project, would then trigger a “claim” or “extra” negotiation between the contractor and the owner.Withoutsuchaclause,thecontractorshouldincreasetheinitialbidtocoverunforeseenhazardsoradditionalworkthatmayonlybediscoveredonceworkbegins;otherwise the contractor runs the risk of paying for any such additional work.
