Assembly and Governance Measure 2016 [AS ASSENTED TO BY THE SCHOOL COUNCIL, ASSENTED TO BY HEAD TEACHER]

A Measure of the School Council of Newtown High School to make provision about the School

Council and its transition to an Assembly; the governance arrangements of such an Assembly; the

creation of the Cabinet of the Assembly and its powers and role in executing executive functions; the

delegation of a budget to the Assembly for use by the Assembly and for regulations regarding the

release and entry of sums, auditing and procedures; and for connected purposes.

hereas the School Council, in exercise of their powers conferred articles 16(a)(viii)1 and

16(a)(xii)2 of the Llais Cyfle Constitution; and

Now, therefore, this Measure, passed by the School Council of Newtown High School on 18th May

2016 and approved by the head teacher on 18th May 2016, enacts the following provisions:-

PART 1

STUDENT ASSEMBLY

1 Transition

(1) There shall be a Student Assembly (“the Assembly”) which shall replace the School

Council.

(2) The school shall, transfer the property, rights, powers and other provisions from the School

Council to the Student Assembly on a day appointed by them.

2 Student Assembly

(1) The Assembly shall—

(a) Execute the legislative functions of the School Council, and

(b) Overview and keep the Cabinet of the Assembly accountable, and

(c) Any other function transferred by the school under section 1.

(2) The Assembly shall consist of twenty-four elected members and two or four non-voting

members, unless—

(a) The non-voting members are elected members, then the Assembly shall consist of

twenty two elected members.

3 Composure

(1) Out of the twenty-two members there shall be—

(a) Two members from Year 7 on the Newtown Campus, and

(b) Two members from Year 7 on the John Beddoes Campus, and

(c) Two members from Year 8 on the Newtown Campus, and

(d) Two members from Year 8 on the John Beddoes Campus, and

(e) Two members from Year 9 on the Newtown Campus, and

(f) Two members from Year 9 on the John Beddoes Campus, and

(g) Two members from Year 10 on the Newtown Campus, and

(h) Two members from Year 10 on the John Beddoes Campus, and

(i) Two members from Year 11 on the Newtown Campus, and

(j) Two members from Year 11 on the John Beddoes Campus, and

(k) The Head Boy and Head Girl from Year 13.

4 General elections

(1) The poll at an ordinary general election is to be held on a day in the month of June or July

in the first calendar year following a previous ordinary general election was held.

(2) The Headteacher, by proclamation (“the proclamation”) under the seal shall appoint the

date that any poll is to be held on under this section.

(3) The Assembly is to be dissolved, by the proclamation, at the end of the last meeting before

the date of the poll under this section.

(4) The proclamation must contain the date of the next meeting in the new session of the

Assembly.

(5) “The seal” meaning the seal located in Appendix C2 of the Llais Cyfle Constitution.

(6) The Clerk shall issue notifications of election under this section upon the sealing of the

proclamation.

5 Extraordinary elections

(1) This section applies where a vacancy has occurred in the composure (section 3).

(2) This section applies when the Assembly has resolved that it should be dissolved, and if the

resolution is passed the number of members voting in favour must not be less than two-

thirds of the total number of members of the Assembly.

(3) The Headteacher, by proclamation (“the proclamation”) under the seal shall appoint the

date that any poll is to be held on under this section.

(4) “The seal” meaning the seal located in Appendix C2 of the Llais Cyfle Constitution.

(5) The Clerk shall issue notifications of election under this section upon the sealing of the

proclamation.

6 Provision regarding elections

(1) The school shall publish, statutory guidance providing for procedures when relating to any

election under this Part.

(2) Elections to the Assembly shall be regulated under this section and articles 4 and 5 of the

Constitution.

7 Electors and franchise

(1) The persons entitled to vote as electors at an election for membership of the Assembly are

those who on the day of the poll—

(a) Would be entitled to vote as electors under the Llais Cyfle Constitution.

8 Term lengths

(1) The term of office of any Assembly member—

(a) Begins when the Assembly member is declared the winner, and

(b) Ends with the dissolution of the Assembly.

9 Resignation of members

(1) A member of the Assembly may at any time resign by giving notice in writing to the Clerk.

10 Disqualification from membership of the Assembly

(1) A person is disqualified from being a member of the Assembly if—

(a) They are not a registered pupil of Newtown High School,

(b) They are specified by the school to be disqualified.

11 Presiding officer

(1) The Assembly shall be presided over by the Chair of the Assembly.

(2) If a vacancy has occurred in the office of Chair of the Assembly, then the functions of the

presiding of meetings of the Assembly shall be exercised by the Clerk until the vacancy

has been filled.

12 Standing orders

(1) The proceedings of the Assembly shall be regulated by standing orders, resolutions of the

Assembly, Measures of the Assembly or directions from the Clerk.

13 Power to call for witnesses and documents

(1) The Assembly may require any student—

(a) To attend its proceedings for the purpose of giving evidence, or

(b) To produce documents in his custody or under his control, which

(c) Concerns any subject for which has been consented to by the school.

14 Oversight of the Cabinet of the Assembly

(1) The Assembly shall provide for regulatory functions of the Cabinet of the Assembly to be

determined by standing orders, resolutions of the Assembly, Measures of the Assembly or

directions from the Clerk.

15 Remuneration of Assembly members

(1) The school may make provision for the payment of sums to members of the Assembly.

(2) “Sums” meaning sums paid out of the digital fund.

16 Amendments to the Constitution

(1) The Constitution of Llais Cyfle is amended as follows.

(2) Amend the phrase “School Council” to “Student Assembly” where it occurs.

(3) Amend the phrase “the Council” to “the Assembly”

(4) Amend article 3(b) by omitting “who are members of Llais Cyfle”.

(5) Add a new clause to article 3 to read “Members of the Assembly may be referred to as

Assembly Members.”

17 Transitional provision

(1) The school may make as much transitional provision as it requires necessary in the

carrying out this Part.

PART 2

CABINET OF THE ASSEMBLY

18 Cabinet of the Assembly

(1) There shall be a Cabinet of the Assembly, whose members shall be—

(a) The Chair of the Assembly, and

(b) Such Officers as provided for under this Part.

(2) The members of the Cabinet of the Assembly are referred to collectively as the Officers of

the Cabinet.

(3) The Cabinet of the Assembly shall execute the executive functions of the School Council

19 Chair of the Assembly

(1) The Chair of the Assembly is to be appointed from the position of Head Boy and Head Girl

concurrently.

(2) A person ceases to hold office as the Chair of the Assembly if another person is appointed

to that office.

(3) The functions of the Chair of the Assembly are exercisable by a person designated by the

Clerk to the Assembly if—

(a) The office of the Chair of the Assembly is vacant,

(b) The Chair of the Assembly is for any reason unable to act, or

(c) The Chair of the Assembly has ceased to be a member of the Assembly.

(4) The Chair of the Assembly is the head and presiding officer of the Cabinet of the

Assembly.

20 Officers of the Cabinet

(1) The Chair of the Assembly may, with the approval of the Headteacher, appoint Officers

from among the Assembly members to be named and hold office as Officers of the

Cabinet.

(2) An Officer of the Cabinet appointed under this section holds office at the pleasure of the

Chair of the Assembly.

(3) An Officer of the Cabinet may be removed from office by the Chair of the Assembly or the

Headteacher.

(4) An Officer of the Cabinet may at any time resign.

(5) An Officer of the Cabinet who resigns ceases to hold office immediately.

(6) Any Officer of the Cabinet who resigns from their office does not resign from being a

member of the Assembly.

21 Limit on number of officers and composure

(1) No more than five persons are to hold a position as an Officer of the Cabinet (excluding

the Chair of the Assembly).

(2) At least two of the five persons of the Cabinet shall—

(a) Be pupils who for the majority of the time, reside at the John Beddoes Campus.

(3) “Pupils” means a registered pupil of Newtown High School.

(4) Subsection (2) may be suspended by the school in the instance that no members of the

Assembly, under the terms of subsection (2) (a), wish to nominate themselves to the

positions of Officers of the Cabinet.

22 Exercise of functions

(1) The persons to whom this section applies have the functions conferred or imposed on them

by or by virtue of this Measure or any other enactment.

(2) This section applies to Officers of the Cabinet and the Chair of the Assembly.

(3) Functions may be conferred or imposed on the Cabinet by that name.

(4) “The Cabinet” shall refer to the Cabinet of the Assembly or the Officers of the Cabinet.

23 Transfer of functions

(1) The school may, transfer as many functions, rights, property or provisions as they think it

is expedient for the carrying out of required functions of the Cabinet of the Assembly

under this Measure or future Measures.

24 Functions of the Officers of the Cabinet

(1) Schedule 1 has effect.

25 Meetings of the cabinet

(1) Where possible, the Cabinet should meet at least once every calendar month.

(2) Meetings of the cabinet shall be co-ordinated and organised by the Clerk or other

designated person.

(3) All meetings of the cabinet should have minutes taken by the Clerk or other designated

person.

(4) Meeting minutes are to be published to the secure area for the Cabinet.

(5) Subsection (1) may be suspended when required by the Clerk or other designated person.

26 Remuneration of the cabinet

(1) The school may make provision for the payment of sums to Officers of the Cabinet.

(2) “Sums” meaning sums paid out of the digital fund.

27 Amendments to the Constitution of Llais Cyfle

(1) The Constitution of Llais Cyfle is amended as follows.

(2) Repeal article 6 and 7.

(3) Omit article 9(c).

PART 3

LEGISLATION

28 Assembly Measures

(1) The Assembly may make rules and enactments, to be known as Measures of the Student

Assembly of Newtown High School (referred to as “Assembly Measures”).

(2) A proposed Assembly Measure is enacted by being passed by the Assembly and approved

by the Headteacher.

(3) This Part does not affect the power of the school to make rules or enactments.

29 Legislative competence

(1) Any Assembly Measure which does not comply with article 16 of the Constitution shall be

invalid.

30 Legislative competence – procedure to amend

(1) The Headteacher, by instrument, and affixed with the seal, may amend article 16 of the

Constitution.

(2) “The seal” meaning the seal located in Appendix C2 of the Llais Cyfle Constitution.

31 Proceedings on proposed Assembly Measures

(1) Before a draft Assembly Measure becomes a Measure of the Assembly it must—

(a) Be considered by the Assembly, and

(b) Be resolved on by the Assembly with a two-thirds majority of all Assembly

members.

(2) Subsection (1)(b) may be suspended if—

(a) The proposed Assembly Measure is not affecting both campuses of Newtown High

School.

(3) If subsection (1)(b) is suspended then—

(a) The proposed Assembly Measure shall only require the consent of two-thirds of

members from the campus in which it affects.

(4) “Not affecting” shall be a topic determined by the Clerk at the time before the voting.

32 Submission of proposed Assembly Measures

(1) If is for the Clerk to submit proposed Assembly Measures for approval by the Headteacher.

(2) The Clerk may not submit a proposed Assembly Measure for approval by the Headteacher

at any time when—

(a) The proposed Measure is outside the legislative competence of the Assembly.

33 Approval of proposed Assembly Measures

(1) Any measure which is submitted under section 32 applies.

(2) Once an Assembly Measure has been approved by the Headteacher, the Clerk must send

the assent instrument to the Assembly.

(3) The date of the approval by the Headteacher is to be written on the Assembly Measure by

the Clerk, and forms part of the Assembly Measure.

(4) The Clerk must publish the assent instrument by which an Assembly Measure is approved.

34 Withholding of approval to proposed Assembly Measures

(1) Any measure which is submitted under section 32 applies.

(2) Once assent to an Assembly Measure has been withheld by the Headteacher, the

Headteacher must make in writing, the reason why and the Clerk must send this to the

Assembly.

(3) The proposed Assembly Measure is null and void.

35 Referendum of decision regarding proposed Assembly Measures

(1) Any measure which is submitted under section 32 applies.

(2) Once an Assembly Measure has been signified by the Headteacher that they wish to hold a

referendum of the entire school on the question of approving or withholding approval then,

the Headteacher shall issue this to the Clerk who shall send this to the Assembly.

(3) The Clerk must organise the referendum subject to subsection (2) and article 15 of the

Constitution.

(4) The referendum result is not binding.

36 Signature and seal

(1) Any proposed Measure which has been submitted in accordance with section 32 to 35,

shall—

(a) Be signed by the Headteacher in their own hand, and

(b) Be affixed with the seal of the Headteacher.

37 Resolutions

(1) This section applies when the Assembly has resolved or proposes to resolve something.

(2) Any resolution made by the Assembly does not require the assent of the Headteacher to be

valid.

(3) Any resolution made by the Assembly shall only require a majority of members present to

vote for it to be valid.

(4) Any resolution made by the Assembly shall be published in an appropriate place.

(5) The Standing Orders shall make further provision in implementing this section.

38 Delegated and instrumental legislation

(1) Any enactment which provides for a power to be exercised by instrument is

(a) Granted to the person or title in that enactment.

(2) All instruments shall be pursuant to annulment by a resolution of the Assembly, except—

(a) Those instruments issued by the Headteacher, and

(b) Those instruments issued by the Clerk to the Assembly.

(3) All instruments shall be published in an appropriate place.

39 Amendments to the Constitution of Llais Cyfle

(1) The Constitution of Llais Cyfle is amended as follows.

(2) Repeal the sections of article 13.

(3) Add a new section to article 13 to read “Measures are set out and regulated by Part 3 of the

Assembly and Governance Measure 2016.”

(4) Add a new section to article 13 to read “Measures of the Council continue to be valid

under the old terms of this article.”

(5) Amend article 22(a) by changing “Measure of the Council” to “resolution of the

Assembly”.

(6) Repeal article 22(b).

(7) Repeal article 22(c).

(8) Amend article 22(e) by changing “Measure of the Council” to “resolution of the

Assembly”.

PART 4

FINANCE

40 Creation of the general account

(1) There shall be a general account (“the account”) held by the school and exercised under the

terms of this Measure.

(2) The Assembly shall receive from the school, a sum decided by the Headteacher to be paid

into the account when the Headteacher shall authorise.

(3) The account shall—

(a) Be overseen and audited by the Clerk, and

(b) Be overseen and managed by the Finance and Environment Officer, and

(c) Be overseen and regulated by the Chair of the Assembly.

(4) The Finance and Environment Officer must make a statement regarding—

(a) The amount still remaining in the account, and

(b) The amount still remaining in the digital account, and

(c) The details of sums paid in or out since the last statement given.

(5) The statement must be given at the start of each meeting of the Assembly or the Cabinet.

(6) The account is regarded as an executive function for the purposes of this Measure.

41 Payments out of the account

(1) A sum may only be paid out of the account if—

(a) It has been charged on the account by any enactment, and

(b) It has been authorised by a Measure of the Assembly.

(2) This section is in accordance with article 17 (Finances) of the Constitution.

(3) The account is to renew at the start of each session of the Assembly.

42 Auditing and control of finances

(1) The Assembly must obey all directions given by the school in relation to auditing of the

account.

(2) The Assembly is regulated under Schedule 3 in the direction of auditing and controls.

43 Procedures relating to finances

(1) Schedule 2 has effect.

(2) Schedule 3 has effect.

(3) Schedule 4 has effect.

44 Digital fund

(1) The school may transfer a sum from the holding area to the digital fund (“the digital fund”)

at any time with approval from the school.

(2) Any transfer of sum under this section shall be noted in the digital register.

(3) The Assembly may, via Measure, allow for the release of any sum from the digital fund.

(4) “Holding area” meaning the digital account named the “Bank of Newtown High School”.

(5) “Digital fund” meaning the digital account named “Digital Fund of the Student Assembly”.

(6) “Digital account” meaning a CyfleID account.

45 Power to charge the Assembly for charges incurred

(1) The school may charge and invoice the Assembly for sums to be paid out of the account

and paid to the school.

(2) If the school has invoiced the Assembly then—

(a) The Assembly must receive in writing the invoice or receipt, and

(b) It must be published on the general register.

46 Levying

(1) The Assembly may, via a Measure of the Assembly, establish a levy on—

(a) Any digital currency in use by the School.

(2) Such levy must only apply to—

(a) The purchasing of a digital or physical item using the digital currency,

(b) The transferring of digital currency from one function to another,

(c) The redemption of a digital voucher which provides for digital funds,

(d) The transfer of ownership on items for which a digital currency is used,

(e) The automated function of addition to a digital currency for a particular user.

(3) Subsection (2) may be amended by the school via regulations.

(4) The power to amend via regulations is exercisable by instrument.

47 Maximum value on any levy

(1) No levy established under section 46 must not—

(a) Be established at a rate above five points of a digital currency.

(2) Subsection (1) may be amended by the school via regulations.

(3) The power to amend via regulations is exercisable by instrument.

48 Collection and management of the levy

(1) Any sum from a levy established under section 46 shall—

(a) Be held in the digital fund, and

(b) Be managed and overseen by the Finance and Environment Officer unless—

(c) This function has been transferred to a separate committee under an enactment.

(2) Any committee created under an enactment to manage and oversee the collection and

management of the levy shall have the full powers of the Finance and Environment Officer

in relation to the management and collection of the levy.

(3) “Digital fund” meaning the digital account named “Digital Fund of the Student Assembly”.

(4) “Committee” in this section, meaning a group of persons or a service.

49 Commencement of the levy enactments

(1) The levy enactments (section 46 to 48) shall only commence when—

(a) Approved by resolution of the Assembly, and

(b) The Clerk has published guidance on the rules relating to levying, and

(c) The Assembly has commenced the provisions of Schedule 4, and

(d) A referendum has been issued by the school on the question of commencing the

levy enactments and such referendum has been approved by a majority of the

number of votes cast.

(2) Any guidance published shall be laid to the Assembly.

(3) The Clerk must organise the referendum subject to subsection (2) and article 15 of the

Constitution.

50 Duty to inform regarding new levying

(1) If a levy is established via a Measure of the Assembly, then—

(a) There shall be information and directions given by the Cabinet of the Assembly in

the exercising of the levy, and

(b) Such directions and information should be informative for students.

(2) Any information and direction given shall be published in an appropriate place.

(3) The Clerk shall issue impartial advice, regarding any new levy, to be published in an

appropriate place.

51 Amendments to the Constitution of Llais Cyfle

(1) The Constitution of Llais Cyfle is amended as follows.

(2) Add a new section to article 16 (a) to read—

“(xv) the provision and direction of any digital currency in use by the school,

(xvi) the provision and creation of levy of a digital currency,

(xvii) the authorisation and release of funds granted to the Assembly,”

(3) Substitute article 16 (a) (xi) for “the provision of financial matters authorised by the

Constitution or the Assembly and Governance Measure 2016,”

PART 5

GENERAL AND CONSEQUENTIAL

52 Provision of Welsh

(1) Where possible, in any proceeding of the Assembly, the provision of Welsh should be

respected.

53 Title and commencement

(1) The title of this measure is the Assembly and Governance Measure 2016 and it shall come

in force on the day in which the Clerk shall appoint.

54 Amendments

(1) The Constitution of Llais Cyfle is amended as follows.

(2) Section 55 of this Measure shall apply to Appendix A.

(3) The Suggestion and Involvement Measure 2016 is amended as follows.

(4) Add the following after section 4—

“4A Secure area for Cabinet Officers

(1) on any digital page, which relates to the Cabinet of the Assembly, shall be

accessible to members of the Cabinet of the Assembly.

(2) Any digital page created under subsection (1) shall include as much

information as required in the carrying out the functions of the Cabinet of the Assembly.

(3) the school shall, implement this section as it sees fit.”

55 Interpretation

(1) In any Measure of the Council or Measure of the Assembly the following shall be

known—

(a) “the Council” (“y cyngor”) meaning the School Council or the Student Assembly;

and

(b) “Constitution” (“Cyfansoddiad”) meaning the Constitution of Llais Cyfle; and

(c) “the Assembly” (“y Cynulliad”) meaning the Student Assembly; and

(d) “measures” (“mesur”) meaning Measures of the Council or Measures of the

Assembly or Draft Measures; and

(e) “staff member” (“aelod o staff”) meaning a person employed at Newtown High

School; and

(f) “Clerk” (“Clerc”) meaning the person designated to be the Clerk to the Assembly;

and

(g) “Chair” (“Cadeirydd”) meaning the person designated to be the Chair of the

Assembly; and

(h) “student” (“Myfyriwr”) meaning a pupil enrolled at Newtown High School; and

(i) “The Cyfle” (“y Cyfle”) meaning the newspaper published by the School; and

(j) “Officers” (“swyddogion”) meaning the Officers of the Council as outlined in

Article 6 of the Llais Cyfle Constitution or Officers of the Cabinet as outlined in

Part 2 of the Assembly and Governance Measure 2016; and

(k) “Headteacher” (“Pennaeth”) meaning the head teacher or acting head teacher of

Newtown High School; and

(l) “Dashboard” (“dashfwrdd”) meaning any digital service produced by Newtown

High School to be designated as Dashboard or any digital service which is the

homepage to the majority of students at Newtown High School; and

(m) “the Website” (“y wefan”) meaning any the school website of Newtown High

School; and

(n) “secure area” (“ardal ddiogel”) meaning the same thing as in the Suggestion and

Involvement Measure 2016.

(o) “proclamation” (“Maldwyn”) meaning an instrument made by the headteacher.

(p) “resolution” (“penderfyniad”) meaning the same as in Part 3 of the Assembly and

Governance Measure 2016.

(q) “levy” (“ardoll”) meaning the provisions of Section 46 of the Assembly and

Governance Measure 2016.

(r) “enactment” (“ddeddfiad”) meaning an enactment, or future enactment of a

Measure of the Council, Measure of the Assembly or instrument.

56 Powers to make statutory provision

(1) The school may, when deemed necessary, produce and enforce statutory provisions under

this enactment for the Student Assembly, the Cabinet of the Assembly or any other

function under this Measure.

(2) Any statutory provisions published shall be laid to the Assembly.

(3) Any statutory provisions published under this section shall be pursuant to annulment by a

negative resolution of the Assembly.

57 Powers to be exercised concurrently

(1) Any power under this Measure which is exercisable by the Clerk is exercisable by the Lead

Teacher.

(2) Any power under this Measure which is exercisable by the head teacher may not be

transferred.

(3) Any power under this Measure which is exercisable by the school may be exercised by

either the head teacher, senior leadership team, Lead Teacher or the Clerk.

58 Regulations to amend

(1) The school may, by regulations, amend this Measure.

(2) Any regulation created in subsection (1) is exercisable by instrument.

SCHEDULES

59 Schedule 1 – functions of the Officers

(1) The Chair of the Assembly shall—

(a) Run, manage, and chair all meetings of the Cabinet and the Assembly, and

(b) Be responsible for public engagement of the Assembly in the wider community,

and

(c) Represent the Assembly, the Cabinet and the school at events where appropriate,

and

(d) Ensure the constitution is upheld, respected, and

(e) Promote the use of the Assembly in school business.

(2) The Officer of the Cabinet appointed as Communications and Involvement Officer shall—

(a) Communicate and be responsible for communicating all business of the cabinet

and the Assembly, and

(b) Work with and liaise with the school on the development of digital services

relating to the Assembly, and

(c) Be responsible and co-ordinate all suggestion and involvement tools including the

suggestions submitted, and

(d) Assist the Chair of the Assembly in the promotion of the Assembly.

(3) The Officer of the Cabinet appointed as Welfare Officer shall—

(a) Be responsible and co-ordinate all business of the cabinet and the Assembly

relating to student welfare, and

(b) Be responsible and co-ordinate all business of the cabinet and the Assembly

relating to bullying and wellbeing and be the lead member on these issues.

(c) “Student welfare” meaning welfare, bullying, conduct, free times, rewards, school

planners and internal school services.

(4) The Officer of the Cabinet appointed as Teaching and Learning Officer shall—

(a) Be responsible and co-ordinate all business of the cabinet and the Assembly

relating to teaching and learning, and

(b) Be responsible and co-ordinate all business of the cabinet and the Assembly

relating to the Teaching and Learning policy.

(5) The Officer of the Cabinet appointed as Finance and Environment Officer shall—

(a) Be responsible and co-ordinate all business of the cabinet and the Assembly

relating to finances of the Assembly, and

(b) Be responsible and co-ordinate all business of the cabinet and the Assembly

relating to the environment, recycling, ESDGC, the Resource Centre and school

buildings.

(6) The Officer of the Cabinet appointed as Health and Fitness Officer shall—

(a) Be responsible and co-ordinate all business of the cabinet and the Assembly

relating to sport, health, community, fitness and food.

(b) Be responsible and co-ordinate all business of the cabinet and the Assembly

relating to the Food and Fitness policy.

(7) The Chair of the Assembly or the Clerk to the Assembly may change these roles as they

see fit.

60 Schedule 2 – Financial procedures

(1) Before any sum may be paid out of the account there must—

(a) Be a document signed by the authorising members assenting to the payment.

(b) Be an entry to the general register about the—

1. Date given to the sum,

2. Name of the sum,

3. Amount of the sum,

4. The intended destination of the sum.

(2) Before any sum may be paid into the account there must—

(a) Be a document signed by the authorising members assenting to the payment.

(b) Be an entry to the general register about the—

1. Date given to the sum,

2. Name of the sum,

3. Amount of the sum,

4. The origin of the sum.

(3) Subsection (2) (a) does not apply when the origin of the sum is from the Head teacher

under section 39.

(4) “Authorising members” means the Clerk, the Finance and Environment Officer and the

Chair of the Assembly collectively.

(5) “The general register” means a spreadsheet setup by the school, held in a digital location.

(6) The digital fund shall be used to provide for any payment of balance to members of the

Assembly or members of the Cabinet under this Measure.

61 Schedule 3 – Auditing procedures

(1) The school may examine the general register at any time.

(2) The Clerk may examine the general register at any time.

(3) Any student may examine the published general register at any time.

(4) Any external audit, examination or examiner may examine the general register at any time.

(5) The general register must be kept up to date in accordance with Schedule 2.

(6) At the end of any session of the Assembly, prior to dissolution, there must be—

(a) A register of all sums paid in or out of the account for the session,

(b) A total sum of all sums paid out of the account for the session.

(7) The register, total sum and the digital register must be published in an appropriate place

and in the annual report established under Part 3 of the Suggestion and Involvement

Measure 2016.

(8) “The general register” means a spreadsheet setup by the school, held in a digital location.

(9) “The digital register” means the same as in section 43.

62 Schedule 4 – Finance committee

(1) There shall be a committee of the Assembly named the Finance Committee to oversee the

finances of the Assembly.

(2) The committee shall have the power to—

(a) Call the authorising members to give evidence in relation to the account.

(b) Examine the general register.

(3) No member of the Cabinet may sit on the Finance Committee.

(4) Subsection (2) may be amended by resolution of the Assembly.

(5) This section shall only take effect when it has been approved by a resolution of the

Assembly.
