    1.0 Introduction

    1. On May 15, 2013 staff of the British Columbia Utilities Commission (“BCUC”)

    requested, by email, for ATCO Electric to provide an updated “block diagram” of

    ATCO Electric’s electric distribution system (“cross border facilities”) in

    northeastern British Columbia (“B.C.”). On June 12, 2013, ATCO Electric

    responded by email and provided a block diagram showing its electric distribution

    system in northeastern B.C. This block diagram provided, among other things,

    details of the 11 lines crossing the Alberta/B.C. border along with the customers

    served from each line.

    2. By letter dated August 23, 2013, the BCUC asked that ATCO Electric provide

    responses to the BCUC’s request for certain information with respect to the

    updated block diagram provided by ATCO Electric in its June 12, 2013 email. In

    particular, the BCUC’s August 23 letter requested that ATCO Electric provide

    responses to six questions. ATCO Electric provided its responses to these six

    questions in a letter dated November 1, 2013. The BCUC’s August 23, 2013

    letter and ATCO Electric’s November 1, 2013 response have been included in

    this Application in Appendix 1 and 2 respectively.

    3. Subsequent to ATCO Electric’s November 1, 2013 letter, the BCUC sought

    additional information in respect of certain of ATCO Electric’s cross border

    facilities. ATCO Electric required advice and direction from the BCUC and on

    Friday March 21, 2014, staff from the BCUC and ATCO Electric held a

    conference call to discuss the additional information required by the BCUC. In

    that conference call it was acknowledged by staff of the BCUC and

    ATCO Electric that amendments to existing Orders in respect of certain

    ATCO Electric cross border facilities were required and that regulatory approvals

    and/or exemptions were required for other cross border facilities.

    4. Accordingly, ATCO Electric hereby submits this Application to the BCUC for

    certain approvals or exemptions in respect of its cross border facilities (and

    customers served from those facilities) or amendments to existing BCUC Orders.

    Details of the specific approvals or exemptions being sought in this Application

    are provided in the sections below. A summary of the specific approvals,

    exemptions or amendments to existing orders sought at each of ATCO Electric’s

    cross border facilities in this application has been included in Appendix 3.

    5. ATCO Electric notes that it went through a name change in 1999. Prior to 1999

    ATCO Electric’s legal name was Alberta Power Limited (“Alberta Power”).

    ATCO Electric notes that this was a legal name change only and did not involve

    any change in the ownership of ATCO Electric. In Appendix 4, ATCO Electric

    has provided a copy of the Certificate of Amendment, issued by Industry Canada,

    noting the change of name from Alberta Power Limited to ATCO Electric Ltd. A

    number of the BCUC Orders referred to in this Application were granted to

    Alberta Power. In this Application any and all required references to

    Alberta Power, in respect of these BCUC Orders, will be to ATCO Electric.

    6. Since 2001, Albertans have had the power to choose the company they

    purchase their electricity from. Currently there are a number of retailers selling

    electricity in the retail market in Alberta. Electricity retailers in Alberta combine

    the cost of purchasing electricity with the cost to deliver the electricity and sell

    that electricity to end-use customers either through a non-regulated contract or

    through a regulated tariff. ATCO Electric owns and operates transmission and

    distribution facilities in its service territory but does not operate in the Alberta

    retail market. The tariffs that ATCO Electric charges for the delivery of electricity

    through its distribution system are regulated by the Alberta Utilities Commission

    (AUC). In this Application, ATCO Electric has made reference to, and has

    provided copies of, the tariffs that are applicable to the customers it delivers

    electricity to in the Province of B.C. As ATCO Electric does not operate in the

    retail market in Alberta, it has not provided a copy of the retail contract or tariff

    that these customers are ultimately billed on. For more information on the retail

    market in Alberta, including a list of retailers operating in the province, please

    refer to the website of the Office of the Utilities Consumer Advocate at

    www.ucahelps.alberta.ca.

    2.0 Approvals and/or Exemptions Sought

    2.1 Exemptions from Section 88(3) of the Utilities Commission Act (UCA)

    7. Section 88(3) of the Utilities Commission Act (UCA) states:

    88(3) The commission may, on conditions it considers advisable, with the advance approval of the Lieutenant Governor in Council, exempt a person, equipment or facilities from the application of all or any of the provisions of this Act or may limit or vary the application of this Act.

    8. ATCO Electric hereby seeks BCUC approval of an exemption, in accordance

    with section 88(3) of the UCA, for two of its cross border facilities.

    2.1.1 Line 2 – Elmworth

    9. ATCO Electric owns a distribution line to a ConocoPhillips Canada Resources

    Corp. (“ConocoPhillips”) site approximately 2.35 km across the Alberta/B.C.

    border. ATCO Electric provides distribution service only to ConocoPhillips and

    there are no other customers connected to the line. The line and service to

    ConocoPhillips has been in place for almost 30 years. ATCO Electric did request

    BCUC approval of this line and service by letter dated January 22, 1987, a copy

    of which was provided in ATCO Electric’s November 1, 2013 response, but it is

    not known whether or not a BCUC order approving the line was ever issued.

    Canadian Hunter Exploration Limited (“Canadian Hunter”) was the original owner

    of the compressor station being served off of the line but that facility has since

    been taken over by ConocoPhillips. ATCO Electric was unable to locate a copy

    of an Electric Service Agreement with Canadian Hunter (or ConocoPhillips) in its

    paper or electronic records. ConocoPhillips is served on ATCO Electric’s AUC

    approved Price Schedule D31 – Large General Service/Industrial Distribution

    Connected Tariff, a copy of which has been provided in Appendix 5.

    10. Accordingly, ATCO Electric hereby respectfully requests BCUC approval of an

    exemption in accordance with Section 88(3) of the Utilities Commission Act for

    this line and service to Conoco Phillips.

    2.1.2 Line 12 – Baytree-Bonanza/Spirit River

    11. During the course of conducting its investigation in respect of the BCUC’s

    August 23, 2013 letter, ATCO Electric located three small distribution taps

    crossing the Alberta/B.C. border that were not originally identified in

    ATCO Electric’s June 12, 2013 block diagram. These taps are located in the

    Spirit River area of Alberta, and serve a total of five small residential and farm

    customers in B.C. just across the Alberta/B.C. border.

    12. The following is a summary of pertinent details in respect of each of the three

    small distribution taps:

    Tap 1 – Consists of approximately 160 meters of 14.4 kV line west of the

    Alberta/B.C. border serving one residential customer. The customer is

    served on ATCO Electric’s AUC approved Price Schedule D11 – Standard

    Residential Service, a copy of which has been provided in Appendix 5.

    ATCO Electric received approval from B.C. Hydro to provide electrical

    distribution service to this customer in a letter dated November 5, 2008. A

    copy of this letter has been provided in Appendix 6. This letter contained

    BC Hydro’s approval to provide electrical distribution service to a 4 lot

    subdivision but, to date, only one lot has been developed and

    interconnected.

    Tap 2 – Consists of approximately 100 meters of 14.4 kV line 11 meters

    west of the Alberta/B.C. border serving one farm customer. The customer

    is served on ATCO Electric’s AUC approved Price Schedule D56 – Farm

    Service, a copy of which has been provided in Appendix 5. ATCO Electric

    received an e-mail from B.C. Hydro on May 4, 2012 in support of

    ATCO Electric providing electric service to this customer. A copy of the

    e-mail has been provided in Appendix 7.

    Tap 3 – Consists of a total of approximately 2.0 km of line west of the

    Alberta/B.C. border serving three farm customers. Two of these

    customers were originally interconnected in the 1950’s and were members

    of the Baytree-Bonanza Rural Electrification Association (“REA”). In

    Alberta, REA’s are not-for-profit cooperatives that own an electric

    distribution system and supply electric energy to its members in a rural

    region. The electric distribution facilities that served the members of the

    Baytree-Bonanza REA were owned and operated by its members.

    ATCO Electric purchased these electric distribution facilities from the

    members of the Baytree-Bonanza REA in 1984, at which point in time the

    members became customers of ATCO Electric, including the two

    customers noted above. The third customer requested service and was

    connected to the line in August 2009. All three customers are served on

    ATCO Electric’s AUC approved Price Schedule D56 – Farm Service, a

    copy of which has been provided in Appendix 5.

    13. ATCO Electric hereby respectfully requests BCUC approval of an exemption in

    accordance with section 88(3) of the Utilities Commission Act for these three

    small distribution taps and the service to the five customers as noted above.

    2.2 Amendments/Updates to Existing Orders and/or Exemptions

    14. In the past, the BCUC has issued certain Orders that provided exemptions and/or

    approvals directly related to ATCO Electric’s cross border facilities. These

    exemptions/approvals were in respect of either the distribution facilities located in

    B.C. or Electric Service Agreements with specific customers served from facilities

    at or near the Alberta/B.C. border.

    15. Since the issuing of certain BCUC Orders, there have been some changes to

    aspects of the service provided at certain cross border facilities. These changes

    include a change in the ownership of the customer facilities being served by

    ATCO Electric’s cross border facilities and/or the addition of other customers to

    the cross border facilities. ATCO Electric hereby seeks BCUC approval to

    amend existing Orders at three of its cross border facilities.

    2.2.1 Line 4 – ENCANA

    16. ATCO Electric owns and operates a distribution line to the B.C. border. From

    that point, Encana Corporation (“Encana”) owns the line to its plant located within

    B.C. The BCUC issued a letter dated October 3, 2006, in reply to a request from

    ATCO Electric in respect of the B.C. regulatory treatment of the supply of service

    at this site, and concluded that, among other things, Encana was not a public

    utility as defined by the UCA, that ATCO Electric was not operating within the

    province of B.C., and that no regulatory approvals or exemptions were

    required for the supply of the service to Encana. Since the BCUC issued its

    October 3, 2006 letter, the ownership of the line and plant changed from Encana

    to Veresen Energy Infrastructure Inc. (“Veresen”). ATCO Electric notes that this

    is the only aspect of the service provided at this cross border facility that has

    changed since the BCUC made its determination outlined in its October 3, 2006

    letter. A copy of the BCUC’s October 3, 2006 letter has been included in

    Appendix 8.

    17. Accordingly, ATCO Electric respectfully requests a BCUC ruling, similar to the

    ruling provided in its October 3, 2006 letter, that no regulatory approvals or

    exemptions are required for the supply of distribution service to Veresen at this

    location.

    2.2.2 Line 8 – Ring Border

    18. On August 1, 1991 the BCUC issued Order G-76-91 exempting the sale of power

    to a Canadian Hunter Exploration Ltd. (“Canadian Hunter”) gas plant from a

    25 kV distribution line located at Ring Border B.C., from provisions of the UCA

    other than Part 2 and Section 114. Since the issuing of Order G-76-91, the

    ownership of the gas plant has changed from Canadian Hunter to

    ConocoPhillips. A copy of Order G-76-91 has been included in Appendix 9.

    19. Schedule 1 provided in ATCO Electric’s November 1, 2013 response to the

    BCUC incorrectly included Bell Mobility Inc. (“Bell Mobility”) as a customer being

    fed off of Line 8. Bell Mobility is actually fed off of Line 9 (Kahntah). In addition,

    the November 1, 2013 version of Schedule 1 noted two other customers,

    TransCanada and Nova Gas, as being fed off of this line. This is incorrect as the

    only customer actually fed off of the portion of the line that is located in B.C is

    ConocoPhillips. Finally, Schedule 1 noted that ATCO Electric owned

    approximately 100 meters of line from the Alberta/B.C. border to the customer’s

    site. This is incorrect as ATCO Electric owns approximately 800 meters of line

    from the border to the customer’s site. ATCO Electric has provided a revised

    Schedule 1, with these errors corrected, in Appendix 10.

    20. ConocoPhillips is served on ATCO Electric’s AUC approved Price Schedule D41

    – Small Oilfield and Pumping Power Tariff, a copy of which has been provided in

    Appendix 5.

    21. ATCO Electric respectfully requests an amendment to BCUC Order G-79-91 to

    reflect the change in ownership of the gas plant, and thus the sale of power from

    the 25 kV distribution line, from Canadian Hunter to ConocoPhillips.

    2.2.3 Line 9 – Kahntah Oil Field

    22. On February 28, 1995 the BCUC issued Order E-7-95 approving the Electric

    Service Agreement between ATCO Electric and Home Oil Company Limited

    (“Home Oil”) for the supply of electricity to Home Oil’s gas plant at Kahntah, B.C.

    On June1, 1995 the BCUC issued Order G-47-95, in respect of an application by

    ATCO Electric to construct a 68 km - 25 kV distribution line to Home Oil’s

    Kahntah gas plant, exempting the sale of power to Home Oil from the application

    of the UCA other than Part 2 and Sections 29 and 30, effective May 17, 1995.

    Since the issuing of Orders E-7-95 and G-47-95, the ownership of the gas plant

    has changed from Home Oil to Devon Canada Corporation (“Devon Canada”).

    In addition, three other customers are now served off of the 25 kV line; Telus

    Communications Inc. (“Telus”), ConocoPhillips and Bell Mobility. A copy of Order

    E-7-95 and Order G-47-95 has been included in Appendix 11. As noted above,

    Bell Mobility was incorrectly included as a customer being fed off of Line 8 (Ring

    Border) in Schedule 1 provided in ATCO Electric’s November 1, 2013 response

    to the BCUC. ATCO Electric has provided a revised Schedule 1, with this error

    corrected, in Appendix 10.

    23. Telus and Bell Mobility are served on ATCO Electric’s AUC approved Price

    Schedule D21 – Standard Small General Service Tariff. ConocoPhillips is served

    on ATCO Electric’s AUC approved Price Schedule D41 – Small Oilfield and

    Pumping Power Tariff. Devon Canada is served on ATCO Electric’s AUC

    approved Price Schedule D31 – Large General Service/Industrial Distribution

    Connected Tariff. Copies of these tariffs have been provided in Appendix 5.

    24. ATCO Electric respectfully requests an amendment to BCUC Orders E-7-95 and

    G-47-95 to reflect the change in ownership of the gas plant, and thus the sale of

    power from the 25 kV distribution line, from Home Oil to Devon Canada. In

    addition, ATCO Electric respectfully requests that the sale of power to Telus,

    ConocoPhillips and Bell Mobility be included in the amended Order.

    2.3 Operating Permits

    25. ATCO Electric is currently developing an application to be submitted to the British

    Columbia Safety Authority (“BCSA”) in respect of securing Operating Permits for

    the following lines: Line 2: Elmworth, Line 6: Boundary Lake – Blue Range, Line

    8: Ring Border, Line 9: Kahntah, Line 10: Chinchaga and Line 12: Baytree-

    Bonanza-/Spirit River. ATCO Electric will notify the BCUC when the Operating

    Permits have been obtained from the BCSA.

    3.0 Supplemental Information

    26. In addition to the approvals requested in the sections above, ATCO Electric has

    provided additional information to assist the BCUC in its determination of the

    approvals and amendments requested in this Application.

    3.1 Line 1 – Jasper

    27. ATCO Electric owns the distribution facilities that serve Canadian National

    Railway (“CN”) facilities near Jasper, Alberta including approximately 330 meters

    of 14.4 kV distribution line from the Alberta/B.C. border to the point of delivery

    west of the Alberta/B.C. border. These distribution facilities have been in place

    for over 30 years. CN owns the distribution facilities west of the point of delivery

    and serves several end use customers from these facilities. ATCO Electric is not

    privy to any commercial arrangements that may exist between CN and these

    end use customers. ATCO Electric serves CN on its AUC approved

    Price Schedule D21 – Standard Small General Service Tariff. A copy of

    ATCO Electric’s D21 Price Schedule has been provided in Appendix 5.

    3.2 Line 3 - Goodfare

    28. ATCO Electric owns distribution facilities up to the Alberta/B.C border in the

    Beaverlodge area of Alberta, which interconnects with distribution facilities in the

    province of B.C. owned by BC Hydro. ATCO Electric sells electricity to BC Hydro

    through these facilities. ATCO Electric was unable to locate in either its paper or

    electronic records a copy of an Electric Service Agreement with B.C. Hydro for

    the supply of electricity at this interconnection point. ATCO Electric serves BC

    Hydro on its AUC approved Price Schedule D31 – Large General

    Service/Industrial Distribution Connected Tariff. A copy of ATCO Electric’s D31

    Price Schedule has been provided in Appendix 5.

    3.3 Line 5 – Cherry Point

    29. ATCO Electric and BC Hydro executed a Border Services Electric Service

    Agreement (“Border Services Agreement”) on March 2, 1987. This agreement

    covered the supply of electricity by B.C. Hydro to ATCO Electric sites at five

    points of delivery at or near the Alberta/B.C. border. Only one of the five points

    of delivery that was identified in that Border Services Agreement is still in place,

    being the Cherry Point/Clayhurst delivery point. ATCO Electric was unable

    to locate in either its paper or electronic records a copy of an update to the

    March 2, 1987 Border Services Agreement with B.C. Hydro. A copy of the

    March 2, 1987 Border Services Agreement with B.C. Hydro has been provided in

    Appendix 12.

    30. BC Hydro bills ATCO Electric for the electricity provided at this point of delivery

    on BC Hydro’s Schedule 1600, 1601, 1610, 1611 – Large General Service Rate

    Schedule. A copy of this Rate Schedule has been included in Appendix 13.

    3.4 Line 7 – Boundary Lake – Esso Boundary

    31. On May 1, 2008, the BCUC issued Order G-79-08 in respect of certain electric

    facilities located in the Boundary Lake area northeast of Fort St. John B.C.,

    owned by Imperial Oil Resources (“Imperial Oil”), as well as a Power Purchase

    Agreement (“PPA”) between Imperial Oil and ATCO Electric. Since the BCUC

    issued Order G-79-08, the ownership of the electric facilities changed from

    Imperial Oil to Whitecap Resources Inc. (“Whitecap”). ATCO Electric notes that

    the application that led to the issuing of Order G-79-08 was submitted by Imperial

    Oil and understands that any application required to amend to Order G-79-08

    should be submitted by Whitecap. Whitecap’s website, including contact

    information, is at www.wcap.ca. If ATCO Electric’s understanding of the process

    required to amend Order G-79-08 is incorrect, ATCO Electric respectfully

    requests BCUC direction in respect of what is required of ATCO Electric to

    amend this particular Order. A copy of Order G-79-08 has been included in

    Appendix 14.

    3.5 Distribution Tariffs and Terms and Conditions

    32. In this Application, ATCO Electric has included all AUC approved Price

    Schedules that are applicable to ATCO Electric’s customers in the Province of

    B.C. In addition to the Price Schedules, ATCO Electric has included a copy of its

    AUC approved Customer Terms and Conditions for Electric Distribution Service

    (“Distribution T&Cs”) in Appendix 15. These Distribution T&Cs are intended to

    govern the relationship between ATCO Electric and customers that require a

    service connection to ATCO Electric’s electric distribution system.

    ATCO Electric’s Distribution T&Cs are applicable to ATCO Electric’s customers

    located in the Province of B.C.

    33. ATCO Electric is currently serving, and has historically served, its B.C customers

    on its AUC approved Price Schedules and Terms and Conditions. ATCO Electric

    respectfully requests BCUC approval for ATCO Electric to continue to apply its

    AUC approved Price Schedules and Terms and Conditions, as amended from

    time to time, to its customers in B.C.

    4.0 Additional Matters

    34. ATCO Electric trusts that the information provided in this Application will assist

    the BCUC in its determination of the granting of the requested approvals and

    amendments. Should the BCUC require additional information, ATCO Electric

    will endeavor to provide the additional information on a timely basis.

    35. Further, ATCO Electric respectfully requests BCUC advice and direction in

    respect of the process required for ATCO Electric to obtain BCUC approval for

    any cross border arrangements that it may possibly be required to enter into in

    the future or any additional facilities that may be required, or any new customers

    connected, in the Province of B.C. at any existing cross border facility.

    On May 15, 2013, British Columbia Utilities Commission (Commission) staff requested by email that ATCOElectric provide an updated block diagram of ATCO Electric's electrical distribution system in northeasternBritish Columbia (B.c.). On June 12, 2013, ATCO Electric responded by email and provided a block c;liagramshowing its electrical distribution system in northeastern B.C., "ATCO Electric Border Customers (Alta - Be) - asof June 2013." ATCO Electric's updated block diagram is appended to this letter as Attachment A.

    Staff reviewed ATCO Electric's updated block diagram and advises ATCO Electric that it may be operating as apublic utility in B.C.

    Staff reviewed:

    1. Commission Orders E-75-95 and G-47-95 and understands that the Alberta Power Ltd./Home Oilreference now applies to ATCO Electric /ConocoPhillips and is shown as Line 9 on the updated blockdiagram, and

    2. Commission Orders C-2-98, G-58-98 and G-ll-02 and understands that the ATCO Electric/Pioneer'sChinchaga reference is shown as Line 10, Chinchaga, on the updated block diagram.

    3. Commission Order G-79-08 and understands that the Imperial Oil Resources reference is shown as Line7, Boundary Lake - ESSO Boundary, on the updated block diagram.

    Staff did not find any Commission Orders for the other ATCO Electric electrical distribution lines in B.C.

    The Commission requests ATCO Electric:

    1. review staff's interpretation per items 1,2, & 3 above and confirm whether or not they are correct;

    2. provide confirmation of compliance with Commission Orders currently in effect;

    Dear Ms. Hamilton: RE: ATCO Electric Border Customers

    ATCO Electric is in receipt of a letter dated August 23, 2013 from the British Columbia Utilities Commission (BCUC) that included a block diagram, detailing ATCO Electric’s electrical distribution system in northeastern British Columbia (B.C.), appended to the letter as Attachment A. In that letter, the BCUC asked that ATCO Electric provide responses to the BCUC’s request for certain information with respect to the above noted matter.

    ATCO Electric is pleased to provide the following responses to the six questions put forward by the BCUC in that letter.

    Question 1: Review staff’s interpretation per items 1, 2 and 3 (as outlined in the August 23, 2013 letter) and confirm whether or not they are correct.

    ATCO Electric response: BCUC staff’s interpretation of the specified BCUC orders and applicability to ATCO Electric’s Lines 7, 9 and 10 (as per Attachment A to the August 23, 2013 letter) is correct, with one addition. ATCO Electric believes that Order G-79-08 also applies to Line 6. ATCO Electric’s distribution facilities connect to the Boundary Lake distribution system in B.C. in two separate locations (Line 6 and Line 7). The Boundary Lake distribution system is owned by Imperial Oil Resources.

    ATCO Electric has provided further information in respect of the Orders noted in items 1, 2 and 3, as well as ATCO Electric’s 11 cross border distribution lines, in the attached Schedule 1. Please note that in item 1 of its August 23, 2013 letter, the BCUC made reference to an Order E-75-95 (emphasis added). ATCO Electric was unable to find a BCUC Order E-75-95 and assumes this reference was intended to be to Order E-7-95, in respect of the approval of an Electric Service Agreement (ESA) between Alberta Power Limited and Home Oil Company Limited (Home Oil).

  • Question 2: Provide confirmation of compliance with Commission Orders currently in effect.

    ATCO Electric response: ATCO Electric believes it is in compliance with all BCUC Orders currently in effect.

    Question 3: Provide confirmation of compliance with the Utilities Commission Act (UCA):

    ATCO Electric Response: ATCO Electric believes that it is in compliance with the UCA, other than for the possible exceptions noted below, and has described the details supporting its compliance for each line on the attached Schedule 1. The possible exceptions are:

    Line 1 – Jasper: This distribution line has been in place for over 30 years. ATCO Electric owns the distribution line to a point near the Alberta/B.C. border and CN Rail owns the line continuing west into B.C. ATCO Electric was unable to locate in its electronic or paper records, a BCUC order approving the supply of energy on this line into B.C.

    Line 2 – Elmworth: Similar to Line 1, this line has been in place for a long time, well over 20 years. ATCO Electric owns the distribution line to a Conoco Phillips site approximately 2.35 km across the Alberta/B.C. border. ATCO Electric was unable to locate in its electronic or paper records, a BCUC order approving the supply of energy on this line into B.C. However, ATCO Electric did locate a paper copy of a letter from Alberta Power Limited to the BCUC, dated January 22, 1987, requesting BCUC approval of this line/service. A copy of this letter has been included with this response. ATCO Electric will continue to search through its paper records for a copy of a BCUC order in respect of this line/service.

    Line 6 – Boundary Lake Blue Range: In Order G-79-08 the BCUC granted authorization to Imperial Oil Resources to sell energy to ATCO Electric through Imperial Oil’s Boundary Lake distribution facilities. ATCO Electric owns and operates approximately 2 km of distribution line from the boundary lake distribution system in B.C. to the Alberta/B.C. border. This line continues eastward into Alberta from the Alberta/B.C border and serves a number of ATCO Electric’s customers. All customers that are served off of this line are located in Alberta and there are no customers served off of the 2 km section of line that is located in B.C. ATCO Electric believes the 2 km section of line is covered under Order G-79-08.

    New Line/cross border arrangement (not originally identified in ATCO Electric’s updated block diagram – Attachment A to BCUC’s

  • August 23, 2013 letter): During the course of conducting its investigation in respect of the 11 lines identified on the updated block diagram, ATCO Electric located three small distribution taps crossing the Alberta/B.C. border. These taps are located in the Spirit River area of Alberta, were all installed in the last five years and serve small residential/acreage customers in B.C. just across the border. In each case, ATCO Electric has received permission from B.C. Hydro to serve the customers in that area, however, it appears that a BCUC order or exemption has not been obtained.

    Question 4: Provide ATCO’s view with reasons on whether or not Order E-7-95 has expired.

    ATCO Electric Response: Article 2.1 of the ESA between Alberta Power Limited and Home Oil states:

    “Subject to the provisions hereof, the Effective Date of this Agreement shall be March 15, 1995, for a period of 10 years thereafter (the “Initial Term”). Unless either party provides written notice to the other of its intention to terminate this Agreement, not less than thirty (30) days prior to the expiry of the Initial Term, this Agreement shall be renewed without further formality and shall continue to remain in effect from year to year thereafter unless either party provides written notice of termination to the other at least thirty (30) days prior to the Anniversary Date in any year, to be effective on such Anniversary date.”

    BCUC Order E-7-95 states: “NOW THEREFORE the Commission orders as follows:

    Pursuant to Section 85.3 of the Act, the Electric Service Agreement dated, February 1, 1995 between APL and Home Oil for the supply of electricity to Home Oil’s gas plant at Kahntah, B.C., for an initial period of 10 years, is approved.”

    To date, neither ATCO Electric (Alberta Power Limited) nor Conoco Phillips (Home Oil Company) has terminated the ESA and, accordingly, the ESA still remains in effect. Based on the fact that the ESA still remains in effect, ATCO Electric respectfully submits that Order E-7-95 has not expired.

    ATCO Electric has included a copy of the ESA between Alberta Power Limited and Home Oil with this response.

    Question 5: Advise if there are any other orders, Commission or otherwise, that apply to ATCO Electric’s electrical distribution system in northeastern B.C.

  • ATCO Electric response: In the course of preparing this response, ATCO Electric found two BCUC orders and a letter in respect of ATCO Electric’s border customers. These two orders and letter have been itemized in the attached Schedule 1 and are as follows:

    1. Letter from BCUC dated October 3, 2006 related to Line 4 (Encana) 2. Order G-76-91 related to Line 8 (Ring Border) 3. Order E-4-98 related to Line 10 (Chinchaga)

    ATCO Electric has included copies of the letter and 2 orders with this response.

    Question 6: Confirm the electrical loads shown on ATCO Electric’s updated block diagram are physically inside the boundaries of B.C. ATCO Electric response: The electrical loads shown on the updated block diagram are located in both Alberta and B.C. Please refer to the attached Schedule 1 for further details in respect of each line and customer.

    Other than for the three possible exceptions and the new cross border arrangement identified in response to Question 3 above, ATCO Electric believes it is in compliance with the UCA as well as all of the Orders identified in the attached Schedule 1. In regards to the three possible exceptions and the new cross border arrangement, ATCO Electric respectfully requests BCUC advice and direction on how to proceed to ensure compliance with the UCA is established, to the extent it has been determined that ATCO Electric is not in compliance. In addition ATCO Electric respectfully requests BCUC advice and direction in respect of the process required for ATCO Electric to obtain BCUC approval for any cross border arrangements that it may possibly be required to enter into in the future.     Estimated Demands - Where it is impractical to meter a point of service, the Company may bill on the basis of estimated maximum demands. In such case, the monthly bill shall be the demand charge above applied to the estimated demand, plus a flat rate of $1.47 per kW in lieu of the charge for energy.

    The Metered demand will be the greater of the registered demand in kW, or 90% of the registered demand in kV.A where a kW reading is not available.

    Charge for Deficient Power Factor - where a Customer’s power factor is found to be less than 90%, the Company may require such Customers to install corrective equipment. For Customer power factor which is less than 90%, an additional charge for deficient power factor of 52.73 ¢/kV.A/day will be applied to the difference between the highest metered kV.A demand and 111% of the highest metered kW demand in the same billing period.

    ORDER

    A. Section 85.3 of the Utilities Commission Act (lithe Act") requires that Energy Supply Contracts betweenproducers and consumers be filed with the Commission for approval; and

    B. On February 10, 1995 Alberta Power Limited ("APL") filed with the Commission for approval an ElectricService Agreement (lithe Agreement") dated February I, 1995 between APL and Home Oil CompanyLimited ("Home Oil") for the supply of electricity to Home Oil's gas plant at Kahntah, B.C.; and

    C. The Agreement provides for the annual sale by APL of 4.5 MW in 1995 increasing to 7.5 MW in theyear 2000 for an initial term of 10 years commencing March 15, 1995; and

    D. The project has received the necessary approvals from the Ministries of Environment, Lands and Parks,and Municipal Affairs, Recreation and Culture to permit construction of the powerline from APL's RingCreek substation in Alberta, through Crown Lands to Home Oil's Kahntah gas plant in British Columbia;and

    E. The Commission has reviewed the Agreement and supporting documentation and is satisfied thatapproval is necessary and in the public interest.

    NOW THEREFORE the Commission orders as follows:

    Pursuant to Section 85.3 of the Act, the Electric Service Agreement dated February I, 1995 betweenAPL and Home Oil for the supply of electricity to Home Oil's gas plant at Kahntah, B.C., for an initialperiod of 10 years, is approved.

    ORDER

    June 1, 1995

    A. On December 22, 1994 Alberta Power Limited ("APL") filed with the Commission, an Application for

    exemption from the provisions of the Utilities Commission Act ("the Act") for the supply of power by

    APL to Home Oil Company Limited's ("Home Oil") Gas Plant at Kahntah, B.C.; and

    B. APL proposes to serve Home Oil by constructing a 68 km 25 kV line from its Ring Creek substation in

    Alberta to Home Oil's Kahntah gas plant in British Columbia ,and will supply up to 4.5 MW in 1995,

    increasing to 7.5 MW in the year 2,000; and

    C. By Order No. E-7-95 dated February 20, 1995, the Commission approved the Electric Service Agreement

    between APL and Home Oil dated February 1, 1995; and

    D. On September 12, 1994 the Ministry of Municipal Affairs, Recreation and Culture - Electrical Safety

    Branch, issued to APL an Annual Utility Permit allowing the utility to perform and operate electrical

    work on the project in British Columbia; and

    E. On November 9, 1994 the Ministry of Environment, Lands and Parks issued to APL a Temporary Permit

    - General, allowing for the construction of the power line on Crown Lands in British Columbia; and

    F. On August 16, 1994 British Columbia Hydro and Power Authority confirmed that it had no plans to

    B.C.; and

    G. The Commission has considered the Application and is satisfied that an Order exempting APL from

    certain sections of the Act properly conserves the public interest; and

    H. On May 17, 1995 the approval of the Lieutenant Governor in Council was given to the said exemption by

    Order in Council No. 0557, 1995, attached as Appendix A; and

    I. The Commission may, pursuant to Section 114 of the Act, reconsider, vary or rescind an Order made by

    it.

    NOW THEREFORE pursuant to Section 103(3) of the Act, the Commission orders as follows:

    1. The sale of power by APL to Home Oil is exempted from the application of the Act, other than Part 2

    and Sections 29 and 30 effective May 17, 1995.

    2. APL is responsible for the safe and proper operation of its plant facilities consistent with the requirements

    of the Electrical Safety Branch.
