SECTION 002113 – INSTRUCTION TO BIDDERS RFP No. RFx-000249-2010 PROJECT: Rochester RNC Master Plan Design The Contractor acknowledges in submitting a quotation that:

1. Contractor has received, read, and understands the Verizon Wireless RFP and this quota-tion is made in accordance therewith and with the Bid Drawings dated October 6, 2010 and Specifications dated October 6, 2010 and other Related Bid Documents included in this Attachment D.

2. Contractor has visited the work site and become familiar with the local conditions under which the work is to be performed, and has correlated all observations with the require-ments of the Verizon Wireless RFP.

3. Contractor agrees to:

a. Provide all required equipment, materials and labor to complete the project as specified in the construction documents without exception.

b. Provide at no additional expense to the owner, any overtime or additional expenses re-quired to meet the agreed upon construction schedule.

c. Include all applicable state and local sales and use taxes required for general construction projects.

d. Review and comply with all applicable Verizon Wireless construction standards in-cluded in Attachment F.

4. Contractor shall include in their proposal:

a. Cost for on site security during construction. Security to remain in effect until final completion and project closeout.

b. Cost to staff project with experienced and competent people. At a minimum to in-clude a full time on-site qualified superintendent and a full time on-site qualified pro-ject engineer. Resumes will be submitted on these key personnel to Verizon Wireless and they reserve the right to review and approve the personnel in these positions.

c. Cost to obtain a full payment and performance bond for the entire contract amount.

5. Contractor shall coordinate, schedule and manage:

a. Weekly scheduled conference calls shall be actively attended and supported to ensure targeted milestone completion of the overall Project Plan and timely issue resolution.



b. Employees, staff, subcontractors, vendors, owners vendors and installation contrac-tors to meet major milestones per construction schedule and contract commitments required to complete the phases to on time and on budget. The Owners vendors and installation contractors may include, but not limited to, Ladder Rack, Telecommuni-cations, and DC Power.

SPECIAL CONDITIONS 1. FORMAT OF SPECIFICATIONS

The following specifications, for the greater part, are of the abbreviated type and frequently include incomplete sentences. Omission of words such as “the Contractor shall,” “shall be,” “as noted on the drawings,” “a,” “an,” “the,” “shall,” etc., is intentional. Omitted words and phrases shall be included by inference.

2. DEFINITIONS Verizon shall mean Verizon Wireless. The Project Manager shall mean the on-site Project Manager or other authorized representative. Verizon Wireless, the Architect/Engineer, and the Contractor are treated throughout as if each were of the singular number.

3. RESPONSIBILITY FOR THE CONTRACTORS Should the Contractor sustain any damage through any act or delay in performance of any other Contractor who holds a contract with Verizon Wireless, or through any act or delay in performance of a Subcontractor of any such other Contractor, the Contractor shall have no claim against Verizon Wireless of such damage, it being understood that Verizon Wireless does not assume any responsibility of the action of another Contractor.

4. COMPLETION DATE Contractual Completion Date, set forth in the proposal form, must be met, and shall mean completion of all work. Substantial completion shall be achieved prior to this date to allow for corrections as a result of final inspection.

5. COOPERATION WITH OTHER CONTRACTORS The Contractor shall allow other Contractors reasonable opportunity for the introduction and storage of materials and the execution of their work, and shall properly connect and coordinate his/her work with theirs.

6. CORRECTIONS Upon completion of the corrections noted on Verizon Wireless Punch List, Project Manager will inspect the corrected work. If any corrective work remains to be done after Verizon Wireless’ inspection, the Project Manager will inspect the remaining corrected work when he/she is notified it is complete. The Contractor will pay for the Project Manager and/or Architect/Engineer costs based on their normal hourly rate plus traveling expenses for all re-inspections required by the Project Manager and Architect/Engineer after the first inspection.

7. ONE YEAR GUARANTEE Where items on Verizon Wireless’ Punch List have not been corrected prior to expiration of the one year guarantee period, it shall nevertheless be the responsibility of the Contractor to permanently correct said items after the one year guarantee period, and the contract shall not be fully performed until such permanent corrections are made. Cracks or imperfections that may occur, from any reason, and within the one year guarantee period in plastered or gypsum wall board, concrete or concrete surfaces shall be repainted at no cost to Verizon Wireless and within the terms of the Agreement. This stipulation shall in no way effect the normal guarantee requirements applying to the whole contract. All corrective work performed by the Contractor in remedying defective work during the one year period following Verizon Wireless’ acceptance of the project shall be subject to the same guarantee requirements of the original work for a period of one year from the date of completion of the corrective work.

8. RECORD DRAWINGS Upon completion and before final payment, Contractor shall turn over to the Project Manager one set of clean prints, marked in a neat legible manner, showing all deviations from the original design. These prints shall include architectural, landscape, civil, structural, mechanical, and electrical drawings.

9. HAZARDOUS MATERIALS Contractor shall comply with standards issued or requirements imposed by the Code of Federal Regulations for Hazardous Materials and State and Local Laws and Regulations during the term of this contract relating to transportation, handling, use and disposal of such materials. Contractor shall provide to the Project Manager current MATERIALS SAFETY DATE SHEETS (MSDS) for all hazardous materials used in the performance of this contract prior to its delivery to the job site. Contractor shall keep copies of MSDS on job site in three ring binder for reference. Contractor shall notify Project Manager or Verizon Wireless representative of any unsafe, hazardous, potential violation, or alleged violation of applicable health and safety acts, laws, statutes, ordinances, rules and regulations of any governmental entity having jurisdiction over the project and shall immediately cease work and take all necessary measures to correct any such condition or violation before proceeding with the work.

2. Fireproof tarpaulins are to be used around work area, including floor.

3. All welding and cutting equipment shall be kept outdoors whenever possible.

4. If acetylene and oxygen tanks are indoors, they shall be kept as far from the actual work location as possible.

5. All welding and cutting equipment shall, whenever practical, be removed from the building daily.

6. All equipment such as cables, hoses regulators, etc. shall be in good condition.

7. A fire watch consisting of at least one man furnished by the Contractor, with no other assigned duties, shall be posted to stand by and observe the area for any potential hazards at all times while cutting or welding is being done.
